2 Data Forensic Investigator Job Purpose To provide SW Regional Forces with an evidential Data Investigation capability. To take responsibility for the management of the technical investigations including securing and retrieving data from seized computer systems and mobile devices, including configuration of operating systems and applications, attending searches where necessary, producing technical documentation in relation to data retrieved from computers and media. Presenting evidence in court as required and providing advice to police officers on forensic computer analysis, in order to assist in the investigation of Hi-Tech crime in its entirety and gathering of evidence to support a criminal prosecution. The majority of the examinations will be undertaken at the request of the Investigating Officer to provide intelligence and evidence to identify and prosecute offenders and identify witness/victims. A vital part of the role is the Forensic integrity and continuity of evidence with subsequent presentation at judicial proceedings. Main Responsibilities 1. Examination and Investigation Physical examination and recording of details of seized computers and Media, including the BIOS, CMOS, UEFI and re-programming the same if required. Use sound problem solving skills to Identify the most appropriate method and techniques to/and forensically image computer systems and Media in accordance with ACPO Guidance and legislation. Ensure the imaging process produces a verified, sound forensic copy of the computer. Identify the operating system of the computer and decide on the suitable software to investigate the various artefacts. Work unsupervised to Investigate seized computers and media for relevant evidence. Use specialist technical and analytical skills to investigate the provenance of the evidence and the user s activity/interaction with the evidential data. Investigate the relevant programs and how it interacts /associates with the data cache/storage/use etc. Work independently to manage Hi-Tech Crime investigations including, risk management, and problem solve the complexities of forensically examining and the reconstruction of computer data to identify evidence of criminal offences. Use multiple complex software applications to establish the best evidential available. Interview suspects/witnesses and offenders providing expertise in respect of technical issues of computers. Build, maintain and develop all aspects of computer systems used in investigation, maintaining specialist knowledge of development of computers and software. 2. Continuity, Security and Statements of Evidence Manage and maintain the continuity of evidential exhibits and working-copy information. Record the handling and processing of images/data used as evidential material. Take personal responsibility in the preparation of statements of evidence and attend court/ judicial proceedings when required to give evidence on results of the examinations undertaken and the complex processes involved. Knowledge of legislation to identify illegal content to enable correct handling of data and advise Investigators. Maintain and record the continuity of exhibits and report on this within witness statements. Take personal responsibility to ensure any relevant data supplied to defence experts and/or other agencies is correctly documented in relation to the Memorandum of undertaking. Ensure all sensitive and/or illegal data which leaves the unit is encrypted in accordance to unit/force 2
3 policies. Brief both the Prosecution and Defence council and supply guidance on the technical aspects of the evidence involved. 3. Knowledge / Legislation Maintenance of ongoing professional personal development for Technical / Criminal law and Procedural aspects of the forensic computing arena. Knowledge of legislation in relation to Hi-Tech Crime, including Regulation of Investigatory Powers Act, Computer Misuse Act, Data Protection Act and ACPO Guidelines for Computer Based Evidence and how this interacts with digital evidence and Freedom of Information Act 2000, The European Convention on Human Rights and Management of Police Information in relation to all work processes. 4. Research, Training & Development Liaise on a regular basis with colleagues in other Law Enforcement Agencies and other forensic practitioners in order to share and learn best practice. Develop and maintain specialised and up to date technical knowledge of both general and forensic procedures, keeping abreast of developments by attending courses, conferences and exhibitions as required within the digital forensics industry in order to secure the success of future investigations and to further develop Data Investigations. Research and develop new systems for the improvement of services and facilities to the organisation. Maintain ongoing personal professional and organisational development in both Investigatory and Technical aspects of the role. Conduct other associated tasks that are considered appropriate given the rapid changes in technology and the amendment of practices to take these into account thus assisting in the criminal justice process. Ensure continual professional and organisational development particularly in areas such as changes in technology, forensic computing techniques and data recovery methodologies. Maintain the quality of the end product produced for investigating officers. 5. Management and Maintenance of Equipment Take responsibility of the management and maintenance of the unit s forensic equipment including licensing and firmware/software maintenance issues. Carry out routine maintenance and minor repairs on equipment within the unit. Undertake first line servicing/diagnostic-repairs/ maintenance of computer equipment, systems, storage and server facilities within the unit, acknowledging health and safety and security requirements. 6. Provide Technical Specialist Advice / Assistance and Guidance Provide SIO s and Major Incident Teams with advice to form investigation strategies and advice for operational investigators in relation to search warrants and seizure of computer equipment including acquisition options. Assess computer systems on site scenes and problems solve the complexities of the task to achieve the desired outcome. To assist in the maintenance of systems, storage, server facilities within the Hi-Tech Crime Unit. To liaise with Specialist units, The Crown Prosecution Service, prosecution and defence solicitors, forensic organisations, other police forces/law enforcement agencies and suppliers. 7. Intelligence Take personal responsibility to provide intelligence reports for further development to divisional investigators within the SW forces. Maintain and support the Hash database / and National CAID. Take personal responsibility to provide intelligence packages for National / International law enforcement agencies and risk assess the magnitude of impact the information will have and prioritise workloads appropriately. 5 Person Specification Data Forensic Investigator Attributes On Appointment Criteria Qualifications: Educated to degree level in computing science with relevant workplace experience and/or Possess extensive investigatory experience, knowledge of computer based evidence gathering and computer investigation, technical knowledge of dismantling and re-assembly of computer systems, knowledge of file systems and architecture. Experience in a range of Operating Systems including DOS, Microsoft, Macintosh, Linux and BIOS & CMOS. Investigative experience, knowledge of statutes, police powers, and definitions of criminal offences. Desirable Experience of having given evidence at court, particularly Desirable regarding complex technical cases at Crown Court. Skills: Computer literate with good keyboard skills Competent in the use of Microsoft Word, Outlook and Excel Ability to communicate ideas, being creative / innovative, where the subject can be complex and technical. Ability to retrieve, record, prepare and present evidence to a Court. Excellent problem solving skills and the ability to undertake multi complex technical issues. Ability to display tenacity in investigative work and make good decisions Ability to recognise risks and manage them effectively The ability to work with graphic and traumatic images and information. Individuals will have the ability to recognise and manage their own stress levels in conjunction with their line manager. Proven Specialist Investigative, Diagnostic and Analytical skills Ability to work within strict protocols using initiative, flare and imagination to identify and recommend improvements. Ability to develop and adapt to changing working practises in order to meet the demands of the Wiltshire Police/SW Region, including new legislation or new policies introduced within Wiltshire Police/SW Region. Greater understanding and ability to risk assess against necessity and proportionality to the investigation and organisational needs. Ability to liaise with other law enforcement and specialised outside agencies on sensitive high risk operations. 9 Other Information Data Forensic Investigator Wiltshire Police provides a 24 hour 7 day a week service therefore applicants should be prepared to be flexible in their approach to working hours. Where applicable the post holder will be expected to wear a uniform at all times when on duty. Wiltshire Police is committed to safeguarding and promoting the welfare of children and young people and expects all staff and volunteers to share this commitment. USERS - MoPI (Management of Police Information); Share information where appropriate with community partners and other agencies, paying regard to force procedures for recording such sharing. Ensure information recorded is relevant, accurate and adequate, meets legal requirements and data quality standards. The post holder should hold a full UK driving licence. As this role is part of a Regional Collaboration and there may be occasions when individuals are required to attend another Force in order to support a specific operation or Department resilience. If individuals have undertaken the Force driving test then they will be supplied with a pool car to undertaken this journey. If you do not hold a Force driving permit then a discussion needs to take place with your line manager to assess if this is a viable option. You will be required to attend and successfully complete nationally accredited courses. Failure to pass these courses may result in the termination of contract. Should the post holder leave within 2 years, there may be a requirement to repay training costs. All successful applicants will be required to submit themselves for drug testing in line with employing Force's Drug Policies. Please note that, due to the nature of security checks undertaken, applicants must have 3 years' continuous residency in the UK up to the date of the application and Home Office approval for indefinite leave to remain within the UK. The role involves exposure and handling of disturbing and graphic images from investigations You may be required to perform other duties which are not necessarily specified on the role profile, but which are commensurate with the responsibilities of the role holder. This role requires regular Occupational Health assessments This post has Designated Powers in relation to seizure, handling and creation of exhibits and involves manual handling and movement of hardware and consumables 9
