When applicable: 1) You shall provide this office with a notarized affidavit from the owner of the property and/or equipment authorizing the use of their property for the loading of subject Barge. 2) You shall provide this office with an original valid copy of your Certificate of Liability Insurance naming The Town of Southampton as an additional insured (a minimum of $2,000, for public liability and $200, property damage). 3) The sponsor of the display shall make provisions for adequate fire protection for the display. 4) The sponsor shall consult with the authority having jurisdiction and the operator to determine the level of fire protection required. 5) During the loading, where pyrotechnic materials are present, unescorted public access to the site shall not be permitted. 6) The operator shall be responsible for ensuring that all assistants are fully trained in the proper performance of their assigned tasks and that they are educated with regard to safety hazards. 7) No smoking shall be allowed within 50 ft (15 m) of any area where fireworks or other pyrotechnic materials are present. 8) Measures shall be taken to protect all pyrotechnic materials to be used in the display from adverse weather conditions. Moisture-damaged materials shall not be used. 9) No person shall be allowed in the discharge area while under the influence of alcohol, narcotics, or medications that could adversely affect judgment, mobility, or stability. 10) Shells shall be carried from the storage area to the discharge site only by their bodies and shall never be carried by their fuses. 11) Shells shall be checked for proper fit in their mortars prior to the display. 12) When being loaded into the mortars, shells shall be held by their fuses or lowering cords if provided, and shall be lowered carefully into the mortar. At no time shall any part of the body of the person loading the shells be placed over the mouth of the mortar. 13) The person loading shells shall be certain to the degree practicable that the shell is properly seated in the bottom of the mortar. 5 14) The safety cap protecting the fuse shall not be removed by the person responsible for igniting the fuse until immediately before the shell is to be fired. 15) No person ever shall place any body part over the mortar during the loading and firing of a display until mortars have been checked for the absence of any shells following the display. 16) Where the mortars are positioned vertically, the mortars shall be placed at the approximate center of the display site. 17) Mortars shall be permitted to be angled during a display to allow for wind and to carry shells away from the main spectator viewing areas. 18) The angled mortars shall be permitted to be placed up to 1/3 of the distance from the center of the display site (see Table 3-1.3) toward the main spectator viewing area. 19) The mortars shall be angled so that any dud shells fall at a point approximately equal to the offset of the mortars from the center of the display site, but in the opposite direction. 20) The proper disposal instructions shall be provided by the supplier and shall be followed. (See Operator Responsibilities) 21) All arrangements for fire protection, emergency medical services, etc. Shall be in place and approved by the Fire Marshal prior to firing. 22) Any arrangements or notifications required for persons who may be adversely affected by the display, due to medical or other conditions, shall be the responsibility of the Permit Holder. 23) Debris management programs shall be provided. REQUIREMENTS FOR OUTDOOR DISPLAY OF FIREWORKS The following requirements are set forth in the Town of Southampton Code 164, NFPA edition (Generally Accepted Standard) Penal Law of the State of New York, Section 405. A diagram showing he fireworks discharge site and surrounding areas shall be submitted with the application, but in no instance less than 5 days in advance of the event day. The site shall conform to all requirements contained in this bulletin. The application shall include the following information: 1. The age, experience and physical condition of the persons who are to do the actual discharge of the fireworks. 2. The number and kind of fireworks to be discharged, (shell diameter). 3. The manner and place of storage of such fireworks prior to the display. 4. An ORIGINAL certificate of commercial general liability insurance. Insurance requirements are as follows: A. General aggregate limit of not less than two million dollars ($2,000,000). B. An occurrence limit of not less than two million dollars ($2,000,000). 5. Methods of providing fire protection. 6. Methods of providing crowd control. Page 5 of 7
6 SPONSOR RESPONSIBILITIES Whenever any condition exists that affects safety such as lack of crowd control, adverse weather conditions, or any violation of applicable laws or codes, the fireworks display shall be immediately stopped or postponed by the Fire Marshal until the situation is corrected. Adverse weather conditions include precipitation and high winds. Under no circumstances shall fireworks be discharged when wind speed exceeds 30 mph. Monitors, whose sole duty shall be the enforcement of crowd control, shall be located around the display area by the sponsor. Provisions for crowd control shall be approved by the Town Police Chief & Town Fire Marshal. Monitors shall be located around the discharge site to prevent spectators or any other unauthorized persons from entering the discharge throughout the display and until the discharge site has been inspected after the display. Where practical, fences and rope barriers shall be used to aid in crowd control. OPERATOR RESPONSIBILITIES (Fireworks Company & Site Fireworks Team) Salute displays shall be fired only from properly secured wood mortar racks OR if loaded in cardboard boxes, salutes must be adequately secured using sand bags on all four sides. The operator has the primary responsibility for safety. While the operator is allowed to actively participate in the firing of the fireworks display, safety shall be his primary concern. A test shot fired shall be observed carefully to determine that its trajectory is such that the shells function over the fallout area and that any dangerous debris or unexploded shells will land in the fall out area. This display shall be interrupted and the mortars shall be re-angled or repositioned as necessary for safety any time during the outdoor fireworks display. Following the display, the firing crew shall conduct an inspection of the fall out area for the purposes of locating any unexploded aerial shells. This inspection shall be conducted before any public access to the site is allowed. Any shells found during the search shall not be handled until at least fifteen minutes have elapsed from the time the shells were fired under the direction of the Fire Marshal and Chief Fireworks Technician. The fireworks shall then be doused with water and allowed to remain for at least five more minutes before being cautiously placed in a plastic bucket or fiberglass box. The supplier shall be contacted as soon as possible for disposal instructions. When fireworks are displayed at night and it is not possible to thoroughly inspected the site, the operator shall ensure that the entire site is re-inspected very early the following morning. 7 SAFETY No smoking shall be allowed within 50 feet of any area where fireworks or other pyrotechnic materials are present. No person shall be allowed in the discharged area while under the influence of alcohol, narcotics or drugs that could adversely affect judgement, movement or stability. During the period before the display when pyrotechnic materials are present, unescorted public access to the site shall not be allowed. Unless aerial shells have been preloaded, ground display pieces shall be positioned outside of the discharge area. If ground display pieces are to be fired electronically, they can be located in the fallout area. Dry grass or combustible materials located beneath ground display pieces shall be wet down before the display. Page 7 of 7
