3 Terms and definitions Ener- Renewable gies Biomass Biogas Biomethane Region Hydropower (pumped storage plants minus energy input for pumping operation), wind power, biomass, biogas, landfill gas, solar power, geothermal power, sorted biogenic portion of municipal and industrial waste. Energy carrier according to the German biomass ordinance valid at the time of the audit. Generic term for Biogas as well as landfill gas and sewage gas from biomass. Biogas that has been refined to fulfill natural gas standards and which is fed into the natural gas grid. A specific area, for example a single community or several counties for which a specific electricity product is intended. It can also be a service area of a local / regional electric utility, which operates its own grid, but it can also be an area where a provider without an own grid is offering a energy product via transit contracts. A region is an area that is mostly connected and supplied without the use of routes of transit grids 1. The use of internal high-voltage routes of the municipal / regional electric utility or the municipal / regional grid operator however is allowed. Admissibility of a region definition will be clarified via questionnaire for every certification. Extended Region Certification Cycle An area of about 20km depth around the region defined above that is supplied without the use of routes of the transit grid. The use of internal high-voltage routes of the municipal / regional electric utility or the municipal / regional grid operator is allowed. The precise size will also be defined via questionnaire. A certification cycle consists of one initial audit and two monitoring audits. 4 Foreword This standard should be used as basis for the certification of electricity products that are completely generated from renewable energies. It is separated into General requirements, which are intended for the certificate holder and Special requirements that are intended for the product itself as well as "Optional requirements". Optional requirements are defined for the regionality of the eco power product. In general, the purchase of a eco power product implies that the development and preservation of renewable energies is supported. This implication is guaranteed in particular by this TÜV SÜD standard. The certificate holder is obliged to protect the climate and develop renewable energies. The seller can also use an additional fee for renewable energies to promote the construction of new plants. Eco power products certified with this standard guarantee the customer that the annual consumption is covered and simultaneously the consumed energy is in the same amount fed into the grid from renewable energy sources. For this purpose a pool of cooperating power plants is required that ensures that the consumed energy is fed into the grid. If the option "regionality" is chosen, at least 60% of the energy consumption must be matched by regional sources. The regionality of consumption and generation of renewable electricity can minimize the demand for transmission lines and is an important contribution to the energy turnaround. Energy sources that fulfill the requirements of the TÜV SÜD Standard Generation EE and the Generation EE + module ( electrical work and power guarantees ) are especially suited to provide the energy for the eco power products certified with this TÜV SÜD EE02 standard. In this TÜV SÜD standard the term renewable energies is used as defined by the German legislation (renewable energies act, biomass ordinance). If this standard is used outside of Germany and other legal regulations are used, then the more strict definition of renewable energies should be used. If an energy source is not considered renewable in one country although it is in Germany, the energy source should not be considered renewable for the TÜV SÜD certification. Also no energy source that is not considered renewable in Germany should be considered renewable for TÜV SÜD certifications outside of Germany. The product certification is always based on the specific energy sources and guarantees the buyer the verified origin of the electricity from renewable energies. Part I Scope and fundamentals 1. Scope of the certification This standard defines the requirements for electricity products from renewable energies, optionally produced from regional sources. 2. Sources and legal basis a. Directive 2009/28/EC of the European Parliament and of the Council of 23 April 2009 on the promotion of the use of energy from renewable sources; b. Act on granting priority to renewable energy sources (Renewable Energy Sources Act- EEG) in its currently valid version; c. German Law on Energy management (EnWG) in its currently valid version; 3. Validity This standard (Version 07/2013) becomes effective on 01/08/2013. Certificate holders have 12 months to adjust their certified systems to the new requirements of the standard. The monitoring or re-audit at the end of this period is conducted according to the revised standard. Exceptions of this regulation must be approved by the certification body Climate and Energy of TÜV SÜD. This standard exists in different language versions. In case of doubt the German version shall be binding. Part II General Requirements 4. Corporate policy The protection of the climate is an essential aim of the business policy; especially the growth of Copyright TÜV SÜD Industrie Service GmbH Page 4 of 7

5 renewable energy as an instrument for a better climate protection should be promoted. These goals are set out in writing, correspond with the activities of the company and may exceed legal requirements. 5. Communications The green power product should be promoted actively, continually and with suitable means of communication. The statements on the published green power product must be covered by the certification. No misleading communication is allowed. In order to fulfill the module "Regionality", "completely regionally produced" may only be advertised, if it is guaranteed that the electricity is 100% of regional origin. End users should be kept informed via suitable means of communication of further development of the technology trends and the application of renewable energies. 6. Organization The certificate holder nominates an audit mandatory who is responsible for the green power supply and who provides all necessary information on the certification. The processes, roles and responsibilities necessary for the supply of the product are defined and documented. Part III Special Requirements 7. Rights and permissions The certificate holder has the sole right to market the certified eco power product. Relevant legal obligations and other requirements, that the organization is obliged to fulfill due to the eco power product, are determined and made available for the respective persons. The certificate holder ensures that all the legal obligations and requirements as well as other obligations are observed. Additionally, the certificate holder is obliged to offer customer contracts for green electricity that do not contain any disadvantages compared to conventional contracts. Customer contracts with time periods of more than 2 years or payment in advance as terms of payment are not permitted. 8. Energy carriers and Energy sources The certified electrical power provided as a green power product, must be derived from 100% renewable energy sources and the certified electrical power provided as renewable energy can be traced back to clearly described and identifiable sources. The supplier should disclose these sources to his customers in an appropriate way. As long as this is guaranteed, the proof of the energy sources can also be performed by certificates which are issued by an accepted certificate trading system. From the start of a national register of guarantees of origin according to directive 2009/28/EC on the guarantees for the delivery of electricity from renewable energy sources must be issued from the respective national register. If there is no national register of guarantees of origin, the guarantees of origin have to be made by: a. Generation testing within the scope of a TÜV SÜD certification Product EE02 on the basis of the TÜV SÜD Standard "Generation EE"; b. Guarantees of origin according to article 5 of the EU directive 2001/77/EC; c. RECS/EECS-certificates, if there is no national legal regulation regarding guarantees of origin; d. A certification of electricity according to TÜV SÜD Standard Generation EE or any similar standard. In case of a generation inspection within the scope of a eco power product certification it must be ensured that the certifier is granted access to all relevant plants and documents of external suppliers. 9. Prohibition of double-marketing Electricity amounts that were subsidized in order to promote the development of renewable energies cannot be certified. 6 pensated electricity cannot be certified. Directly marketed, non-subsidized electricity from plants that may be subject to subsidization can be certified. Investment subsidized plants can be certified if the promotion of all investments is less than 15%. Subsidized electricity which, due to legal regulations, is circulated onto by the final customers can be certified in the respective amount and does not need to be bought elsewhere. 10. Electricity labeling The information and description of the electricity labeling from the company mix as well as from eco power product comply with legal regulations. If the certificates are used as guarantee of origin the recipient is asked to report back the electricity mix to the producer before it is re-declared by the use of certificates, as long as this has not happened due to national regulations concerning residual mix. The producer or supplier is also asked to observe this for his electricity labeling and electricity disclosure. 11. Matching of generation and supply Certificate holders use a reliable procedure to continually monitor and secure generation or purchase to ensure that the amount matches the consumption or sale. The delivery quantities as well as the assured services are defined and confirmed by the supplier or eco power provider. 12. Equality of time The work is supplied simultaneously to the consumption. Equality of time must be ensured at all times. The shortest time unit should be applied, in concordance with the time unit used by the national energy market of the country of origin. If data for the shortest time unit is not available, compliance with the load profile must exist at least at an hourly basis. In exceptional cases this criterion should be considered fulfilled, if the consumed amount exceeds the generated amount in at maximum three time periods with a total of 18 hours. Unpredictable events for which the certificate holder is not responsible (Force Majeure/act of god) are exceptions to this rule. The effectiveness of the introduced system will appropriately be announced publicly and to the customers. Even if redistributors will be supplied, the supply will be effected simultaneously to the generation. 13. Funding element Two thirds of surcharges of the eco power products compared to conventional energy products or surcharges of eco power products that are not caused by buying, developing or generating renewable energies, must be used to promote climate protection, especially the development of renewable energies. Other funding elements may be possible from case to case as long as the funding is on a par with the aforementioned requirements. 14. Implementation of subsidies Subsidies according to number 14 or 16 should be invested promptly. Depending on the amount of funding money, appropriate projects should be conducted in 1 to 3 years periods. The use of the subsidies must regulated and planned to determine how, when and which projects will be supported. The plan must be updated regularly. A positive list of support measures can be found below. The money taken and spent must be documented properly. 15. Positive list of support measures The following measures generally fulfill the requirements of this TÜV SÜD Standard: new plants to generate electricity from renewable energies. Legal funding is allowed if the earnings are spent as funding money; new plants to generate heat from renewable energies; Renewal of plants in accordance of TÜV SÜD standard "Generation EE", module "EEnew"; climate protection projects with plants that use renewable energies; Copyright TÜV SÜD Industrie Service GmbH Page 6 of 7

7 funding programs with heat pumps after a preceding energy consultancy; funding projects for solar thermal power; Research projects of future technology that integrate renewable energies into the energy market (e.g. new storage technologies, intelligent grids/regulation of producers and consumers). The funding of research projects must be validated from case to case. During pre-audits, specific goals / requirements are worked out and defined and the basic feasibility is checked. The worked out goals / requirements are documented after the pre-audit and regarded as part of the certification requirements. Afterwards the client works out the product conception including an implementation plan. The drafting is part of the certification audit. The relevant parts of the regionality concept must be published by the certificate holder. Part IV Module Regionality (optional) The module "Regionality" is optional. Compliance with this module can be stated separately in the certificate. An electricity product certified according to the Standard EE01 including the module regionality is characterized by a proportional generation from sources that are located in the region of the customer of the electricity product. Therefore, electricity products that are marketed nationally cannot fulfill the module regionality. 16. Regional energy Regionally produced energy is used. The used energy sources are located within region or the extended region. For clarifications regarding the terms "region" or "extended region" see section "Terms and definitions" of this standard. Within the balancing period a minimum of 60% of the delivered energy must be regionally produced. However, it is not necessary to fulfill simultaneous supply from the regional sources. According to number 11 the conformity with the regional requirement must be integrated into the required procedure. External examination is conducted during the annual audit by comparison of the regional work and the total work, that customers of the certified product have consumed in the respective time period. 18. Citizen participation The following requirements are not mandatory for the fulfillment of the module regionality. Compliance with this module can be stated separately in the certificate. Citizens of the region should be given the possibility to participate in regional power plants and / or regional energy supply concepts with a minimum percentage of 15%. For example as timely limited pre-emption. If the citizen participation has not been implemented prior to the initial certifications, a corresponding citizen participation offer must be made. The registered office of the operating company of the power plant with citizen participation must be in the region. 17. Procedure Regionality of a energy product can be achieved through varies methods.
