1 On this date,, the Parties to this Agreement, ( Customer ) and Tampa Local Movers ( Moving Company ), hereby agree that Moving Company will provide moving services to Customer in accordance with the terms set forth below: 1. SERVICES. Customer hires Moving Company to provide moving services in accordance with these terms: A. Location Moving Company will transport Customer s possessions, furniture, appliances and goods (herein property ) from: Current Address to: Destination Address B. Timing Moving Company will begin rendering services on the date of your scheduled move and will complete the same day. C. Services Moving Company will load all Customer s possessions from Customer s current address into a vehicle, will drive that vehicle to Customer s destination address, and will unload all Customer s possessions at their destination address. The following services and restrictions will apply: i. Moving Company will not provide packing services. Customer is obligated to pack Customer s property into appropriate boxes and other containers. ii. Moving Company will disassemble and reassemble furniture as is appropriate. iii. Moving Company will unload Customer s property into specific rooms at Customer s direction. iv. Moving Company will use 2 employees during the loading and unloading phases. v. The Moving Company will Blanket wrap your furniture The Customer understands that this takes time and is billed at the hourly rate. If the Customer is trying to save money and refuses Blanket Wrapping of their furniture they are also subjected to losing their right to insurance claims for damages and is done at your own risk. vi. The Moving Company s employee s will look over the Customers furniture and inform the customer of any existing damages and scratches already on the customers furniture. Do you want blanket wrapping? 2 Yes NO 2. PAYMENT. Customer agrees to pay Moving Company in accordance with these terms: A. Hourly Rate Customer will pay Moving Company $85 per hour during the packing, loading and unloading phases. Customer will pay Moving Company $75 for driving time. Moving Company employees will take breaks in unison. Customer will not pay the hourly rate during breaks taken by Moving Company employees. Breaks are only given when the move takes more than 4 hours. The hourly rate applies to all employees at once and not to each individual employee. B. Other Costs Customer will not pay per mile. Customer will not pay for moving supplies. Customer will pay 60 per hour for any waiting time caused by Customer s tardiness. C. Price Increase Customer will pay a price increase from the free over the phone quote estimate if the customer withholds or fails to mention added fees. These fees include but are not limited to. Walking distances over 50 ft, Stairs, Extra Overly Heavy items, Extra time of moving services, Extra stops, Hoisting, Washer/Dryer installation, Assembly of beds. D. Time of Payment Customer will pay Moving Company at the end of the move. E. Cancelation Customer will pay a non-negotiatable $50 cancelation fee if they cancel within 48 hours of the move. If Customer cancels within 24 hours they will pay a non-negotiatable $75 cancelation fee. If customers fails to cancel at all and the movers show up to the customers dwelling or place where the move was scheduled to take place the customer will be required to pay $75 fuel/trip fee and 1 hour of moving at $85/hr Customer will be required to pay not less than $160. F. Postpone Your Move If Customer has to Postpone due to their house closing falling through, or other circumstances the Moving Company will work with the new moving date at no additional charge. If Customer is simply trying to postpone to avoid cancelation fee s then the cancelation fee s in Section 2E will still apply. G. Credit Card Convenience Fee The moving company will charge a 3% Convenience fee to any and all Credit/Debit card charges. H. Customer Helping Move We apologize but we cannot allow you to help us with the move. When you hire The Moving Company you are hiring us to perform your whole move. The Moving Companies insurance cannot cover the customer

3 in the event of an accident or the customer damaging the furniture while trying to help. If the customer insist on helping the Customer agrees to paying 1 hr of moving time in addition to the actual time the move took to perform. I. Customer understanding the Free over the phone Estimate The Customer understands that The Moving Company gives a free over the phone estimate based on what the Customer informs The Moving Company about their move. Ever move is unique and The Moving Company does it s best to give an accurate Estimate but the quote given may not be the actual ending price at the end of the job. This price could be more or less than the estimated quote given. There are different items or things that can raise this price Such as but not limited too. Long walk from the Customers door/storage to the truck, Overly heavy items, Stairs, Hoisting, assembly of beds, Trip fee. 3. NO ADDITIONAL COSTS Moving Company hereby agrees that it understands the requirements and intricacies of Customer s move and that it will not charge Customer for any services not described in this Agreement. Any add on charges are based on what this agreement states in 2C and 2G. 4. LICENSING AND INSURANCE Moving Company hereby asserts that it is properly licensed and insured under applicable state and federal laws. A. Insurance - Moving Company will personally insure customers property with valuation insurance for $0.60 to the pound for any damage caused during Moving Company s services. B. Moving Company Licensure and Insurances Moving Company s state license number is IM2380. Moving Company s insurance carrier is: ITMA International Transportation & Marine Agency, policy Number Y. C. Damages to Customers Furniture/Goods The Moving Company will provide free of charge valuation insurance at the rate of $0.60/lb per an item per an article. D. Particle Board/ Pressed Wood Furniture Damages The Moving Company will do everything in their power to see to it that all furniture will stay intact and in the same condition it was in during the move. Unfortunately the Customer understands that the Moving Company will not be held liable to damages to this type of furniture that usually requires the assembly by the customer after the original purchase from the store. We notice that you have various household furnishing constructed of particleboard (also known as pressed wood ). This type of furniture is suspect of brakeage, cracking, dents, and related forms of damage following exercise of due care. The reason for this problem is the inherent weakness of the unstable wood product used in its construction.

4 Furniture manufactured from press board and particle board is designed to go into a box when it is moved from the manufacturer to the retailer then to the customer unassembled. It is not built to withstand the normal stresses of a move as an assembled unit. Most are not designed with the extra wood structural pieces to adequately brace the unit for movement out of or into a residence or office, nor the normal moving truck vibration, even in air-ride moving trailers. Usually chips or dents are not repairable. Surface impressions can be made on the furniture when writing on a single piece of paper you can imagine how it must fare when stacked in a moving truck. Assembly instructions frequently suggest that connecting hardware pieces be glued in place. This does not significantly improve the structural integrity of the furniture, but does make disassembly impossible without creating substantial, irreparable damage. For these reasons, moving companies and third party insurers do not offer coverage for these types of items. The Moving Company s movers will do their best to transport these items for you in a safe and careful manner, but because pressed wood furniture is so unstable we are unable to offer cargo valuation or increased insurance on these pieces. If damage does occur you will not be able to submit a claim, even for $.60 per pound. Pressed wood and particle board furniture is moved at your own risk! E. Customer packed Boxes Boxes that are packed by the customer and are not packed in such a fashion that it would protect its contents cannot be insured by The Moving Company. F. Lost, misplaced or stolen items. We can not be held liable or responcibile for lost or misplaced items. This includes but is not limited to Furniture hardware such as nuts, bolts, screws, metal or wooden dolls, shelf pins, shelfs, or anything else that can come off with ease from the furniture. We do a walk through of the truck before we are finished to see if anything may have came out but sometimes things drop off on the road, sidewalk, or grass and we would be unable to locate those. We ask that you have already secured such items and any other valuables. Although we do screen all of our employee s and would never hope for one to be caught stealing this could happen. If one is caught stealing we would help with their prosecution against them. 5. DAMAGES IN EVENT OF BREACH OF CONTRACT Or NEGLIGENCE A. In the event Moving Company does not provide services to Customer, Moving Company may be liable to Customer for foreseeable consequences, including the cost of hiring a new moving company in short time. B. In the event Moving Company s negligence causes damage to Customer s

5 possessions or real property, Moving Company will be liable for the full value lost. This provision does not affect Moving Company s agreement to insure Customer s belongings, as established by Part 4(A) of this Agreement. C. In the event Customer does not pay in full, Moving Company has the right to retain Customer s property. Moving Company may pursue remedies against Customer as provided by this Agreement. 6. MISCELLANEOUS A. Dispute Resolution In the event of breach or a dispute that cannot be resolved without third party intervention, the Parties agree to resolve their dispute in arbitration. B. Choice of Law In the event of a dispute where federal law does not apply, the Parties agree that Florida state law will apply. The Parties agree to resolve any dispute in Pinellas County, in the state of Florida. C. Entire Agreement - This Agreement contains the entire agreement of the parties. No other agreement, statement, or promise made by any party to this Agreement or any third party on or before the effective date of this Agreement will be binding on the parties. D. Modification - This Agreement may be modified by subsequent agreement of the parties only by an instrument in writing signed by both of them or an oral agreement only to the extent that the parties carry it out. E. Severability - If any provision of this Agreement is held in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire Agreement will be severable and remain in effect. F. Attorney s Fees In the event a dispute involving this Agreement is resolved in a third party judicial proceeding, including arbitration, the prevailing party will have a right to be reimbursed its attorney s fees and costs for enforcing its rights under this Agreement. G. Interest In the event a dispute involving an unpaid amount under this Agreement is resolved in a third party judicial proceeding, including arbitration, the prevailing party is entitled to interest of 3% starting on the date the amount unpaid became due. 7. Specials and Promotions if the Customer had bought one of our specials or promotions and it was for a given time and your move took less then the promotional time there is no reimbursement for the unused time. SIGNED & DATED The Parties have read and understood the foregoing terms and agree to them.
