1 Green Card(PERM) Overview for s The Green Card (PERM) process requires information from three main parties; the employer, employee and. In your account, you will see that the process is broken into six stages. Recruitment Stage 1 Recruitment Stage 2 Recruitment Stage 3 Filing Stage 1 Filing Stage 2 Filing Stage 3 Prevailing Wage Job Order Recruitment Activities ETA 9089 I-140 I-485 (I-131 and I-765 if desired) You will be most active in Recruitment Stage 1 and Filing Stages 1-3. will work with your to complete Recruitment Stages 2 and 3. Please reference this information to introdue you to the Green Card (PERM) process. Please note that this is a general reference guide and the documents listed are general and may not reflect your specific case. If you have any further questions (such as an estimated timeline), please post to your Communication Center for advice from an attorney. Recruitment Stage 1 - Prevailing Wage First, the employer must file a Prevailing Wage Request with the U.S. Department of Labor (DOL) to determine the minimum wage for the green card position. You will need to supply documents to prove that you meet the minimum job requirements before can file this form for your employer: Diploma (official or copy thereof) Education evaluation & translation of diploma (if applicable) Resume/Curriculum Vitae (most recent) Experience Letters (These must specifically include all skills and experience required for your position. Once your questionaire is submitted, you may post to your Communication Center if you require more information about what should be included in these letters.) PERM Account Job Description Previously run ads for same position Ads for similar position by competitors Statement about complexity of offered position Job Order Account The job description determines whether you will be placed in the EB-2 or EB-3 green card category. cannot determine your green card category until the job description has been uploaded. Please post to your Communication Center for your green card category after the job description has been uploaded by your.

2 Green Card (PERM) Overview for s Recruitment Stage 2 - Job Order After has received the Prevailing Wage Determination, we will begin to prepare the Job Order. The Job Oder is a form submitted in the state where the intended place of employment is located. This form is submitted for 30 days to locate a qualified U.S. worker or Permanent Resident. will also prepare the Applicant Evaluation Form for your. This document will be used by your to determine if any job applicants qualify for the green card position. Recruitment Stage 3 - Recruitment Activities In Stage 3 of recruitment, will help your advertise for the position to prove that there are no qualified U.S. citizens or permanent residents. Sunday newspaper advertisements, an internal posting notice, and various other types of advertisements will be placed. This may happen at the same time as the job order will take 30 days. After advertising is finished, there is a mandatory 30-day cling off period before the ETA 9089 (PERM) application may be submitted to the DOL. Filing Stage 1 - ETA 9089 In the first filing stage, the ETA 9089 is submitted, which will determine your priority date. In this stage we will need you and your to review and approve the ETA 9089 form that prepares. Documents Required for I-94 Arrival/Departure card Signature card (provided by ) Filing Stage 2 - I-140 Once the ETA 9089 is approved by the DOL, we can start the I-140 stage of the Green Card (PERM) case. The I-140 stage is the only part of a Green Card (PERM) case that can be premium processed. All previous Form I-797 Approval Notices Form I-94 Passport Payroll paycheck stubs for the last two pay periods Transcripts W-2 Wage and Tax statement All prior Forms I-20ID (if applicable) Previous EAD cards Signature Card (provided by ) Annual Report and/or Audited Financial statements Letter of Support (to be drafted by )

3 Green Card (PERM) Overview for s Filing Stage 3 - I-485 When your priority date becomes current per the Visa Bulletin *, we can begin working on the I-485. Depending on your EB category, it may be years until your priority date becomes current, so we may require updated documents at this stage. Please note that your family members (spouse, children) will need their own I-485 cases. U.S. Federal Income Tax Return Payroll paycheck stubs for the last two pay periods Civil Birth Certificate Civil Marriage Certificate (if applicable) Divorce or Death Certificate of Forms Spouse(s) (if applicable) Criminal Record (if applicable) Military Record (if applicable) Form I-94 All Previous Form I-797 Approval Notices Form I-20ID (if applicable) Previous EAD (if applicable) Passport Completed I-693 medical examination (must be completed by a USCIS authorized civil surgeon and physically mailed to ) Two identical color passport-size photographs (must be physically sent to ) Employer Verification Letter (to be drafted by ) If you would also like to apply for an I-131 (Advanced Parole) and an I-765 (Employment Authorized Document), this is the best time to apply. Both the I-131 and I-765 will require two passport-size photos each that must be mailed to. Please post to your Communication Center if you have any questions about the I-765 or I-131 *The Visa Bulletin is a statement published by the government at the beginning of each month. The U.S. has a certain amount of availability for immigrant visas. The Visa Bulletin is not something that has control over and is often difficult to predict.
