It is increasingly recgnized that assciatin between FSC and rganizatins that are invlved in unacceptable frest-related activities is harmful t FSC s reputatin and ultimately t its ability t deliver n its missin. In rder t address this cncern, in March 2007 the FSC Bard f Directrs mandated the FSC Internatinal Center t develp criteria fr the assciatin f third parties with FSC. Thrugh this plicy FSC expects t be able t identify rganizatins nt cmmitted t the basic fundamentals f respnsible frest management and prevent them frm misusing their assciatin with FSC. It is especially relevant, but nt limited t, the granting and maintenance f FSC trademark licenses and FSC certificates t rganizatins assciated with FSC thrugh frest management, chain f custdy and/r cntrlled wd FSC certificatin. In judging the case, the Panel will take int accunt the lcal circumstances, the scale f the peratin and plans fr cntinued cnversin. NOTE: Fr the purpses f this plicy, the establishment f ancillary infrastructure necessary t implement the bjectives f respnsible frest management (frest rads, skid trails, lg landings, etc) is nt cnsidered cnversin. Human rights Rights as established by the Universal Declaratin f Human Rights f the United Natins. Illegal Lgging Harvesting f timber in vilatin f any laws applicable in that lcatin r jurisdictin including, but nt limited t, laws related t the acquisitin f harvesting rights frm the rightful wner, the harvesting methds used and the payment f all relevant fees and ryalties. ILO Declaratin n Fundamental Principles and Rights at Wrk Adpted in 1998, the Declaratin cmmits Member States t respect and prmte principles and rights in fur categries, whether r nt they have ratified the relevant Cnventins. These categries are: freedm f assciatin and the effective recgnitin f the right t cllective bargaining, the eliminatin f frced r cmpulsry labr, the ablitin f child labur and the eliminatin f discriminatin in respect f emplyment and ccupatin. Indirect invlvement: Situatins in which the assciated rganizatin r individual, with a minimum wnership r vting pwer f 51%, is invlved as a parent r sister cmpany, subsidiary, sharehlder r Bard f Directrs t an rganizatin directly invlved in unacceptable activities. Indirect invlvement als includes activities perfrmed by subcntractrs when acting n behalf f the assciated rganizatin r individual. Traditinal rights Rights which result frm a lng series f habitual r custmary actins, cnstantly repeated, which have, by such repetitin and by uninterrupted acquiescence, acquired the frce f a law within a gegraphical r scilgical unit. Als knwn as custmary rights (FSC Principles and Criteria). It als encmpasses the rights f Indigenus and Tribal Peples as established by the ILO Cnventin f 6

PART I - POLICY ELEMENTS Apprved by the FSC Bard f Directrs at its 51st Meeting, July FSC will nly allw its assciatin with rganizatins that are nt directly r indirectly invlved in the fllwing unacceptable activities: a) Illegal lgging r the trade in illegal wd r frest prducts b) Vilatin f traditinal and human rights in frestry peratins c) Destructin f high cnservatin values in frestry peratins d) Significant cnversin f frests t plantatins r nn-frest use e) Intrductin f genetically mdified rganisms in frestry peratins f) Vilatin f any f the ILO Cre Cnventins 1 1 As defined in the ILO Declaratin n Fundamental Principles and Rights at Wrk. PART II - POLICY IMPLEMENTATION 2 Due Diligence 2.1 Befre entering int an assciatin with an rganizatin r individual, FSC shall cnduct a due diligence evaluatin accrding t FSC-PRO t evaluate the existence f bjective evidence that an rganizatin is directly r indirectly invlved in any f the unacceptable activities as listed in Part I Clause FSC shall nly enter int an assciatin with rganizatins r individuals that have passed the due diligence evaluatin. 3 Investigatins f allegatins 3.1 Any stakehlder, including FSC, can file a frmal cmplaint against an rganizatin r individual that is suspected t be invlved in any f the unacceptable activities as listed in Part I Clause Cmplaints shall be filed and prcessed in line with the requirements and regulatins f the FSC Dispute Reslutin System. 4 Disassciatin 4.1 A decisin t disassciate frm FSC shall nly be taken by the FSC Bard f Directrs. 4.2 Fllwing the decisin t disassciate, actins t terminate the cntractual relatinships with the rganizatin r individual shuld be taken within a perid f thirty (30) days. 4.3 The decisin t disassciate cannt be appealed. 4.4 Tgether with the decisin t disassciate, the FSC Bard f Directrs may specify a timeline and cnditins fr renewal f the assciatin with FSC. 6 f 6
