Box 190 Eric Jewer Spaniard s Bay, NL Brenda Seymour A0A 3X0 Wayne Smith Town Manager - Tony Ryan spaniardsbay@persona.ca June 18, 2012 The Municipality of Spaniard s Bay A regular meeting of Council took place on the above date with the following members in attendance: Mayor Drover, Deputy Mayor Menchions, Councillors Collins, Dominix, Jewer, Seymour and Smith. Janice Fitzgerald and Angela Morgan representing the Spaniard s Bay Recreation Commission were in attendance. Mayor Drover opened the meeting at 7:11 pm and welcomed everyone to the meeting. Motion to Adopt Agenda It was moved by Councillor Collins, seconded by Deputy Mayor Menchions, that the Agenda for the meeting of June 18, 2012 be adopted as presented. Visiting Groups Janice Fitzgerald addressed Council on behalf of the Recreation Commission. She advised Council that the committee has spent considerable time putting together policies and procedures for the Summer Program. She asked that Council reconsider its position on the No Touch policy and allow the committee to address the matter of applying suntan lotion. Council asked Ms. Fitzgerald to put a policy together to present to Council for review. Mayor Drover thanked Ms. Fitzgerald and Ms. Morgan for attending the meeting. They left at 7:46 pm.. Town Manager s Report June 18, To the best of our knowledge there is one leak outstanding. This is the responsibility of the property owner to repair. 12. The scheduled water main flushing has now been completed. 13. Attached to my report is a letter from Lynch s Trucking Enterprises Ltd advising that HST applies to tipping fees and that he must collect it going back to January 01, HST applicable to tipping fees for us up to end of May 2012 is $19, (This number has been adjusted to reflect the actual amount). This is a matter that should be taken up with CBN Joint Councils, MHAs and MPs. 14. I need a motion to cover the $25.00 contribution made in memory of Lily Jane Smith. Mrs Smith is the mother of employee Jeffrey Smith. She passed away on Friday, June 15, 2012 at age I have received the survey from Finn and Whalen in reference to taking over a private right of way on Finn s Hill. I need the Planning Committee to review it. 16. We will be scheduling branch collection this week. This will be done on a collect and burn

3 basis as to not leave the site for burning looking like a dump site. We will schedule a similar type of collection again before the end of summer. 17. We are having some work done to the 2005 International Dump Truck. Brookside will send someone with an analyser tomorrow. If the problem cannot be fixed locally we will need to send the truck to Harvey and Company in St. John s. Motions and/or Notes in Reference to the Town Manager s Report Above HST on Tipping Fees It was generally agreed that Mayor Drover will raise the matter of HST charges on Tipping Fees at the CBN Joint Councils meeting as the majority of member towns use the same contractor that we do. In Memory of Lily Jane Smith It was moved by Councillor Jewer, seconded by Councillor Dominix, to make the standard $25.00 donation in memory of Mrs. Lily Jane Smith. Takeover of Private Right of Way at Finn s Hill It was moved by Councillor Jewer, seconded by Councillor Collins, that a request to take over a private right of way at Finn s Hill be referred to the Planning Committee for its review and recommendation back to Council. Committee Reports: Finance Committee Accounts Payable It was moved by Councillor Smith, seconded by Councillor Dominix, that accounts payable in the amount of $22, be paid. Quick Stats,Cash Position, Income and Expense Statement along with the Cheque Register were provided for the information and scrutiny of Council. Honda Trash Pump It was moved by Councillor Dominix, seconded by Councillor Jewer, to approve the purchase of a 3" Honda Trash Pump. It was further moved that the Town Manager be authorized to order this pump after evaluating the price without the requirement of having to return to Council for additional approvals. Planning Committee The Committee reviewed a request from G Murrin asking that Council provide a water and sewer connection across Brazil s Hill to their property line for the purpose of developing a future multiple dwelling development. It was moved by Councillor Smith, seconded by Councillor Seymour, that the applicant be required to connect a 6" water and 8" sewer line at the point of the existing infrastructure at Brazil s Hill and that such a connection be completed to the appropriate engineering specifications. It was further moved that this multiple dwelling development must comply with the Town of Spaniard s Bay Development Regulations for sub divisions.

4 The committee reviewed a request from a resident to sell a parcel of Town owned property located at Mercer s Lane, Tilton. It was moved by Councillor Smith, seconded by Councillor Dominix, to defer the request to purchase Town owned land at Mercer s Lane, Tilton to the next regular meeting of Council. Joint Management Committee The minutes of the Joint Management Committee meeting of June 07, 2012 were tabled for the information of Council. Public Works The Committee reviewed a matter concerning drainage at Station Road which is allegedly causing flooding issues at a neighbouring property on Mint Cove Pond Rd. North. It was moved by Councillor Dominix, seconded by Councillor Jewer, that this matter be deferred to the next regular meeting of Council. Heritage Society It was moved by Councillor Seymour, seconded by Councillor Collins, that Council accept the recommendation of the Heritage Society that Chairperson Walter Peddle, Treasurer Ted Jones and Town Manager Anthony (Tony) Ryan be appointed as signing officers for the Heritage Society and that two of the three named individuals be required to sign each cheque on the account. Supported Employment Awareness Month A letter was tabled from Gordon Stone of the Mariners Resource Opportunities Network asking that Council demonstrate its support for the inclusion of persons with disabilities by proclaiming June as Supported Employment Awareness Month. It was moved by Councillor Jewer, seconded by Deputy Mayor Menchions, that Mayor Drover sign a proclamation declaring June as Supported Employment Awareness Month in Spaniard s Bay. Letters/ Request for Compensation for Encroached upon Land at 18 Carroll s Road A letter was tabled from a resident seeking compensation for land which was encroached upon when water and sewer was installed at Carroll s Road in the late 1990s. It was moved by Councillor Jewer, seconded by Councillor Dominix, to refer the letter seeking compensation for encroached upon land at 18 Carroll s Road to the Public Works Committee for its review and recommendation back to Council. Nuisance Dog and Dog Catcher An was tabled from a resident in reference to a nuisance dog roaming in the New Harbour Road area. The also expressed concern about the way the Dog Catcher handled the situation. The Town Manager advised that he had already spoken with the Animal Control Officer on this matter and it appears that two very different renditions of this story is being conveyed. At this time, Council is satisfied that the Animal Control Officer acted appropriately and therefore no further action is required.

5 Newcomer Portal A letter was tabled from Gordon Stone of the Mariners Resource Opportunities Network (MRON) advising of the Newcomer Portal being put together by MRON. They are seeking Towns along the Baccalieu Trail to participate in this portal and advised that the best way to participate would be to keep our web site current. Third Party Contractors and HST - Eastern Waste Management A letter was tabled from Ken Kelly of Eastern Waste Management on the topic of HST being charged to third party contractors. This item was acknowledged for the information of Council as it is currently being addressed. Permits New House at 80 Chipman s Road - A Walker An application was tabled from M. Drover seeking permission to construct a new house at his property at 80 Chipman s It was moved by Councillor Jewer, seconded by Deputy Mayor Menchions, that approval be granted to construct a new house at 80 Chipman s Road in accordance with the application submitted subject to the provisions of the Town of Spaniard s Bay Development Regulations and/or all other applicable provincial and federal regulations. New House at 10 Church Hill - B Seymour & L Jones Councillor Seymour declared that she is in conflict on this matter in accordance with Section 207(b) of the Municipalities Act (1999) as she is the applicant. Councillor Seymour left the Chambers at 8:58 pm. An application was tabled from B Seymour and L Jones seeking permission to construct a new house at his property at their property at 10 Church Hill. It was moved by Councillor Dominix, seconded by Councillor Smith, that approval be granted to construct a new house on the back lot at 10 Church Hill in accordance with the application submitted subject to the provisions of the Town of Spaniard s Bay Development Regulations and/or all other applicable provincial and federal regulations. It was further moved that the applicant be permitted to access municipal water and sewer by tying in to their existing connection provided that 2 additional curb stops are installed to permit the town the ability to isolate the lines. Councillor Seymour returned to the chambers at 9:04 pm. New House at Ryan s Road Extension - B and N Lundrigan An application was tabled from B&N Lundrigan seeking approval in principle to construct a new house at property they are interested in purchasing at Ryan s Road Extension. It was moved by Councillor Jewer, seconded by Deputy Mayor Menchions, that approval in principle be granted to construct a new house at Ryan s Road Extension in accordance with the application submitted subject to the provisions of the Town of Spaniard s Bay Development Regulations and/or all other applicable provincial and federal regulations. It was further moved that the applicant be required to service the property with a 2" water and 6 sewer line and that these lines have the appropriate valve, curb stop and sewer clean out. Further to the above, the applicant shall be made aware of the fact that the access to the chosen location shall be by private right of way in which town services such as snow clearing and garbage collection will only be available to the beginning of the right of way at Ryan s Road Extension.

6 Crown Land at Ridge Road - A Parsons Planning Area Boundaries was tabled from A Parsons seeking approval from Council to proceed to apply for land at Ridge It was moved by Councillor Seymour, seconded by Councillor Dominix, to approve a Planning Area Boundaries to A Parsons who is applying for a parcel of Crown Land at Ridge Crown Land at Ridge Road - D Janes Planning Area Boundaries was tabled from D Janes seeking approval from Council to proceed to apply for land at Ridge It was moved by Councillor Collins, seconded by Councillor Dominix, to approve a Planning Area Boundaries to D Janes who is applying for a parcel of Crown Land at Ridge Crown Land at Ridge Road - D Byrne Planning Area Boundaries was tabled from D Byrne seeking approval from Council to proceed to apply for land at Ridge It was moved by Councillor Seymour, seconded by Councillor Dominix, to approve a Planning Area Boundaries to D Byrne who is applying for a parcel of Crown Land at Ridge Crown Land at Ridge Road - D Whalen Planning Area Boundaries was tabled from D Whalen seeking approval from Council to proceed to apply for land at Ridge It was moved by Councillor Collins, seconded by Councillor Dominix, to approve a Planning Area Boundaries to D Whalen who is applying for a parcel of Crown Land at Ridge Donations Avalon North Wolverines Search and Rescue - Request to advertise on Rescue Vehicle Councillor Dominix declared that he is in conflict in accordance with Section 207 of the Municipalities Act (1999) in the matter of a request for a donation from the Avalon Wolverines Search and Rescue as he is a member of that organization. He left the Chambers at 9:37 pm. A letter was tabled from Perry Bowering on behalf of the Avalon North Wolverines seeking a donation of $ in exchange for the right to advertise on the Association s Rescue Vehicle. It was moved by Councillor Smith, seconded by Councillor Jewer, to accept the request from the Avalon North Wolverines to contribute $ to the Association in exchange for the right to place an ad/logo on their rescue vehicle.

7 Councillor Dominix returned to the Chambers at 9:41 pm. Other Business Deputy Mayor Menchions advised that the Special Events Committee have applied for funding in the amount of $31, to fence the ballfield. Councillor Jewer spoke to the matter surrounding used tires stored alongside the main road and regarding several commercial properties that are getting dirty. Councillor Seymour advised that a Soccer Program is set for Spaniard s Bay this summer. This program will be for kids up to 8 years of age and will cost $40.00 per child. Councillor Smith asked whether or not the Town has finished patching pot holes as there are several in Back Cove that have not been done. Councillor Dominix advised that he will bring a report from the Fire Department to the next regular meeting. Councillor Collins asked about checking out the basketball nets at the Tilton basketball court. She then gave Council an update on the activities that the Special Events Committee have planned for their Canada Day celebration on June 30 th. Councillor Jewer asked if we could get the grass cut along the Lassy Wall. Adjournment The next meeting of Council will be at the call of the Chair.
