1 TERMS AND CONDITIONS OF HSBC HOME MORTGAGE LOAN, HOME EQUITY LOAN PROMOTION 1. The HSBC Home Mortgage Loan, Home Equity Loan ( Home Loans ) Promotion Campaign ( Campaign ) is applied in Ho Chi Minh City, Ha Noi, Da Nang, Binh Duong, Can Tho and Dong Nai. 2. The campaign period ( Campaign Period ) is from 23 August 2012 to 23 October 2012 (both days inclusive). 3. Eligible customers ( Customers ) All existing and new-to-bank individual customers of HSBC Bank (Vietnam) Ltd. ( HSBC or the Bank ) aged from 18 years old or above, excluding HSBC staffs. 4. Gift ( Gift ) will be offered for the Campaign: Samsung Galaxy S3 HHP smart phone: 10 units 5. Gift is sponsored by Samsung Vina Electronics Company Ltd. ( Supplier ), gift value is announced by the Supplier in the Cooperation Agreement between HSBC and the Supplier. 6. The gifts will be given on a first-come-first serve basis until stock lasts The first 10 Customers who have Home Mortgage Loan or Home Equity Loan applications submitted from 23 August 2012 to end 23 October 2012 and disbursed from 23 August 2012 to end 19 November 2012 with a minimum disbursement value of VND 1 billion and above will each receive a (01) Samsung Galaxy S3 HHP smart phone. Each Customer is eligible to receive one (01) Samsung Galaxy S3 HHP smart phone. The Terms and Conditions of this Campaign are integral parts of the Home Mortgage Loan and Home Equity Loan application. Standard Terms and Conditions of Home Mortgage Loans and Home Equity Loans in accordance with HSBC s policy shall be applied. 7. The gifts offered cannot be replaced with any other products or exchanged for cash. 8. Customers will be responsible for paying the ad-hoc Personal Income Tax (PIT) for every early bird gift on their behalf. 9. HSBC will notify the Customers on receiving the Gifts via phone or post from 29 November 2012 to 7 December 2012 (according to the phone number and correspondence address they registered with HSBC). HSBC will not be responsible if Customers are not notified due to out of date contact information, or because their notification letter has been mislaid, damaged or stolen during delivery. The promotional period: from 23 August 2012 to 19 November 2012, both days inclusive (the Promotion Period ). 5. The Promotion is applicable to customers in Ho Chi Minh City, Ha Noi, Da Nang, Binh Duong, Dong Nai and Can Tho. 6. The Promotion is undertaken with the mechanics of a Lucky Draw. 7. 3 - Total value of prizes awarded under The Promotion is VND 174,480,000 VND (One hundred seventy four million and four hundred eighty thousand Vietnam dong) (excluding VAT and Personal Income Tax for the winners). - Prizes are sponsored by Samsung Vina Electronics Company Ltd. ( Supplier ). Prize values are announced by the Supplier under an Agreement of Cooperation between HSBC and the Supplier. - The gifts offered cannot be replaced with any other products or exchanged for cash. - The winners will be responsible for paying the ad-hoc Personal Income Tax (PIT) for the prize won. 9. The Promotion details: - The Promotion is applicable to all Home Loans applications successfully disbursed from 23 August 2012 to end of 19 November Standard Terms and Conditions of Home Mortgage Loans and Home Equity Loans in accordance with HSBC s policy shall be applied - Lucky draw code generation mechanism: The lucky draw codes of each customer are calculated according to the total loan amount disbursed during the Promotion Period. The quantity of lucky draw codes is equal to the total loan amount in Vietnam dong disbursed in the Promotion Period divided by 500 million, and then rounded down to the nearest whole number. Quantity of lucky draw codes = Rounded down ( total loans amount disbursed from 23 August 2012 to end of 19 November 2012 ) 500,000,000 Example 1: Customer A applies for a VND 1.6 billion Home Mortgage Loan: Initial loan disbursement on 17 August 2012: VND 500,000,000 Second disbursement on 29 August 2012: VND 1,100,000,000 Customer A will earn the following number of lucky draw code(s) for the promotion: Quantity of lucky draw codes = 1,100,000, ,000,000 = 2.2, rounded down to 2 Example 2: Customer B applies for a of VND 1.8 billion Home Equity Loan: Initial disbursement on 14 August 2012: VND 400,000,000 Second disbursement on 20 September 2012: VND 1,400,000,000 Customer B will earn the following number of lucky draw code(s) for the promotion: PUBLIC 2

4 Quantity of lucky draw codes = 1,400,000, ,000,000 = 2.8, rounded down to 2 - The quantity of lucky draw codes earned by each Customer is unlimited. Lucky draw codes are recorded in HSBC s system. - The lucky draw code is defined as a number constituted by The Customer Number (the first nine digits); followed by The order number of the lucky draw code the customer has earned. - The Customer Number of each Customer provided by the Bank is unique. Customers can contact the HSBC Customer Service hotline for their lucky draw codes, if required. Time and mechanism of lucky draw: - The lucky draw event will be held on 29 November 2012 (tentative) at the Transaction Office of HSBC, Metropolitan Building, 235 Dong Khoi Street, District 1, Ho Chi Minh City and be witnessed by the representatives of the Ho Chi Minh Department of Trade and Industry and a group of customers. - The lucky draw will be conducted using the Bank s computer system. The winner will be selected spontaneously by the Bank s software. - The lucky draw results will be recorded in hard copy and verified by signatures of the witnesses. - Procedure to receive prizes: - The winners information will be posted on the HSBC website ( once the lucky draw has successfully concluded. - The Bank will notify the winners via phone or post (according to the phone number and correspondence address which they registered at the Bank) within seven (07) business days of the lucky draw. The Bank will not responsible if the winners are not notified due to out-of-date contact information, or because their notification letter has been mislaid, damaged or stolen during delivery. - The winners will receive a notification letter at one of HSBC Branches. - HSBC will arrange to deliver prizes to the winners addresses registered with the Bank. - In order to receive their prizes, winners must show the original copies of their notification letter and their identification cards or passports for verification by the Bank. In the case that the winner has authorised another person to collect their prize, the authorised person must present the original copy of his/her identification card or passport, the certified true copy of the winner s identification card/passport and the authorisation letter legally verified as stipulated by the law. - The winners must collect their prizes within 30 days of the promotion ending. Winners that do not collect their prizes during such period will forfeit their prizes and undisbursed prizes will be dealt with according to the law. PUBLIC 3

5 - The prizes will be sponsored by Samsung Vina Electronics Company Ltd. and will be under warranty with the Supplier. HSBC is not the supplier of the Promotion Prizes and thus shall not be responsible for any enquiries or disputes related to the Prizes. Customers must contact the Supplier for such enquiries or disputes. 10. Responsibility of Public Announcement: - HSBC is responsible for announcing the Terms and Conditions of this promotion and the information of the winners via at least one mass media channel and the Bank s public website ( 11. Other terms: - The winners will bear all costs incurred and ad-hoc Personal Income Tax for their receipt of their prizes. - With the customers consent, the Bank reserves the right to publish or display the name and picture of the customer in announcements and advertisements in newspapers and other media without paying any fee to the customers. - The Bank is responsible for the accuracy of the lucky draw documents. In the case of inaccurate lucky draw result documents leading to customers being incorrectly informed that they have won, the Bank is responsible for sending the relevant prize(s) to the customer(s) erroneously notified. - In case of any dispute related to this promotion, the Bank will be responsible for solving the dispute in the most satisfactory way for customers. If it fails in this respect, disputes will be solved in accordance with Vietnamese law. - The Bank shall be responsible for reporting results of promotional programme in accordance with the law on the reporting timeline, required documents (minutes of lucky draw event, winners list, proof of prize delivery). - For uncollected prizes, the Bank must transfer 50% of the value of those prizes to the State Treasury as stipulated in Article 96.4 of the Commercial Law. - In case of any discrepancy or inconsistency between the English version and Vietnamese version of these terms and conditions, the Vietnamese version shall prevail. 6 10. The Customers will receive Gifts at one of HSBC branches. 11. The notified Customers must show the original copy of his/her identification card or passport. HSBC will verify Customers before giving the Gift. In the case that the Customer has authorised another person to collect his/her gift, the authorised person must present the original copy of his/her identification card or passport, the certified true copy of the Customer s identification/passport and the authorization letter legally verified as stipulated by the law. 12. The Customers must collect their gifts no later than 18 December If the Customers refuse to receive their gifts at the time they are notified, they will be deemed to have forfeited their gifts and shall not be able to claim the gifts at a later date. 13. HSBC is not the supplier of the Gifts in the Campaign and thus shall not be responsible for any enquiries or disputes related to the Gifts. Customers must contact the Supplier for such enquiries or disputes. 14. In case of any dispute arising from the Campaign, the HSBC s decision shall be final. 15. In case of any discrepancy or inconsistency between the English version and Vietnamese version of these terms and conditions, the Vietnamese version shall prevail. Issued by HSBC Bank Vietnam Ltd.
