1 Job Description (JPO) GENERAL INFORMATION: Tittle of the post: Associate Protection Officer (Citizenship) Sector: Protection Location/Duty Station: Khartoum, Sudan Duration of the assignment: Two years SUPERVISION: Tittle of Supervisor Assistant Representative (Protection) Title of other international staff members in same duty station Senior Protection Officer Content and methodology of the supervision (describe the supervisory role exercised over the incumbent in terms of planning guiding and reviewing the work) The Associate Protection Officer (Citizenship) works under the direct supervision of the Assistant Representative (Protection). The work of the Statelessness Unit cross-cuts different areas of work within the Protection Section and statelessness activities are closely coordinated with the other units. The Representative will act as the reviewing officer. DUTIES AND RESPONSIBILITIES: Establish a network of relevant stakeholders with an interest in prevention and reduction of statelessness; Maintain awareness among relevant stakeholders on issues relating to prevention of statelessness, and nationality issues; Undertake legal work on drafting proposed amendments to the nationality laws and relevant constitutional provisions, as well as advocating for Sudan to accede to the statelessness conventions, particularly in light of the secession of South Sudan in 2011; Advocate for the adoption of laws and regulations which are conducive to the prevention, or reduction, of statelessness;

2 2 Support operational activities relating to the issuance of birth certificates and other civil documentation, including nationality documentation, which will contribute to the prevention / reduction of statelessness; Support legal aid projects benefiting persons of concern to UNHCR particularly in the context of prevention / reduction of statelessness; Design a prevention of statelessness training programme and undertake training and workshops with key governments counterparts in issues related to the reduction and prevention of statelessness Provide technical guidance and support to UNHCR in Sudan and to the Government of Sudan on implementation of the Framework Agreement on the Status of Nationals of the Other State, signed between Sudan and South Sudan on 27 September 2012 Provide support for an analytical study of populations at risk of statelessness including though desk research, analysis of data collated by UNHCR field offices, identifying trends and proposing strategies to assist populations at risk. Organising of training workshops and seminars on citizenship and statelessness for UNHCR staff, UN agencies, NGOs and Government Actors. Contributing to formulation of UNHCR s advocacy, information and protection strategy in the field of statelessness. ACCOUNTABILITY (key results that will be achieved) The protection of populations of concern is met through the application of International and National Law, relevant UN/UNHCR protection standards and IASC principles. The protection strategy incorporates a thorough age, gender and diversity (AGD) analysis and reflects the Organization s global, regional and country level priorities. The Participation of persons of concern is assured through continuous assessment and evaluation using participatory, rights and community based approaches. Protection incidents are immediately identified and addressed. Monitoring of populations at risk of statelessness across Sudan takes place according to agreed procedures, information is collated, reports are produced and analysed. Legal and administrative barriers to access nationality and civil registration documents are identified and addressed. Individuals at risk of statelessness are identified and supported in confirming their nationality. Advocacy is conducted so that existing procedures and legislation for confirming and withdrawing nationality include safeguards against statelessness. Population of concern has access to legal aid services and documentation

3 3 Smooth running of statelessness activities in Sudan through support for planning, operational and reporting activities, development of partnerships and promotion of UNHCR s stateless mandate is supported. AUTHORITY (decisions made executing responsibilities and to achieve results) Identify and prioritize activities of the Statelessness Unit. Represent UNHCR s statelessness unit. Intervene with authorities on protection issues. Negotiate locally on behalf of UNHCR. Enforce compliance of staff and implementing partners with global protection policies and standards of professional integrity in the implementation of the activities. Enforce compliance with, and integrity of, all protection standard operating procedures. QUALIFICATIONS AND EXPERIENCE: Education: University degree in law, human rights, international relations or related field. Job experience: At least 2 years of relevant experience working in a legal or protection capacity preferably in the field of human rights, statelessness or the protection of minorities. Excellent knowledge of English. Knowledge of Arabic a plus. REQUIRED COMPETENCIES, which illustrate behaviours that are essential to achieving deliverables described above, and that are critical to successful performance. 4 TRAINING COMPONENTS AND LEARNING ELEMENTS: Training components: 4 At the beginning of the assignment, the JPO will benefit from on-the job induction training by the international expert on statelessness. During the whole assignment the JPO will benefit from on-the job training by the Assistant Representative (Protection). The JPO will be expected to take part in internal trainings through UNHCR s Learn and Connect platform as well as any other internal training opportunities available. Specifically, the JPO is expected to complete UNHCR distant learning training on statelessness. Learning elements: The JPO is expected to learn the following: Identification of potential causes of statelessness in national legislation and bureaucratic procedures for confirmation and withdrawal of nationality as well as for access to nationality documents and birth registration. Formulation of policies and procedures to prevent statelessness. International standards on civil and birth registration. In depth knowledge on the international and regional legal framework on statelessness and international standards for the protection of stateless persons, as well as UNHCR role and mandate on statelessness. Building and maintaining positive relationships with government authorities and multiple stakeholders. BACKGROUND INFORMATION: Brief Project Description: The secession of South Sudan raises important issues under UNHCR s statelessness mandate. Under the August 2011 amendment to the Sudan Nationality Act, any individual who has acquired South Sudanese nationality automatically loses their Sudanese nationality. South Sudanese nationality is automatically acquired by any individual with one ancestor born in South Sudan and any individual belonging to the indigenous tribal communities of South Sudan, as well as individuals with long residence in South Sudan. However, current implementing regulations on nationality in Sudan have not been updated to take into account the recent amendment to the Nationality Act. UNHCR considers that the risk of large-scale statelessness for populations of Southern origin is low. However, UNHCR is concerned that lack of due process rights and legal safeguards linked to loss of Sudanese nationality will result in uncertain citizenship status and a risk of statelessness in individual cases. Individuals of mixed origin and South Sudanese with very long residence in the Republic of Sudan are particularly likely to be

De-nationalization and marginalization of populations with strong links to the Republic of Sudan could also have serious implications for the creation of a stable and inclusive State in the post-secession era. People who lose their Sudanese nationality but who wish to remain in Sudan lack information on how to regularize their stay as lawful residents. With the loss of Sudanese nationality, South Sudanese who had been living in Sudan also lost all related rights and entitlements. Without valid documents they also lost the ability to conduct basic official transactions. Although the Government of South Sudan started to process applications for nationality documents for the South Sudanese population in Sudan in April 2012, it will still take a long time to cover the large population that remains in the country. Protection risks linked to their loss of status include loss of livelihood, eviction, threat of expulsion, lack of documentation and access to basic rights. In October 2012, the Governments of Sudan and South Sudan ratified a Cooperation Agreement that foresees the implementation of a Framework Agreement on the Status of Nationals of the Other State, under which the two countries should identify and establish measures to allow nationals of each state to enjoy the freedom of residency, movement, undertake economic activities, and acquire and dispose of property in the territory of the other state. However, the agreement has yet to be implemented. On the other hand, the new Sudanese Civil Registry Act 2011 introduced a unified registration procedure for all Sudanese nationals, the National Number, which regulate access to national identity cards and is the base of all official transactions and access to services. The law also provides for the foreign number which should be issued to all foreigners in the country. The registration of foreigner has started at the beginning of 2013 and it is to be seen how it will affect individuals of South Sudanese origin in Sudan. The main objective of UNHCR s work in this area is to take a broad range of actions to ensure comprehensive, fair, transparent and workable arrangements on nationality and prevention of statelessness for at risk populations in Sudan following the secession of South Sudan in July Based in Khartoum, the JPO s work will mainly focus on individual of South Sudanese origin residing in Sudan who have lost their Sudanese nationality as a result of amendments in the Sudanese Nationality Act after secession of South Sudan. The JPO is expected to perform field missions to other areas of Sudan where there is a considerable presence of South Sudanese communities. Khartoum is classified as a family duty station (B in the UNHCR system), with a good level of services, accommodation and facilities. It is a relatively safe environment sometimes marked by small criminality or anti-western public demonstrations. MORSS compliance is required.
