26 TERMS & CONDITIONS Carriage Paid: Carriage will be paid on all orders over 150 net within the British Isles with the exception of Ireland, Scottish Highlands & Islands and Channel Islands (over 200). Orders less than carriage paid will be charged carriage at the current rate, presently a minimum of 8. Pro-forma Invoices: Meri Meri, at its discretion, will despatch invoices pro-forma to new customers. Goods shall be kept in store for fourteen days. Customers whose payments are received after fourteen days may be liable to incur a delay before receiving their goods. Prices: All prices quoted are subject to VAT at the current rate. All goods will be invoiced at prices correct at the time of data entry. Meri Meri reserves the right to alter any prices or specifications without prior notice. Deliveries: Orders will be despatched as soon as possible after an order is placed (unless the customer specifies a future date). Meri Meri will try to despatch the goods by any estimated date, but we cannot guarantee a time or date for delivery, nor will any claims for consequential loss be accepted. Damaged & Returned Goods: Any goods received damaged or defective should be notified within two days of receipt by telephone and confirmed in writing within 7 days to Meri Meri. Meri Meri will replace any defective or damaged items provided the preceding terms are met. No other returns will be accepted. Payment: Accounts are due for payment within thirty days of invoice, subject to prior application and approval. We reserve the right to charge interest at 3.5% above Bank of England Minimum Lending Rate calculated on a daily basis on invoiced amounts not settled within thir ty days of date of invoice. Accounts remaining unpaid after eighty days will also become subject to a 25% surcharge. Payment can be made by cheque, BACS, credit or debit card. Intellectual Property & Copyright: The sale of the goods by Meri Meri to the Customer shall not confer upon the customer any right to use the trademarks or other intellectual proper ty rights of Meri Meri and such rights shall at all times remain the exclusive proper ty of Meri Meri. The copyright of the goods remain the proper ty of the ar tist. No copies of these goods can be made without the written permission of Meri Meri. Returns Policy: Meri Meri does not operate a Sale or Return policy. In extraordinary circumstances and only at the discretion of Meri Meri, goods may be accepted for return. In these circumstances, a handling charge of 15% will be applied and the customer will be responsible for the safe and complete return of the goods. Risk & Title: Title of goods will remain with Meri Meri until full payment is received. All goods supplied shall be at the Customer s risk from the time of delivery to the Customer s premises or premises nominated by the customer. If at any time payment of the price (or any other amount due from the Customer to Meri Meri) is overdue, the Customer hereby authorises Meri Meri by its servants or agents to enter the Customer s premises and take possession of the goods at the Customer s expense. Governing Law: The validity construction and performance of any contract to which these Conditions apply shall be governed by the laws of England and be within the exclusive jurisdiction of the English Courts. Severability: If any of these terms and conditions or any part hereof shall be held rendered void or unenforceable by any legislation to which it is subject it shall be void or unenforceable to that extent and no fur ther.
