8 The State Department J-1 Work Travel Program is an Exchange Visitor Program designed to achieve the educational objectives of international and cultural exchange by involving young adults in the daily life of the host country through temporary employment opportunities and to return home to share their experiences, and to encourage Americans to participate in the educational and cultural programs in other countries. Workers will receive the federal minimum wage set by the Fair Labor Standards Act (FLSA). Federal Minimum Wage is $5.15/hour. Employers of "tipped employees" must pay a cash wage of at least $2.13/hr if they claim a tip credit against their minimum wage obligation. If an employee's tips combined with the employer's cash wage of at least $2.13/hr do not equal the minimum hourly wage, the employer must make up the difference. Any international workers employed will be paid the equivalent of their American counterparts. Participants may not be employed as domestic employees in U.S. households or in positions that require them to invest their own money to provide themselves with inventory for the purpose of door-to-door sales.* 7 of 7
9 CONDITIONS OF EMPLOYMENT FOR WORK & TRAVEL PARTICIPANTS 2008 USE BLOCK LETTERS I (first name) (last name), the undersigned, understand and agree: PROPERTY INFORMATION I understand and agree to the following: 1. That the type of employment I am given is determine ultimately decided upon arrival at the work site by HCMS management. based on my arrival date, position availability, English level, and skill required 2. That I must speak English to understand employment requirements. 3. That I must abide by all rules of conduct and grooming required by the property location. These rules include, but are not limited to the following: a) Pass drug testing whenever applicable b) No visible tattoos c) For men no hair below collar level d) No Facial hair e) No piercing other than normal in ears f) To respect management and all employees at property g) To undertake all duties assigned in a precise and timely manner h) All shifts are scheduled by the property, there may be three different shifts a day and week-ends are most busy during seasonal work i) Hours per week 32 minimum j) If you are working in Gaming, certain gaming and alcohol related service jobs, you must be 21 years of age and obtain a gaming license at your expense. 4. That I, personally have to inform my direct supervisor if I am going to be absent whether for illness or vacation. Vacation time has to be pre-approved by the supervisor. 5. That non-compliance with any of the conditions therein is reason enough to be changed from position, or terminated from the job and also from the Work and Travel program. 6. That being terminated from the program may render me out of visa status and would require me to return immediately to my country without receiving any kind of reimbursements or travel time. GOVERNMENT PROGRAM RULES That the government s aim with this J-1 visa program is to achieve the goals of international exchange by involving me directly in the daily life of the US through travel and temporary employment opportunity. That the J-1 visa only allows me to work on the dates specified on the DS-2019, not earlier or later. If no earlier departure is indicated on my I-94 card, US immigration only allows me to remain in the US up to 30 additional days as a tourist. I cannot work during those 30 days. That in accordance with government regulations I am NOT authorized to work in the following positions/fields: health care, child care (au pair, nanny, baby sitting, etc. aviation, crew member of a ship or an airplane. That I will leave the US upon completion of my program, no later than 30 days after the ending date in the DS That this visa category does not allow for any type of extensions. That if I do not report either on the phone or in person within 48 hours upon my expected arrival to the US work site or to Hospitality, I can be terminated from the program at the discretion of my sponsor in regulations with the SEVIS program. That my sponsor needs to know my whereabouts. Hospitality is obligated to report to sponsor. That if I leave my employment or am terminated by my employer; then my employer will notify my sponsor. This notification of not completing my employment as agreed upon may jeopardize my visa status as deemed by the sponsor. This decision is at the sole discretion of my sponsoring agency. To complete any written and oral evaluations required by the site, the employer and to comply with the Government regulations. FINANCE That I have completed my budget sheet based on the minimum amount of money guaranteed by my job offer and that I have made an accurate assessment of how much money is left after I pay taxes and all expenses. That I should not expect to make more money than what I calculated in my budget sheet. That I understand that most job sites have seasonal business work. This implies that for me to receive the expected total averaged gross amount in my budget sheet I have to remain the entire time in the program and arrive no later than the starting date offered in my job offer. That I understand that in some cases but not all participants in all sites that there are opportunities for overtime, good tips and higher pay doing night shifts THESE OPPORTUNITIES ARE NOT GUARANTEED TO ANYONE. I understand that there will be a mandatory orientation meeting at the property site and it may take up to one week before I may start work. I will be prepared to cover my expenses for this. That I understand that if my arrival to housing is not during operation hours, I will have to spend a night in a hotel at my own expense 1
10 That I am responsible for my own expenses related to all travel from site at the end of the Work & Travel Program assignment and for all other personal expenses incurred from end of the Work & Travel Program until I return home. HOUSING AND TRANSPORTATION. Hospitality is an employer and does not own or operate housing facilities. However its purpose is to secure safe, comfortable and affordable housing for its employees for duration of the entire program. The housing is arranged exclusively for Hospitality employees and may not be occupied by anyone who is not an employee of Hospitality or whose employment with Hospitality was terminated. Usually housing is located in apartment communities or employee/student dormitories. There is NO SMOKING allowed in any housing. Apartments are one, two or three bedroom units with a kitchen and a bathroom, 2-3 students will share each bedroom. There is basic rental furniture provided: beds, couch, kitchen table and kitchen chairs. Kitchens are typically equipped with cabinets and stove. In case there is no furniture rental, students will be required to purchase the basic necessities for a healthy lifestyle. This will include beds, kitchen table, chairs and lamps. Hospitality s management will assist its employees whenever possible in obtaining cost effective furniture. For example a set of 4 airbeds, two bedroom lamps and a kitchen table and four chairs may be purchased in discount stores for as little as $ Under no conditions participants of our programs will be allowed to sleep on the floor or maintain an improper living environment. Cookware and silverware is not provided and must be brought by the students or purchased upon arrival. Sheets, blankets, pillows, pillowcases, towels, washcloths are not provided and must be brought or purchased upon arrival also. All Students must live in HCMS housing and must sign a minimum 3 month sub lease upon arrival. The student is responsible for rent for the duration of the sub lease. If the student is fired or deserts, they are still responsible for this cost and can be pursued through payroll deduction and/or any remedy allowed by law by the USA or country of origin. COST Of HOUSING: Total cost of furnished housing may range from $ $ per person per month. Some special factors may cause the cost of housing to be slightly higher including: 1. Furniture rental if required, if not provided by landlord. 2. Utilities and utility deposits if required, if not provided by landlord. 3. Excessive utilities will be charged for. The allowable amount for a 2 bedroom is $200 per month, and for a 3 bedroom is $300 per month. If your utilities exceed these amounts, you will be responsible for the difference, along with your current roommates. *Remember, a short term lease cost greater than a long term lease. Keep this in mind when comparing your rental cost you will pay. ***PAYMENT DAY OF ARRIVAL First month rent AND security deposit is due upon arrival. Be prepared to pay this when you arrive. If you do not have enough money for your rent when you arrive, you will not be able to move in. Your first month rent is separate from your security deposit. You will have to pay a total of $400 the first day you arrive. HOUSING SECURITY DEPOSIT: A security deposit per person is required in order to hold the apartment until students arrival. The maximum security deposit will not exceed $ Hospitality then transfers the deposit to the landlord on participant s behalf. Landlord holds the deposit for the length of the lease to secure themselves in case of damages or early move outs. The security deposit may not be used as first month rent. The deposit will be refunded based on the state of the apartment upon move out and other factors stated in the lease agreement which participants need to sign upon arrival prior to moving in. Students moving out prior to completion of the lease will not be refunded their deposit. Usually a cleaning fee of $50.00 will be held by a landlord. Generally you can expect the landlord to issue a deposit refund check days after your apartment/dormitory is vacated by all persons. In some cases it may take longer, some landlords are able to refund deposits on the day of departure. The amount of the refund is solely determined by the landlord (apartment management) and not Hospitality s, based on their assessment of the apartment. Any undue cleaning or damages will be deducted from your security deposit. Please understand that these are general conditions, which will apply in most of the locations. However, under very specific circumstances, in upscale resort areas for instance, staying within the reasonable cost of the accommodation may compromise its quality. TRANSPORTATION 1. It is participants responsibility to get to work on time and to cover the expenses of transportation. 2. The housing site has been selected on the basis of a number of criteria including: cost, availability, safety and location to your work place and shopping. Because of these many criteria, it is not always possible to secure housing that the participant is able to walk to and from to go to work. In some cases accommodations are available within walking distance or biking distance from work. Otherwise, participants will use public transportation to get to and from work. If none of the above options are available, Hospitality will arrange for transportation service, which will operate on a fixed schedule basis. Cost of such transportation is not more than $6.00 per person per day. 3. If Hospitality provides such transportation, all students must use transportation for first month. If they find alternative transportation they must give two weeks notice when they pick up paycheck to their supervisor. SEVERAL That it is in my best interest and my full responsibility to keep a copy of all documents I sign with the recruiter, and that I am responsible for keeping them in my possession together with my budget sheet during my stay in the USA. That I have had a face to face interview prior to signing this agreement, that I provided proof of my student status and that my English level has been tested. That I authorize Hospitality to release any information provided with this application for the following purposes: placement, medical and/or government issues. I understand that this release may take the form of a photocopy, verbal, and electronic transfer of the information contained in this application. 2
11 That I fully understand and am responsible for my actions while living in the US in regards to critical issues of American laws in dealing with drinking, partying and making excessive noise, child abuse, stealing, driving, emergency information, instructions to proceed upon my arrival to the US, safety issues and insurance coverage. That I will notify Hospitality of my arrival date and time at least two week prior to arriving in the United States at info@hospitalitymail.net.
