Any individual wishing to start a divorce (also called a domestic relations action) must file the correct papers with the circuit court according to specific rules. If you talk to people at your local county clerk s office, they may advise you to have an attorney. The clerk will tell you that they cannot give you legal information. However, you can do your own uncontested divorce and it is quite simple actually. Most people who performed their own divorce would recommend it to their friends. There are certain papers to be filed with the court to begin a divorce. 1. The Complaint or Petition 2. The Summons 3. And various other papers based on the particular situations of the individuals. (explained below) Every divorce begins with a Plaintiff (you) filing a Complaint or petition; which asks the court to grant an order. For example, a Complaint may ask the Court to grant a divorce. The Defendant (your spouse) is the person whom the Complaint is filed against. The Summons is a document that legally asks the person complained against to answer the Complaint. This must be delivered to that person in a way that gave them notice of the action against them. This is called "Service of Process". If your Spouse agrees to the divorce and will sign the paperwork, this is called an Agreed Divorce. If your Spouse does nothing with the divorce papers and doesn t sign them and doesn t contest anything with a lawyer, but simply sits on his/her hands, this is called a Default Divorce. The Waiting Period prepare your own case There is a waiting period in most states. For example, Michigan has a waiting period for all divorces; it is 180 days (6 months) for divorces with children and 60 days (2 months) for divorces without children. Residency Requirement Different states have different amounts of time that you must be in the state for you to get a divorce there. Also various counties have different amounts of time as well. Usually a person must live in a state 6 months and be in their county for 10 days for you to be able to file for divorce there. Service To The Defendant After your spouse has been "Served" with the divorce papers, and proof of that filing is given to the court, you can set your court date for your final hearing. You have only one court hearing in an uncontested divorce; which usually lasts around minutes. When you are ready, you simply Print, Sign, and File the divorce at your local county courthouse. 6. Spouse is officially served with the Divorce Forms. The Default is filed, if spouse has not Agreed to the divorce. 8. The Final hearing date is scheduled. 9. Court Costs Please Note: This price is not included in our service. This fee pays the Judge and the Clerks. You can check with the Court Clerk in your county for the exact court cost. State fee usually around $100-$200. This must be paid when you file your first papers with the court. They usually accept money orders and bank certified checks. All counties are different so, call ahead. If you have children, the Children's Agency in your State does charge a fee as well. All counties are different. The fee is usually around $75 dollars. This applies only if you have children. You may call them and check as well.
