22 In accordance with the provisions: the ISPS Code entered into force on 1 July 2004 SUPREME DECREE No MTC established measures for applying the International Ship and Port Facility Security (ISPS) Code NATIONAL MARITIME AUTHORITY NATIONAL PORT PORT AUTHORITY
23 THE MARITIME AUTHORITY HAS REGULATED UNDER THE ISPS CODE ON THE FOLLOWING: - Director s Resolution No /DGC on 15/12/2003: Standards for obtaining Ship Security Certificate under ISPS Code. - Director s Resolution No /DGC on 09/03/2004: Standards for registration and authorization of recognized security organizations - RSO. - Director s Resolution No DGC: It establishes that a vessel entering port shall submit maritime security information to the Maritime Authority with SEVENTY TWO (72) hours in advance. In the event that time of navigation to port is less than the above-mentioned, information required shall be provided when leaving.
24 THE MARITIME AUTHORITY HAS REGULATED UNDER THE ISPS CODE ON THE FOLLOWING: For implementation of the ISPS Code, US Coast Guard rules (Navigational Vessel Inspection Circulars NVIC 04-02, 09-02, 10-02, and 11-02) have been taken as references for ship and port facility security. Also, rules developed by countries in the region have been taken into account. DICAPI conducts audits for checking Ship Security Plan SSP through its own Auditors, upon previous approval of SSP developed by the company or any authorized RSOs. DICAPI does not require the SSA or SSP to be developed or endorsed by a RSO
25 Additionally, there are complementary rules relative to: a. Security Patrol of Waterfront with permanently decentralized vessels in Northern and Southern coasts. b. Supervision of 14 ports and coves on the Peruvian coastline. c. Maritime Traffic Control. d. Immediate Response Group. e. SAR responsibility. f. NAVAREA XVI

DATES WHEN TANKERS SHALL BE PROVIDED WITH DOUBLE HULL OR WITHDRAWN FROM OPERATION CATEGORY OF OIL TANKERS DATE OF OUT OF SERVICE Category 1 31 JULY 2010 Categories 2 and 3 31 DECEMBER 2011 DOUBLE HULL TANKER
33 ANTIFOULING 1.- It is applicable to vessels of 400 gross tons and above. 2.- Application or reapplication of organostannic paints on vessels is prohibited, unless those are provided with a coating that prevents lixiviation. 3.- It approves the National Compliance Document issued by the Maritime Authority that certifies that the implemented antifouling system does not pose risks to the marine environment and health. IMPLEMENTED PROVISIONS 4.- It establishes obligation to submit accredited documentation that shows a null toxicity of the paint. 5.- It establishes obligation to submit lab tests that show a null damage to marine biota and health. The Peruvian State is not a Party to the International Antifouling Convention; therefore, the regulation is of national nature.
34 AIR POLLUTION 1.- Any deliberate emissions of ozone-depleting substances shall be prohibited. 2.- It shall be prohibited on all vessels flying the Peruvian flag of 400 gross tons or above and engaged in international maritime navigation. 3.- Shipboard incineration of the following substances shall be prohibited: 3.1. Polychlorinated biphenyls (PCB) Garbage containing more than traces of heavy metals Refined petroleum products containing halogen compounds. 4.- Documentation accrediting sulphur content of any fuel oil used on board ships shall not exceed 4.5% m/m; in order to reduce sulphur oxide (SOX) emission Documentation accrediting that ship s engine is provided with an exhaust gas cleaning system to reduce nitrogen oxides (NOX) emission Documentation accrediting that ship is provided with a control system for volatile organi c compounds (VOCs). The Peruvian State is not a Party to the MARPOL 73/78 Annex VI; therefore, the regulation is of national nature.
