1 P 3.9 Million Seafarer Awarded to Press Release Regional Branch No. NCR April 19, 2016 Regional Conciliation and Mediation Board NCR Director Teresita E. Audea announced recently the labor dispute between Antonio A. Cabidog and Alpha Ship Management Corporation after they have settled the case on March 31, On October 21, 2015, Mr. Cabidog filed a Notice to Arbitrate case against the said manning agency to seek payment of total and permanent disability claim. The case was assigned to Con-Med Helena R. Flores who facilitated the conduct of several conferences with the parties to convince them to settle. However, the parties opted to submit the issues to voluntary arbitration (VA) on February 23, The conciliation conference continues even the parties are still in the process of deliberation on the selection of a Voluntary Arbitrator that will handle the case. However, the conciliation efforts of the branch generated positive results and eventually led to the settlement of the dispute and the granting of P3.9 million as monetary award. Ako po ay lubos na nagpapasalamat kay Con-Med Flores dahil talaga naman po na mas maayos pa rin ang kasunduan kaysa sa isang desisyon mula sa voluntary arbitrators, Cabidog said. Hindi ka pa sigurado kung mananalo ka sa kaso o hindi at kung hanggang kalian ka maghihintay na matapos ito, he added.

Aguirre RCMB-NCR Settles Labor Disputes Two (2) Press Release Regional Branch No. NCR April 12, 2016 Two water-proofing installer and a project manager were paid a total of Php 97, in monetary benefits after the Regional Conciliation and Mediation Board National Capital Region settled separate complaints through the Single Entry Approach (SENA) Program, Director Teresita E. Audea announced today. Audea, in her report to Executive Director IV Shirley M. Pascual, said that the two installer Mssrs Salvador Aceron, Jr. and Jonel Felicilda, who used to work with Century Limitless Corp. in Manila filed a complaint on March 22, 2016 for illegal dismissal and non-remittances of SSS & Philhealth premiums. On 06 April 2016, the parties reached an agreement after the complainants accepted the offer of management. Aceron and Felicilda were paid not only of their salaries amounting to Php 5, each for March 18-31, 2016 but also, they were reinstated through transfer to AFINES, Inc. effective 01 April 2016.
3 In a related situation, the complaint of Mr. Eugenio M. General, Jr. was settled after he accepted management s offer of Php 87, for his claims on separation pay on 06 April General, who was employed as project manager in one of the projects of DM Wenceslao & Associates, Inc., seek the assistance of the RCMB-NCR on March 11, 2016 on forced resignation issue. The settlement of the foregoing SENA Request for Assistances once again prevented a complaint from reaching the dockets of the NLRC, Pascual said. Had these SENA cases not been promptly attended to, the parties may be forced to square-off before the labor arbiter, Pascual added. She commended Con-Med Helena S. Flores for her efforts in helping the parties to find solution to their problems. END/ Renato R. Cañutal and Diadema A. Aguirre PLDT, Union, ink P2 Billion CBA PRESS RELEASE April 12, 2016 Executive Director Shirley M. Pascual announced today the settlement of the Notice of Strike involving Philippine Long Distance Telephone Company (PLDT) and its union, the Manggagawa ng Komunikasyon sa Pilipinas (MKP) -Rank-and File employees. Pascual said the parties reached settlement on April 9, 2016,
4 paving the way for the conclusion of negotiations for the last three years of their Collective Bargaining Agreement (CBA). On November 2, 2015, the Manggagawa ng Komunikasyon sa Pilipinas Rank-and file employees, filed a Notice of Strike with the Regional Conciliation and Mediation Branch NCR, on account of CBA deadlock on economic and non-economic benefits. Pascual said the CBA will benefit 1,174 workers with estimated economic package worth P2 Billion. The agreement retroacts to November 9, 2015 and expires on November 8, The agreement provided for a wage increase of P3,300/month for the 1st year effective November 2015, P3,000/month effective November 2016 for the 2nd year and another P3,000/month effective November 2017 for the 3rd year. Other features of the agreement include gift certificate per covered employee, funeral assistance (death of spouse or any legitimate dependent/children), environmental funding assistance, educational trust fund, per diem of P1,000 per day, safety shoes, group insurance plan with double indemnity in case of death due to accident and additional seventy two (72) man-hours union leave per month for legitimate union activities. The company also agreed to hospitalization benefits for dependents and prescription eyeglass subsidy for the three year term of the CBA. Each member of the bargaining unit also received a one-time lump sum CBA conclusion bonus worth Twenty Five Thousand (P25,000.00) plus 65% of the covered employees monthly salary as of November 8, Pascual congratulated the conciliating team composed of Conciliator-Mediators Estelita S. Bautista and Rowena M. Gutierrez, Directors Jay Jasper B. Javines and Teresita E. Audea for expediently resolving the deadlock through the
5 conduct of an extensive conciliation-mediation conferences. Executive Director Pascual praised the efforts of the conciliating team in effecting amicable settlement to the dispute, and lauded the parties for choosing a peaceful settlement rather than pushing through with a strike. The agreement also manifests the trust and confidence of the parties on objectivity an d sense of fairness. Tirao, negotiating panel chairman. The forum was attended by media people from various television, radio station and media companies like ABS-CBN channel 3, E Media MO! Broadcasting, the Philippine Information Agency (PIA), Radyo ng Bayan, RPN News 5, and Daily Zamboanga Times. Regional Conciliation-Mediation Branch No. IX, Director Reynaldo R. Foncardas who attended and presented the Branch s 2015 accomplishments of its major core program in the prevention and settlement of labor disputes, as well as its plans and targets for He also reported the Branch s
7 participation in the creation of Zamboanga Federation Industrial Peace Advocate (ZAMFEIDA), 10th National LMC Convention and the convergence activities with the DOLE RCC. During the open forum, Director Foncardas advised employees to file their issues and complaints before the DOLE or NCMB when asked about grievances arising from employer-employee relationship. The DOLE RCC and E-media Mo! sign a Memorandum of Agreement (MOA) wherein E-Media Mo! gives DOLE RCC a free one-hour program slot every Thursday afternoon for a period of one year. With the signing of MOA, the media becomes a partner of DOLE in its advocacy to promote harmonious relationship between employers and workers and settle issues through the SENA program. E-Media Mo will have a key role to play in promoting the DOLE programs, clarifying and answering queries on labor issues from callers.

Pascual of the National Conciliation and Mediation Board (NCMB) commended Director Foncardas for his participation and active involvement in the activities of the DOLE RCC. She also acknowledged the E-Media Mo! for its role in giving the promoting the Board s programs and activities in Region IX. PRESS RELEASE April 28, 2016 Four hundred twenty workers of the Siliman University Medical Center Foundation, Inc. Employees Union- ALU-TUCP stand to benefit from the settlement of the notice of strike filed by their union against Siliman University Medical Center Foundation, Inc. after the settlement of notice of strike/lockout case last April 14, 2016 RCMB-VII Officer-incharge Gemma R. Poloyapoy yesterday said. In a report to NCMB Executive Director Shirley M. Pascual, Poloyapoy said the parties have agreed to a settlement package
9 worth P8.4 million on April 14, The signing of the agreement was the outcome of the 2nd marathon conference held at DOLE Negros Oriental Provincial Office, Dumaguete City. The agreement includes wage increases of P 1,000/month for 2016, and P 500/month for 2017 and took effect on January 1, The union filed a notice of strike on March 21, 2016, on grounds of bargaining deadlock specifically on salary increases for 2016 and 2017, funeral assistance/mortuary aid, service recognition award and annual physical examination. The union also alleged the company of unfair labor practice particularly on discrimination of wage increase which resulted to unjust disparity of wages between the rank and file union members and non-union members. Pascual commended RCMB VII Conciliator-Mediator Paciano L. Murro, Jr., for his effort in facilitating the settlement. With this agreement, a strike was averted and the parties were assured of a continued harmony in the workplace, she said. Silliman University Medical Center Foundation is a non-stock, non-profit hospital and is located at Aldecoa Road, Daro, Dumaguete City. It has approximately 439 employees. The union represents the 420 workers in the bargaing unit. It is affiliated with ALU-TUCP and is headed by Ms. Edelyn Obedencio, union president./ Diadema A. Aguirre & Remus M. Caducoy. 10 Receives Monetary Through SENA Claims GOOD NEWS April 11, 2016 A Customer Service Officer received a total of P54,000 in separation and other benefits following the resolution of his complaint through the SENA. successful Mr. Conrado R. Macaraig, Jr. dismissed after working for 12 years at Steel Puyat Steel Corporation in Don Chino Roces Extension, Makati City, filed a complaint for illegal dismissal, non-payment/underpayment employer last March 7, of wage against his Regional Conciliation and Mediation Branch NCR Director Teresita E. Audea, in her report to Executive Director Shirley M. Pascual, said the complaint of Mr. Macaraig was settled on April 1, 2016, after 3 conciliation meetings presided by Conciliator-mediator Helena R. Flores. Pascual commended RCMB-NCR Conciliator-mediator Helena R. Flores for facilitating the settlement. Mr. Macaraig received the amount of P54,000 as full settlement of his claims as well as his Certificate of Employment. His case is just one of the 1,034 Request for Assistance handled by the RCMB-NCR under the SENA program for the first quarter of SENA is a 30-day mandatory conciliation-mediation which seeks to provide a speedy, impartial, inexpensive, and accessible settlement service for unresolved grievances and complaint arising from employer-employee relations.
11 Under these scheme, complaints are processed thru conciliation as the initial step. If the complaint is not settled within 30 days, the same is referred to the appropriate office department. Aguirre Waitress receives financial assistance through SENA Good News April 26, 2016 A waitress receives P40,000 as financial assistance after the Regional Conciliation and Mediation Branch IX resolved her complaint against her employer through the Single Entry Approach (SENA). RCMB Director Reynaldo S. Foncardas, in his report to NCMB Executive Director Shirley M. Pascual, said today. Ms. Edna P. Tolorio, a waitress who worked at Zalo s Restaurant for 12 years filed a complaint for unpaid service incentive leave, non-payment of overtime and 13th month pay against her employer last April 11, Pascual said the parties reached amicable settlement when Mr. Mark Vincent Uy, manager of Zalo s restaurant appeared in a conciliation conference on April 18, Dir. Foncardas, said Mr. Uy offered a financial assistance of P40,000 as full settlement of her claims in which the complainant readily accepted. Pascual commended the worker for availing the SENA program and
