1 Thank you for your interest in providing catering at our AFL Match, between Western Bulldogs FC v Gold Coast SUNS FC match held at Cazalys Stadium on Saturday 16 th July It is a requirement of all site holders to read, understand and agree to all of the following information and pass on any necessary information onto your staff. Site Meeting at set up 4. Event 5. Post briefing and review. All stalls are processed on a first in, first served basis. AFL Cairns will place food stall as desired around ground. Stall selection and site placement is final and no correspondence or discussion shall be entered into. 3 Insurance As a stallholder, you must have Public Liability Insurance for ten million Australian dollars covering the activities at this stall site. Without proof of Public Liability coverage held by applicants for sites, AFL Cairns may reject access to Site holders at its absolute discretion. Please attach proof of your current insurance certificate Details of current Public Risk Insurance provided will be respected as private and confidential information. Heath Department All food stallholders are required to comply with, and adhere to, all conditions of the Queensland Food Act 2006 or subsequent Acts or regulations. Food stalls must also comply with all current City Council regulations and permit conditions. Please attach a copy of your current food licence. Stall Dimensions Please specify exact dimensions of stall (e.g. food van, marquee, trailers, ropes, signs and Cold rooms etc ) Length metres x Depth.metres. Display Fastenings Under no circumstances shall a site holder excavate, dig or place pegs in his area without first obtaining authority from AFL Cairns. If your stall requires such fasteners please detail your requirements below: Peak loads Site holder must ensure reasonable cue lengths and item supply during peak times. Generally these times are just prior to game start, ¼ times and half time. Planning and preparation prior to these times will ensure maximized sales, happy customers and happy event organisers. We reserve the right to limit worker passes if deemed necessary. Passes will be available from Cazalys reception on 14 th and 15 th of July 9am to 5pm. If worker passes are lost they will not be replaced. Stall holders will then need to purchase general admission tickets from reception. Pass collection will require someone to sign for them and identification will be requested. Waste Stall holders are allowed to dump rubbish in the appropriate skip bins located around the grounds after event. Cazalys stadium has an Oil collection point in the club house loading dock area. Illegal dumping of oil will attract fines. No stall holder is to place any rubbish into any wheelie bins. When possible please use only recyclable packing and biodegradable containers and try to lessen the use of plastics. Page 4

5 Set up and dismantle Stall holders are to advise Jason Wale once arriving on site. Stall holders must abide by all speed limits, general signage and any directions given from any AFL Cairns staff member or approved agent. Stall holder must set up within approved area and be polite and courteous to all other stall holders at all times. The movement of any vehicle on AFL Cairns grounds must be done with a spotter ensuring the safety of everyone or item on site. Stallholders may not bring their vehicles on site during the event. Only vehicles displaying Cazalys or AFL Cairns Passes will be allowed access to the event site. Stalls can setup from Friday 15 th July from 8am-5pm and 6am-10am Saturday 16 th of July. Setup outside these times must be approved by AFL Cairns. It is preferred operators set up on Friday to ensure stalls are set-up as planned and all utilities are tested. Jason Wale s time is limited on game day so setting up on Friday is appreciated. Please nominate which day you wish to set up: Friday 15 th Saturday 16 th Stalls are forbidden to pack up their site prior to half hour after the game. The earliest approved pack up time for this event will be: 10.30pm. Presentation Appearance and stall presentation is important to us. We encourage you to decorate your stall in a manner which reflects your goods and attracts patrons. Stallholders must keep their site and surrounding areas clean and tidy at all times. 1. STALL REGULATIONS: All stalls must be constructed and maintained in accordance with the appropriate State, Federal and LGA departmental regulations. It is the responsibility of the applicant to see that all permits and inspections etc. have been obtained and carried out. Details of these regulations are available through the appropriate web sites. a) Food Acts All Site holders are required to comply with and adhere to all conditions of the Food Act 2006 All food vehicles/stalls etc, must have a current Food Business Licence Certificate. All Food sites producing grease must supply their own grease trap. The stallholder must ensure that all food and beverages are prepared and stored in a clean and hygienic manner and that tools and utensils used to prepare and serve food and beverages are clean and hygienic. Any cooking equipment and other equipment required for the preparation, storage and sale of food and beverages must be provided by the stallholder. All food stalls must display a current food permit and comply with all current Cairns Council regulations and permit conditions. Cairns City Council Officers will carry out checks as required and make decisions at their sole discretion. Page 5

6 b) CAMPING ABSOLUTELY NO CAMPING BEHIND SITES OR WITHIN THE STADIUM IS PERMITTED. OFFENDERS SHALL BE REMOVED FROM GROUNDS 2. SUB-LETTING: The allocated site is to be used only and solely for the purpose specified on the application and by the person or firm to whom it has been allocated. 3. RAFFLES / GAMBLING: Gambling, disposal of any article by lot or chance and sale of art union tickets is strictly prohibited. Site Holders must not allow their areas to be used for fund raising raffles even though the Site holder may be sponsoring a charity. 4. SITE AND SELLING RESTRICTIONS: The Site Holder must confine his/her business to the purpose accepted on the Site Application. No selling, canvassing, hawking or distribution of printed or other matters will be permitted outside the area allocated. Canvassing off your site will lead to closure of your site and forfeiting of monies. AFL Cairns reserves the right to forbid the sale of any line for which specific application has not been made. 5. FOOD AND DRINKS The selling of only the food specified in your application is permitted to being sold. No alcohol is to be sold by site holders as Cazalys Cairns Ltd has the sole rights to do so. No glass. Soft drink cans is to be sold. Coca cola soft drink products are only to be sold. Please provide a list of saleable items and prices for approval: Failure to adhere to approved product list and pricing will result in forfeiture of bond held. Forbidden saleable items: Alcohol, Tobacco, Team merchandise. Non Coca cola soft drink product. Any item not listed above 6. Restricted items: The sale of the following items is NOT PERMITTED as it is our view and aim to protect families at our AFL game. bb guns, Musical instruments; Whistles; Flags with handles exceeding 1.6 metres; Fireworks, flares, laser lights; Rollerblades, skateboards, scooters, bicycles; Any large article that cannot be placed under a seat; Any device or item that in the opinion of AFL Cairns management has the potential to cause injury or public nuisance or inconvenience to other patrons. Any other item not listed in above approved selling items. 7. SITE PERSONAL SAFTEY and MONEY/TAKINGS: Site holders will be solely responsible for and bear all risks associated with the collection of money and transfer of money to and from the site. 8. SITE ALLOCATION RESTRICTIONS: No banners, flags or display stands must be outside the site boundary. No part of an exhibitor s display material, tents, pegs, ropes, marquees or items for sale etc. to encroach on another site. All staff must remain within their own site boundaries. Page 6

7 9. ADVERTISING SIGNS: The display of approved advertising signs of any description is restricted to the area occupied by the Site Holder. No permanent signs to be erected unless otherwise arranged with AFL Cairns. Any Advertising material deemed offensive or conflicts with sponsorship arrangements entered into by AFL Cairns will be removed. 10. SITE HOLDER CONDUCT: The Site Holder and/or employees are to conduct themselves in an orderly and respectful manner while they are in the Stadium. Alcoholic beverage consumption or illegal Drug Use is not permitted. 11. OFFENSIVE MATERIAL: AFL Cairns shall have the power to enter sites and remove any article, sign, picture or printed matter, which, in their opinion may be a cause of offence to the public or AFL Cairns. 12. SOUND SYSTEMS: Site holders are not permitted to use PA Systems, projectors and sound systems of any sort. 13. ELECTRICAL USEAGE FROM POINT OF SUPPLY: Site Holders are to ensure Electrical Safety Switches are plugged in at all times at the Point of Supply.Under the Electrical Safety Act IT IS COMPULSORY to use electrical safety switches at the Point of Supply and Electrical Leads MUST BE TESTED AND TAGGED. This is at the site holder s expense. The Point of Supply is the permanent location of power points (single and three phase) or similar type of connection connected to the AFL Cairns electrical installations. At all times electrical leads MUST NOT IMPEDE the flow of pedestrians and vehicles. Stallholders will be required to supply their own electrical power leads. 14. DOUBLE ADAPTORS: AFL Cairns disallows the use of double adaptors and piggy back leads to prevent overloading of circuits. 15. OPERATIONS OF SITE: Stalls must be operational for the duration of the advertised time of the event. Stalls must provide for sale of all items from 2.30pm to 7.30pm. The stallholder understands and agrees that Cairns AFL Club has the rights to remove without refund or recourse, any stallholder who misrepresents themselves or their products. 16. DAMAGE TO SITE: If any Damage has been caused to the site holders will be liable for restorative claims made by AFL Cairns for the remainder of the costs. 17. SITEHOLDER INFORMATION: From time to time people enquire about sites and products that site holders sell. It is understood that AFL Cairns can pass on your contact details. If you do not wish this to happen, please advise in writing. 18. LOSS OR DAMAGE: AFL Cairns will not under any circumstances be held responsible for any loss of or damage to the stock in trade, etc. or any part there of any site holder from any cause whatsoever. 8 19. INDEMNITY: AFL Cairns will not be responsible for any accident which may be caused through or by the site holder, or which may happen in connection with his/her business & the site holder shall save AFL Cairns harmless & indemnify it against any legal proceedings arising from every such accident. 20. WORKPLACE HEALTH & SAFETY REGULATIONS: The signed application/contract is assurance, that any temporary structures, vans, equipment etc. and any activity that takes place on or adjacent to your site, complies in all respects with Workplace Health & Safety Legislation. This includes but is not limited to testing and tagging of all electrical equipment and fitting of earth leakage detection devices if equipment is not double insulated. You are also required to provide a written report of all accidents and/or dangerous occurrences within 12 hours. 21. FIRE SAFETY EQUIPMENT: The Site Holder must ensure that appropriate fire safety equipment including fire extinguishers and fire blankets are available for the duration of the event. 22. ALTERATIONS: AFL Cairns reserves the right to alter these Terms & Conditions at any time and without further reference to site holders. 23. ROVING MASCOTS: The Site holder is not permitted to have a mascot of any kind in the stadium prior to or on game day. 24. AREA ACCESS: Certain Areas of Cazalys Stadium are off limits. Only Cazalys Stadium Staff access pass will be permitted. All stallholders, workshops, performers and artists will permit Cairns AFL Club to take photographs of the event and reproduce these images in any form, in whole or part, and distribute the works by any means including the internet, CD-ROM or other multi-media for future promotional purposes. Event may or may not be covered by external media outlets. The Site holders are to understand they re not entitled to any fee for such use or exposure. 25. CANCELLATIONS: Cairns AFL Club reserves the right to cancel an event without notice if the safety of patrons at the event is, as determined by the events manager, considered to be at risk. No stall/site fees collected by Cairns AFL Club will be refunded should any event be cancelled. All Cairns AFL Club events will continue in all weather conditions unless it is deemed unsafe to do so by the Events Manager. 26. FIRST AID First aid is available at each bar for customers attending event. Staff of Stall holder are the sole responsibility of the stall hirer. Stall Holders must ensure they comply with all first aid requirements. 27. Sales information Post event site holders will be required to advise us on sales on the day so we can further analyse the event for serviceability of attendees for future events. Page 8

JASON SALECICH, GENERAL MANAGER, (07) REASONS FOR PLAN In the interests of spectators to the AFL Match, the club has established a Designated Outdoor Smoking Area to cater for the needs of spectators who wish to smoke and drink during the football game. This Smoking Management Plan explains how the Stadium administers the DOSA. It outlines legislative requirements for the DOSA, including location and boundaries of the DOSA and buffers; how smoking is managed on the premises; staff training provided; procedures for handling complaints from patrons; and other measures that will assist the Stadium to ensure compliance with the laws. The Plan is required under section 26ZC of the Tobacco and Other Smoking Products Act 1988 and is available to members, guests & bona fide visitors upon request. Available on request main entrance ticket office MANAGEMENT OF SMOKING MINIMISING ENVIRONMENTAL TOBACCO SMOKE The stadium has implemented the following measures to manage smoking and smoking issues, with the aim of minimizing Environmental Tobacco Smoke on the premises: Ensured that smoking only occurs in the DOSA. Instructed staff to direct customers who wish to smoke to the DOSA or outside main entrance gate. Complied with the DOSA requirements: o No food or drink is to be served in the DOSA. o No food is to be consumed in the DOSA. o No entertainment is to be provided in the DOSA; and Complied with other legislative requirements, in particular: o Instructed staff not to sell tobacco products to a minor; request for a o proof of age unless satisfied that the person is an adult; Banned tobacco competitions or promotions that involve free product samples, product coupons redeemable for prizes or gifts, free merchandise and tobacco as prizes. Located smoking apparatus such as ashtrays and smokers bins only in the DOSA and unlicensed breakout areas. Tables provided to place drinks on prior to entering break out areas. Trained staff to adequately handle non-compliance matters (see Complaint Handling Procedures Pg 3). Page 12

13 STAFF TRAINING The stadium has provided the following training, instruction and awareness activities to staff & contracted security & contracted staff to ensure proactive compliance with tobacco laws on premises: Explained to staff & contracted security & contracted staff where customers can and cannot smoke at the stadium. Instructed staff & contracted security & contracted staff to observe and apply the DOSA requirements i.e. food may not be consumed in the DOSA, no service is allowed in the DOSA. Informed staff & contracted security & contracted staff of the penalties for a breach, in particular the following maximum fines: o $200 to a person for smoking in a no smoking area. o $200 to a person for not stopping to smoke when directed to do so by an authorized person. o o $14,000 to the licensee for allowing smoking in a no smoking area. $14,000 to the licensee for providing food or drink to a person smoking in a no smoking area when the person has continued to smoke and failed to comply with a direction to stop smoking; and o $14,000 to the licensee for failing to comply with the DOSA requirements i.e. no food or drink to be served in the DOSA; no food to be consumed in the DOSA; Instructed staff & contracted security & contracted staff to take the following action when they see a person smoking in a no smoking area: o Direct the person to stop smoking immediately and tell them that they are breaking the law if they do not stop smoking; o Immediately cease food or drink service to the person if the person does not follow the direction to stop smoking; o Record the incident, including date and time; actions taken (if any); and the outcome in the Smoking Incidents Register; and o Inform Section Supervisor of the situation as soon as practicable. Put an agenda item on smoking in staff & contracted security & contracted staff meetings, where matters relating to smoking are discussed. COMPLAINT HANDLING PROCEDURES: OTHER MATTERS Regarding complaints received should someone be smoking in a no smoking area: The stadium will resolve smoking related complaints expeditiously and in a transparent manner as follows: The stadium will designate an employee as the point of contact for smoking related complaints, namely a Senior Manager or Section Supervisor or security provider. Upon receiving a complaint, a designated employee will take appropriate action to resolve it on the spot by informing the person who is smoking in the no smoking area of the legislative requirement, including the penalties, and stopping the supply of food and drink while the person is smoking in the no smoking area. If the complaint has no basis, the designated employee will take no further action. The designated employee will inform the complainant of the outcome. If the complainant is unsatisfied with the outcome, the designated employee will direct the complainant to other avenues for redress, for instance to Senior Management and failing satisfaction the Queensland Health Tobacco Hotline: The designated employee will keep a written record of a complaint, including the date and time, action taken (if any) and the outcome in the Smoking incident Register. 14 REVIEWING THE PLAN: The stadium will make changes to the Plan as needed by obtaining regular feedback from staff and customers on how the Plan is operating and monitoring the number of smoking related incidents on the premises. OTHER REQUIREMENTS Please advise if there are any other requirements of your stall that need special consideration by the Event Organisers. Any changes to circumstances, issues or approval requests must be forwarded in writing to Jason Wale Page 14

15 DECLARATION In making this application, I acknowledge that I have read and understood the Terms and Conditions and agree to abide by them. The stallholder hereby releases and indemnifies AFL Cairns, it s officers, employees and agents from and against all actions, claims, proceedings and demands whatsoever including but not limited to any actions in contract, tort, and or criminal prosecution which may be made or brought by any person, entity or authority against the stallholder or AFL Cairns for actions, conducts, negligence and or omission by the stallholder, it s employees, agents and/or representative in respect of any loss, injury or damages including death to any person or property and consequential loss caused or contributed to (to the extent of the contribution) by any wilful or negligent act or omission of the stallholder, it s employees, agents and or representative.
