It is suitable for public disclosure

2 1.0 ABOUT THIS POLICY 1.1 This policy explains how West Mercia Police will approach the deployment of Hostage and Crisis Negotiators. 1.2 The policy is primarily aimed at all West Mercia Police staff that are likely to be involved with critical incidents whereby a Negotiator is likely to be deployed. These staff will include: Force Negotiators, Force Control Room Inspectors, Force Gold, Silver and Bronze Commanders, Senior Investigating Officers and Technical Support Unit personnel. 2.0 GENERAL PRINCIPLES 2.1 West Mercia Police is committed as part of its strategy to building a safe community by ensuring that a high standard of service is given to those seeking the safe resolution of critical incidents where life is at risk. 2.2 The role of Hostage and Crisis Negotiator 1 is recognised across the country as an invaluable option in the safe resolution of incidents ranging from domestic and criminal sieges, to suicide intervention, kidnap and extortion, product contamination and terrorism. Recent years have seen the gradual increase in demand for the deployment of appropriately trained negotiators. Not all types of incidents involve the taking of hostages but all are life threatening or display the potential for significant harm/damage to the community, a person or commercial enterprise. 2.3 This Policy may engage with any of the Articles of the Human Rights Act, however it is not possible to predict the exact nature or events that combine to create a critical incident. Everything within this Policy and related procedure is drafted with the intention of improve police responses to the needs of the individual and/ or our communities. Any negotiation strategy set will be within the parameters of the law and will give due consideration for the right to life of all persons. (Article 2, European Convention on Human Rights)). 2.4 The legal basis for this Policy comes from the common law duty of the police to protect life and property and detect crime. 1 Negotiators are referred to nationally as Hostage and Crisis Negotiators the term Negotiator will be used henceforth in this document to mean Hostage and Crisis Negotiator. 3 3.0 POLICY 3.1 West Mercia Police will provide and regularly review and update a policy and a procedure in respect of the Deployment of Negotiators. 3.2 West Mercia Police will comply with the principles of the National Deployment Model (outlined in the procedures document associated with this policy). 3.3 West Mercia Police will maintain a cadre of trained negotiators. A minimum of two such trained officers, and a negotiator co-ordinator will be 'on call' and available for immediate deployment on a 24 hour basis. 3.4 West Mercia Police is committed to the provision of appropriately trained and experienced negotiators to any other police force in the country that requires mutual aid support. 3.5 A list containing relevant contact numbers and call out rota of trained negotiators will be held by the Force Duty Inspector. 3.6 West Mercia Police will provide appropriate training and equipment to each Force Negotiator. 3.7 West Mercia Police will nominate a suitably trained and knowledgeable officer who will be known as the Force Negotiator Co-ordinator. This officer will be responsible for: ensuring that there are appropriate numbers of trained negotiators in the force ensuring that appropriate equipment is issued to negotiators ensuring that negotiators undergo appropriate and regular training in order to maintain their skills and knowledge ensuring that the list of contact numbers and call out rota, held by the Force Duty Inpsector, is accurate ownership of the force policy on Negotiator Deployment and accompanying procedures reviewing and updating the force policy on Negotiator Deployment and accompanying procedures 3.8 The appointment and selection of negotiators must be conducted in accordance with Force Personnel Policies and procedure. 3.9 In recognition of the extra responsibility associated with the role all trained Force Negotiators, who are available for deployment, will be considered for a Special Priority Payment in accordance with the Police Reform Act Page 3 of 5

4 4.0 IMPLICATIONS OF THE POLICY 4.1 Financial implications / Best Value The introduction of this policy will have limited additional financial implications. However, as new Force Negotiators are selected and appointed there will be costs associated with appropriate training and equipment. Broadly it will be the responsibility of Force Training to fund the appropriate initial and on-going training requirments of Force Negotiators. The relevant Division or Department will have responsibility for budgetting for the uniform, equipment and expenses of those officers who are part of their establishment. 4.2 Staffing /Training All staff should be aware of the existence of this policy and, where appropriate, be responsible for ensuring compliance. There are no specific training requirements involved in the adoption of this policy. 4.3 Crime and Disorder Act There are no implications for partner agencies arising out of this policy. 4.4 Bureaucracy The implementation of this policy will promote better management of resources. The policy will also increase the knowledge of all West Mercia Police staff ensuring that Negotiators are appropriately deployed. The bureaucracy involved with the deployments will be kept to a minimum and regularly reviewed. 4.5 Publication/ Distribution This policy is suitable for public disclosure and forms part of the Force Operations Policy Portfolio published within the Publication Scheme on the West Mercia Police website. Publication to West Mercia Police staff will be via the force intranet. The procedures associated with this policy will be subject to a 'confidential/restricted' Government Information Marker and for operational reasons will not be available to the public. All trained Negotiatiors will be issued with a personal copy of the policy and associated procedures. Any member of staff who wishes to make a complaint about the policy should do so using the Force Grievance Procedures. Members of the public may make complaints verbally or in writing via the Police Complaints procedure. The policy will be promoted by the policy owner. Page 4 of 5

5 5.0 MONITORING / EVALUATION 5.1. This policy will be monitored by the Force Negotiator Co-ordinator on an annual basis by examining the Negotiator deployment logs and in liaison with Force Operations and the Head of Operations Support Departments. 6.0 REVIEW 6.1.
