1 Disability Discrimination Act 1992 Conciliation Register For Complaints conciliated and finalised in the period of 1-Jan-2002 to 31-March-2002 Education Terms of Settlement Financial compansation $6,000 Complainant alleges her son was bullied and harassed at school due to intellectual impairment. Complainant claims school did not take appropriate action to address bullying and did not develop appropriate education programs. Associate - direct Clubs / incorporated associations Terms of Settlement Policy change / change in practice Complainant has Alzheimer's and Parkinson's disease. Complainant and her husband, who is complainant's carer and associate, play bowls at respondent Club. Complainant does not play any longer but watches her husband play. Complainant's husband has been advised by Club that complainant's presence at her husband's games upsets things and other members object. At a Club meeting it was resolved complainant would be sent a letter advising complainant to stay away. It appears letter was not sent but complainant's husband had a physical fight with Club President causing injury. After this complainants told not to attend. Conciliation Registers :: 1

2 Terms of Settlement Reference provided Complainant has a learning disability and has worked at respondent child care centre for around eight years. Complainant's supervisor requested complainant move her shift from Wednesday to Monday and raised concerns about her performance. Complainant moved shifts but was later advised her contract was not being renewed. Complainant claims disability discrimination. Terms of Settlement Reasonable adjustment provided Complainant is deaf. Complainant alleges that when she has stayed in respondent hotels she has not been provided with text facilities on inhouse televisions, movies etc Terms of Settlement Other access achieved (eg. mobility) Complainant claims respondent hotel did not provide caption for TV which constitutes disability discrimination. Complainant is deaf. Terms of Settlement Development of action plan Complainant claims respondent bank's internet and ATM services are inaccessible. Complainant is blind. Conciliation Registers :: 2

3 Terms of Settlement Financial compensation Policy change / change in practice $14,000 Complainant claims she was rejected by respondent for employment because of her past disability, cancer of the cervix. Complainant claims respondent policy is that applicants must be clear of the disease for five years. Access to premises Terms of Settlement Change in policy / change in practice Complainant is a avid sports fan and uses a wheelchair. Complainant claims when he made inquiries about wheelchair accessible tickets to a major game and was advised there were none available. Complainant claim inadequate seating providing for venues and ticketing policy did not provide adequate access for people with disabilities to wheelchair seating. Terms of Settlement Staff training / development program Complainant claims she did not get a job involving house to house distribution and pick-up because she could not carry heavy boxes because of a lower back problem. Conmplainant claims she could do the job carrying smaller amounts of material. Complainant claims respondent did not considr any form of reasonable adjustment. Conciliation Registers :: 3

4 Terms of Settlement options improved Complainant has been employed by respondent. Complainant has retinitis pigmentosa which is a degenerative visual disability. It appears complainant is now unable to undertake her duties because the software on personal computer is not suitable. Complainant claims respondent did not reasonably accommodate her disability. Accommodation Terms of Settlement Reasonable adjustment to be provided Writer claims his mother-in-law was refused accommodation at the respondent's hotel because she is an insulin dependent diabetic. Disability discrimination direct Duisability discrimination indirect Harassment Terms of Settlement Complainant satisfied with response Writer says a priest at a place of worship told people/devotees in wheelchairs or mobility problems to sit on the floor as this was the rule in the temples in India. Terms of Settlement Provision of goods / services / facilities Complainant is blind. Complainant claims respondent real estate company has discriminated against her because website is inaccessible and information on it can not be read by screen reader software. Complainant alleges he has been harassed at work because of disability. Complainant claims he is always given dirtiest duties, is not asked to do overttime, excluded from meetings and has not been given any training oppiortunities Complainant is "legally blind" and attends the eye clinic of the hospital regularly. Complainant claims respondent hospital is inaccessible for her because signage and lift controls are not appropriate for people with visual impairments. Complainant applied for public housing and advised respondent department that she had a disability and needed a ground floor unit. After six years complainant was offered accommodation in a unit on the top floor. Complainant says respondent advised if she didn't take it her name would go to the bottom of the waiting list. 6 Terms of Settlement Reasonable adjustment provided Complainant claims he has an allergy to cigarette smoking which causes him to vomit and experience breathing difficulties. Complainant also has a mobility disability. Complainant claims that staff of respondent agency congregate around the entrance to his workplace and the car park. Complainant further complains that he has been removed from a training course because he ed trainer asking them not to discriminate against him as he had previously experienced with them. Terms of Settlement options improved - job offer Complainant applied for a job with respondent Commonwealth authority through a recruitment agency. Complainant was unsuccessful but complainant was later contacted about further part-time positions as she was in the next ranked group who were initially unsuccessful. Complainant went through selection process successfully but failed the medical because she could not pass eye-test without her spectacles. Conciliation Registers :: 6
