1 The Police News VOLUME IX, NUMBER 11 Galveston County Edition November 2012 I fired twice. The driver fell to the ground. He was twenty years old. By Ed Lucas as told to Breck Porter Ed Lucas I was watching the news We d n e s d a y a f t e r n o o n, March 26 at 4 PM. Suddenly the newscaster switched to a helicopter reporter covering a police pursuit in Southwest Houston. The chase lasted over thirty minutes. I watched as at least three innocent drivers sustained extensive damages to their vehicles and injuries. Watching this pursuit took me back to November I was the night shift patrol sergeant in the East District of Harris County. I had been with the Harris County Sheriff s Office for six years and a patrol sergeant for almost a year. It was deep into the night as I ate my fast food meal at the McDonald s at I-10 and Sheldon Road. I had a ride along civilian passenger that night, a female Sheriff s dispatcher. A calm voice belonging to a seasoned dispatcher came over my handheld radio. The broadcast was to alert all deputies in the East District that the Houston Police Department was in a high-speed pursuit of a pick-up that had been firing a handgun at motorists traveling on I-10. The chase was coming straight down the freeway towards my location. As I listened to the dispatcher, I began to get a feeling of excitement just listening to the broadcast. The suspect vehicle is approaching Uvalde heading east, any units clear and close to assist Houston as needed, respond. I looked at my ride-along. Her eyes were wide with anticipation. I, however, knew that it was against department policy to get into a pursuit with a civilian onboard. The chase continued towards my location. We left the McDonald s and got on I-10 just east of Sheldon and waited. As I sat in my 1982 Chrysler patrol car with my passenger, I did not think about the danger of a high-speed pursuit. I did not think about what disciplinary action the department would take against me if I got involved in a chase with a civilian onboard and I certainly did not think about how the final outcome would alter certain lives. As the fleeing pick-up truck sped past my vehicle I waited until the last unit cleared before I fell in behind the pursuit. The dispatcher relayed information that shots were being fired from the fleeing vehicle towards the pursuing officers. My emotions jumped to a higher level. I advised the dispatcher that I was involved in the pursuit, and I would take command of the Sheriff s units and I would call the pursuit. I believe there were three Houston units, one DPS unit and three Harris County units involved in this eastbound pursuit in excess of 70 miles per hour. I am sure there were more but I didn t see them. I saw the fleeing vehicle swerve across all three lanes trying to take out any police vehicle that got too close. This maneuver happened time and time again. I observed shots being fired from the pursuing units. The fleeing vehicle got off the freeway at the Highlands exit. The pursuit went through the entire community of Highlands. Hairpin turns, U -turns, running red lights, stop signs, wrong way, through yards and ditches, this pursuit was like none other I had been involved in. My pulse rate and adrenalin flow must have been off the chart. When the chase finally got back on the highway after going through Highlands, somehow I had become the second chase car and the DPS was the lead vehicle. I observed the trooper on the passenger side firing at the fleeing vehicle. The DPS car was parallel to the suspect when I saw the brake lights blink on and off on the fleeing vehicle. The suspect slammed on his brakes and the DPS car flew past him. I was able to stop my car beside and to the rear of the suspect. I jumped out of my car and positioned myself by my right rear fender. I had my.357 Smith, leveled at the driver s side door. I screamed for the driver to show me his hands and stay in the vehicle. He did not. As the other police vehicles were coming to a stop and the DPS car was backing up, the driver s door burst open and the driver lunged in a crouching position from the vehicle. Without hesitation, I fired twice. The driver fell to the ground. He was pronounced dead later at Hermann Hospital. He was twenty years old. Besides shooting a gun at motorists the vehicle he was driving was reported stolen. There was an extensive search conducted, however, no gun was found on the suspect or inside the truck. Later, divers searched the San Jacinto River but no weapon was ever found. The investigation concluded that the gun must have been thrown from the fleeing vehicle during the pursuit. What the driver s intention was, when he lunged from the pick-up, I will never know. I know that at that particular point in time I thought he had a gun and he would use it on me and the other officers. The chase and the outcome was frontpage news for several days. Assistant DA, Terry Wilson, Harris County Sheriff s Detective Lieutenant Grace Hefner and Detective Ed Kroschel as well as Houston detectives and DPS investigators spent countless hours investigating, interviewing witnesses, listening to all agency dispatcher tapes and conducting SCUBA dives before the case was presented to a Grand Jury in I was no billed. The FBI looked at the case and came to the same conclusion. Based on the information I had at the time, the emotional state, the adrenalin rush, the way he came out of his vehicle and it being night time, I have never second guessed what happened that fateful night. Naturally when it was discovered there was no gun I felt different. In my opinion drivers who flee from the police and endanger innocent lives are using a deadly weapon, the vehicle. Police officers should be able to use deadly force, when practical, to terminate the chase before innocent livesare lost. Safe Online Surfing New Cyber Safety Website for Teachers, Students With school back in session, one topic that s on many class curriculums around the nation is cyber safety. After all, it s a hyper-connected world with texting, social networking, e- mail, online gaming, chat, music downloading, web surfing, and other forms of wired and wireless communication now a regular part of children s lives. The FBI has a new program that can help. Today, as part of its longstanding crime prevention and public outreach efforts, the FBI is announcing a free web-based initiative designed to help teachers educate students about cyber safety. After entering the FBI-SOS website, students travel to their grade-specific island, which includes either seven or eight learning portals to visit. These areas address topics such as the protection of personal information, password strength, cell phone safety, social networking, and online gaming safety. The videos also include real-life stories of kids who have faced cyber bullies and online predators. Visit SOS. It s called the FBI-SOS (Safe Online Surfing) Internet Challenge and it was developed with the assistance of the National Center for Missing & Exploited Children and with the input of teachers and schools. FBI-SOS is available through a newly revamped website at The site features six grade-specific islands for third- through eighth-grade students highlighting various aspects of cyber security through games, videos, and other interactive features. Each island has either seven or eight areas to explore with a specific cyber safety lesson and its own central character and visual theme. For example, fourth grade features Ice Island, complete with falling snow and penguins. To encourage participation and enhance learning, FBI-SOS includes both testing for students and competition among schools. Each grade level has its own exam, which can only be taken after teachers have signed up their respective classes and all activities on the island have been completed by each student. And once all the exams for a class are graded (done electronically by the FBI), schools appear on a leader board in three categories based on the number of total participants. During each rating period, top scoring schools in each category nationwide are awarded an FBI- SOS trophy and, when possible, receive a visit from a local FBI agent. All public, private, and home schools are eligible to participate. For teachers and schools, FBI-SOS provides virtually everything they need to teach good cyber citizenship: A free, ready-made curriculum that meets state and federal Internet safety mandates Age-appropriate content for each of the six grade levels; A printable teacher s guide that spells out how teachers can sign up their classes and use the site; and Detailed rules and instructions for students. The Safe Online Surfing (SOS) website is the second tool the FBI has launched over the past year to help protect kids. The other the FBI Child ID app provides an easy way for parents to use their Smartphones to store pictures and information on their kids in case they go missing. Learn More Can anyone visit the website? Absolutely. Kids of all ages and even adults can explore the site, play the games, watch the videos, and learn all about cyber safety. However, the exam can only be taken by third- to eighthgrade students whose classes have been registered by their teachers. An important note: the FBI is not collecting student names, ages, or other identifying information through the website. Students are identified only by number when taking the exams; their teachers alone know which number matches which student. And teachers only need to provide their name, school, and address when signing up. The address is needed to verify the teacher s identity for registration purposes. FBI-SOS is a fun, free, and effective way to teach kids how to use the Internet safely and responsibly, says Scott McMillion, head of the unit that manages the program in the FBI s Criminal Investigative Division. The year-long program is aimed at preventing deaths and injuries on local roadways by focusing enforcement actions on speed violations and impaired drivers. The $70, grant award funds will cover the cost of hiring off-duty officers to work the year-long traffic initiative. The program will run from October 2012 to September 2013 and will cover sections of IH-45, Seawall Boulevard and Harborside Drive. Traffic surveys were conducted on all three roadways which revealed that the speed compliance rate was well under 40%. The Impaired Driver portion of grant will cover the entire island. On September 30, 2012, the Galveston Police Department ended a similar type grant awarded by the Texas Department of Transportation which yielded the following results: Grant Period: Oct. 1, 2011-Sept. 30, 2012 Hours Worked: 912 Speeding Citations Issued: 1,757 DWI/Impaired Driver Arrest: 72 Other Citations Issued: 301 Voters and candidates should continue supporting lawsuit reform In an increasingly divided electorate, it s rare to find issues that bridge the partisan divide. So, it might come as a surprise to know that in a recent national survey by the American Tort Reform Association and the Sick of Lawsuits campaign, an overwhelming majority (89 percent) of Americans agree that lawsuit abuse is a problem. The concern over lawsuit abuse cuts across partisan lines. And, as the November election approaches, nearly three-quarters of the survey s respondents said they are more likely to support a candidate who favors reforms to reduce abusive lawsuits. Here in Texas, we ve seen firsthand how reform works, as landmark lawsuit reforms have done much to improve our business climate, create jobs and ensure our courts are used for justice, not greed. It is time for voters to weigh in again this November and for candidates, across the nation and party lines, to listen and act in support of jobs, not lawsuits. Jennifer Harris, Citizens Against Lawsuit Abuse of Central Texas HUMOR Drinking and driving The Environmental Engineering News published some rather sobering information about punishment for drunk driving convictions in other countries. In Australia, the names of drunk drivers are printed in newspapers under the caption, He s drunk and in jail. In Malaysia the driver is jailed and, if married, the spouse is jailed. In the United Kingdom, Finland and Sweden there s an automatic jail term of one year. In Turkey, drunk drivers are driven twenty miles out of town and forced to walk back ten miles. In Bulgaria, a second drunkdriving conviction results in capital punishment. In El Salvador, your first offense is your last -- execution by firing squad. Woman chases visitors with pooper scooper Nobody was hurt when a woman chased two people out of her house with a pooper-scooper. Davenport, Iowa police officer Robert Bytnar said police were called to a house on West 10th Street on a report of a woman who had attacked someone with a pooper-scooper. Officer Bytnar said police were told that a man and a woman had overstayed their welcome at the house, so the owner chased them out with the pooper scooper. As the two ran from the house, police said they dropped a collection of Beanie Baby toys. Police later escorted them from the spot where they dropped the toys to a storage facility where they would be secured. Officer Bytnar said that while the pooper-scooper was not loaded, it still was dangerous. We believe it was empty, but it had residue on it, he said. No arrests were made. The Police News - Page 3

TEXAS EXECUTIONS UPDATE: Execution Stayed Then Carried Out UPDATE: The U.S. Court of Appeals overturned the stay of execution and Jonathan Green was executed on Oct. 10. Earlier: Jonathan Green was scheduled for execution in Texas on October 10, but a federal judge issued a stay because the state did not afford him due process in examining his mental competency. U.S. District Court Judge Nancy Atlas said, It is clear from the record that, at a minimum, the trial court prevented Green from presenting testimony by treating mental health professionals, relied on an order solicited from and drafted by the state to which Green had no opportunity to object, and applied at least one incorrect legal standard. Green s lawyers argued that the Texas competency hearing was so abrupt that medical personnel from Jonathan Green the Texas Department of Criminal Justice, who had treated Green, were not available to testify. James Rytting, one of Green s defense attorneys, said, Mr. Green is seriously mentally ill; he suffers from schizophrenia and constant hallucinations. Rytting added that Green s condition has worsened while on death row because of lack of adequate treatment. Green was put to death for the abduction, rape and strangulation of 12-yearold Christina Neal who was snatched as she walked home on June 21, 2000, in Montgomery County, about 60 miles north of Houston, according to the attorney general s summary of the case. Investigators became suspicious of a neighbor, Jonathan Green, after they learned he had been burning trash soon after the girl s disappearance. They obtained a warrant and searched his property, discovering a shallow grave. Inside the house, tucked behind a chair, they found Christina s body stuffed inside a bag. Killer of two scheduled to die Nov. 15th Preston Hughes, III, now 45, was convicted and sentenced to death in Houston for the 1988 murders of fifteen-year-old Shandra Charles and her three-year-old cousin, Marcell Taylor. At Hughes s 1989 trial, the State presented evidence that Hughes stabbed both of the victims in the neck and chest, severing their aortas and jugular veins. W h e n the police arrived at the scene, S h a n d r a C h a r l e s was still alive. She told a police officer that a man Preston Hugues III named Preston had stabbed her after trying to rape her. The police officers went to an apartment complex near the vacant field in which they were found. The manager of the complex gave them a list of tenants. The only tenant named Preston was Preston Hughes, III. The officers went to Hughes s apartment around 2:30 a.m. He agreed to accompany them to the police station, where he later gave two written statements admitting that he had stabbed both victims. In the first statement, Hughes said that he had been carrying a knife with him because some people had been talking about trying to kill him. He said that, as he was w a l k i n g h o m e through the vacant field, s o m e o n e came up behind him and touched him on the shoulder. He said he turned and just started sticking with the knife. It was dark, and he couldn t tell who was there, but after he stuck the first two times, he saw that it was Shandra Charles (He called her Shawn ). He said, I was f***ed up and I just got scared and kept sticking. In the second statement, he said Shawn did not come up behind him and tap him on the shoulder, as he had said in his first statement. Instead, he said he saw her walking with a little boy. He said when they met in the middle of the trail through the field, she told him she was on her way to his apartment to borrow his contact lenses. When he told her she was not going to wear his contacts, he said she kissed him, and then started rubbing his crotch. He described in detail the events that occurred next. He said heavy sexual activity followed, which became unsatisfactory to him. When Shawn demanded money, he refused. She threatened to accuse him of rape and when she hit him, he pulled his knife and began stabbing her. Texas Executions...Cont. on pg 6

5 Webster cop collects nearly half million from drunk driver Driving drunk is bad. Hitting a police care while driving drunk is really bad. But hitting a police car in injuring the officer who is driving the police car, who also happens to be a lawyer, is the worst case scenario. At shift change, Officer George Schilter, who is also an attorney, was ending his shift and turning into the police parking lot from State Highway 2 in Webster, Texas, when he says, Suddenly the police car lurched forward and things began to come apart. I was absolutely surprised. When the police dispatcher broadcast a horrendous crash at the rear of the station, I instinctively reached for the mike to take the call. There was no mike. It wasn t where it was supposed to be. Later I determined the mike had become a flying missile and parted my hair. I was wearing a vest and seat belt and still had a major bruise across my chest. My Ford Expedition was demolised. I suppose I was fortunate the vehicle absorbed a great deal of the energy of the crash. After forcing the door open, Schilter was able to step out of his mangled Expedition and see the vehicle that had just hit him. The driver was still sitting behind the wheel and the engine compartment was literally gone. The vehicle was filled with air bag smoke. Schilter went to the driver who was fixated and looking straight ahead with his hands still on the steering wheel. Schilter could see through the smoke that there was a person in the passenger seat and the dashboard was in the seat with him. The officer, making his way to the passenger door, went behind the vehicle and saw the rear of it completely missing. Later it was determined the impact had caused the rear of it to raise up and land in the opposite lane of traffic where it was smashed into by a passing truck and torn from the vehicle. This was the third time the officer/ lawyer had been hit by a drunk driver while on duty and the fifth collision he had been in during his long driving career. All had been in police cars and all, but one, had been the other drivers fault. The last he had been involved in was while he was in pursuit of a drunk driver who was driving without headlights and on a flat tire. In that crash, Schilter made a sudden stop and backed into a vehicle behind him. In considering his options in this case, Schilter engaged the services of long time friend and personal injury attorney, Steve Waldman. I told Steve I was tired of getting hit by drunks and I wanted to make an George Schilter example of this one. I wanted to sue for punitive and exemplary damages. Steve agreed and a suit was filed in the State District Court in Houston, Harris County. Schilter explained, The success in winning a punitive, exemplary damage case is the preparation and the building of the facts. Just like the criminal case in which the elements of a crime have to be proven, the facts in this civil case must rise to the same level of civil proof. Initial settlement offers by the defendant were woefully inadequate, even for the injuries suffered. The City of Webster was reimbursed for the total loss of the police care and the injuries were covered by Workman s Compensation Insurance. Developing the facts became a very important part of this case, Schilter explained. We were able, through the defendant s deposition, to have him admit he was driving his wife s company car, with her permission, and both of them had been consuming alcohol over several hours. Thus he had committed all the elements of a felony assault. Although he was not charged with a criminal offense, he nonetheless admitted the elements and raised the settlement stakes. Additional considerations were developed. During the rehabilitation phase of his treatment it was discovered Schilter had Carpal Tunnel Syndrome in both hands. Initially his treating workers comp physician did not relate that malady to the collision. However, after consultations with Dr. James Stafford of the Baylor College of Medicine in Houston, and the fact that he had no previous symptoms of the syndrome, the problem was determined to be related to the trauma of the collision. The lawsuit was amended twice. Each time additional information was discovered it increased the potential liability of the defendant. Boxing management firm alleges protégé refused to perform, abused steroids GALVESTON Bad Boyz Inc. alleges an El Paso boxer it managed failed to honor a contract between them. A lawsuit filed in Galveston County District Court claims amateur fighter David Rodriguez Jr. turned down potential challenges and engaged in conduct detrimental to his ability to perform, stating such acts violated their agreement. The boxer s parents, David Rodriguez Sr. and Patricia Rodriguez, join their son as co-defendants in the case. Bad Boyz explains that the younger Rodriguez had aspirations of fighting in the professional circuit and turned to it in hopes of developing his craft. Both parties executed a renewable contract in February Under the agreement, Bad Boyz Inc. consented to exclusively manage and represent Rodriguez Jr., provide him with adequate gym and training facilities, locate and schedule matches and to further his professional boxing career in whatever manner possible. Meanwhile, Rodriguez Jr. agreed to fulfill any contracts entered into on his behalf by Bad Boyz, to not participate in hazardous or potentially dangerous activities and to attend necessary events including but not limited to training exercises and medical examinations. He was paid a signing bonus of $30,000 over the first 30 months of the agreement. Bad Boyz, Inc. says it expended countless hours and sweat and spent more than $400,000 developing Rodriguez Jr. as a professional athlete, however, he has not performed as agreed. The one-time protégé refused to accept fights against formidable foes on several occasions, drank excessively and abused steroids, the lawsuit argues. Bad Boyz adds several promoters around the country knew of Rodriguez Jr. s purportedly destructive lifestyle and would not include him on cards, which caused it to instead arrange fights in Mexico. His parents are believed to have played a significant role in the decisions that he had made in connection to his boxing career, the suit says. Galveston County 212th District Court Judge Susan Criss is presiding over the case. When the boy ran between him and Shawn, he stabbed the child several times. Marcell Taylor At the guilt-innocence phase of the trial, Hughes took the stand in his own defense. He denied he killed the two and claimed he was framed by the police. He testified he confessed to the killings because the police beat him and threatened him, causing him to fear for his life. The jury found him guilty of capital murder. At the punishment phase, the State called Tracy Heggar. She testified Hughes had raped her in 1985, when she was thirteen years old and had threatened her with a gun in an attempt to prevent her from testifying against him about the rape. The State also presented evidence that, at the time of the murders, Hughes was serving two ten-year probated terms for the aggravated sexual assault and aggravated assault of Heggar. The defense called several witnesses. Six of Hughes s friends and his mother testified that he was a good-natured, non-violent person. He testified in his own behalf at the punishment phase denying he raped or threatened Tracy Heggar. He professed sorrow for the deaths of the victims, but denied he committed the murders. He promised the jury that he would not be violent in the future and asked the jury to spare his life. They sentenced Hughes to death. Needle will end life of rape, murder and mayhem Ramon Torres Hernandez was indicted in Bexar County, San Antonio, Texas on one count encompassing several crimes, including killing Rosa Rosado in 2002 as part of a common course of conduct along with killing two middle school girls in 1994, in the course of an aggravated sexual assault, in the course kidnapping and robbing her. In the common scheme of the one-count indictment, two middle school girls, Sarah Gonzales and Priscilla Almares, were abducted in San Antonio in December The next day, their bodies were found in the brush by a road. Both had been sexually assaulted and asphyxiated. An anal swab of Gonzales found sperm, but a vaginal slide found none. DNA testing could not match the sperm at the time, but a 2001 test showed Hernandez s DNA was a match. Rosado disappeared in San Antonio in March According to H e r n a n d e z s c o n f e s s i o n, Ramon Torres Hernandez while driving with his girlfriend, Abel Abdygapparova, Hernandez, and Santos Minjarez saw Rosado at a bus stop. 7 Texas Executions...Cont. from previous pg. Minjarez tried to grab her purse, and when she resisted, he pulled her into the car and covered her head, and Hernandez drove away. They stopped at Hernandez s house to get tape to bind Rosado, gagged her, and went to a motel, where she was raped and killed. Her body was cleaned using bleach and a douche. Abdygapparova was sent to get a shovel, which was used to bury the body. Hernandez and Abdygapparova took Rosado s possessions and items used to cover her and burned them or dispersed them by tossing them from the car as they drove after her death. Two crucial statements were made to police. Abdygapparova provided a written statement of the abduction, robbery, sexual assault, and murder of Rosado. She also led police to the body, the motel where the events occurred, and the car she had sold after using it in the crime. Although Hernandez initially denied participating and asked for an attorney, thus ending his first interrogation, the next day he asked to speak to the detectives again. He gave a statement confessing to participation in the crime but saying it was Minjarez who had raped and killed Rosado. A jury found Hernandez guilty of the crimes charged in the indictment, and he received a sentence of death and is scheduled to die by lethal injection in Huntsville on November 14th. He will be 42 years and one week old, having been born November 8, His previous criminal history consisted of an 18-year sentence for three counts of Burglary of a Residence with Intent to Commit Theft One occasion involves Hernandez entering a residence and forcing a 21-year old Hispanic female into intercourse, with injuries involved. He was released on parole on June 11, Liar, liar, can t lie to the needle On December 28, 2002, 44 year old Lola Nixon s friends called the police after she did not show up for dinner the night before and they could not locate her the next day. Police went to Nixon s house on Iris Circle in Longview, Texas, and discovered evidence of forced entry and blood throughout the house. Police focused Mario Swain their investigation on a truck that one of Nixon s neighbors said was parked in front of a vacant house on Nixon s block the night before. The truck was registered to Mario Swain s grandfather, and when investigators spoke with him, he told them his grandson had been using the truck. Detective Terry Davis spoke with Swain on the phone, and Swain told him he could come speak with him where he worked, at a residential treatment center. Detectives Davis and Jim Nelson drove to the address Swain had given and Swain s grandfather s truck was parked in the driveway. Swain came out and met them in front of the open garage door. They asked him why his truck was seen parked on Iris Circle the night before, and Swain told them that he had gone riding with a friend and ended up parking his truck there. One of the detectives told Swain that this was his opportunity to come clean, which prompted Swain say, the night before, he and a friend, Casey Porter, broke into a house on Iris Circle and when the owner came home, Porter attacked her. They put the woman, who was alive but unconscious, in the trunk of her car and drove to a remote location near the airport where they left her. Swain took the detectives to the place where he said he and Porter had left the woman. Swain rode in the back of the detectives car and directed them to a field where they discovered blood, a black trash bag, and a piece of a tire jack, but they did not find Nixon. Detective Davis testified in court he did not recall handcuffing Swain at any point while they were at Swain s workplace or while Swain rode in their car, and that he administered Miranda warnings to Swain when he got into the detectives car. Detective Nelson testified that he handcuffed Swain at some point when we were in the garage talking and at that point, we told him we were going to detain him. The detectives then took him to the Longview Police Department. There, he was read his Miranda rights again and he gave several written statements. In his first statement which included an acknowledgment that he had the right to remain silent and not make any statement at all and... the right to have a lawyer present Swain admitted that he participated in burglarizing Nixon s house, but accused Porter alone of assaulting her. Police arrested Porter, but soon discovered that he had an alibi. The detectives confronted Swain with this information and after they informed him of his rights again, Swain provided a second written statement. This statement also included an acknowledgment that I have the right to remain silent and to have a lawyer present. Swain again admitted to participating in the burglary; however, this time, he claimed a man named Brian Mason Woods was his accomplice and that Woods had assaulted Nixon. As with Porter, police questioned Woods and discovered that he had an alibi. Several hours later, Swain was charged with burglary of a habitation and was taken before a magistrate who read him his rights in accordance with Texas law. Swain was then taken to the district attorney s office where a different detective and an investigator with the DA s Office questioned him. He agreed to lead them to Nixon s body, and directed them to a vehicle containing her corpse that was close to where he had first led Detectives Davis and Nelson. Nixon had been beaten over the head and stabbed in the chest. The medical examiner ruled the cause of death was homicidal violence, including sharp force injuries, blunt force injuries, and probable strangulation. After disclosing the location of Nixon s body, Swain was taken back to police headquarters. There, Detective Davis read him his rights again and Swain gave a third written statement. As with the previous two, this statement included an acknowledgment of the right to remain silent and the right to have a lawyer present. This time, Swain admitted that he had committed the burglary on his own. He also confessed the burglary ended in a struggle with Nixon when she returned home and that he bludgeoned her with a tire tool and placed her semiconscious body into the trunk of her car and drove her to a field where he left her while she was breathing but barely conscious. Then he returned to her home where he stole her money, jewelry and credit/debit cards. Later, police found the tire tool that Swain had used to bludgeon Nixon; they also searched Swain s truck and found clothing with Nixon s blood on it and Nixon s car keys and garage door opener. Swain was tried for capital murder and, over his objection, his several statements were introduced against him. After a three-day trial, a jury found him guilty and sentenced him to death. The Texas Court of Criminal Appeals upheld his conviction and sentence; and the Supreme Court denied review. Mario Swain is scheduled to die by lethal injection in Huntsville, Texas on November 8, He will be 33 year old. VISIT US ON U.S. Marshals Add Homicide Suspect to 15 Most Wanted Felipe Alexander Torrealba is wanted for multiple crimes in various jurisdictions in Texas and Florida, including: homicide, aggravated battery of a law enforcement officer, possession with intent to distribute cocaine, trafficking oxycodone, unlawful flight to avoid prosecution, aggravated assault with a firearm and resisting officers with violence. Torrealba is wanted by the Felipe Alexander Torrcalba Broward County (Florida) Sheriff s Office for questioning in the murder of a 42-year-old man earlier this year. Torrealba is a violent 26-year-old male with an extensive criminal history dating back to He has previously been arrested for aggravated assault with a deadly weapon, carrying concealed firearms, battery, narcotics, larceny, fraud and failure to appear. Torrealba has eluded capture on at least three occasions. On Jan. 2, the Sweetwater (Florida) Police Department conducted a routine traffic stop on a vehicle driven erratically by Torrealba. The officers discovered the vehicle was stolen and the driver had outstanding warrants for narcotics and assault charges. Torrealba grabbed a weapon from the driver s side and fled from the scene in the stolen vehicle. In April, the Brownsville (Texas) Police Department conducted a traffic stop on Torrealba, who provided the officers with a Texas driver s license issued in his alias Jose Alberto Rodriguez and was released. In August, Torrealba departed a targeted location minutes before U.S. Marshals Service personnel arrived to arrest him. On Sept. 26, Torrealba was involved in an altercation with two off-duty Miami- Dade police officers. Following a verbal dispute, Torrealba reportedly produced a handgun and began firing at them. Both officers were unharmed and Torrealba managed to get away. Torrealba is a violent career criminal, who not only poses a threat to the public but to law enforcement as well, said David Harlow, Assistant Director of Investigative Operations for the U.S. Marshals Service. It is imperative we utilize all available investigative measures to immediately locate and arrest Torrealba before he has the opportunity to offend again. Neil K. 9 Crime Stopper Alert - La Marque La Marque Police are still seeking information on a robbery which occurred in April of last year. This is a police sketch of one of the robbers in an aggravated robbery that took place in the 1800 block of Main April 13th of last year at about 10:00 o clock in the evening. This man was accompanied by a second black man appearing to be in his 20 s and of average build, who may go by the alias of Twin. There was also a black woman appearing to be in her late teens or early 20 s who was thin with braided hair and having a male child 3-5 years of age with her. The trio s getaway car was a silver or gray 4-door sedan with spoke rims and a body style similar to that of a Buick or Ford. These three thugs were the last patrons at the Laundromat where the victim worked. The robber in this sketch got out of the vehicle and approached the victim as she went to her car after closing the business. He got in on the passenger side, pulled a pistol and made the victim drive to a nearby isolated side street where he robbed her of her jewelry, purse, cell phone and other items. He then ran off on foot rather than getting back into the getaway car. He is 5 09 and weighs close to 170 pounds. He has black hair and brown eyes. Torreabla has a tattoo on his neck with the word Jillian and has gold teeth. Torrealba is considered armed and dangerous. Bank robber stealing A man walked into the local bank and handed a teller a note demanding money. The man had one hand in his pocket, as if holding a gun, so the teller began handing over the contents of her cash drawer. When she had forked over $7,000 the robber said, That s enough and walked out the door. It s hard to find a bank robber who knows when he s got enough. John Pruitt for Sheriff of Galveston Co. By Breck Porter Since the beginning of our publication in 2004, The Police News has endeavored to not have a public position in politics and political races, our reason being that we must work closely with law enforcement in order to be effective in reporting police news. So, we must have the cooperation of police chiefs, sheriffs, constables and other officials, regardless of their political parties or philosophies. However, over the years we have witnessed case after case of politics determining the selections of police chiefs, regardless of qualifications. In some cities unqualified police chiefs have been appointed to the top position only because he or she was the hometown boy or girl, even when there was a long list of more qualified applicants. It s the good old boy rule and it is still alive and well everywhere, not just in Galveston County. In elective positions there is a better chance of getting a qualified person as sheriff or constable because it is we the people who make the selection and not a handful of politically influenced volunteer council members who rarely listen to feedback from voters acting instead on their personal bias. In the sheriff s race in Galveston County in 2012, there are two qualified candidates, both longtime veterans of the Galveston County Sheriff s Office, both capable, both with many friends and supporters. So the job of selecting one over the other, in our case, is influenced by who the candidates have surrounded themselves with and who has publicly announced support for them. It would be difficult for me to imagine a more influential endorsement of a candidate for sheriff than that of Galveston County Sheriff Freddie Poor, one of the most highly regarded and respected lawmen in Galveston County and beyond., not only as a lawman but as an individual as well. And how can one ignore the endorsement of Erin Sikes, mother of longtime missing Shelley Sikes, whose respect for an investigator in her daughter s case was made public when she said, during the time in my life every parent fears most, John Pruitt stood by my side every step of the way. In the years that I have been editor of The Police News, I came to know another legendary lawman. And when I say legendary I mean it in every sense of the word when it is used to describe Oscar Ekelund. Some years ago I had the honor to sit down with Oscar and Joyce Ekelund after they had been driven from their home by Hurricane Ike, and were living with a grandson, one of two who are Galveston Police Officers. From that visit came the story of how Oscar started his law enforcement career wearing a borrowed uniform and pistol. He and his story reminded me so much of my own father, a 33 year veteran of the Houston Police Department and before that a Texas Ranger. Both of these dedicated men remain with me in honor and sprit, having gone on to their just rewards. In her recent endorsement of Pruitt, Oscar s daughter, Mary, said: John shares the qualities used by others to describe my father. He is hardworking, fair, caring and a real cop s cop.
