2 What Is Harassment? Harassment is unwelcome behavior directed at a member of a protected group Harassment usually involves a pattern of behavior Harassment is a form of illegal discrimination

3 What Is Harassment? Harassment is often blatant jokes, slurs, labels, graffiti, or threats Harassment can also be subtle veiled comments and subtle intimidation Behavior short of illegal discrimination Rude, insensitive, or abusive behavior

4 What Harassment Is NOT Occasional teasing Offhand comments Isolated incidents that are not extremely serious

5 When Is It Harassment? One extremely serious incident Intimidating, hostile, offensive environment Unreasonable interference with work performance Negative effect on an individual s employment opportunities

6 Why Harassment Is a Problem Victims may lose their sense of security, dignity, and confidence All employees may be demoralized People may start to feel unsafe on the job Confidence in the organization may be threatened Accused employees may suffer loss of reputation and credibility or even their jobs 9

7 What the Law Says About Workplace Harassment Title VII of the Civil Rights Act of 1964 prohibits workplace harassment because of race, color, religion, national origin, or sex State fair employment laws prohibit workplace harassment These laws require us to have a policy that prohibits harassment and include procedures for handling employee complaints, investigating incidents, and taking corrective action

8 Our Harassment Policy Firmly prohibits workplace harassment Encourages victims to come forward Promises prompt response to employee complaints Ensures fair and professional treatment of all employees Promotes a respectful work environment

9 Verbal Harassment Threats Intimidation Offensive language, slurs, or derogatory comments Graffiti Jokes Circulating insulting stories or rumors about a person

10 Nonverbal Harassment Staring Standing over someone in an intimidating manner Displaying or circulating offensive pictures, cartoons, or objects Singling out members of protected groups for unfavorable treatment

11 Harassment Complaints Report all incidents right away No complaints will be ignored You are allowed to bypass the normal chain of command You will be protected from further harassment

12 Questions Asked During Investigations Questions we may ask the person making the complaint:

13 Questions Asked During Investigations Questions we may ask the alleged harasser Are the allegations true? If not, why do you think the person who complained made them? Are there any other employees who have relevant information about the charges? Are there any notes, physical evidence, or other documentation regarding the incident(s) alleged in the complaint? Do you have any other relevant information?

14 Questions Asked During Investigations Questions we may ask witnesses What did you see or hear? When did this occur? Describe the alleged harasser s behavior toward the person who complained and toward others in the workplace. What did the person who complained tell you? When did he or she tell you this? Do you have any other relevant information? Are there other employees who might have relevant information?

15 Has Harassment Occurred? The next step is to make a determination about whether harassment has occurred in violation of company policy and fair employment laws. It may be impossible to say whether harassment has occurred because there is not enough evidence. We still need to take preventive measures to make sure that whether harassment occurred in this particular case or not, it does not occur again. A report about the incident will be written and submitted to management. The parties involved in the complaint will be informed of the results of the investigation and the action that will be taken. In cases where inappropriate behavior has occurred that falls short of illegal harassment, we will make sure that the employees involved understand that such behavior will not be tolerated.

16 Corrective Action We must make sure: The victim is not adversely affected The harassment stops immediately and does not occur again We must also: Correct the effects of the harassment Follow up to make sure the problem is solved

17 How You Can Help Prevent Workplace Harassment Read and understand harassment policies and procedures Monitor your own behavior Speak up in support of a respectful workplace Report incidents immediately Cooperate with investigations
