2 What is Council Tax Benefit? Council Tax Benefit is paid by your local council to reduce the amount of council tax you have to pay. How much you get depends on how much you have coming in and how much you have in savings. You can claim if you own your home or rent it. You can claim if you are in work or unemployed, or a pensioner, too ill to work, or looking after someone who is sick or disabled. You can get Council Tax Benefit even if you already get a 25% discount for living alone. You get more Council Tax Benefit if you are a pensioner, or you are sick or disabled, or a carer, or if you have children. You may get more Council Tax Benefit if you get Attendance Allowance or Disability Living Allowance. Most students cannot get Council Tax Benefit but there are exceptions. Even if you can t get Council Tax Benefit in your own right, you could get a rebate based on the income of someone else in your home. See 'The Second Adult Rebate' on page 5. Alison and Kevin are a couple in their forties. Alison doesn t work and gets Disability Living Allowance of a week. Kevin works 28 hours and earns 200 a week. They get Council Tax Benefit of 1,140 towards a council tax bill of 1,600. 2

3 Council Tax Benefit Savings Your savings include money you have in the bank, or building society, but not the value of the home you live in. For a couple your joint savings are taken into account. If you get the guarantee credit of Pension Credit your savings are ignored altogether. Savings under 6,000 are ignored ( 10,000 if you or your partner are over the qualifying age for Pension Credit*). You will get less Council Tax Benefit if your savings are above these figures. If your savings add up to more than 16,000 you cannot normally get Council Tax Benefit, unless you get the guarantee credit of Pension Credit. *Qualifying age for Pension Credit is rising from 60 to 65 along with women s state pension age. Kate is aged 73. She lives alone and has savings of 30,000. She has Retirement Pension of 100 a week and gets Attendance Allowance and Pension Credit including the guarantee credit. Kate gets full Council Tax Benefit, so she has nothing to pay. Because her claim was backdated 3 months she got a refund of some of the council tax she had paid the previous year. 3

4 People living with you You may get less Council Tax Benefit if one or more adults live with you, but who are not dependent on you, for example a grown-up son or daughter (but see The Second Adult Rebate opposite). How much less will depend on their age and how much money they have coming in. But you will not get less Council Tax Benefit if: you or your partner are registered blind or get Attendance Allowance, Constant Attendance Allowance, or the care component of Disability Living Allowance or the person who lives with you does not count, for example you get Child Benefit for them, or they are a student, or they get Pension Credit, Income Support, income-related Employment and Support Allowance or income-based Jobseeker s Allowance. Sam is 50 and gets income-related Employment and Support Allowance and the middle rate care component of Disability Living Allowance. Sam gets full Council Tax Benefit even though his adult son who is in full-time work lives with him. 4

5 Council Tax Benefit The Second Adult Rebate If you claim Council Tax Benefit your local council should check whether you would be better off getting a Second Adult Rebate instead. You cannot get this rebate and Council Tax Benefit at the same time. You could qualify for Second Adult Rebate even if you cannot claim Council Tax Benefit, for example because you have over 16,000 in capital. It is the income of the people who live with you that counts, not your own income or savings. You may be able to get Second Adult Rebate if you have someone living with you who is on a low income, for example a parent, or adult son or daughter or a friend. But, if you have a partner living with you, or someone who is jointly liable for the council tax, or who pays you rent or board, extra rules apply. His council tax bill is 1,400 a year. Qamal earns too much to get Council Tax Benefit. Rubina gets Retirement Pension, a private pension and Pension Credit. Qamal gets 25% off his bill, an amount of 350, because his mother gets Pension Credit. 5

6 How to claim Council Tax Benefit or Second Adult Rebate Get a claim form from your local council offices. If you are making a new claim for Income Support, incomebased Jobseeker s Allowance, income-related Employment and Support Allowance or Pension Credit, JobCentre Plus or the Pension Service should also take your claim for Council Tax Benefit. Backdating An award of Council Tax Benefit is normally paid from the date you claim. But if you or your partner are over the qualifying age for Pension Credit (see page 3) your award should be backdated for up to 3 months provided you qualified for that period. If you claim Pension Credit and get a backdated award of the guarantee credit you should also get an award of maximum Council Tax Benefit backdated to the same date. You may need to check that the council has done this. If you are aged under the qualifying age for Pension Credit your Council Tax Benefit can be backdated for up to 6 months if you have a very good reason for not claiming at the right time. For example, you were ill and there was no-one to help you. Or perhaps you are unable to manage your own affairs. Tell the council on your claim form that you want your claim backdated. Get advice if you are turned down. 6

7 Council Tax Benefit There are other ways to pay less council tax You may be able to get your council tax reduced whether or not you qualify for Council Tax Benefit, for example if someone in your home is sick or disabled or a carer.
