1 RED FLAG WORDS that can NEVER be used This article contains a list of red flag WORDS that CANNOT be used in any communications, personal websites, Facebook Posts, Blogs, Tweets, Posts on LinkedIn or any of the many social media sites including personal . In light of the FDA issuing warning letters to a number of Network Marketing companies in the last few months for violations in what was being said and published in social media, it has become increasingly more important that we police ourselves both corporately and as distributors. We are requesting that every exfuze Distributor do some spring cleaning and search for, and immediately remove any of the following words from any personal websites, Facebook, Twitter, YouTube, Pinterest, blogs or any marketing material that you may have produced or control. This includes comments sections, any links to your pages or any other pages that may involve the use of these Hot Words as they relate to any type of disease or abnormal condition of the body and are directly or indirectly connected to the use of any exfuze product. In no way is any exfuze product or combination of products to be claimed or inferred as a way to diagnose, cure, mitigate, treat, or prevent any disease illness or abnormal condition of the body. If we find distributors using these words we are required to take action to show that we are responsibly monitoring the situation. Therefore it is imperative for distributors to take action immediately and to remove these words immediately. Our having to ask you to remove these words or pages containing these words will require us making a record of that in your file. Note: Please do not replace these words with a description that simply describes the actual word or disease without actually saying the word. Any use of a combination of words that imply the word is the same as using the word. You cannot replace the word can**r with the words, a rapid proliferation of malformed cells. That description would be considered the same as having use the C word itself. Please share this list with your personally enrolled distributors and your organization a quickly as possible and set the example by removing any of these words from your materials as soon as possible. 3 The above list of names is NOT an all-inclusive list, but rather a compilation of the more popular recognizable disease names that may tend to get referenced in personal testimonials. If there is any doubt about a word that should not be used, just ask if it describes a disease or condition for which a person would normally go to a doctor or is it something for which a drug could be prescribed? If the answer is yes, then do not mention it. Also, do not mention our products as a comparison to any over the counter or prescription drug or mention any of our products as a substitution for any OTC or Rx Drug. We must focus only on WELLNESS. We can talk about being well, staying well, becoming heathier, striving for optimal health, but we can never talk about any disease, sickness, illness, or condition. The # 1 Rule by which to live is A food, beverage, or supplement product may not be intended to diagnose, treat, cure, or prevent a disease, illness, or abnormal condition. It does not matter if a company can provide substantiation that a supplement or food product does help with any disease. This is because Congress decided only DRUGS can be offered to diagnose, treat, cure or prevent a disease. Even if you consumed a product and you believed that it cured your particular problem, you cannot share that testimonial if it includes the name or description of a disease or abnormal condition. For further detailed information of what you CAN T say and what you CAN say, please read the following explanation of structure function claims as outlined in the Code of Federal Regulations. STRUCTURE FUNCTION CLAIMS (Statutes governing what can and can t be said regarding a product) 21 CFR (g)(2)(i) Claims an effect on a disease or class of diseases Claims that mention a disease by name You CAN T SAY the following because you are referencing a disease: Consuming Seven+ will help reduce the risk of cardiovascular disease Consuming Seven+ will prevent colds and flu Claims that otherwise describe a disease You CAN T SAY the following because you are describing a disease: Relieves crushing heart pain (Heart attack) Prevents bone fragility (Osteoporosis) Controls blood sugar in people with insufficient insulin (Diabetes) 3
4 NOTE: Any claims about ingredients that are contained in a product are considered to be claims about the product. 21 CFR (g)(2)(ii) Claims an effect on a characteristic sign or symptom of a disease You CAN T SAY the following because you are referencing a characteristic or symptom of a disease: Reduces cholesterol (Cardiovasclar disease) Reduces joint pain (Arthritis) You may make a claim that specifies a non-disease purpose or qualifies it as maintaining already healthy conditions You CAN SAY: Reduces inflammation associated with muscle fatigue from exercise Maintains cholesterol levels already within the normal range 21 CFR (g)(2)(iii) Claims an effect on an abnormal condition of a natural state or process Claims associated with abnormal conditions of a natural state or process are a disease claims (and therefore NOT PERMITED) You CAN T SAY: Depression Alzheimer s or senile dementias ADD/ADHD High Blood Pressure Claims associated with normal conditions of a natural state or process are permitted You CAN SAY: May help support Mild mood changes, cramps associated to menstrual cycle (because this is a normal process) Mild memory loss associated with aging Normal behavior A normally functioning cardiovascular system 21 CFR (g)(2)(v) Claims that a product belongs in a class of products that are intended to diagnose, treat, cure or prevent a disease Such as: (Just to name a few) Antidepressants Anti-inflammatories Vaccines 4
5 As stated earlier, you MAY make a claim that either specifies it is used for a non-disease purpose or qualifies is as maintaining already healthy conditions May support emotional wellbeing Reduces inflammation associated with muscle fatigue from exercise Supports a healthy immune system 21 CFR (g)(2)(vi) Claims to be a substitute for a product that is a therapy for a disease Claims that suggest a product is a substitute for a drug or therapy for a disease are disease claims Take instead of chemotherapy is a natural alternative to Prozac is like an Herbal Viagra Take for six months and you will be off of all your prescription drugs I took for three months and now I am no longer taking my insulin Claims that a product will have fewer side effects than a therapy for a disease Take and you will get all the benefits of ( drug ) without the side effects 21 CFR (g)(2)(vii) Claims to be a substitute for a product that is a therapy for a disease Claims to augment a therapy or drug intended to diagnose, mitigate, treat, cure or prevent a disease Claims that a product will assist a drug therapy Use as part of your diet when taking insulin to help maintain a healthy blood sugar level CAN say: Use as part of your daily supplementation to help maintain a healthy blood sugar level 21 CFR (g)(2)(viii) Claims to have a role in the body s response to a disease or to a vector of a disease Supports the body s antiviral capabilities 5
6 Supports the body s ability to resist infection Consuming will prevent you from getting ( disease ) 21 CFR (g)(2)(ix) Claims to treat, prevent or mitigate adverse events associated with a therapy for a disease Disease claims if the adverse events constitute diseases Reduces nausea associated with chemotherapy Help avoid diarrhea associated with antibiotic use 21 CFR (g)(2)(x) Claims to otherwise suggest an effect on a disease (Catch-all) In other words NEVER mention our product and the name of a DISEASE in any conversation, , online post, tweet or blog. 6
