16 Hazmat Employer * Transporting hazardous materials (hazmat) in commerce; * Causing hazmat to be transported or shipped in commerce; * Representing, marking, certifying, selling, offering, reconditioning; or * Testing, repairing, or modifying packaging as qualified for use in the transportation of hazmat. The term "hazmat employer" also includes any department, agency, or instrumentality of the United States, a State, a political subdivision of a State, or an Indian tribe engaged in offering or transporting hazmat in commerce.

17 Hazmat Employee a person (including a self-employed person) who: * loads, unloads, or handles hazmat; * tests, reconditions, repairs, modifies, marks, or otherwise represents packagings as qualified for use in the transportation of hazmat; * prepares hazmat for transportation; * is responsible for safety of transporting hazmat; or * operates a vehicle used to transport hazmat.

21 Training (Hazmat) A systematic program (i.e., consistent approach, testing, and documentation) that ensures that a hazardous materials (hazmat) employee has knowledge of hazardous materials and the Hazardous Materials Regulations (HMR), and can perform assigned hazmat functions properly. Refer to (b) through of the regulations.

23 Initial Training A new employee, or an employee who changes job functions, may perform hazmat job functions before completing training, provided: * the employee does so under the direct supervision of a properly trained and knowledgeable hazmat employee; and * the hazmat training is completed within 90 days of employment or change in job function.

29 What is a Hazardous Material? Hazardous material means a substance or material, which has been determined by the Secretary of Transportation to be capable of posing an unreasonable risk to health, safety, and property when transported in commerce, and which has been so designated. The term includes hazardous substances, hazardous wastes, marine pollutants, and elevated temperature materials as defined in this section, materials designated as hazardous under the provisions of of this subchapter, and materials that meet the defining criteria for hazard classes and divisions in part 173 of this subchapter.

31 What is a Hazardous Substance? Hazardous Substance: 1. Any material that poses a threat to human health and/or the environment. Typical hazardous substances are toxic, corrosive, ignitable, explosive, or chemically reactive. 2. Any substance designated by EPA to be reported if a designated quantity of the substance is spilled in the waters of the United States or is otherwise released into the environment.

34 What is a Hazardous Waste? In regulatory terms, a RCRA hazardous waste is a waste that appears on one of the four hazardous wastes lists (F-list, K- list, P-list, or U-list), or exhibits at least one of four characteristics ignitability, corrosivity, reactivity, or toxicity. Hazardous waste is regulated under the Resource Conservation and Recovery Act (RCRA) Subtitle C.

38 SHIPPING DOCUMENTS (PAPERS) The shipping document provides vital information when responding to a hazardous materials/dangerous goods incident. The shipping document contains information needed to identify the materials involved. Use this information to initiate protective actions for your own safety and the safety of the public. The shipping document contains the proper shipping name (see blue-bordered pages), the hazard class or division of the material(s), ID number (see yellow-bordered pages), and, where appropriate, the Packing Group. In addition, there must be information available that describes the hazards of the material which can be used in the mitigation of an incident. The information must be entered on or be with the shipping document. This requirement may be satisfied by attaching a guide from the ERG2012 to the shipping document, or by having the entire guidebook available for ready reference. Shipping documents are required for most dangerous goods in transportation. Shipping documents are kept in the cab of the motor vehicle, the possession of the train crew member, a holder on the bridge of a vessel, or an aircraft pilot s possession. The 4-digit ID Number may be shown on the diamond-shaped placard or on an adjacent orange panel displayed on the ends and sides of a cargo tank, vehicle or rail car.

46 Basic Shipping Description The basic DOT Shipping Description must follow this order: UN/NA ID Number, Proper shipping name, DOT Hazard Class, Packing Group # The shipping description information for DOT hazardous materials is found in 49 CFR Hazardous Materials Table columns 2 though 5 of the table RQ s (Reportable Quantity) must be added to the shipping to the shipping description at either Before the UN/NA ID number or after the PG number if the amount of the hazardous substance in one package being shipped reaches the established RQ value of the material. RQ Values are found in 49 CFR Appendix A Table #1. (Note: RQ may also be placed in the HM block of the shipping document although EPSVT does not recommend placing RQ in this block on our shipping documents)
