1 CASITAS DEL RIO HOMEOWNERS ASSOCIATION PURPOSE ARCHITECTURAL GUIDELINES To maintain the existing architectural integrity and environment of the Casitas Del Rio development. GENERAL CONDITIONS 1. Any exterior alteration, addition or change must be submitted to the Architectural Committee for approval PRIOR to installation. 2. Minimal landscaping and ground cover should be completed within six (6) months of the close of escrow. 3. Approval by the Architectural Committee does not constitute approval by the City of San Juan Capistrano, nor does approval by the City of San Juan Capistrano constitute approval by the Casitas Del Rio Architectural Committee. Approval by the City of San Juan Capistrano is the responsibility of the homeowner. The City of San Juan Capistrano requires a building permit for: A. All structural alterations, additions, or changes B. All fences or walls over two (2) feet in height C. All patio covers 4. All submissions to the Casitas Del Rio Architectural Committee must be in duplicate and in 1. writing on a minimum of 8-1/2" x 11" sheet of paper and be accompanied by a plot plan showing: A. Location of residence on the lot with the dimensions from lot lines B. Complete dimensions of improvements proposed C. Measurements of improvements in relationship to home and lot lines D. Indication of color scheme of end product E. Description of materials to be used F. Drawing showing affected elevations, footings, etc. G. Plotted location of sprinklers, drain, trees, shrubs, fences, etc. H. Details of all affected areas, when needed 5. Also show the street address, lot number, tract number, owner s name and a telephone number where the applicant or the contractor can be reached between 9:00 a.m. and 5:00 p.m., as well as a home number where the applicant can be reached after these hours. 6. All exterior additions, changes, or alterations which are visible from the common walkway or street must be consistent in design and color with the Casitas Del Rio development.
2 7. Written notice of completion of the addition, change or alteration is required for inspection by the Architectural Committee. If the Architectural Committee discovers that the approved plans have not been complied with, the Board of Directors will be asked to take appropriate action. Inspection by the City of San Juan Capistrano is the responsibility of the homeowner. 8. The addition, change or alteration must be completed within thirty (30) days, once begun. 9. All maintenance on any exterior alteration, addition or change is the direct responsibility of the homeowner. 10. The homeowner may appeal any adverse decision of the Architectural Committee to the Board of Directors. 11. All additions, changes, or alterations which were approved by Tri-S Homes, Consulate Construction Co. Or Arrojado Corp. Prior to the establishment of the Architectural Committee shall be recognized as approved requests for architectural changes. FENCES, WALLS, OR OTHER ENCLOSURES All walls or fences shall be stuccoed concrete block to match the texture of the homes or the wall around the pool area or masonry to match existing slumpstone or wrought iron consistent in design to the wrought iron fencing surrounding the recreational pool area. Natural cedar or redwood fencing which conforms precisely to the design of the permanent rough cedar fencing in the Casitas Del Rio development is acceptable: 1" x 4" or 1" x 6" rough cedar or redwood, with 1" spacing, and boards squared at the top. All wood fences will remain in a natural wood state to be maintained by Woodlife or clear matte finish preservatives. All enclosures or fences shall be of the same material in overall height. The maintenance of all fences and walls is the responsibility of the homeowner who initiated the additional wall, fence or enclosure. No wall, fence, or enclosure may touch or connect adjacent property without the written permission of the owner of the adjacent property. Any deviation in the use of wrought iron design for fencing must have the prior approval of the Architectural Committee. All fences, walls, or enclosures over two feet (2') in height require a building permit from the City of San Juan Capistrano. No fences, walls, or enclosures shall exceed six feet (6') maximum in height.
3 No fence, wall, or enclosure shall be installed in front of the house. PATIO COVERS 1. Wood only in natural or painted redwood or painted fir and painted to match the color of the window trim of the homes in the Casitas Del Rio development (Olympic stain: Coffee) 2. No aluminum or other metal, plastic, fiberglass, cloth covers or composition shingles are acceptable. 3. The City of San Juan Capistrano requires a building permit for all patio covers. 1. PATIO SLABS All patio slabs must be submitted for Architectural Committee approval prior to installation. The City of San Juan Capistrano does not require a permit for a patio slab. UTILITY BUILDINGS, PLAY HOUSES, AND PET HOUSES Utility buildings, play houses, and pet houses must receive the approval of the Architectural Committee PRIOR to installation. A general guideline is that no such structure shall be visible over the top of the fencing or wall from any street or common walkway. AWNINGS, EXTERIOR SHUTTERS, AND SUN SHADES Awnings, exterior shutters, and sun shades, where visible from a street, common walkway or neighboring residence, are discouraged. Installation of any awning, exterior shutter, or sun shade is subject to the prior written approval of the Architectural Committee. WINDOW COVERING All interior window coverings must be completed within three (3) months after the close of escrow. AIR CONDITIONERS All exterior or window air conditioners must be submitted to the Architectural Committee PRIOR to installation. WATER SOFTENERS All exterior water softeners must be submitted to the Architectural Committee PRIOR to installation. STORING OF BOATS, RECREATIONAL VEHICLES, TRAILERS The storing of boats, recreational vehicles or trailers on the property is prohibited except in the garage. Neither may any of the above be stored in the streets of the Casitas Del Rio development. Storage of any materials, including but not limited to firewood, lumber, sand, gravel, etc, in any visible area is prohibited.
4 BASKETBALL HOOPS No basketball hoops shall be erected on the front of the house or garage. RAIN GUTTERS All rain gutters shall be painted to match the exterior of the house or be in an off-white or neutral precolored tone which blends with the exterior stucco color. The above guidelines were approved at the Casitas Del Rio Homeowners Association Board of Directors meeting on March 10, 1983.
