The defendant in the signed agreement pled guilty to unlawful possession of controlled substance of marijuana, while the remaining charge will be dismissed at the request of the government, as part of the plea. According to the government s case, Vice and Narcotics Division with the Department of Public Safety received a call from Customs Agents that canine Grace alerted near the defendant who was in the immigration line for the incoming Lady Naomi. It s alleged that when a pat down search was conducted, Customs came across two bulges on the defendant s hip and leg. The defendant removed his shorts and police observed two taped bundles around his left knee, a small bundle located on his hip and a third bundle inside his pockets. Police uncovered 230 hand rolled marijuana joints and several bundles of dried marijuana leaves. Court filings say police conducted testing and found the leafy substance to be marijuana. Associate Justice Lyle L Richmond who accepted the plea agreement asked Assistant Attorney General Russell Smith why there was a delay in the implementation of the plea agreement when the signed plea deal was filed in February. While the prosecutor was unaware of the reason for the delay, Assistant Public Defender Joel Shiver explained that at the same time the change of plea was filed, the defendant was charged in another drug case. Richmond has scheduled sentencing for the defendant on June 6, 2015 a pre-sentenced report was ordered for this case. As of yesterday defendant has been incarcerated for over 18 months at the Tafuna Correctional Facility. The second case against Sevi is pending in the High Court. The second case with which he s charged came to light when the corrections officers conducted a surprise raid at TCF where they found a bag of taro chips from Samoa containing marijuana equivalent to 20 joints and a pill container with six marijuana joints in the defendant s possession. In this new drug case he is again charged with unlawful possession of a controlled substance, marijuana, with intent to distribute and unlawful possession of marijuana. (all ANSWERs ON PAGE 14)

Lolo by Joyetter Feagaimaali i-luamanu Samoa News Reporter American Samoa s listing as a colony by the United Nations is an issue that the people and the government have over the years tried unsuccessfully to resolve, as the territory does not see itself as a colony. This is the issue being tackled in a draft letter to the UN 3rd International Decade for the Eradication of Colonialism to be held in Managua, Nicaragua May 19 to 21, Attorney General Talauega Eleasalo Ale accompanied by Secretary of Samoan Affairs Mauga Tasi Asuega will attend the UN seminar and will present the final document or letter from the Territory/ governor concerning the issue of American Samoa s political status the UN currently lists it as a colony of the U.S. In his presentation of the draft at the governor s cabinet meeting this past Wednesday, Attorney General Talauega said the question that this poses is, how close do we have to be to the United States to no longer be considered a colony of the U.S.? MORE EXCEPTS OF DRAFT LETTER The draft letter, as it stands, would say that the Territory firmly believes that American Samoa s current political status as an unincorporated and unorganized territory of the United States is neither sustainable nor economically secure. Moreover, it lacks appropriate vestiges of self-governance as required by the UN Charter. Lolo notes that for a people that have been loyal members of the American family for well over 100 years; whose patriotism is manifested in one of the highest rates of enlistment from any State or territory in the Armed Forces of the United States; for people who carry U.S. passports and whose extended families live across the United States as well as abroad; for people for whom the United States has opened its arms as the land of opportunity; these are not easy choices to make. He explains, Back in the 1970s many American Samoans did not support the idea of electing our own Governor. That time has long past. Although the proposed constitutional amendment failed last year, the resulting public discourse suggests that American Samoa is ready to take the next step of entertaining serious discussion about what our future political status should look like. Lolo also points out that the U.N., when discussing the development of self-government as noted in Chapter XI of the United Nations Charter should do so in the context of the particular circumstances of each territory and its peoples and their varying stages of advancement. It s a question of economic viability in the absence of reliance upon the administering country s resources. We recognize that the economic dilemma we face points up the need for the territory to be more proactive in determining its course for the future. Lolo says that throughout American Samoa s long relationship with the United States, the administering power has been a benevolent one, although sometimes near-sighted, overseer of our growth and development. At no point in time has the United States acted contrary to the expressed wishes of the people of American Samoa, he states. When a constitutional form of government was the will of the people, it happened. When the people wanted to elect their own governor, it happened. When the people felt that Congress should protect them from the possibility of unilateral changes to the Constitution by the Department of Interior, it happened. He notes what our people have begun to do is chart our course for the future, one that has sparked a lively public debate among voters and local residents about American Samoa s political status and future. The next steps will require continued serious dialogue among all the people of American Samoa. Addressing the role of Congress in approving changes to our Constitution, which will require an act of Congress, shouldn t be undertaken until we engage in serious discussions about our future. Lolo says, Our choices are varied, and profound : (i) maintain the status quo, which causes us continuing concern due to the future uncertainties (He highlights in the draft examples of the U.S. federal laws and trade agreements that have stymied American Samoa s ability to develop a sustainable economy, as well as the shortfalls in the Territory s current form of government); (ii) consider an Organic Act, like Guam and the Virgin Islands, which would draw us closer to the United States, but on the other hand would likely lock us into economically untenable circumstances; (iii) look to the idea of Commonwealth status akin to Puerto Rico and the Commonwealth of the Northern Marianas Islands; (iv) or consider some form of free association with the United States as in the case of Palau and Marshall Islands. All are possible. Not all are viable. The draft document or letter may need further input, according to the AG, who has urged the cabinet members to go through it, as in its present form it reflects the governor s views on what the Territory should say to the United Nations about its relationship with the United States. Talauega told them that he, Mauga and Governor Lolo welcome constructive comments, whether positive or negative. That s the debate and the discussion that the governor Happy would like the cabinet to engage in with the community, to determine where we want to be. There s also a discussion about whether the status quo is sufficient. Many of our leaders have come to the conclusion that the status quo is unsatisfactory and it s not economically safe for us because of our inability to have some control over our resources and over our land, he pointed out. BACKGROUND Chapter XI of the UN Charter says, The administering nations have committed to develop selfgovernment, to take due account of the political aspirations of the peoples, and to assist them in the progressive development of their free political institutions, according to the particular circumstances of each territory and its peoples and their varying stages of development. Congresswoman Aumua Amata, praised the passage of the Magnuson Stevens reauthorization through the House Natural Resources Committee markup on Thursday. Aumua, who serves as the Vice Chairman of the Indian, Insular & Alaska Native Affairs Subcommittee voted in favor of the measure. This is the first step in the process, but I am pleased that the committee saw the importance of this much needed re-authorization of the law that is the foundation of our nation s fisheries management, she said. Chairman Young s bill, which I was proud to be an original cosponsor, will ensure that our fishermen and the coastal communities like mine in American Samoa have more input into the science and data collection regarding our fisheries and remove some of the influence from outside interests like the environmental lobbies whose agenda often has no concern for the local communities affected by the law. Thursday, the House Committee on Natural Resources completed the markup of H.R. 1335, the Strengthening Fishing Communities and Increasing Flexibility in Fisheries Management Act, legislation reauthorizing the Magnuson-Stevens Fishery Conservation and Management Act (MSA), the primary law governing fisheries resources management in the United States. The committee also conducted a markup of H.R. 774, Illegal, Unreported, and Unregulated Fishing Enforcement Act of 2015, which aims to strengthen enforcement mechanisms to stop illegal, unreported, and unregulated fishing. Both bills passed through the committee and will now be brought to the House floor for further consideration. As a co-sponsor of both of these important measures that will strengthen our nation s fishing industry and level the playing field for U.S. flagged vessels in regards to foreign competition, I am confident that both of these bills will make it to the President s desk to be signed, concluded Amata. 5 Joseph and the Amazing Technicolor Dreamcoat debuts to standing ovation by Terry Custodio Auva a, Special to Samoa News Emotional, brought forth a sense of warmth was the description given by the Lt. Governor Lemanu Peleti Mauga when asked to say a few words after the premier showing of the American Samoa Community College Fine Arts Department s production of Joseph and the Amazing Technicolor Dreamcoat. The play is driven by music composed by Andrew Lloyd Webber, with lyrics by Tim Rice, and has absolutely no spoken dialogue. It is based on on the biblical story of Jacob, his favorite son Joseph and his 11 brothers. The Lt. Governor also jokingly said that productions like these are an alternative way to learn about the bible other than listening to the Good Revered and His wife. A high-spirited musical, with a variety of styles of song and dance had the cast rocking the stage with a high level of energy, performing to rock & roll, pop, country-western, Calypso and even the Charleston engaging the audience throughout the whole performance. The talented cast of dancers kept the mood light and fun with a mixture of fox trots, jigs, some folk dancing, fandango, mambo, and Samoan fuataimi moves, you name it they had it, gallivanting from one end of the stage to the other. Joseph s brothers and their wives definitely kept the energy going. The star of the show was definitely the talented Miss Herthalina Lutu, who had the audience enthralled from beginning until the end with her vibrant energetic soprano narration of the story. Her animated voice and movements and superior voice kept the focus on her storytelling whether she was the focal point or blending into the scene. Such talent was so refreshing to see. The rich high tenor of Joseph played by George Sega, expressed the different moods and feelings he was going through and the emotion was picked up by the audience during his scenes. Pharaoh played by Alton Faasala, who also played Potiphar in Act one, was outgoing, engaging and able to connect with the audience with his comedic singing, imitating Elvis Presley s style. He basically owned the stage with his dance moves. The temperature in the Auditorium rose a couple of degrees when the beautiful but scheming Mrs. Potiphar entered the stage. Played by the multi-talented Princess Custodio Auvaa, her sensual dance moves and facial expressions while trying to lure Joseph into her arms had the audience erupting in laughter and applause. From the dramatically designed stage props, the hardworking stage crew, the meticulous technical crew, to the vibrant costumes, the energetic backup choir, the intermission highlighting the beginning orchestra class (mus187), the ASCC should be very proud of its efforts in putting together such a stimulating production. Special kudos should go to the ASCC Fine Arts Department chaired by Kuki Tuiasosopo, with Regina Meredith and Poe Mageo. While standing ovations should go to all including cast & crew. Bravo! Brava! Vaitinasa first revealed during the cabinet meeting on Wednesday the dates for the public high school graduations and the two hour time limit, which has been the practice for the last two years. (See yesterday s edition for details) With the graduation season not far away, parents and others in the community have again raised questions about the length of public high school graduation ceremonies. Vaitinasa said yesterday that the department, in particular, the Secondary Education Office, have made it a rule that all graduation ceremonies will not exceed two hours time. The goal is to honor all students and parents for their achievements and not concentrate only on those who will receive awards, she said in an message to the news media. We received overwhelming positive feedback from our community in the last two graduations thanking DOE and the schools for this change. She pointed out that it was a practice in the past for high school graduation ceremonies to last for 3-4 hours each. Today, our community can enjoy the sweet, simple and short essence of all graduation celebrations for our high school students, she said. Vaitinasa also said that another ASDOE ruling is to suspend graduation ceremonies for Kindergarten and 8th grade students in elementary schools. Instead, we encouraged all elementary schools to plan award ceremonies for students, she said. Regarding school buses, she said the buses would not be transporting any extra-curricula activities during the summer months, as all existing buses will be scheduled for full repair services. First and foremost, the purpose of [the] school buses is to ensure that all students have transportation to attend school during regular school schedule, she said. Vaitinasa informed parents that students who live within a mile radius of their school would not be provided transportation as their school is within walking distance. For example elementary schools located in the villages such as Aunuu, Fagasa, Masefau, Vatia, Matatula, Laulii, Aua, Afono, Alofau, etc. She explained that 10 new schools buses are being processed for bid and until the procurement process is complete, these new buses will not be on island. She hopes that the new buses will be shipped to DOE before the new school year begins in September. At this moment, there are only 13 buses in operation for both public and private schools, she noted. The new school buses are funded through federal funds under the Capital Improvement Projects, administered by the U.S. Department of Interior s Office of Insular Affairs. We appreciate the parents and community support during this difficult time when we are operating with only very few buses to do the work of a larger fleet of buses. Court jails 10 for involvement in attack on Malala Yousafzai MINGORA, Pakistan (AP) A Pakistani court on Thursday sentenced 10 militants to life in prison for their involvement in the 2012 attack on teenage activist Malala Yousafzai, a public prosecutor said. Sayed Naeem said the court announced the ruling at an undisclosed location because of security concerns. Each militant got 25 years in jail. It is life in prison for the 10 militants who were tried by an anti-terrorist court, he said. In Pakistan 25 years is considered a life sentence. Malala was shot in the head by the Pakistani Taliban when she was returning from school. The militants targeted her because she advocated education for women. Malala was initially treated in Pakistan, but was later flown to a hospital in Britain, where she now lives with her family. Malala, now 17, won world acclaim for her campaign and last year was awarded the Nobel Peace Prize. Mullah Fazlullah, the Taliban leader who ordered the attack, is still at large, as are other militants who took part in it. The 10 who were sentenced on Thursday were detained by the military last year. Also Thursday, the military said that 27 militants and five soldiers were killed in a gunbattle in the country s volatile northwestern Khyber tribal region. The statement said the military was making strong gains in Khyber, a known militant stronghold. Last June, Pakistan launched a major offensive in the North Waziristan tribal region, a longtime haven for the Taliban and other militant groups.

South Korea to allow more journalists to visit North Korea SEOUL, South Korea (AP) South Korea says it will push to allow more journalists to travel to North Korea to cover civilian exchange programs between the rival countries. Seoul s Unification Ministry announced Friday it would actively support sports, culture and academic exchange programs with North Korea as a way to boost cooperation between the two nations. Seoul had toughened restrictions on civilian trips to North Korea following an attack on a South Korea warship in 2010 that has been blamed on North Korea. (AP) Albuquerque s former police chief accepted perks and consulting work from Taser International as he helped the company land a lucrative no-bid contract to supply officers with body cameras, the New Mexico state auditor said Thursday. Ray Schultz committed substantial violations of city and state ethics laws in his dealings with Taser and prosecutors should determine whether to bring criminal charges, State Auditor Tim Keller said. A yearlong review of the city s handling of the $1.95 million contract found rampant disregard for all of those things that protect our taxpayer dollars, Keller said. You want the police chief of the Albuquerque Police Department to be this sort of shining star in public office. In this case, it points to the opposite direction, Keller said. Schultz is now assistant police chief in Memorial Villages, Texas. His attorney, Luis Robles, said Schultz didn t do anything wrong, adding that the city budget office led the procurement process and his successor made the final decision to award the contract. Brought in as a reformer in 2005, Schultz stepped down in 2013 under a cloud of bad morale and an investigation by the U.S. Department of Justice into alleged civil rights violations and questionable police shootings. He has said his departure wasn t linked to those problems, and supporters have praised him for innovative policing. Keller said Schultz gave Taser an unfair advantage for the 2013 contract in the final days of his tenure, even sending a Taser salesman an saying the process was greased. The same day, the two discussed his prospective employment as a consultant, which would later take him to Amsterdam, Australia and elsewhere to speak about technology on the company s dime. Keller said flaws in city purchasing processes and weak oversight improperly allowed Taser to win the award without competition. He said it was also inappropriate for Schultz and other department employees to accept trips, meals and a party at a San Diego nightclub that were paid for by Taser. Gilbert Montaño, spokesman for Mayor Richard Berry, said the city has halted monthly contract payments to Taser for the last seven months as it conducts a comprehensive review of the contract. The internal controls failed under Schultz, and the city made changes to ensure that that type of circumvention of the process does not occur again, he said. Scottsdale, Arizona-based Taser has become a leader in the fast-growing market for cameras that officers wear on their uniforms. But its relationships with police officials have raised ethics questions. The company has covered airfare, hotels and meals for chiefs and associates who attend its training and networking events and hired Schultz and two other chiefs as consultants within weeks or months after they retired. Taser general counsel Doug Klint said the company believes it complied with ethics guidelines in Albuquerque. But going forward, Taser will implement a one year cooling-off period for consulting contracts with former law enforcement officials to eliminate any perception of conflict of interest. Schultz may have violated ordinances that ban employees from influencing purchasing decisions while negotiating employment with vendors and that require ex-employees to wait one year before representing certain companies, Keller s report said. District Attorney Kari Brandenburg and Attorney General Hector Balderas said they were reviewing the matter. Schultz began early retirement Sept. 7, 2013, but remained on Albuquerque s payroll through Jan. 1, He began his Taser consulting as he was still getting his city salary, Keller said. As the department considered body cameras in 2012, Schultz and a deputy were guests at a Taser-sponsored party at Stingaree Night Club in San Diego during a national conference. Two others traveled on an all-expenses paid trip to Taser s headquarters to learn how to use its Evidence.com storage software. Albuquerque s first major purchase of body cameras, in March 2013, avoided competitive bidding by improperly relying on an earlier contract for other Taser equipment, Keller said. City officials justified the subsequent $1.95 million contract by saying a pilot program determined Taser s cameras performed the best but auditors didn t find documentation that other models were tested. Despite Schultz s promotion of body cameras for Taser, a Justice Department report has blasted the city s hasty implementation of them, saying officers were not given enough training and were failing to record some incidents in which they used force. The official, who was briefed on the incident and spoke on the condition of anonymity because the person wasn t authorized to speak publicly, said workers on the tarmac found the dynamite Tuesday when they noticed the bright colors on the stick. It was left behind after a Saturday evening training exercise for K9 officers and their dogs who work at the airport. Though live, the dynamite would have required a detonator or explosive to be set off. Sgt. Belinda Joseph, a spokeswoman, said the object was a training aid and there was a certain amount of TNT contained in it but denied that it was a stick of dynamite. She said airport police are investigating and have notified the Transportation Security Administration. The stick was checked out from a TSA explosive storage container for training. Such trainings are done nearly daily, the official said. TSA officials didn t immediately respond to a request for comment. RI woman returns home, finds wild turkey in her bathroom WARWICK, R.I. (AP) A Rhode Island woman thought a pipe burst when she returned home to find water pouring from her garage ceiling. But the culprit turned out to be an unusual houseguest that dropped in. WLNE-TV reports Nancy Page went upstairs to find the source of the running water and discovered a wild turkey had crashed through a bathroom window and somehow turned on the sink. Page says she immediately realized it was a turkey, which left behind its own mess. Police and a Department of Environmental Management officer caught the turkey and released it. Page was forced to throw out the bathroom sink. She says it had been running for two to three hours. Ri Quang Wu was charged Thursday with bribery in official and political matters and obstructing the function of government. Court records with bail information or a lawyer for the 59-yearold Wu were not posted online. Prosecutors say Wu passed the bribe during a May 2014 assessment at a property in South Philadelphia. They say the evaluator tried to give the cash back, but Wu refused and the evaluator turned it over to his bosses at the Bureau of Revenue and Taxation. District Attorney Seth Williams says the case shows that the city is not for sale and that employees won t tolerate dishonest behavior. (Continued on page 13)
