1 Special Members Edition October 2012 Carpenters Local 1946 London LiUNA and a majority of the other Construction Building Trades Unions have had major issues with the Carpenters Union raiding their Collective Agreements, signing companies that do work traditionally in the jurisdiction of other Unions, and cutting their members wages to break into other Unions jurisdictions. In LiUNA Local 1059 s geographic jurisdiction, the Carpenters promoted an illegal concrete forming agreement in the ICI sector stipulating wage rates at almost ½ the amounts that the Labourers and Carpenters standard ICI Agreements stipulate. The Ontario Labour Relations Board in 2010 found it illegal. They have cut their ICI wage package and lengthened their overtime to 50 hours per week on some ICI jobsites. Employers that have Bridge Agreements with Local 1059 like EllisDon have been approached by the Carpenters offering a bridge agreement at whatever rates the Employer wants, even though Local 1059 holds the jurisdiction for all work on bridges. The Carpenters Union in the last couple of months has been approaching our members on jobsites and offering them memberships. This while they have unemployed members and no work to send them to. This is just a low down way to get members to sign a Carpenters Application for membership document so the Carpenters can use that document to displace a Local 1059 s Collective Agreement and require our members to join the Carpenters. The Carpenters Union is not really interested in having our members join, only in stealing the Collective Agreements and our work. The Carpenters Union is on an aggressive campaign to amalgamate their Local Unions and remove all democracy from their members. 1 Carpenters members cannot elect their Business Manager and Representatives. 2 Carpenters members cannot vote on their Collective Agreements. 3 Carpenters members do not decide or vote on how or where their dues are spent. The Carpenters ICI Collective Agreement requires a deduction of $3.11 per hour Union dues which equals on a 40 hour week $124.40, and over a year almost $6,468.80, from a Carpenters wage package of $45.76 per hour. Union General Contractors The Carpenters Union has only two active London-based general contractors left, EllisDon and McKay Cocker, while Local 1059 has over 150 active employers under agreements covering many sectors of work. Local 1059 contractors perform almost all the concrete forming, site servicing, masonry, fencing, asphalt, curb, gutter and sidewalk, asbestos removal and demolition for all the nonunion general contractors in the London area.
2 DAVE Garcia ex-member Dave Garcia was warned in 2010 that if he joined the Carpenters Union he would lose his membership in Local Not only did he join the Carpenters, he has been a puppet poster boy for the Carpenters Union to provide false and misleading information to our members. The Carpenters Union has made a YouTube video to make personal, immature and false allegations against Local 1059 and our Executive Board members. Carpenters Local 1946 wants to tell us how to run our Local Union. watch?v=cy6qhib2jwk&sns=em This would be one reason Carpenters members pay the highest dues in Ontario. The members of the Carpenters Union also paid for a flyer which was distributed on some of the Local 1059 jobsites highlighting Garcia s whining about losing the benefits of Local 1059 membership. In addition, the Ontario Labour Relations Board upheld Local 1059 s right to expel Garcia from membership; the LiUNA International Appellant Officer has also upheld that decision Garcia_Carpenters_Local_1946.aspx The Carpenters members have paid for and represented Garcia at his Local 1059 trial board, the Ontario Labour Relations Board, a Superior Court complaint and Garcia s appeal to the LiUNA Appellate Officer. Garcia complains that he can t have Local 1059 s benefits which are obviously vastly superior to the Carpenters benefit plan (why else would he want them?) and he wants continued membership in Local He is obviously concerned that the Carpenters Union s spike in work is temporary and he wants to keep his option open of coming back to work under Local 1059 agreements. He previously worked 11 years without layoff under Local 1059 collective agreements. Labourers Pension Fund A member of Local 1059 that joins the Carpenters Union and works under their Collective Agreements, that displaced a Labourers collective agreement, risks not receiving a pension from the Labourers Pension Fund while he is employed under such Carpenters Union Agreement. It makes no difference whether membership in Local 1059 continues or not. Section 5.06 Retirement (a) Definition To be considered retired, a Participant or former Participant must withdraw and refrain from any further work in Covered Employment, and from any work within the geographical jurisdiction of the Union for wages or profit of the type included in an Agreement at the time of his retirement. For Employees as defined in Section 1.12(b), (c) and (d), to be considered retired, the Participant or former Participant must withdraw and refrain from any further work in Covered Employment, and from any work for any Employer in respect of similar work, employment or services prior to application by the individual for benefits under the Plan. 02
3 LiUNA, Local 1059 Benefit Trust Fund A Local 1059 member that joins the Carpenters Union will lose his or her membership in Local 1059 and our benefits. To receive benefits under the Local 1059 Benefit plan, you must be a member of Local Joining the Carpenters Union will result in you losing your benefits eligibility and also access to your accumulated dollar bank in the Local 1059 Plan for future benefits. Carpenters New London Training Centre and Office Without any vote or approval by its members, Carpenters Union Local 1946 is building an 8 million dollar facility in London for its 500 members. Carpenters members currently pay $0.56 per hour from their ICI wage package for training, an amount that surely will be raised in their new ICI agreement to pay for such an extravagant facility. Kevin Hoy, a spokesperson for the Carpenters Union told the Daily Commercial News in March, 2012, that the new facility would have close to 1000 a year new trainees. The Carpenters Union did not use their unemployed members to form and pour the concrete curbs, gutters and sidewalks on their new facility. This suggests the Carpenters Union must be planning on flooding their Local with new apprentices or they don t think their current members have the skills now needed by employers. Maybe the building is really a statement to try and justify where all the training monies and dues taken from their members wage package is going. 03

8 HAYMAN CONSTRUCTION Hayman Construction Inc. is a General Contractor that has been in business since It had an agreement with the Carpenters Union since the early 1900s. It is one of the last companies in Ontario that has been in operation that long. In 2010, 15 members of the Carpenters Union employed by Hayman voted to decertify the Carpenters Union as their bargaining agent and then voted overwhelmingly to be represented by Local Since 1872 The carpenters employed by Hayman were struggling to remain employed because the companies the Carpenters Union forced Hayman to subcontract to resulted in Hayman losing work as they were not competitive. Specifically, the Carpenters Union drywall, acoustic ceilings, glazing, resilient flooring, bathroom partitions and fixtures subcontractors were not competitive. Every general contractor, without a collective agreement with the Carpenters Union, was able to price jobs lower than Hayman. LARRY KING I was a member of Carpenters Local 1946 for 5 years. In 2010, myself and 14 other members of the Carpenters Union, employed directly by Hayman, voted to decertify the Carpenters Union as our representative. We then voted to join LiUNA Local This has provided new work for the 14 previous members of the Carpenters Union. We have mandatory recall rights, job security, higher wages, less Union dues, a better benefit plan and more job opportunities being only with the Labourers Union. Labourers Local 1059 understands our concerns, supports us on jobsite safety and are always there when we call. Labourers Local 1059 is a real Union concerned about its members.
