1 Director Information for Applicants North Kensington Law Centre is seeking a new Director to lead and develop the organisation. You will be our voice in the community, to our funders and to the legal and voluntary sector. You will be a champion for vulnerable clients and a leader to our award- winning staff. Following government cuts to Legal Aid funding, the Law Centre has undergone a period of significant change in its sources of funding and its operational platform. Together with an engaged set of trustees, you will define the strategy for the organisation, develop our services and strengthen our solid financial platform. Title Main Purpose Salary Hours Accountable to Director SUMMARY JOB DESCRIPTION The Director is responsible for the overall management of the Law Centre, for fundraising, financial planning and communications and will work with the Management Committee (which comprises the trustees of the Law Centre) to develop the strategic plan. The Director s further responsibilities include implementing the Business Plan, staff supervision, office management and oversight of compliance and regulatory matters. 45,900 pro rata, plus matched pension contribution Full time or part time, by negotiation The Management Committee BACKGROUND TO THE ROLE The present economic and political environment has created greater need than ever for high quality legal services to help poor and vulnerable members of the community to assert their legal rights in relation to housing, immigration, employment and welfare benefits, to challenge discrimination and to avoid homelessness, poverty and crisis. Recent cuts to government funding for legal services have led us to seek and sustain new sources of funding, to develop innovative methods of service provision and to seek greater ties within the community and charitable sector. In recent years we have maintained breadth and quality in a wide range of service areas while increasing the efficiency of our operations and building a sustainable funding model. Recent developments include: New sources of income, including additional grants and earned income from casework The introduction of a triage function which has doubled the number of clients we help each year Page 1 of 11

2 A restructuring of the staff team which has focused our resources on high quality complex case work An office move and new IT systems which have reduced overheads Our current director is leaving the organisation after two years in post with a specific remit to oversee a period of significant operational and strategic development. Now that this has been achieved, we are looking for an experienced professional to fill this vacancy who can help to sustain our current levels of service provision and to develop and grow the organisation in line with our strategic objectives (further described in our Business Plan) and who will play a central role, together with the Management Committee, in defining the Law Centre s future direction. ABOUT NORTH KENSINGTON LAW CENTRE North Kensington Law Centre was founded in 1970 and was the first law centre in England to provide access to justice for the local community through the provision of high quality legal advice and representation. Now located in new offices near Latimer Road station, the Law Centre continues to focus on meeting the needs of the most vulnerable members of the community in North Kensington and beyond while providing a broad range of legal services and advice in the areas of housing, immigration, employment and welfare benefits. DETAILED JOB DESCRIPTION Accountability and management responsibilities The Director is accountable to the Management Committee (which comprises the trustees of the Law Centre), is directly supervised by the Chair and works closely with the Treasurer on all financial matters. The Director is expected to report to the Management Committee and the Finance and Personnel Subcommittee on a bi- monthly basis. The Director is responsible for the supervision of all staff and (together with the Senior Solicitor) for oversight of our caseworkers, volunteers, paralegals and trainees. The Director is supported by a number of non- legal staff, as detailed below under the heading Personnel matters. The Director is expected to manage the responsibilities of the job by delegation to other members of staff as appropriate. Page 2 of 11

3 Fundraising and partnerships The Director is responsible for developing and maintaining relationships with new and existing grant funders and partners in the community and charitable sector. In particular this will involve: Applying for grants and other means of funding new and existing services and developing the organisation in accordance with the strategy and Business Plan Identifying gaps in service provision and new services which the Law Centre could offer, either alone or in partnership with other organisations and developing appropriate funding strategies Together with the Chair and other trustees, building relationships with external stakeholders and supporters Keeping abreast of national and local policy and practice and how this affects the Law Centre s work Communications, monitoring and evaluation The Director is responsible for devising and implementing a communications strategy, including: Maintaining and developing our website and social media presence Representing the organisation at external events and to the press and holding publicity and fundraising events Developing the organisation s membership and communicating with members Collecting qualitative and quantitative data to measure our performance and the outcomes of our work Governance The Director works with the Management Committee to set the strategic goals for the organisation and is responsible for implementing the strategy and Business Plan. In particular, this will involve: Preparing proposed business and strategic plans for discussion with and approval by the Management Committee Reporting to the Management Committee and other committees on a regular basis, and preparing agendas and papers for such meetings Maintaining the risk register and providing regular management financial information and non- financial key performance indicators to trustees Assisting the trustees in ensuring compliance with legal and regulatory requirements in relation to the Law Centre as a charity, a company limited by guarantee and an employer and in relation to the Law Centre s pension schemes Page 3 of 11

4 Working with the Senior Solicitor to ensure that the Law Centre is compliant with the regulations of the Solicitors Regulation Authority Organising and preparing for the Annual General Meeting Financial management The Director has overall responsibility for managing the income and expenditure of the Law Centre and for budgeting and financial reporting. In particular, this will involve: Preparing annual budgets and monitoring performance versus budget Preparing annual accounts for approval by the Law Centre s Independent Examiner and Management Committee Maintaining the Law Centre s contracts with the Legal Aid Agency, ensuring that work under these contracts is appropriately billed (with the assistance of individual case workers and the Law Centre s external costs draughtsman and Legal Aid billing clerk, where appropriate) Approving expenditure Preparing regular management accounts and cash- flow forecasts and working with the Senior Solicitor and caseworkers to monitor the value of work in progress Supervising external bookkeeping and payroll service providers Ensuring the Law Centre s pension schemes and other employee benefit arrangement are appropriately administered Working with and providing assistance to the Treasurer on other financial management and planning matters Personnel matters As the senior management employee, the Director is responsible for the management and oversight of all other employees. Specific responsibilities include: Ensuring a safe, pleasant and collegiate working environment for all staff Line management of all staff and, together with the Senior Solicitor, supervision of the caseload of legal staff and volunteers Holding regular staff meetings and annual away days Carrying out annual staff appraisals Management of contract staff, including payroll, bookkeeping and billing Implementing any HR policies the organisation may from time to time adopt Page 4 of 11

Office management The Director is responsible for the general management of the office, including: Maintaining office contracts in relation to computers, databases and software, photocopying and printing, post and DX, and telephones, internet and fax Ensuring a safe working environment Maintaining appropriate insurances Legal casework management The Director is jointly responsible, together with the Senior Solicitor, for ensuring that the legal practice is compliant with the requirements of the Solicitors Regulation Authority and that all casework is compliant with the requirements of the Legal Aid Agency (if applicable) and capable of being billed and of recovering disbursements incurred. The Director is expected to monitor the financial and operational efficiency of the Law Centre s case work arrangements, to report to the trustees on such matters and to make appropriate proposals in relation to the development of the casework team. 6 Other matters The Director will undertake, and/or supervise other employees and volunteers in undertaking, other general and administrative duties, as required, including: archiving and maintenance of case files, liaising with courts and the Legal Aid Agency, managing disbursements, liaising with counsel, filing, managing payments and debtors, updating the website and other promotional material and collecting and analysing statistical data. PERSON SPECIFICATION The ideal candidate will possess the following qualities: Experience Experience of financial, operational and strategic leadership, preferably within the charitable sector, at senior management level Track record of successful fundraising in a comparable organisation Previous experience of managing partnership working between a range of different stakeholders, including voluntary sector organisations and the local authority. Some experience of organisational communications and publicity Please note that experience of legal services (charitable or otherwise) would be an advantage but is not required. 7 North Kensington Law Centre Business Plan: 2015 to 2018 A LAW CENTRE FOR TODAY SOCIALLY MOTIVATED, BUSINESS MINDED SECTION ONE: About the North Kensington Law Centre NKLC was founded in 1970 as the first ever Law Centre in England to provide the communities of North Kensington and beyond with access to justice through high quality legal casework and representation. Based originally on the Golborne Road, it focused only on helping the poor and those facing serious discrimination and injustices. Now located near Latimer Road station, the Law Centre continues to maintain a presence in an area of poverty and deprivation and to focus on meeting the needs of the most vulnerable, whilst also providing a legal service to the broader community. The Law Centre is very proud of its past and many years of achievement but understands that it must continue to review and adapt to the changing economic and political environment, and how this affects its funding and the needs of its service users and communities. This is reflected in its mission, vision and guiding principles. Strategic Aim Two To provide a level of advice that is accessible to all Intended Outcome: more problems are resolved before they become serious and so the number of people at risk of falling into poverty is reduced We will achieve this by: Offering a system of triage which enables us to assess the needs of each visitor to the Law Centre quickly and efficiently. Training front line staff and volunteers to offer basic advice in house Ensuring a system of referral from triage to in- house lawyers and caseworkers Building up a bank of agencies to which we can refer service users Opening our services between 10am and 5pm Strategic Aim Three Empower service users to exercise their legal rights through self advocacy Intended Outcome: more people are able to able help themselves thus reducing the need for detailed case work We will achieve this by: Providing our clients with the knowledge they need to be able to challenge the injustices they face Working in partnership with other agencies to provide services such as training and mentoring in addition to our core legal advice services Producing educational literature for service users Strategic Aim Four To identify gaps in provision and to meet changing needs Intended Outcome: more groups of people who currently are not able to access support are identified and helped. We will achieve this by: Maintaining comprehensive statistics about our clients and their needs and using these to identify projects that help clients before they reach crisis Listening to and engaging with our service users and partners to identify new projects and opportunities Exploring new innovations Strategic Aim Five To hold power to account and challenge injustices on a broader scale Intended Outcome: Law Centre evidence contributes to national and local policy thinking Page 8 of 11

9 We will achieve this by: Taking part in campaigns organised by national agencies to challenge legal issues Partnering locally with organisations such as the Kensington and Chelsea Social Council to raise awareness of poverty issues Where appropriate, challenge policy and practice by responding to consultations and contributing to debates Where appropriate, leading on campaigns and policy issues SECTION TWO: CORE SERVICES AND PRODUCTS Our Core Services and Service Users We are a specialist legal advice agency and offer casework and representation in the areas of Housing, Employment, Immigration and Welfare Benefits. These are provided through legal aid, private fees or grant income. Our focus is on those clients who are socially and economically most disadvantaged and are either already below or in danger of falling below the poverty line. Our constitution enables us to work with clients across London. Primarily we will market our services in RBKC and neighbouring boroughs. We are also keen to embed ourselves in the local communities within the Nottingdale and Golborne wards partly because of tradition but also because these are considered to be the wards in which there is most need. However, we recognise that as other Law Centres close entirely or reduce specific services, we are increasingly attracting clients from across London. This is particularly the case with our employment work. The majority of our clients are recently unemployed or at risk of losing their jobs, on long term benefits or in low income jobs. They will often face other disadvantages, such as their immigration status, mental illness, physical or mental abuse, or disability. Core Services 2015 to Housing Until April 2016, we have a contract with the Legal Advice Agency to provide legal aid in housing matters and it is our intention to apply for a further extension to this contract. Whilst the scope of legal aid has been reduced dramatically, we are still able to help a large number of people in homelessness, repossession and disrepair cases. The majority of our clients arrive via our Monday morning housing clinic. This is a partnership between BPP Law School and North Kensington Law Centre. It enables a system of triage, from which our Housing Solicitor is able to take on cases which fall under legal aid scope. This clinic provides us with as many clients as we can manage with one housing solicitor. Our Housing Solicitor works only on behalf of tenants, mainly on homelessness, evictions and possessions, and disrepair. In 2015/16, under the current contract, we have 85 matter starts and the potential to be awarded another 43, which will enable us to help at least 128 people under our Legal Help contract. In 2016/17, we will renew the contract and look to secure an additional contract under the County Court Duty Solicitor scheme. This would enable us to secure additional matter starts and employ an additional housing solicitor to fulfil this contract. Page 9 of 11

10 2. Immigration We continue to run a Legal Aid contract which is due for renewal in April However, with much more out of scope for legal aid, we cannot only rely on Legal Aid funding to run an immigration department on full cost recovery. Under Legal Aid, we are able to take on cases in Asylum, Domestic Violence and Trafficking. Much of our most recent work has been generated through walk- ins as well as referrals. In addition to our Legal Aid contract, we offer an additional fee paying service primarily in Home Office applications. With one caseworker managing this work on 2 days a week, we can offer up to ten half- hour consultations and follow up work over the course of a week. Our private work is secured through our triage system, which assesses each case and makes appointments accordingly with our Immigration caseworker. We will also continue to offer some pro bono advice in cases where children and young adults are involved, and we will continue to seek grant funding for this. In 2015/16 we will continue to maintain the level of service that we have provided in 2014/15, with the work load managed by a full- time Senior Solicitor and a part- time caseworker. In 2016/17 we aim to have established a loyal client base and a reputation which enables us to increase the hours of our caseworker and increase our private work. 3. Employment Advice to Individuals Employment is no longer in scope for Legal Aid, however we are able to continue to offer pro bono advice in employment with the aid of a grant from Trust for London. In addition to pro bono support we offer representation in discrimination and unfair dismissal cases either on a fixed fee basis or through a damages based agreement. Our employment work is currently generated through our legal triage system, cases that relate to discrimination or unfair dismissal are referred to the Law Centre s senior caseworker. Other cases are handled by volunteers or triage under the supervision of the caseworker. Under this system we aim to help up to 1,000 people a year in short term advice under the conditions of the grant and another 300 people through fixed fees and DBA contracts. 4. Employment Advice to the Voluntary Sector In 2015/16 we have a grant from the Royal Borough of Kensington and Chelsea to provide employment advice to the voluntary sector in Kensington and Chelsea. This is a start up grant to scope and understand the needs of the voluntary sector, and offer employment advice to help staff, who are not likely to be HR specialists, to make informed decisions regarding employment issues. This includes drafting new contracts, tupe issues, redundancy issues and disciplinary processes. In 2015/16 we aim to help up to 20 organisations. In 2016/17 we aim to increase this and to introduce a paying service. 5. Welfare Benefits We will draw upon our expertise and knowledge to develop our focus on complex welfare benefits cases mainly tribunal representation. We will explore new areas of growth and specialism training, research, as well as delivery. We will work with a range of different agencies and explore new avenues such as the relationship between welfare benefits and health and how we can deliver through new partnerships such as health centres, disability groups, mental health agencies and hospitals. Generalist level one advice and sign posting The purpose of our front line triage work is two fold: - To maintain a level of advice for matters that are now out of legal aid scope such as welfare benefits. - To generate new work, directed to our specialist caseworkers. Our front line services are essential in maintaining our presence and services in the community both locally and wider. Our services are available 10am to 5pm during which time new and existing clients can contact us via telephone or in person. They can expect to be taken through a series of questions by either a volunteer or the triage coordinator, and will then be directed accordingly for example an appointment with a specialist caseworker in house, a referral to another agency, or basic level one advice from the triage co- ordinator.
