1 REPORT TO COUNCIL: RAPPORT AU CONSEIL: ECO DEV DATE: 04/02/12 SUBJECT Report on the implementation of a business license policy for the Township of Russell BUSINESS LICENSE POLICY POLITIQUE LICENCE D AFFAIRES SUJET Rapport sur la mise en œuvre d une politique de licences d affaires pour la Municipalité de Russell. RECOMMENDATION That municipal council adopt the proposed by-law and implement the new business license effective August 1 st,2012 and that the Administration contact the Village of Casselman and the Municipality of Nation so to promote this initiative and to encourage them to introduce similar by-law. FINANCIAL IMPLICATION - This year s budget included a revenue of $15,000; with an effective date July 1 st to June 30 th ; - Annual cost per business license is $100; - Revenues of $15,000 will be prorated from August 1 st to July 31 st ; - 50% of revenues will be reallocated to a local Chamber of Commerce such as ESTIC for an approx. expense of $6,250 (300 businesses X $100 per year / 5 months / 50%); - There will be some staff time to be allocated to implement and administer the business license system; RECOMMANDATION Que le Conseil adopte le règlement et la mise en œuvre de la politique de licences d affaires en vigueur en date du 1 août 2012 et que l Administration communique avec la Municipalité de Casselman et de la Nation afin de promouvoir cette initiative et de les encourager à introduire un règlement semblable. 3 Provide a list to the municipality of the existing business which will in turn be a tool to leverage business development in areas where the Township is lacking. - Fournir une liste de commerce qui servira comme outil afin de promouvoir le développement d affaires dans la Municipalité. The issuance of a license does not create a right but is a privilege that is subject to review, suspension or revocation, for just cause, in accordance with the Municipal Act and any special legislation that has been obtained by municipalities to govern that activity. The Ontario Municipal Act, 2001, empowers municipalities to license and regulate businesses for the following reasons: Nuisance control; Consumer protection; and Health and safety of the public Some examples of the types of businesses regulated include food premises, rooming houses, taxis, etc. Issue The Township of Russell currently lacks publicly accessible data about businesses located within its boundaries. This lack of data negatively affects the Township s ability to measure economic development performance, ensure public safety and enforce code compliance and municipal revenues. Economic development The lack of data prevents economic development organizations from providing statistics on job growth and business sector growth and ultimately providing meaningful economic performance measures. Some of these measures include new jobs created and new businesses opened. Without a systematic method for collecting this information, confidence in the accuracy of the measures will be compromised. Public Safety The lack of data also contributes to inefficiencies and public safety concerns. Emergency dispatch service spends significant time attempting to track new businesses opening, moves and re-naming. The fire department needs this information in order to ensure that new businesses meet current fire codes. In addition, the Township lacks information on the storage of hazardous material and installation of fire suppression systems. The accuracy of this information is crucial for responding to emergencies safely, effectively and efficiently. 4 assist the By-law department to monitor businesses and ensure that they are in compliance with all municipal by-laws. Furthermore, this will be a tool to assist the tax and utilities department to insure that these businesses are paying their fair share. Local Chamber of Commerce Our chamber of commerce has a key role to play in the economic development of our community. It has over the past few years been struggling to attract members to register with the new amalgamated chamber. Presently, there are an estimated members of the local chamber of commerce with a potential of 600 to 700 businesses in the area that could be part of the new chamber of commerce. In our community there is an estimated business. In addition to the issues identified above, there is an opportunity to support our local chamber of commerce with the introduction of a municipal business license. Not only can the municipality gathers information about our established businesses and used it for future development planning and public security, it can financially support the chamber of commerce by contributing a part of the license fee to this organization to insure its viability. In return, the municipal council can request that this money be utilized for activities to be organized by the chamber specifically in the Township of Russell. I would recommend that 50% of the license fee be our contribution to the chamber of commerce. The fee that I m proposing is $100 which means that the total amount remitted to the chamber would be $10,000 to $15,000. If the three municipalities would follow our initiative it could represent $30,000 to $35,000 annually to ESTIC. We should encourage the Village of Casselman and the Municipality of Nation to adopt a similar policy. de manière efficace. En plus des questions mentionnées ci-dessus, il y a la possibilité d appuyer notre chambre de commerce locale avec l introduction d un programme de licences d affaires. La Municipalité peut recueillir des informations sur nos entreprises établies afin de faire la planification du développement futur et de la sécurité publique mais peut également soutenir financièrement la chambre de commerce locale en contribuant une partie des frais afin d assurer sa viabilité. En échange, le Conseil peut demander que ces argents soient utilisés pour des activités organisées par la chambre de commerce spécifiquement dans la Municipalité. Je propose que 50 % des frais soit contribué à la chambre de commerce. Le 100 $ proposé, signifie un montant total à verser à la chambre de commerce de $ à $. Si les trois municipalités suivent notre initiative, ceci représenterait un montant annuel de $ à $ à la chambre de commerce. Nous devrions encourager le village de Casselman et la municipalité de la Nation à adopter une politique semblable. 5 THE CORPORATION OF THE TOWNSHIP OF RUSSELL BY-LAW BEING A BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF RUSSELL TO PROVIDE FOR LICENSING, REGULATING AND GOVERNING CERTAIN TRADES, CALLINGS, BUSINESSES OR OCCUPATIONS. WHEREAS under the provisions of the Municipal Act, S.O. 2001, Chapter c-25, the Council of the Corporation of the Township of Russell may pass by-laws with respect to licensing, regulating and governing any business carried on within the Township of Russell even if the business is being carried from a location outside of the Township of Russell. NOW THEREFORE the Council of the Corporation of the Township of Russell enacts as follows: DEFINITIONS 1. For the purposes of this By-Law: Applicant means a person applying for a licence under this By-Law. Building Department means the Chief Building Official or any of his subordinates appointed by Council of the Corporation. Business means a trade, business or occupation and includes the sale or hire of goods or services on an intermittent or one-time basis, the showing for the purpose of sale or hire of samples, patterns or specimens of any goods and shall include exhibitions held for hire and gain, theatres, music halls, bowling alleys, movie pictures shows but does not include; (i) (ii) (iii) a manufacturing activity or and industry, except the extent that the sells its products or raw material by retail. the selling of goods by wholesale; or the generation, exploitation, harvesting, processing, renewal or transportation of natural resources; Township Clerk means the Clerk or any of his subordinates appointed by the Council of the Corporation. Corporation means the Council of the Corporation of the Township of Russell.

6 Council means the Council of the Corporation of the Township of Russell. Fire Department means the Fire Chief or any of his subordinates appointed by the Council of the Corporation. Home occupation as defined in the Russell Township Zoning By-law No , as amended Home Industry as defined in the Township of Russell Zoning By-Law No as amended Licence means a licence issued under this By-Law by the Corporation of the Township of Russell. Licenced means a licence issued under the provisions of this By-Law. Licenced Premises means the premises where the licensee carries on his/her licenced business. Licensee means a person or corporation to whom a licence has been issued under this By- Law. Medical Officer of Health means the Chief Medical Officer of Health or his/her appointee. Motor Vehicle means an automobile, motorcycle, motor assisted bicycle unless otherwise indicated in the Highway Traffic Act, and any other vehicle propelled or driven otherwise than by muscular power, but does not include a street car, or other motor vehicle running only upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement or husbandry or road-building machine. Municipal Building Department means the Chief Building Official of the Corporation or any of his subordinates. Municipal Law Enforcement Officer means a Peace Officer for the purpose of enforcing Municipal By-laws for the Corporation of the Township of Russell. Person means an individual, a partnership, a body corporate and any association, and the heirs, executors, administrators, successors and assigns or other legal representatives thereof to whom the context means a human being of the male or female gender. Planning Department means the Director of Planning or any of his subordinates appointed by Council of the Corporation.

7 Police Officer means the Chief of police as defined in the Police Services Act R.S.O. 1990, Chapter P.10. Seasonal means a business that operates less then 6 consecutive months during a specific time of the year. Township means the Corporation of the Township of Russell Vehicle means a motor vehicle, trailer, traction engine, farm tractor, road building machine, bicycle and any vehicle drawn, propelled or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or a street car. INTERPRETATION 2. No person shall operate within the Township of Russell any business as defined in this Bylaw without first obtaining a licence from the Corporation authorizing him/her to operate a business. APPLICATIONS PROCESSING AND ISSUANCE 3. Every person who requires a licence under the provisions of this By-Law for any business shall: a) file an application in writing by completing a prescribed form available at the Municipal Law Enforcement Service; b) provide as required by the Municipal Law Enforcement Officer any documents, permits or permission pertaining to the operation of the said business; c) pay, the non-refundable application fee as indicated in Schedule A of this By-law; d) submit the annual licence fee as indicated in Schedule A of this By-law. 4. The annual licence fee referred in Section 3.d) shall not be reduced or pro-rated. 5. The issuance of the licence under this By-law may, where applicable, be subject to the written approval of all or any of the following: a) the Planning Department b) the Building Department

8 c) the Fire Department d) the Medical Officer of Health e) the South Nation Conservation Agency (Septic systems) 6. If an applicant fails to provide the Municipal Law Enforcement Officer with any written approval, pursuant to Section 5. of this By-law, the application will not be processed. 7. No person shall be deemed to have been issued a business licence until the Municipal Law Enforcement Officer has signed and issued the licence. The application for a business licence does not constitute a licence. 8.1 The Municipal Law Enforcement Officer shall upon receipt of the written approval(s), make or cause to be made any investigations considered necessary or which are required by law or by the Corporation relative to the application. 8.2 A license shall be required for each separate location of business. 8.3 A person is not eligible for a license unless his or her application is accompanied by the full license fee for that business, as set out in the applicable schedule. 8.4 Except as otherwise provided in the applicable schedule, a license is valid for the specified business under the application and the specified premises. 8.6 No person shall carry on any trade, business or occupation for which a license is required under this by-law: (i) if the license has expired ( temporary or special sale)or been revoked; or (ii) while the license is under suspension. 8.7 No person shall hold a license if the proposed use of the land, building or structure is not permitted by the Zoning By-law that applies to the property, unless the land, building or structure was lawfully used for th purpose on the day of the passing of the Zoning By-law. 8.8 No person shall hold a license if the property to be used for carrying on the trade, business or occupation does not conform with all applicable law, including but not limited to the property standards by-law that applies to the property, the Tobacco Control Act, the Fire Protection and Prevention Act, 1997, the Fire Code, the Building Code, the Health Protection and Promotion Act.

9 8.9 A person is not eligible to hold a license if the operation of his or her business does not conform with the applicable standards and requirements of: (1) every by-law of the Township; (2) every Provincial or Federal Act and regulation made under such an Act; and (3) every instrument of a legislative nature made or issued under a Provincial or Federal Act or regulation, including standards and requirements with respect to the qualifications of the persons carrying on or engaged in the business and with respect to the vehicles and equipment used for the purposes of the business Where any order issued by the Municipal By-Law Enforcement Officer has been appealed and upheld by Council, or where there has been no appeal requested, the licensing officer may suspend or revoke the license Council may modify or uphold an order issued by the Municipal By-Law Enforcement Officer Every licensee shall produce the license for inspection on the request of an authorized employee or agent of the Township Every person carrying on a trade, business or occupation for which a license may be required under this by-law shall allow, at any reasonable time, an employee or agent of the Township to inspect their place of business and any other premises, equipment, vehicles or property used for purposes related to the trade, business or occupation, other than a room or place actually being used as a dwelling, to determine compliance with the requirements of this by-law or any other piece of legislation as set out in No person shall obstruct, hinder or otherwise interfere with an authorized employee or agent of the Township while carrying out an investigation, making inquiries, or performing an inspection for the purposes of enforcing this by-law No licensee shall construct or equip a place of business or other premises used for the business so as to hinder the enforcement of the by-law Every licensee shall maintain his or her place of business in a clean and sanitary condition, with adequate measures for the storage and disposal of garbage and waste and sufficient levels of illumination to permit the safe use of the premises No licensee or employee of a licensee shall refuse to permit a person to enter and remain in a place of business or other premises used for the business to which the public are customarily admitted for the reason that he or she is accompanied by a Service Dog. REFUSAL - SUSPENSION - REVOCATION OF LICENCE 9. If the investigation referred to in Section 8. of this By-law discloses any reason that the

10 carrying on of the said business may result in a breach of the law or of any provisions of any By-laws of the Corporation the Municipal Law Enforcement Officer may refuse to issue the licence and shall notify the applicant of his refusal in writing. 10. The Council may, by resolution; a) refuse to grant a licence; b) revoke or suspend a licence; c) impose special conditions on a business in a class that have not been imposed on all business in that class as a requirement of obtaining or continuing to hold or renewing a licence; and d) imposing conditions, including special conditions, as a requirement of continuing to hold a licence at any time during the licence upon the ground that the conduct of a person or in the case of a business corporation, the conduct of its officers, directors, employees or agents affords reasonable grounds for the belief that the person will not carry on or operate the business in accordance with the law or with honesty and integrity. 11. No person shall enjoy vested right in the continuance of a licence and upon the issue, renewal, cancellation or suspension thereof, the value of the licence shall be the property of the Corporation of the Township of Russell. 12. The granting of a licence under the provisions of this By-law shall be dependent upon the licensee indemnifying and saving harmless the Corporation and the employees, contractors and agents of the Corporation from all loss, damage, legal action, costs and expenses of every nature and kind arising from or in consequence the carrying on of the said business, for which the licence was issued. EXPIRY OF LICENCE 13. The licences for every businesses shall, unless they are expressed to be for a shorter or longer time, be for one year and unless they are sooner forfeited or revoked shall in each case, expire in each year on the date set out in schedule A of this By-law. RENEWAL OF LICENCE 14. The Municipal Law Enforcement Officer may renew an existing licence if the licensee:

11 a) produces his/her licence on or before the expiry date; or b) fulfils the application requirements set out in Section 3 a) to Section 3 c) inclusive; and, c) pays the applicable licence fees set out in Schedule A of this By-law plus any outstanding fines, court costs, municipal orders, related to the business premise and or/operation. REFUSAL TO RENEW A LICENCE 15 A licence shall not be renewed by the Municipal Law Enforcement Officer until it has been determined that the licensee has not complied with: a) the regulations under the jurisdiction of the Medical Officer of Health Unit; or, b) any other laws or by-laws of the Corporation; c) paying the applicable licence fee set out in Schedule A of this By-law. 16. a) If the Municipal Law Enforcement Officer refuses to renew the licence, the licensee shall receive notice of refusal in writing, said notice to be served personally upon or sent by prepaid registered mail to the licensee. b) If the licensee is not satisfied with the terms of the notice referred to in Section 16a) of this By-Law, he/she may appeal to the Township Clerk within thirty (30) days after service of the notice of refusal. PERMIT DISPLAY 17. Every person who a licence has been issued to under this By-Law shall; a) where the licence applied to a premise, keep his/her licence posted up in a conspicuous place on the premises in respect to which the licence is issued; b) where the licence does not apply to a premises, shall keep on his/her person the licence issued; and c) where the licence applies to a vehicle, shall keep on the person driving such particular vehicle the individual licence issued with respect to said vehicle, and where plates are issued with respect to such individual licence, the plates shall be securely

12 fixed to the back of the vehicle. TRANSFER OF LICENCE 18. No licence shall be transferred except with the consent in writing of the Municipal Law Enforcement Service and the Municipal Law Enforcement Officers shall not be bound to give such consent. a) No licence shall be transferred without first paying the transfer of ownership fee as set out in Schedule A to this By-Law. b) No person owning or operating a licensed premise under this By-Law shall move from one location to another within the Township of Russell without first paying the application fee set out in Schedule A to this By-Law and fulfilling the requirements for a licence application as set out in this By-Law. c) No person owning or operating a vehicle licensed under this By-Law shall transfer the licence from one vehicle to another without first paying the plate transfer fee as set out in Schedule A to this By-Law and fulfilling the requirements for a vehicle licence application as set out in the applicable schedules of this By-Law. d) No licence certificate or licence plate shall be replaced without first paying the replacement fee as set out in Schedule A to this By-Law. INSPECTIONS 19. A Municipal Law Enforcement Officer may: a) at all reasonable times, inspect the building, place vehicle or premises that is used for a business for which a person is licensed or is required to be licensed; and b) when deemed necessary by the said officer, inspect the books, records or other documents of the business. 20. Every person who obtains a licence under this By-Law shall produce the licence when requested to do so by a Municipal Law Enforcement Officer or a Police Officer. ADMINISTRATION AND ENFORCEMENT 21. Nothing in this By-law shall exempt any person from complying with the requirements of

13 any other By-law or regulation or any other law in force within the area affected by this Bylaw. It is the responsibility of the licensee and the owner to ensure that the business complies with all legislation and regulation pertaining to the conduct of the business. 22. The provisions of this By-law shall be administered and enforced by the Municipal Law Enforcement Officer 23. No person who is licensed or required to be licenced, shall hinder or obstruct the Municipal Law Enforcement Officer during inspections referred to in Section 19 or cause the inspections to be hindered or obstructed. EXCEPTIONS - SPECIAL CONDITIONS 24. Council may require certain classes of businesses to be regulated separately from this Bylaw, where it is believed that special condition should be imposed and which are not defined in this By-law. The classes of businesses requiring special conditions are defined in Schedule B of this By-law. PENALTIES 25. Each day that a person and location operates a business in contravention of the provisions of this By-law shall constitute a separate offence. 26. Any person who contravenes any of the provisions of this By-Law is guilty of an offence and upon conviction is liable to a fine as provided for in the Provincial Offences Act, 1990, R.S.O., Chapter P. 33. and amendments thereto. ORDER PROHIBITING 27. When a person has been convicted of an offence under the provisions of this By-law, any court of competent jurisdiction thereafter may in addition to any other penalty imposed on the person convicted, issue an order prohibiting the continuation or repetition of the offence or the doing of any act by person convicted directed towards the continuation or repetition of the offence. SEVERABILITY 28. It is declared that if any section or subsection or part or parts thereof be declared by any competent Court of Law to be illegal shall be deemed to be severable and all parts hereof are

14 declared to be separate and independent and enacted as such. BY-LAW IN FORCE 29. This By-law shall come into force and take effect on the day it is duly adopted by Council. 30.
