Singhal Director General EPCES CIRCULAR NO. 27 DATED Sub : (1) Jurisdiction for issuance of Import Export Code Number to SEZ Units : DGFT Public Notice No. 66 dated (2) Ministry of Commerce & Industry letter F.No. 1/153/2007-SEZ, dated 22/8/08, regarding carrying out of default operations by SEZ Developers/Co-developers and allowing duty free material for the same. (1) Jurisdiction for issuance of Import Export Code Number to SEZ Units : DGFT Public Notice No. 66 dated (i) After the open house meeting, under the Chairmanship of Shri G.K. Pillai, Secretary, Ministry of Commerce & Industry, organized by EPCES in Mumbai on 20/6/2008, a meeting with all the Directors of STPIs was convened by Secretary Commerce and Secretary IT. The issues raised in the open house in relation to IT Sector SEZs, were clarified in this meeting. This has already been informed vide EPCES Circular No. 17 dated In this meeting a issue was raised regarding issuance of Import Export Code (IEC) number to SEZ units in the IT Sector SEZs. Now DGFT had issued Public Notice No. 66 dated (copy enclosed) wherein in the Appendix 1 (List of Regional Authorities and Their Jurisdiction), the following note has been added:- Sl.No.1 Units situated in multi product Special Economic Zones other than those mentioned at Sl.No above, shall come within the jurisdiction of respective Development Commissioners of the SEZs. In case of units in single product SEZs including IT/ITES SEZ, the work relating to issuance of IEC shall come under the jurisdiction of respective Regional Authorities of DGFT. With the issuance of this Public Notice, the jurisdiction for issuance of IEC number is as follows:-

2 (i) (ii) (iii) In respect of SEEPZ SEZ, Kandla SEZ, MEPZ SEZ, Cochin SEZ, Visakhapatnam SEZ, Noida SEZ, Falta SEZ and Indore SEZ, as given at serial No. 34 to 41 of Appendix I of Handbook of Procedures, Vol. I, the jurisdiction for issuance of IEC is with the Development Commissioners of these zones. As per the above stated amendment, in respect of multi product SEZs, other than mentioned at Srl. No. 1 above, the jurisdiction for issuance of IEC will be with the respective Development Commissioners of these Multi-Product SEZs. In respect of single product SEZs, including IT/ITES SEZs, the work relating to issuance of IEC shall come under the jurisdiction of respective Regional Authorities of DGFT. (2) Ministry of Commerce & Industry letter F.No. 1/153/2007-SEZ, dated 22/8/08, regarding carrying out of default operations by SEZ Developers/Co-developers and allowing duty free material for the same. Mr. Vijay Kumar, Director SEZ, Ministry of Commerce & Industry has issued a Letter F.No. 1/153/2007-SEZ dated 22/8/08, wherein it has been reiterated again that :- The issue relating to authorized operations in the notified SEZs was discussed in the meeting of the Board of Approval held on 22 nd June Since a time gap exists between the date of notification and actual approval of the authorized operations by the Board of Approval, to avoid delays in the project implementation, the authorized activities, as per the list enclosed at Annexure were approved by the Board of Approval as default operations which may be carried out by the Developer or Co-Developer, as the case may be, after the SEZ is notified. 2. The Development Commissioners/Unit Approval Committee may allow the Developers/approved Co-developers duty free material for these default authorized activities from the date of notification of the SEZ. 3. For other authorized activities, the Developer/Co-Developer may make a separate detailed application, indicating the size and quantum of the activities, to the Board of Approval. A copy of this letter is enclosed alongwith. Earlier letter was circulated vide EPCES Circular No. 15 dated Hence these activities can be started by Developer/Co-developer immediately after a SEZ is notified.
