PUR/ /104 Tender for Supply, Installation of Managed Layer 2 Switches (CISCO Make) & Rack The University invites tender for Supply, Installation and Commissioning of Managed Layer 2 Switches (CISCO Make) estimated to Rs. 1,38,000/-. The detailed Technical Information and quantity of the same is given in Annexure-1. General Guidelines for submission of Tender Please read the following conditions carefully before you fill up and submit your tender. (1) HOW TO SUBMIT TENDER DOCUMENT You have to submit the bid in two separate envelopes viz. (A) Technical Bid and (B) Commercial Bid. These two envelopes should be submitted in one big envelope. Super scribe the Technical Bid Envelope as Technical Bid for Supply, Installation of Managed Layer 2 Switches (CISCO Make) due on 10/08/2015 at 1.00 pm. and on the envelope of Commercial Bid Commercial Bid for Supply, Installation of Managed Layer 2 Switches (CISCO Make) due on 10/08/2015 at 1.00pm. Big envelope should be superscribing Tender for Supply, Installation of Managed Layer 2 Switches (CISCO Make) due on 10/08/2015 at 1.00pm. Tender should be addressed to Registrar, Yashwantrao Chavan Maharashtra Open University, Dnyangangotri, Near Gangapur Dam, Nashik The Said Document and Tender Form is available till upto am on official website of the university Tenderers can download the said document and submit it in stipulated time along with the demand draft of Rs. 1000/- (Price of Tender Form)in favors Finance Officer YCMOU payable at Nashik drawn on any nationalised bank only. (2) DOCUMENTS TO BE ENCLOSED WITH TECHNICAL BID a) Authorization : The authorization letter of the Principal allowing their Authorized Distributors /Representatives to submit the tender should invariably be enclosed in the Technical Bid. b) E.M.D. : You have to submit Rs. 2000/- Earnest Money Deposit on tendered value i.e. Rs. 1,38,000/- of 2

3 Managed Layer 2 Switches in the form of Demand Draft Drawn on only Nationalized Bank payable at Nashik in the name of Finance Officer, Y.C.M.O.U., Nashik (D.D. drawn on Co-operative Bank will not accepted) Tender without EMD will be rejected. c) PAN Card : Enclose photocopy of PAN Card d) Sales Tax Clearance Certificate : Enclose the latest copy of sales tax clearance certificate for the year If you are exempted from payment of Sales Tax enclose the copy of exemption certificate issued by competent authority with the tender. e) Complying of Tender Enquiry : Complying of tender enquiry as per the Annexure-2 and samples should be attached with the Technical Bid. f) Questionnaire : The enclosed Annexure IV must be submitted with complete response to the Questionnaire in the technical bid. Failure to do so could result in disqualification. (Supplier should be providing Technical Data response to questionnaire). (3) DOCUMENTS TO BE ENCLOSE WITH COMMERCIAL BID a) Quotation : Your quotation on your letter head as per Proforma enclose Annexure-3 and it should be duly signed, dated and stamped. b) Token of Acceptance of Terms and : Conditions Enclose the copy of Tender documents duly signed on the bottom of each page towards token of acceptance of tenders GENERAL TERMS & CONDITIONS A. Rates : Rates should be inclusive of all taxes, Charges i.e. Sales Tax, VAT, Excise Duty, Transit, Insurance, Packing, Forwarding. Site Delivery, LBT etc. University is exempted from paying of Octroi charges. The Tenderer should offer the confirmed lowest rates in their offers. B. Warranty : Warranty will be three years from the date of testing report from the Computer Centre of Y. C. M. Open University, Near Gangapur Dam, Nashik C. Installation and Commissioning : Installation of all ordered equipment s and configuring of all network equipment s shall 3

4 be the responsibility of the supplier. D. Billing : If the bidder is manufacturer then he has to submit the bill of first sale. If the bidder is a dealer then he has to submit the bill of second sale. E. Submission of Bill : A bill (invoice) will be valid only if it is accompanied by a duly signed delivery Chelan in respect of Managed Layer 2 Switches F. Matter related to Excise Duty : In any case of First or Second Sale, The University is not liable for any matters related with custom and excise duty payment. Please enclose copy of Excise Gate pass along-with the bill. The bidder will be responsible for custom and excise formalities and clearance of dues if any. G. Payment of bill and Security Deposit : 95% Payment of Switches & Rack work will be released after certification by Computer Centre of the University (After delivery, Installation and Configuration). Security Deposit of 5% of total invoice value will be deducted while paying the bill. This deposit will be retained for Three Months from the date of deduction and will be refunded after full and final completion report. H. Advance payment : No advance on account payment will be made for supply of Managed Layer 2 Switches I. Delivery : The tenderer must deliver the Managed Layer 2 Switches & Rack within 15 days from the date of receipt of Purchase Order. J. Part Delivery : You have to deliver the ordered material in one lot and not in part. In any case part supply will not be accepted. K. Place of Delivery : The tenderer must deliver the Managed Layer 2 Switches & Rack at Stationary and other material desk, Y.C.M.Open University, Near Gangapur Dam, Nashik L. Penalty : Penalty will be per week of the accepted value of tender for delay in supply & will be deducted from the payments due. M. Technical Specification : Managed Layer 2 Switches & Rack should be as per Technical Specifications given Annexure-1 enclosed. 4

5 N. Date and Time of submission of tender: Your tender duly signed and sealed should reach University Head Office in Registrar Office on or before 10/08/2015 at 1.00pm. If possible all received tenders will opened on same day at 3.00pm in the presence of tenderers. O. Delay in receipt of filled tender : Tender received late due to any delay will not be considered. P. Validity of Offer : Your offer should be valid for 120 days from the date of opening of the tender. Q. Any Query : Any addition information/query in regard with this tender you may contact Registrar in person during office hours. R. Technical Negotiation : Tenderers may call only for Technical Negotiation if necessary. S. Purchase Order : You have to supply the material strictly as per the terms & condition mentioned in the Purchase Order. T. Acceptance of Tender : YCMOU does not bind if self to accept the lowest or any other tender. The University has reserved its right to reject any or all terms of tenders without giving any reason for no acceptance. The university may also at its sole discretion to accept full or part quantity of the tender. U. Increase in rates : No increase in rate after Purchase Order accepted by the successful Tenderer will be allowed till the completion of transaction. V. Decrease in Govt. Taxes : Any decrease in Government Taxes i.e. Sales Tax, Excise Duty benefits should be pass on to university. W. Agreement : Acceptance of Purchase Order by the Successful Tenderers is itself an agreement between Tenderer and YCMOU. X. Extension of Supply Period : The Committee of YCMOU will decide extension of supply period and their decision for extension of supply period will be final and binding on the part of supplier. Y. Increase/Decrease in Quantity : The quantity shown in the Annexure 1 of the tender may increase or decrease. In case the quantity is less, the Tenderers will not be entitled to any compensation for the decreased quantity. If the quantity exceeds, 5

6 payments for the exceeded quantity will be made at the accepted rate. Z. Action when inferior material supplied: If the goods supplied are found to be of inferior or substandard quality, the tenderer- supplier will have to replace the rejected material with material of proper quality and standard at his own cost and within the time-limit stipulated by the university. AA. Failure in supplying the material : In case if tenderer fails to supply the ordered Managed Layer 2 Switches & Rack for any reason, the decision of purchase committee will be final for forfeiture of EMD. BB. Signature of tender document : Tender must be signed by the partner/proprietor/power of attorney holder. If signed by power of attorney holder the certified copy of power of attorney holder must be enclosed. CC. Refund of E.M.D. : E.M.D. of successful Tenderer will be refunded after satisfactory supply report from Computer Centre of Y.C.M. Open University, Nashik. In the case of tenderers whose tenders are not accepted the Earnest Money Deposit will be refunded as early as possible on written request duly signed by the original official receipt granted by this university. DD. Jurisdiction : No suit or any proceeding in regard to any matter arising in respect of this tender shall be instituted in any court save the competent city civil court of Nashik. EE. Fax Quotations : Telegraphic or Fax Quotation/Tender will not be accepted. FF. Conditional Tender will not be accepted.
