12 EU Decision-Making Understanding EU Decision-Making: Principles, Procedure, Practice Dates March June October November 2014 s 14/122/01 14/122/02 14/122/03 14/122/ Dr Edward Best, Professor s French Public officials preparing to assume EU responsibilities, EU affairs professionals, people needing to quickly acquire a comprehensive familiarity with how EU decisions are taken. This is a self-standing immersion course. It is also a suitable basis for participation in the specialised courses offered by EIPA on particular aspects of EU decision-making. The course first provides a framework for understanding EU decision-making. It briefly explains the treaty structure and the different kinds of competences which have been given to the EU. The different phases in the policy cycle are then addressed in detail, highlighting the changes introduced by the Lisbon Treaty. The elaboration of a Commission proposal is presented, with emphasis on public consultation and impact assessment. To understand legislative decision-making, participants simulate a Council Working Party, and discuss cases of interaction between the Parliament and Council. Finally, the implementation phase is presented, with a review of the new system of delegated acts and implementing acts. Participants will understand the principles and structures of the EU system and the basic competences and functioning of the EU institutions; they will be familiar with the different stages in the legislative cycle; and they will have an insight into how decisions are reached in practice. 13 EU Decision-Making Regional and National Government and Legislators in EU Law-Making: What Needs to Be Done Date 5-6 March /661/ Gracia Vara Arribas, Expert Maastricht (NL) Natalia Domenech García, This seminar is directed towards national and regional civil servants, members of the civil society and lawyers who already have a general knowledge of EU policy processes, but who require a post-lisbon update and greater detail with regard to the specific roles open to EU regions. The seminar provides a general review of the post-lisbon EU policy cycle, highlighting the main openings and challenges posed for EU regions in the phases of EU policy elaboration, EU legislative decision-making, the adoption of EU delegated and implementing acts, and the application of EU law. The issues arising at each phase are illustrated by cases in key policy fields (including transport and social policies), and by making use of some of the most relevant recent Internal Market Directives where the regional level has been especially active (public procurement and services directive, for example). The seminar will include a range of presentations as well as interactive elements such as group work, case studies and a video. This seminar will provide participants with a sound understanding of the role of the regions in the new post- Lisbon system of EU legal acts. After the two days, the participants should be well prepared to participate in, or provide input for, the different kinds of representation involved in Brussels, as well as having a greater insight into the specific role of regional and national governments, agencies and legislators in ensuring Member States compliance with various (hard and soft) forms of EU law. 14 Impact Assessment Working with Impact Assessment at the EU Level Dates April November 2014 s 14/120/01 14/120/ Dr Theo Jans, Associate Professor Maastricht (NL) Esther Haenen, e.haenen@eipa.eu Officials from most ministries and agencies who are responsible for following policy dossiers at the EU level. This two-day seminar offers participants an intensive practical introduction to impact assessment in EU decision-making. It explains why impact assessment has become an increasingly important part of the policy-making and legislative processes in the EU. It discusses the key analytical steps followed by the European Commission in preparing an impact assessment, as well as the main quantitative and qualitative techniques and tools available. Finally, it offers a forum for considering the opportunities for stakeholder and Member State input into the preparation of the European Commission impact assessment, as well as the inter-institutional dimensions and challenges. A combination of presentations, guest lectures, case studies and group exercises, as well as the sharing of experiences between participants. By the end of the seminar, participants will have obtained a practical understanding of this increasingly important policy development tool. They will be better equipped to participate directly in such processes as well as to provide input into the exercises carried out by the EU institutions as part of the elaboration of EU legislation. 14 Update of eipa s activities at

15 Delegated and Implementing Acts From Comitology to Delegated and Implementing Acts: Practical Challenges and Institutional Issues Dates March September December 2014* s 14/100/01 14/100/02 14/100/ * Dr Mihalis Kritikos, Lecturer s French s Maastricht (NL) Brussels (BE)* Winny Curfs, w.curfs@eipa.eu This two-day seminar is designed for civil servants from EU Member States, candidate countries and the EU institutions, as well as other stakeholders requiring a detailed understanding of the practical challenges posed by Delegated and Implementing Acts as well as of the latest developments in this field. The seminar explains the nature of the new provisions for Delegated and Implementing Acts which were introduced by the Lisbon Treaty; reviews the various rules and agreements which have been adopted to put them into effect; and highlights the legal, institutional, political and normative issues which have arisen. The internal procedures in the institutions involved (notably the European Commission, Council, and European Parliament) are presented, looking in each case at the implications of these for Member State representatives and the opportunities they provide for external input. The seminar is based on a range of presentations and interactive group work, to enable participants to put their knowledge into practice. The seminar integrates case studies and current examples to enable participants to see Delegated and Implementing Acts at work. At the end of the seminar, participants will have a good knowledge of the nature and practice of Delegated and Implementing Acts, as well as insight into both the practical challenges posed, and the legal and institutional issues at stake. Participants will thus be well equipped in the future both to participate in preparatory processes for Delegated and Implementing Acts in Brussels, and to assist in managing these acts at home. 16 EU Budget Understanding the EU Budget: Less of the Same Until 2020? Dates June December 2014 s 14/126/01 14/126/ Dr Theo Jans, Associate Professor Maastricht (NL) Danielle Jacobs d.jacobs@eipa.eu Officials from Member State administrations, candidate countries, and the EU institutions, as well as budget and evaluation consultants who are directly or indirectly affected by European decision-making on budgetary issues and their links with political strategies. This two-day course will provide an intensive overview of the EU decision-making process in the budgetary field and the different ways in which the EU institutions interact in all phases of this process post-lisbon. The budgetary cycle is presented starting from the proposal stage, through adoption, implementation and eventually to audit and discharge. This seminar offers detailed discussions of budget procedures. The revenue and expenditure sides of the EU budget are presented with a focus on the new proposals regarding own resources and the multiannual financial framework The implementation of the budget is also covered as we discuss the main innovations in the new financial regulation. In addition to technical information, participants will be given an insight into the linkage mechanisms between political strategy and the elaboration of the budget, including the clear tensions that it engenders. The course is both practical and interactive, offering a combination of theoretical perspectives, group discussions and recommendations from experts with practical experience in European budgetary affairs. At the end of this course participants will have gained an overall view of the complexity of the decisionmaking process in the budgetary field and will be able to identify the relevant actors involved and understand their role. Furthermore, they will be able to identify the main issues at stake in relation to the elaboration of political strategies and the management of budgetary resources. 17 EU Information Management Europe on the Internet: Finding your Way through the European Information Jungle Dates March October 2014 s 14/110/01 14/110/ Cosimo Monda, Senior Lecturer Maastricht (NL) Esther Haenen, e.haenen@eipa.eu All those who need to be able to find EU information quickly and/or to update their research skills in EU-related matters: EU officials, national civil servants, consultants, information professionals, documentalists, translators, as well as people working in the commercial sector and for NGOs. This course provides participants with a comprehensive and structured guide to a wide range of free and commercial internet resources dealing with European issues. The working sessions allow participants to improve and/or update their knowledge of EU information sources, as well as their abilities to use them effectively. This course will offer demonstrations of the most useful websites and databases, combined with ample opportunities for participants to develop hands-on expertise by exploring the websites themselves in order to find targeted information. Each participant will have at their disposal a PC with high-speed internet connection during the whole duration of the seminar. At the end of the training course, the participants will have a good knowledge of the key EU information sources and search techniques; practical experience in using the main EU and non-eu websites and databases; and a toolbox for finding targeted EU information. They will be able to quickly and efficiently find: legislation, case law and summaries of legislation; working documents, policy papers and press releases; public procurement, calls for tender, grants and loans; contact information, who s who and who s doing what in the EU; statistical data; bibliographical, translation, linguistic and terminological information. One-day standard programme We also offer a standard one-day version of this training course. The target group and objectives are basically the same as in the two-day version, but the programme is adapted to the needs of persons who cannot be absent from their work for more than a day. The programme consists of the following sessions: a short overview of the EU Information Policy: legislative and judicial information; policy making in the EU: legislative and judicial information; monitoring of legislative proposals and other initiatives; keeping up to date with EU events and initiatives; bibliographical information; and search techniques. 18 Transparency and Access to Documents Transparency and Access to Documents in the EU Date September /115/ Cosimo Monda, Senior Lecturer Maastricht (NL) Esther Haenen, This seminar is recommended for anyone whose work relies on public access to documents or relates to the treatment of sensitive information. It is aimed at, among others, information officers, information managers, data protection officers, European, national and sub-national officials, data protection and information lawyers, legal advisors, staff of civil liberties associations, consultants, lobbyists, journalists and researchers. The seminar will familiarise participants with the various aspects of openness and transparency in the EU. While linking the concept of transparency with the broader issues of political accountability and democratic deficit, the sessions will address the latest developments regarding access to documents. These will cover both the acts of the community institutions and other bodies such as agencies, treatment of sensitive data, relevant case law, as well as the role of the Member States. Furthermore, the seminar will focus on the changes resulting from the entry into force of the Lisbon Treaty and their ramifications on the revision process of Regulation 1049/2001. A variety of training methods will be utilised: lectures and presentations, group discussions and online demonstrations. The objective of the seminar is to highlight the practitioners view on the application of European provisions on transparency, to allow for a discussion on the key challenges of Regulation 1049/2001, and to demonstrate different issues faced by the institutional actors in the application of the legal framework for transparency and access to documents. At the end of the seminar participants will have a sound understanding of the politics of information at the European level, be more aware of the rights and obligations underpinning the access to and treatment of documents, and have a better insight into the strategies aimed at promoting an open Europe. 18 Update of eipa s activities at

19 EU Agencies Fashion or Necessity? EU Agencies in between EU Institutions and Member States Date February /112/ Dr Mihalis Kritikos, Lecturer Maastricht (NL) Esther Haenen, Officials and experts from Member States and EU institutions working with or at EU agencies, as well as experts from non-governmental organisations, law firms and research bodies. EU Agencies have continued to grow in number and, in many cases, have come to play an important role in decision-making. There continues to be debate over their powers and functioning, as well as the overall arrangements for EU Agencies. This seminar will address the management challenges, and the perspectives for further change. It will recall the reasons which led over the years to creating EU agencies; look in detail at the different ways in which EU agencies participate in EU policy processes; and offer an exchange of experiences and practices regarding the management issues which have arisen. These will include questions of conflict of interest, budgeting procedures, accountability and control, differences between agencies, expert groups and committees and their management structures. The seminar will review the state of play in implementing the Common Approach on decentralised agencies adopted by the EU Institutions, and conclude with a forward-looking round table The seminar will be organised around presentations by leading experts, workshops to gather experiences of participants, and panel discussions. This approach will offer the possibility to discuss the latest trends and will enable experts and officials involved in different kinds of agency structures to exchange views. The objective of the seminar is to provide a forum for national officials, EU officials and representatives of EU agencies to discuss the operations of EU agencies and agency-type structures. The seminar will discuss the added value of EU agencies, explore trends in their design and management, and discuss experiences gained, and future perspectives. Update of eipa s activities at 19

22 External Relations Successful Preparation and Implementation of Twinning Projects Dates March October 2014 s 14/341/01 14/341/ Wolfgang Koeth, Senior Lecturer Maastricht (NL) Danielle Jacobs, d.jacobs@eipa.eu The seminar is intended for civil servants and other persons interested in enhancing their knowledge about the Twinning instrument. Among the many cooperation mechanisms developed by the European Union, Twinning has been one of the most extensively and successfully applied institution-building programmes in recent years. It has assisted the new Member States and the (potential) candidates in preparing for EU accession and for the full adoption of the acquis. Since 2005, Twinning has also been applied in the countries of the European Neighbourhood Policy. The seminar is implemented by experienced Twinning practitioners and will draw upon real life examples referring to numerous Twinning projects carried out in the past. The facilitators will give an introduction into the concept of the Twinning project, and will go through the successive components of the process with a focus on potential risks and ways to address these. Each subject will be explained through a short theoretical presentation, illustrated by real life examples. The seminar will be highly interactive, and participants will be encouraged to share experiences and ask practical questions. Lessons learnt from implementation of previous projects will be drawn upon for successful realisation of the new projects. The objectives of the seminar are: to bring together public officials and other persons involved in Twinning projects, both from the Member States and the beneficiary countries, so that they can share their knowledge and practical experiences, identify essential cooperation issues and extend their network; to achieve in-depth understanding of all components of the process of preparation and implementation of a Twinning project; to discuss and analyse from the practical point of view, the main opportunities and challenges of the Twinning project as an effective cooperation tool within the context of the EU integration process; to develop and enhance practical skills in drafting the necessary documents linked to the preparation of a Twinning project. 22 Update of eipa s activities at

23 External Relations Successful Preparation and Implementation of Projects under EU External Financial Assistance (IPA & ENPI/ENI) Date April /343/ Wolfgang Koeth, Senior Lecturer Maastricht (NL) Danielle Jacobs, The seminar is targeted towards civil servants from national and regional administrations, as well as consulting companies and other persons interested in enhancing their knowledge on the EU s external technical and financial assistance instruments (Technical Assistance contracts, Twinning, TAIEX and Sigma). The European Union has developed a number of cooperation mechanisms in order to assist the candidate countries and potential candidates to prepare not only for their accession, but also for the successful management of EU funds after accession. These instruments, in particular technical assistance and Twinning, are also accessible to the countries of the European Neighbourhood Policy (ENP). This twoday practical seminar will provide a complete overview of all existing and accessible instruments under technical assistance, and the capacity-building components of IPA and ENPI in the current programming period. We will also look at the changes that are foreseen for the next programming period , and discuss their possible impact. The seminar also includes some practical workshops on the preparation of IPA/ENI projects. Traditional training methods (lectures and presentations, including real-life examples) will be combined with a highly interactive approach through practical workshops, discussions, exchange of experiences between participants themselves and experts, as well as round tables. By the end of the seminar, participants will have gained a thorough practical knowledge of each step of the preparation process for Twinning and technical assistance projects; they will also have developed practical skills in the drafting of relevant proposals. 24 Internal Market The Services Package 2014 and New Upcoming Reforms: Solutions in Times of Crisis Date November /611/ Gracia Vara Arribas, Expert Barcelona (ES) Natalia Domenech García, EU Member States, EEA and candidate countries, benefiting consumers and patients, at national, regional and local level, who deal with or are affected by the new business services reforms. The package contains three Commission Staff Working Documents, dealing with the zero tolerance principle, the improvement of the points of Single contact and the deeper reform in three sectors (construction, business services and tourism). The business services are used in this training as a case study in the field of mobility of skilled labour and the reforms already in place for Business professional services amount to around 9% of the GDP in the Union and important reforms are imminent; therefore, it has been chosen as a case study to detect the forthcoming challenges that will be facing Member States in complying with the new services package. The economic impact assessment of reserved activities will be presented by the Author of the Commission Report. In addition, a comparative analysis of the reform process in different Member States and candidate countries will be conducted by experts from the public sector who are in charge of this reform. Apart from traditional training methods (lectures and presentations, including concrete examples and case studies), an interactive approach will be applied. At the end of the seminar, participants will have improved their knowledge of the new services package and have a clear understanding of the Commission s upcoming reforms and consequent obligations: mechanisms of evaluating compatibility and identifying discriminatory regulations in the service sector; how to avoid infringement procedures against violations of the Services Directive; benefits and challenges of the Points of Single Contact; results of mutual evaluations and performance checks and the influence for the future reform process; lessons learned from the example followed on access to professions. 24 Update of eipa s activities at

25 Free Movement of Professionals The Modernised Directive on Professional Qualifications and Issues of Practical Implementation Date June /324/ Dr Katerina-Marina Kyrieri, Lecturer Maastricht (NL) Winny Curfs, Officials in the relevant ministries or departments of Member States, competent authorities, chambers and/or professional bodies dealing with the implementation of the professional qualifications Directive, as well as experts in migration working in the field of free movement of professionals and services. It is also of interest to consultants, academics and those developing and monitoring national education policies and structures. In view of adopting the revised Directive on the recognition of professional qualifications and publishing the Commission communication on the evaluation exercise of regulated professions in the second-half of 2013, this new two-day seminar will examine the main changes that need to be implemented by the competent authorities. In particular, it will look at issues such as the introduction of training frameworks and rules on partial access for regulated professions, as well as the modernisation of the minimum training requirements for the sectoral professions. In the context of administrative cooperation, the seminar will also discuss the implementation in practice of both the European Professional Card and the alert mechanism, and how these should be linked and function within the IMI. This seminar will be based on a mixture of presentations, discussions and workshops. It will stimulate active participation and the sharing of policy practices. Specific cases and experiences will be explored. Background documentation will also be provided in an online/e-learning set up. Speakers will include officials from the EU institutions, EIPA staff, academics and practitioners. At the end of the seminar, participants should have: a clear understanding of the changes in the modernised Directive and how they can be implemented in the Member States; enhanced awareness of perceived problems of transposition and how these can be reduced or overcome. The seminar could also be of interest to industry and service providers, as well as to academics, lawyers and other persons working in this field. This seminar will be devoted to the European public procurement reform and concentrate on the new future directive on procurement. A provisional agreement has been reached concerning the new rules on public procurement, entailing the replacement of the Classic Directive 2004/18/EC and the Utilities Directive 2004/17/EC, and in addition, a new directive on the award of concessions contracts. This seminar will mainly focus on the new procurement directive which is expected to enter into force in spring Emphasis will be put on the new issues, procedural aspects, strategic procurement, tools for aggregating demand, and particular procurement regimes. Furthermore, the seminar will also address the new directive on the award of concessions contracts. This seminar will be based on a mixture of presentations and discussions. European Union institutions are preparing a new legislative review that updates Public Procurement Directives (2004/18/CE and 2004/17/CE), aiming to increase efficiency of public spending: on the one hand, by increasing participation of small and medium companies in public procurement contracts and, on the other hand, allowing buyers to support their social and environmental objectives. New proposals include the review of Directive 2004/17 and 2004/18/CE and the adoption of a Concessions Directive. The new Directives could already be enforced this year, and implemented within a two-year framework. The seminar ensures dynamic interactions, therefore the number of participants is limited and experts are expected to attend all working phases. The seminar will analyse in detail the developments of the proposed legislative package and its incidence in the Spanish legal system.
