1 * IMPORTANT INFORMATION * PLEASE READ THE FOLLOWING INFORMATION CAREFULLY 1) In order for your application to be processed, you must ensure that you attend the Licensing Office at Waterfall Lane, Cradley Heath at your designated appointment time. We regret that if you are more than 5 minutes late for your appointment, the appointment will be re-arranged. 2) You should bring the following items with you for your appointment: - This Form, (the form must be fully completed, failure to do so will result in your appointment being rebooked) including signature, with or without stamp, of a Private Hire Operator you will be working for when licensed. The fee (see attached list). You can pay by Cash, Debit/Credit Card or Cheque (with appropriate guarantee card covering the full amount. Multiple cheques will not be accepted). Your DVLA Licence Card (showing entitlement for Category B). An 'Authorisation Number' from the DVLA to allow us to check your driving record (obtained no earlier than 72 hours before your appointment). You can obtain this number by visiting or call the DVLA on To do this you must enter your Driving Licence number and your National Insurance Number. Current Passport or appropriate form of photographic identification. Other forms of identification i.e. Birth Certificate, Marriage Certificate, Utility Bill etc. National Insurance Number (Please see attached CRB information entitled List of Valid Identity Documents ) Please note all documents must state your current address and all documents must display the same spelling of your identity. N.B. The Licensing Office can only accept original documents. Photocopies and Fax copies will not be accepted. 3) You will be subject to a Criminal History Check. 4) Before a licence can be issued, you will be required to: - Successfully complete a medical examination at the Council s designated medical centre. Successfully complete an oral examination to ensure you have knowledge of the conditions and legislation applicable to this licence. If you fail the oral examination, you may take a further 2 retests after paying each retest fee. Successfully complete a driving assessment provided by the Driving Standards Agency and produce the Pass Certificate. 5) If your application is withdrawn, prior to the licence being granted, no refund will be given. 6) If the Licensing Committee refuses the application, no refund will be given. 7) No photographs are required as we will take your photograph during your office appointment. 7 Step by step guidelines for New Private Hire Driver Applications: Step 1 Your application form and the licence conditions are attached to these guidelines. If granted, your licence will be subject to the current licensing conditions. Once you have completed the form, you should contact the Licensing Office on to make an appointment to submit your application form. Step 2 On the day of your appointment you must bring with you the current application fee ( 153 for 1 year or 352 for 3 years), and all the documents listed on the form, in order to complete the Criminal Records Bureau (CRB) form and the DVLA mandate. Please note all documents must state your current address and all documents must display the same spelling of your identity. We will give you the information pack containing the paperwork about the Driving Standards Agency (DSA) test, the medical check and a copy of the current Private Hire and Hackney Carriage Licensing Handbook. You are required to pass the DSA test and the medical before your licence can be issued. If you have a medical condition which you feel may prevent you from obtaining a licence, you may take the medical first. The fee for the medical is paid direct to the Hospital (Sandwell & West Birmingham Hospitals, Occupational Health & Safety Service, West Bromwich). Step 3 Once you have passed the DSA test, the medical and had a clear CRB check and DVLA print out, you should make an appointment to come in and finish off the application process. Please bring your driving licence and your DSA pass certificate with you. You will be required to take the knowledge test, which is conducted by a Licensing Officer, and consists of 10 questions based on the information contained in the Handbook. You must therefore make sure you have read the handbook carefully before you take the test. Provided you pass the knowledge test, you will then have to sign a further declaration to certify that there have been no convictions or matters to report in the intervening period since you first submitted your application form, and show your driving licence again. You will then pay the badge deposit fee ( 30), and we will issue your badges and licence. We will issue 2 badges - one badge must be worn at all times when you are working, and the other badge may be displayed on the vehicle, where visible to the passengers e.g. on the dashboard or clipped to the air conditioning vents. If any problems arise with your criminal or driving history record (step 3), we will write to you and advise you that your application will be referred to the Licensing Committee for decision. You must declare all convictions, cautions, fixed penalties, bind overs etc, as these will be disclosed to us on the CRB and DVLA checks, even if you received them many years ago. The provisions of the Rehabilitation of Offenders Act do not apply to Hackney and Private Hire Drivers, therefore even spent convictions must be declared. I attach a copy of the current criteria which lists matters which would normally mean your application will be referred to the Licensing Committee for decision. Please note: you should aim to complete the application process (i.e. pass the DSA test and medical) within 6 months of submitting your application form, at the very latest. If the process is not completed within 6 months, the application will normally lapse.

8 CRITERIA FOR APPLICANTS Listed below are the circumstances under which the Council will normally refuse your application, or take action in respect of an existing licence. If you are unsure whether your application will be affected by any convictions you may have, a member of the licensing team will be pleased to advise you. PRIVATE HIRE/HACKNEY CARRIAGE DRIVERS We will normally refuse an application, or take action in relation to an existing licence, if: You are a new applicant and have held a full driving licence for less than 2 years, or are under 21 years of age, unless you can provide evidence that you have at least one year s equivalent previous driving experience prior to the issue of your full DVLA (or EU) licence (which you must have held for a minimum of 12 months). You have been disqualified from driving, and have not held your full driving licence for at least 12 months since the disqualification expired. You have not successfully completed the knowledge test. If you fail the knowledge test three times we will refuse to grant your application. You will not normally be able to reapply within 12 months of the date of your last unsuccessful test. If your English or basic skills are below the required standard to pass the knowledge test, you will be advised to take English for Speakers of Other Languages (ESOL) lessons, or literacy and numeracy skills lessons. You have not passed the DSA driving assessment. You have not passed the Council s medical examination undertaken by the Sandwell Occupational Health Unit. You have previously been a licence holder and that licence has been revoked during the past 12 months. The Guidelines to the Licensing (Miscellaneous) Committee (see below) apply to you. The matters detailed in the Guidelines are not exhaustive. You may have to attend Committee if there are other matters (not contained in the Guidelines) which indicate that you have exhibited behaviour which in the opinion of the Authority is inconsistent with that expected of a Sandwell licence holder e.g. allegations of a serious nature; in these cases you will be informed by the Licensing Office. PLEASE NOTE: The Provisions of the Rehabilitation of Offenders Act 1974 do not apply to applicants for Private Hire and Hackney Carriage Driver s licences. Therefore all convictions/cautions, reprimands, conditional discharges, bind-overs and fixed penalties must be declared to the Licensing Office at the time of application.

9 Guidelines to the Licensing (Miscellaneous) Committee 1. Listed below are the circumstances under which a matter will be dealt with by the Licensing (Miscellaneous) Committee or the Licensing Manager for determination. 2. The Committee takes into account the information detailed in the report prepared by the Licensing Office, and any further information provided during the meeting. 3. Each case is considered on its own merits, however, as a guide to the Members, and as a starting point only, the following sanctions are an indication of the likely outcome of an appearance before the Committee. 4. Any reference to convictions also applies to cautions since an offender must have admitted the offence in question to receive a caution. 5. These sanctions may be reduced where there are mitigating circumstances or increased where there are aggravating circumstances. 6. Members of the Licensing (Miscellaneous) Committee have a duty to protect the public, and their decisions will always be made with public protection as the overriding consideration. 7. Categories of matters being referred to the Committee, are listed below, firstly in respect of NEW APPLICANTS and secondly in respect of EXISTING DRIVERS. Guidelines are in italics for ease of reference. (a) Minor Traffic Offences Matter will be referred to the Committee when a new applicant has more than six live* points on their driving licence, or if the points are for a major traffic offence (see section b). Strong written warning administered by Committee and held on file. Committee when considering the grant of a licence must take into account the applicant s driving record. If Committee decides to grant, the decision should include a strong warning that any other matters would probably mean the licence would be suspended / revoked (as DVLA licence is likely to be lost anyway). EXISTING LICENCE HOLDERS: When an existing driver has more than six live* points on their licence. Strong written warning administered by Licensing Office and held on file. NEW OR EXISTING DRIVER who has failed to declare or report a minor traffic offence in accordance with conditions, ON THE FIRST OCCASION: Strong written warning administered by Licensing Office and held on file. Points for minor traffic offence on licence not declared or reported SECOND OR SUBSEQUENT OCCASION - referred to Committee when previous breach(es) would be taken into account: Suspension for one month. *The word live is used in accordance with its normal meaning of live as far as DVLA are concerned. i.e. 3 years from date of offence (although points remain on the licence for 4 years (11 years for drink-drive convictions).

10 (b) Major Traffic Offences Any conviction within the last 3 years for any of the offences (examples) listed in the table below would result in the matter being referred to the Committee. Refusal. Refusal - Must show at least 3 years free from convictions after the restoration of their licence before another application would be considered.

Must pass a medical examination to certify that the applicant is not suffering from alcoholism or drug dependency or addiction. EXISTING LICENCE HOLDERS: Revocation - Must show at least 5 years free from convictions before an application would be considered, as above. 12 In exceptional circumstances only should an application be considered when the applicant can show a substantial period (of at least 5 years) free of such convictions, following the expiry of the sentence, or date of offence, whichever is the later. More than one conviction of this kind should preclude consideration for at least 7 years Convictions for any sexual offences e.g. indecent exposure, indecent assault, importuning, rape Any offences of a sexual nature are to be treated extremely seriously, given the drivers position of trust (f) Violence Any conviction within the last 3 years for any of the offences (examples) listed in the table below would result in the matter being referred to the Committee. Refusal - An application may be considered when the applicant can show at least 3 years free of such convictions, following the expiry of the sentence, or date of offence, whichever is the later. More than one conviction of this kind should preclude consideration for at least 5 years EXISTING LICENCE HOLDERS: Revocation - Another application may be considered when the applicant can show at least 3 years free of such convictions, following the expiry of the sentence, or date of offence, whichever is the later, as above. Convictions for violence e.g. murder, manslaughter, possession of offensive weapon, criminal damage, common assault, assault occasioning actual bodily harm, wounding, GBH Any offences of a violent nature are to be treated extremely seriously, given the drivers position of trust (g) Public Order Offences Any conviction within the last 3 years for any of the offences (examples) listed in the table below would result in the matter being referred to the Committee. Refusal - An application may be considered when the applicant can show at least 3 years free of such convictions, following the expiry of the sentence, or date of offence, whichever is the later. More than one conviction of this kind should preclude consideration for at least 5 years EXISTING LICENCE HOLDER: One to four months suspension (depending on severity of offence) Convictions for public order offences e.g. riot (S.1), violent disorder (S.2), affray (S.3), intentional harassment, alarm or distress (S4.A), harassment, alarm or distress (S.5) (S4) fear. Any public order offences are to be treated seriously, given the drivers position of trust

13 (h) Dishonesty Offences Any conviction within the last 3 years for any of the offences (examples) listed in the table below would result in the matter being referred to the Committee. Refusal - An application may be considered when the applicant can show at least 3 years free of such convictions, following the expiry of the sentence, or date of offence, whichever is the later. More than one conviction of this kind should preclude consideration for at least 5 years EXISTING LICENCE HOLDER: One month to Revocation - Another application may be considered when the applicant can show at least 3 years free of such convictions, following the expiry of the sentence, or date of offence, whichever is the later, as above. Convictions for offences involving dishonesty e.g. theft, obtaining pecuniary advantage by deception, fraud Any offences involving dishonesty are to be treated seriously, given the drivers position of trust (i) Breach of Licence Condition, Byelaw or offence under the Local Government (Miscellaneous Provisions) Act Failure to disclose convictions, cautions, reprimands, conditional discharges and bind-overs (i.e. any matter other than minor traffic offences, as detailed in section a) NEW APPLICANT EXISTING LICENCE HOLDER 2. Other matters, not specifically mentioned above, which indicate inappropriate behaviour or matters which bring into question the person s status as a fit and proper person may also be referred to the Licensing (Miscellaneous) Committee. Although Private Hire and Hackney Carriage Drivers are exempt from the Rehabilitation of Offenders Act, and must declare all convictions, cautions, reprimands, conditional discharges, bindovers and fixed penalties, generally, convictions which come to light, dating back more than 20 years will not be referred to the Committee.

14 The Committee will in addition to using these Guidelines consider the Department of Transport Circular 2/92 and Home Office Circular 13/92, however for the avoidance of doubt the Guidelines will take precedence. New Applicants The Licensing Manager and the Waste and Transport Manager have authority to determine applications and issue licences. Where any application falls within the Guidelines above unless otherwise specifically stated, where they have authority to issue a licence with a warning, the application will be referred to Committee for determination. Where an application raises issues not covered by the Guidelines the Licensing Manager and the Waste and Transport Manager may issue the licence or if they feel because of the nature of the matter they are unable to issue the licence refer the application to Committee for determination. Existing Licence Holders Where an issue concerning an existing licence holder falls within the Guidelines above unless otherwise specifically stated, where they have authority to issue a licence with a warning, the matter will be referred to Committee for determination. In the case of an existing licence holder where there are issues not covered by the Guidelines the Licensing Manager and the Waste and Transport Manager may take no action or if they feel because of the nature of the matter they are unable to take no action refer the matter to Committee for determination. New DVLA codes coming into force from time to time may be added to this list, when considered relevant by the Waste and Transport Manager and the Licensing Manager.

15 This Licence is granted subject to the Local Government (Miscellaneous Provisions) Act 1976 and in addition, the following conditions: 1. The Licence holder must inform the Licensing Office immediately of any change of address. 2. The Licence holder shall ensure that the number of passengers carried in the vehicle does not exceed that stated in the licence. 3. The Licence holder shall ensure that the vehicle is searched at the end of every hiring to ensure that property has not been left behind by the passenger. 4. The Licence holder shall ensure that the Private Hire Driver s badge is worn in such a position and manner as to be plainly and distinctly visible at all times. 5. The Licence holder shall ensure that the Private Hire Drivers badges are returned to the Licensing Office within 7 days of being requested to do so. 6. The Licence holder shall ensure that a copy of his/her current, valid Private Hire Driver s Licence, full DVLA driving licence and Insurance documents are available for inspection at all times at the Private Hire Operators base, through which he/she is working. 7. The Licence holder will successfully complete a medical examination on a 3 yearly basis (unless a more frequent examination is required by the Medical Officer). On attaining the age of 65, the Licence holder shall complete the medical on an annual basis. 8. The Licence holder shall ensure that any conviction or caution, reprimand, conditional discharge, bind-over or fixed penalty sustained during the lifetime of the licence is reported to the Licensing Office in writing within 7 days. 9. The Private Hire Driver s Licence is not transferable. 10. The Licence holder shall not ply for hire under any circumstances. 11. With effect from 1st September 2007, upon grant or renewal of the licence, all private hire drivers shall wear a council approved corporate badge to be issued by the operator bearing the name of the operator. 12. The Licence holder shall ensure that the Private Hire and Hackney Carriage Drivers Licensing Booklet is complied with in every respect.
