3 Important Information Product Information Product Information Roof Static and Structural Dimensioning With our Wagner Solar packages, we deliver a specific number of roof brackets for each solar installation. However, depending on the region (altitude, snow-load zone and/or wind-load zone) as well as building specifics (e.g., installation close to roof edge), the required number of roof brackets could be higher. You are welcome to contact our technical support for calculation support. Please provide a detailed list of dimensions so that our staff can better assist you. Pre-vessel For solar installation packages with heating support and a vertical collector arrangement, a heat dissipation pre-vessel must be installed to protect the expansion vessel. This pre-vessel is included in the solar space heating packages. For an on-roof mounting DHW system with vertical collector installation or any oversized collector field, a pre-vessel must be ordered separately. Solar Accessories Solar cables and electronic small parts are not included in delivery. For limiting the domestic hot water temperature, we strongly recommend the installation of a thermostatic mixing valve (p.25). Arresting Valve (Capped valve) For easier maintenance and commissioning of our solar installations, we recommend the installation of a capped valve (p.26). Note: This is not a technical document. You have 48 hours in which to report any damages, shortages or overages to Wagner Solar. Shipping charges shall be added to purchase order and paid by Buyer. Risk of loss on all products shall pass to Buyer upon delivery to the carrier at the point of shipment. Please note: Missing documentation on the consignment note may compromise your entitlement to transport insurance claims. If you are unable to inspect the goods fully, indicate as such in writing on the consignment note/packing list. Please contact our customer service at right away if any assistance is needed. 4. Transport outside the truck is not included Please note that the drivers will only place the item on the lift gate and are legally prohibited from assisting you in moving them any further. Please arrange to have an additional person/s available to assist in moving the items from the end of the truck to the required location if needed. 37 Return Policy Important Customer Information We will be able to process your return faster and more efficiently if you follow the points below: 1. Please arrange all return deliveries with our office. You can reach Wagner Solar at or We will issue a return authorization number (RA#) for your return delivery. We require this number to properly process your return. 2. Once you have been issued an RA#, we will you a return delivery slip which you must fill out completely and include along with a copy of your packing list or invoice with the return shipment. 3. Any return of goods that was requested by Wagner Solar for the examination of warranty claims is free of shipping charges. 4. In order to process a return of damaged goods, Wagner Solar must first receive: photographs of the damaged items, a list of all relevant article numbers, and a copy of either the Bill of Lading or Delivery Receipt. 5. For all return deliveries aside from warranty claims, Wagner Solar will bill you with the actual freight costs. 6. Please make sure that the return delivery is properly and safely packed. 7. For return deliveries of unused, undamaged and originally packed articles from our current product line, we will credit you with the billed amount minus a 25% restocking fee. 8. If the goods are not in a condition proper for resale, we reserve the right to dispose of or return the products to you. 9. The following products and parts are excluded from returns: Items not purchased from Wagner Solar Inc. Electronic components Items which due to their construction and/or nature can only be stored for a limited period of time (e.g. seals, rubber parts, hoses, etc.) Leftover parts, individual set components Parts manufactured or obtained upon customer request Products that are no longer part of our current product line 10. 38 General Terms and Conditions Important Customer Information 1. General Information These terms and conditions of business are an integrated part of every product and service offered by Wagner Solar Inc. and every business transaction performed and/or purchasing contract signed with it. They apply as of May 1st, General terms and conditions of business, regardless of the type, that conflict with these terms and conditions of business shall be considered invalid and of no legal force. Updated general terms and conditions shall be downloaded under 2. Products and Service All products description, product information, the range of products by Wagner are not binding. We reserve the right to make technical updates to products due to technical improvements and outdated products. All provided technical documentation; drawings, datasheets, publications of the term technical, manuals and operating instructions remain the intellectual property of Wagner. 3. Pricing Unless otherwise agreed in writing, prices are net prices ex works, including packaging but not including applicable crating charges and excluding any applicable discounts based on volume and quantities. The prices of the commercial price list are suggested retail prices, approximated at the time of purchasing or signing a purchase agreement. If material prices change; either increase or decrease at the time of purchase or submittal of purchase agreement, prices shall be adjusted accordingly. This terminology shall be binding for every transaction within a three (3) month period between signing of an agreement and execution. 4. Delivery and Payment All actual shipping charges shall be added to purchase order and paid by Buyer. Delivery dates are never binding unless explicitly agreed in a purchasing contract. If a change to a confirmed delivery date takes place, Wagner Solar Inc. is entitled to establish an adjusted delivery date, and Wagner Solar is not to be held liable for any consequences, harm and damage caused by adjusted delivery dates. If the delay is caused by the contractor or project managing company, the latter must cover all additional costs caused by the delay or Returns and Exchanges. Unless otherwise agreed, goods shall be delivered only cash on delivery, unless a company account has been arranged with Wagner Solar. Discounted rates or payments shall be agreed in advance and in writing otherwise they shall be borne by the customer. Setoff or declining payments by the client is prohibited unless expressively agreed. Payments must be made in full to Wagner Solar Inc. or a person with authority to collect. If a credit period is exceeded and payments are received late, Wagner Solar is entitled to assess late charges in the amount of 5 % per month. Customer must pay any collection fee, intervention fees and any applicable legal charges. Warranty claims asserted by the client do not entitle the client to withhold payments. 37

Limited Warranty Wagner Solar Inc. warrants that all its products sold in accordance with these warranty provisions shall be free from defects in material and workmanship, or other malfunctions or failure to perform, under normal use and service. This warranty is valid for the time listed below from the date of installation, not exceeding 6 months from date of manufacture, by product classification as follows: Standard Components 2 years Solar Storage Tank and Solar Flex piping 6 years Solar Collector and Solar Thermal System 11 years Limited eleven (11) year warranty for the Wagner & Co flat panel solar collectors, the entire solar system* if all original Wagner products and components are used during installation and the installation is consider the original solar system installed and operated by the original owner and at the original site. The solar system must be installed by a certified installer under the Wagner Academy solar training program and during operations maintained according to the maintenance and service instruction provided by Wagner. The obligation of Wagner under the warranty and repair conditions of Wagner shall further be limited exclusively to the repair, replacement, or refund of purchase price, at the sole discretion of Wagner. Wagner shall not be responsible for any special, indirect, incidental or consequential damages caused by the goods and products as described in the in warranty policy at The warranty herein provided are not assignable nor negotiable. 6. Jurisdiction and Arbitration All disputes and claims or demands arising from or relating to the Warranties, or from the terms and conditions herein contained and all claims, demands, rights or liabilities arising from such Warranties or terms and conditions shall be determined in accordance with the law of the city of Cambridge, Massachusetts. In the event of any dispute of Wagner and the Original Owner arising out of the interpretation of performance of the warranty policy provided by Wagner, such dispute shall be submitted to a board of three (3) arbitrators, one of whom shall be determined by Wagner, one by the Original Owner and the third by the first two nominees if there can agree otherwise by a Judge of the Supreme Court of the City of Boston. Disclaimer of Warranties: Wagner Solar Inc. disclaims any warranty not provided herein including the implied warranty of merchantability and implied warranty of fitness for a particular purpose. It is expressly understood that Wagner is not responsible for any consequential or other damages that may arise from using Wagner Solar components. Damage resulting from water freezing in the collector tubing does not constitute a defect in material or workmanship, and shall not be covered by this warranty. * Only certain models apply for full system warranty. 38
