3 Befre Yu Apply Wh may use this applicatin? This applicatin guide is designed fr persns wh wish t apply fr a study permit frm utside Canada. D I require a study permit? This is the fficial dcument issued by an fficer that allws a persn wh is nt a Canadian citizen r a permanent resident t study in Canada. Generally, if yu are nt a Canadian citizen r a permanent resident f Canada yu must btain a study permit in rder t study in Canada. Hwever, nt everyne is required t btain a study permit in rder t study in Canada. A persn may be exempted frm the requirement f a study permit in the fllwing situatins: Minr children attending pre-schl, primary r secndary levels, Family members r private staff accmpanying a freign representative by the Department f Freign Affairs and Internatinal Trade f Canada, and Members f the armed frces f a cuntry designated fr the purpses f the Visiting Frces Act. 4 Nte: If yur prgram f study is six mnths r less but yu intend t cntinue yur studies in anther prgram yu shuld apply fr a study permit befre cming t Canada. This will allw yu t apply t extend yur stay as a student frm within Canada. Otherwise, if yu d nt hld a study permit yu will have t apply fr ne utside Canada What are the requirements yu must meet fr a Study Permit? Yu must shw the fficer that yu meet the requirements f the Immigratin and Refugee Prtectin Act (IRPA) and the Immigratin and Refugee Prtectin Regulatins and that yu will be in Canada fr a temprary stay. Yu must als: Satisfy an fficer that yu will leave Canada at the end f yur studies. Have a letter f acceptance frm an educatinal institutin. Prve that yu have mney fr the duratin f yur stay in Canada t pay fr : tuitin fees, living expenses fr yurself and accmpanying family members, and transprtatin csts t and frm Canada fr yurself and accmpanying family members. Be law-abiding and have n recrd f criminal activity (yu may be asked t prvide a Plice Clearance Certificate). Prduce any additinal dcuments requested by the fficer t establish yur admissibility. Nt be a risk t the security f Canada. Be in gd health (cmplete a medical examinatin, if required). Are there any cnditins n my study permit? An fficer may impse, vary, r cancel cnditins n yurs study permit. These may include ne r mre f the fllwing: the type f studies r curse yu may take, the educatinal institutin yu may attend, the lcatin f yur studies, the time and place at which yu shall reprt fr medical examinatin r bservatin, the time and place at which yu shall reprt t present evidence f cmpliance with applicable cnditins, the prhibitin f engaging in emplyment, the duratin f yur stay in Canada. 4 Applying fr a Study Permit Outside Canada

5 Entry t Canada Entry t Canada is a privilege, nt a right. If yu want t study in Canada, yu must meet the necessary requirements and yu may need a temprary resident visa. D I need a Temprary Resident Visa? If yu want t study in Canada yu must meet the necessary requirements and yu may require a temprary resident visa. A temprary resident visa is an fficial dcument issued by an fficer that is placed in yur passprt t shw that yu have met the requirements fr admissin t Canada as a temprary resident. When yu arrive at the prt f entry, an fficer will make a final determinatin. See Appendix A - Temprary Resident Visa Exemptins fr mre infrmatin n persns wh are exempt frm btaining a temprary resident visa t visit Canada. If yu are applying fr a study r wrk permit and require a temprary resident visa, it is nt necessary t make a separate applicatin r pay a separate fee; an fficer will issue it at the same time as the dcumentatin necessary fr yur entry t Canada as a student. Family members Family members include a spuse, a cmmn-law partner, dependent children, and the dependent child f a dependent child: Term Spuse A cmmnlaw partner Definitin Refers t either f the tw persns (ppsite r same sex) in a legally-recgnized marriage. Refers t a persn wh is living in a cnjugal relatinship with anther persn (ppsite r same sex), and has dne s cntinuusly fr a perid f at least ne year. A cnjugal relatinship exists when there is a significant degree f cmmitment between tw peple. Cmmn-law partners must attach any dcuments that shw they are in a cmmitted and genuine relatinship, fr example, evidence that they share the same hme, that they supprt each ther financially and emtinally, that they have had children tgether, r that they present themselves in public as a cuple. Cmmn-law partners wh are unable t live tgether r appear in public tgether because f legal restrictins in their hme cuntry may still qualify and shuld be included n the applicatin. Cmmn-law partners that meet the cnditins utlined abve but wh have been separated fr reasns beynd their cntrl (fr example, civil war r armed cnflict) may qualify and shuld be included n the applicatin. 6 Dependent child f a dependent child be under the age f 22 and nt have a spuse r cmmn-law partner, r depend substantially n the financial supprt f a parent and have been cntinuusly enrlled and in attendance as full-time students in a pst-secndary institutin accredited by the relevant gvernment authrity since befre the age f 22 (r since marrying r entering int a cmmn-law relatinship, if this happened befre the age f 22), r depend substantially n the financial supprt f a parent since befre the age f 22 and be unable t prvide fr themselves due t a medical cnditin. A ntarized custdianship declaratin, such as the frm Custdianship Declaratin Custdian fr Minrs Studying in Canada (IMM 5646), must be cmpleted by the parents r legal guardians in the cuntry f rigin and by the custdian in Canada. Minr children between 17 years f age and the age f majrity in the prvince r territry (18 r 19 years ld) where they intend t study, may need a custdian at the discretin f an immigratin fficer. Nte: The minimum age required t be a custdian is 19 years f age, regardless f prvince. Fr mre infrmatin n minrs studying in Canada, cnsult the CIC website at: Minrs travelling alne Minr children wh are traveling alne must bring: cntact infrmatin (name, address and phne number) with them abut the custdian, if required, wh will be respnsible fr them in Canada; infrmatin abut the schl where they are ging; and a letter f permissin frm their parent(s) and, if required, a ntarized custdianship declaratin. Nte: If the child is the subject f a custdy rder, prf f custdy and the ther parent s cnsent must als be prvided. May I wrk while I am studying in Canada? Generally, freign students are nt allwed t wrk while they are studying in Canada. Hwever, there are sme exceptins fr full-time students attending publicly funded institutins r private degree-granting institutins. Fr mre infrmatin, cntact yur nearest Canadian visa ffice r cnsult the CIC website: What is a full-time student? A full-time student is a persn, whse prgram f study is nrmally at least 15 hurs f instructins per week, leading t a degree, diplma r certificate, unless therwise defined by the educatinal institutin. 8 What requirements must I meet t get a wrk permit? A wrk permit may be issued t yu if it is established that : yur intended emplyment is an essential and integral part f yur curse f study (nt applicable t medical interns r medical residents), r yur intended emplyment is related t an apprved research r training prgram, r yu hld a study permit and are temprarily facing financial difficulties thrugh circumstances beynd yur cntrl r any persn whm yu are dependent n fr financial supprt t cmplete yur term f study. Yu must shw prf that yu are nt able t btain the mney needed fr daily expenses and that it is a temprary situatin, r yu have successfully graduated frm a prgram at a Canadian university, cmmunity cllege, CÉGEP, r publicly funded trade/technical schl (r frm a Canadian private institutin authrized by prvincial statute t cnfer degrees) and wish t wrk fr a maximum f three years, r yu are the spuse r cmmn-law partner f a full-time student registered at a Canadian university, cmmunity cllege, CÉGEP, publicly funded trade/technical schl r private institutin authrized by prvincial statute t cnfer degrees. Yu may be eligible fr an pen r pen/restricted wrk permit, depending n whether r nt medical requirements have been met. Fr mre infrmatin, refer t the CIC website at: Nte: As a full-time student yu may be eligible t apply fr a wrk permit that allws yu t wrk ff-campus at certain public pst-secndary institutins. Full-time students attending degree-granting and pst-secndary institutins d nt need a wrk permit when the emplyment is n the campus f the cllege r university where they are registered. They can wrk fr as lng as their study permit is valid. The emplyer may be the institutin r a private cntractr perating n the campus. Medical requirements Yu and yur family members may be required t underg a medical examinatin in rder t cme t Canada. 11 3 Prf f financial supprt Evidence that yu can supprt yurself as well as accmpanying family members while studying in Canada. Such evidence may include: prf f a Canadian bank accunt, if mney has been transferred there, Bank statements fr the past fur mnths, prf f payment f tuitin and residence fees, and prf f funding paid frm within Canada fr students with a schlarship r enrlled in a Canadian-funded educatinal prgram. If freign exchange cntrl measures exist in yur cuntry, yu must prvide prf that yu will be permitted by the exchange cntrl authrities f yur cuntry t exprt funds fr all yur expenses. Original r clear and legible phtcpy Nte: If yu are nt a citizen f the cuntry frm which yu are applying, yu must prvide prf f yur present immigrant status in the cuntry f applicatin. If the gvernment that issued yur passprt r travel dcument requires a re-entry permit, such dcument must be btained befre yu apply fr a Canadian visa. Additinal dcuments may be required. D yu intend t study in Quebec? In rder t study in Quebec, students must btain a Certificat d acceptatin du Québec (CAQ) issued by the Ministère de l immigratin et des cmmunautés culturelles (MICC) befre requesting a study permit frm any Canadian visa ffice. The educatinal institutin shuld prvide the student with all the details related t applying fr Quebec. Fr residents f cuntries such as France, Austria, Mexic r the Hng Kng Administrative Regin, where there is a Quebec Immigratin Service (SIQ), they can apply there directly fr a CAQ. Cnsult the MICC website fr apprpriate cntact infrmatin and fr the latest updates n the prcess and dcuments required fr Quebec.
