1 1 Data Management Policy on data management and data protection activities related to the issuance of named match tickets and season tickets, stadium admissions, webshop operation and use, as well as on the issuance of Football Cards IMPORTANT! This Data Management Policy applies only to data management where the Data Manager is the Hungarian Football Federation, i.e., more specifically it applies to data management relating to the Football Card, the central ticketing system, the central club card system and the sports events organised by HFF. With regard to any information concerning a sport event organised by a club, or the sale of the club cards and tickets of that club, the provisions of the Data Management Policy of the respective club shall be applied. The collection of responses to the frequently asked questions concerning data management, illustrated with figures, is available at under the title of FAQs / Information Privacy. 1) Introduction The Hungarian Football Federation (1112 Budapest, Kánai út 2/D., hereinafter: HFF, Service Provider, Data Manager), as Data Manager hereby agrees to be bound by the contents of this legal statement. It agrees to ensure that all data management processes of the Federation related to its official website ( the central ticketing system it runs and the central club card system comply with the requirements laid down in this Data Management Policy and the legal regulations in force. Furthermore, HFF agrees to have these rules and requirements observed by all third parties (ticket sellers, etc.) involved in the operation of these systems. HFF reserves the right to modify this Policy. HFF shall notify users about the changes to this Policy in the form of an announcement on its website 15 days before the changes take effect. The amendment of this Policy cannot be retroactive, however from the effective date the modifications shall extend to all already purchased and valid tickets and football cards to the Data Manager s events, to all ticket, season ticket and card holders, as well as to persons entering stadiums equipped with an access system and used by the Data Manager in a documented manner. This Data Management Policy shall apply to the holders and applicants of club cards, Football Cards (hereinafter collectively: club cards) specifically developed for HFF in the club card system operated with the involvement of HFF, the Data Manager, the data processors, persons that buy tickets or season tickets to and enter sports events organised by the Data Manager in a documented manner, furthermore, to foreign events organised with the involvement of the data processor, and to spectators who buy named match tickets through the Data Manager or its ticket sales partner or online at meccsjegy.mlsz.hu. With regard to the data management related to a sport event organised by a club, or a club card of a club, the provisions of the Data Management Policy of the respective club shall be applied. The HFF only acts as a co-ordinator ensuring the operation of the club card systems and the ticket sales system, the communication of the systems and the IT background to be provided by professional service providers. HFF does not have access to the personal data of the holders of club cards of specific clubs, or supporters purchasing tickets to the events of the clubs. The individual clubs do not have access to the personal data of supporters of other

2 2 clubs of the HFF, unless the supporters purchase a ticket to an event organised by them by using a club card issued by a different club or by HFF. This Data Management Policy shall remain in force until revoked. TEX Hungary Kft. is the ticket seller of HFF, it issues the football cards and performs customer service tasks. The sub-data processors of TEX also include other ticket sellers of TEX Hungary Kft., and its contractual partners delivering the issued club cards to the applicants. The details of such contractual partners can be accessed on the address, and can be viewed at the ticket offices of the stadiums used by HFF during the sale of tickets.

Company registration number: address: 3 The developer of the central ticketing system, Jegymester Kft., commissioned by Nádor Rendszerház Kft., provides support to the system and, as a subcontractor (as well as data processor) of TEX Hungary Kft., takes part in the sale of tickets. As an agent of Nádor Rendszerház Kft, it is also involved in the operation of the webshop at meccsjegy.mlsz.hu. With regard to the central ticketing system and the own club card holders in relation to the central club card system as well as own events, the sports organisation (organiser of the event) issuing the tickets, season tickets or club cards in the systems is deemed the Data Manager. 4) The legal basis and legal background of data management The main conditions of data management are regulated by the following acts: - Act CXII of 2011 on the Right of Informational Self-Determination and on Freedom of Information (hereinafter: Privacy Act); - Sections and 76/A of Act I of 2004 on sports (hereinafter: Sports Act); - Act XLVIII of 2008 on the Basic Requirements and Certain Restrictions of Commercial Advertising Activities (hereinafter: Act on Commercial Advertising Activities); - Act VI of 1998 publishing the Convention on the protection of individuals during automated processing of personal data, signed in Strasbourg on 28 January 1981; - Government Decree 54/2004. (III.31.) on the safety and security of sports events; - Directive 95/46/EC of the European Parliament and of the Council (24 October 1995) on the protection of individuals with regard to the processing of personal data and on the free movement of such data. The Data Manager manages two completely different sets of data. In compliance with this, the legal basis for recording and storing personal data in accordance with Section 5 (1) b) of the Privacy Act is the legal authorisation granted in Section 72/B (2) of the Sports Act (hereinafter: mandatory data management). In the case of data that can be provided for contact and marketing purposes as well as data to be provided for purchasing named match tickets and for invoices the legal basis for data management can only be the data subject s consent in accordance with Section 5 (1) a) of the Privacy Act, and Sections 6 (1)-(2) of the Act on Commercial Advertising Activities (hereinafter: consent based data management). The legal basis for requesting data from the Sports Safety and Security Database managed by the police is the legal authorisation based on Sections 72/A (8) and 73 (6) of the Sports Act. 5) The group of manageable personal details and the purpose of data management The scope of mandatory data management is specified in Section 72/B. (2) of the Sports Act. Pursuant this section, the manageable data include the ticket, season ticket or club card holder s: a) name, b) date and place of birth, c) mother s name,

4 4 d) residential address. HFF neither records, nor manages biometric templates. In the case of mandatory data management the Data Manager can decide on using the data specified in Section 72/B (2) only for the criminal or minor offence proceedings launched because a crime or minor offence was committed at the venue of the sports event, or on the way to/from the venue of the sports event, as well as for the purpose of exclusion from the sports event. Pursuant to Section 73 (2) of the Sports Act, the term of a ban from attending sports events may not be shorter than six months, and may not exceed two years. A ban from entering a specific sports facility can last from six months to four years. HFF will decide on the starting date and duration of the ban on a case by case basis, depending on the circumstances of the act committed. The perpetrator s address will be deleted from the system after the relevant ruling has been delivered to the recipient. For data query from the Sports Safety and Security Database the IT system primarily uses the name and the date and place of birth of the person concerned. If these data can be attributed to more than one person, the data query may extend to other personal data, too (e.g. mother s name). Within the framework of consent based data management, manageable data include data uploaded by the data subject in a voluntary, unambiguous and express manner upon being adequately informed in advance, data provided for contact purposes and/or data specified in Section 6 (1)-(2) of the Act on Commercial Advertising Activities, and/or data uploaded during online registration and application for a football card. In accordance with the cardholder s instructions, for contact and/or marketing purposes the Data Manager can only manage the cardholder s a) name; b) club card number; c) electronic mail address; d) phone number; e) home address; f) signature. In case consent has been given for the use of contact details for marketing purposes, the number and nature of attended matches will be kept on file for the purpose of customised commercial communication. The objective of consent based data management is to ensure communication between the fans and the club card issuer for the issuance, revocation, renewal, etc. of the club card, and/or the provision of information about sports and other events organised by the Data Manager, about the discounts available to club card holders, and to deliver customised commercial offers. For the operation of the club card system (identification of the affected persons, documentation of their statements, and for the purpose of error free operation) the management of the following data is indispensable: a) club card number; b) club membership category; c) date and time of the submission of the card request; d) place where the card was picked up; e) preregistered or not; f) a PIN code (a 4-digit code, to enhance the security of the card); g) signature of the member or his legal representative; h) in the case of persons under 16 years of age, the name and address of the legal guardian (typically the parent).

5 5 The photo made available to the Data Manager for printing the club card will automatically be deleted during printing. The uploading of data required during electronic pre-registration for ordering the Football Card and for speeding up the process of card issuance shall be regarded as the provision of consent as per Section 5 (1) of the Privacy Act. Such uploading of data is deemed to be based on adequate information supply and shall be regarded as the voluntary and firm expression of the will of the data subject, who thereby gives his express consent to the management of his personal data required for the issuance of the club card and for further communication. In the course of registration required for using the webshop, following the consent of the data subject and the voluntary supply of data, the following personal data shall be managed in the system: a) name; b) address; c) phone number; d) invoicing address: During online pre-registration the webpage logs website visits for the secure operation of the website, as well as for the prevention and detection of possible abuses. The log file includes the date and time of the visit, the address of the visited website, the IP address of the visitor s computer, the IP address of the proxy computer in case a proxy is used, as well as information related to the user s operating system and browser. During the analysis of the log files the Data Manager does not link the data with other information, and makes no efforts for the identification of the visitors. The IP address is a string of numbers with the help of which the computers of internet users can be clearly identified. The IP address is even suitable for the geographical localisation of a visitor that logs into the internet from a certain computer. The addresses of the visited websites, the dates and times of the visits alone are not suitable for the identification of the data subject, however in combination with other data (e.g. data provided during registration) they can be used to deduct user specific information. The meccsjegy.mlsz.hu website uses cookies and contains Google Analytics codes. 6) Period of data management Data subject to mandatory data management can be stored for 3 working days from the expiry date of the match ticket, season ticket or Football Card, as per Section 72/B (2) of the Sports Act. After that period, the system shall automatically delete the data when a Football Card or a ticket or a season ticket is invalidated or redeemed unless the authority or the Data Manager orders otherwise. In the case of consent based data management the provided personal data can be used until the expiry of the club card or the revocation of the consent. If the card requester fails to pick up his card he requested online, his data will be deleted from the system after 30 days, and the card will be destroyed. Data are stored in the log files of the website for 365 days. The personal data supplied for using the webshop are managed until the consent is withdrawn or for 5 years from the last date of purchase of the ticket and then they shall be deleted automatically without any prior notification. Pursuant to the Privacy Act, the Data Manager shall maintain data transfer records to allow for checking the lawfulness of data transfers and for the provision of information to the data subject. Such records shall contain the date and time of the transfer of personal data it manages, the legal basis for and the addressee of the data transfer, as well as other data

6 6 specified in the law requiring data management. Pursuant to Section 15 (3) of the Privacy act the Data Manager can store these data for 5 years. After the personal data are deleted, information on data management can only be given on the basis of the card number or the bar code on the ticket, purchased without a card. Returned Football Cards shall be destroyed within no more than 10 working days from the date of request for the cancellation. In the case of consent based data management the declaration of consent will be destroyed as soon as possible after the consent is revoked. 7) Data management for Sports Safety and Security Reasons Pursuant to Section 72/A (8) of the Sports Act when selling club cards the organiser or the person selling tickets on behalf of the organiser has the right to compare the spectator s personal data with those kept in the Sports Safety and Security Database. Pursuant to the provisions of the Sports Act, the Data Manager, the entity selling tickets on behalf of the organiser and the security organisation may request information from the Sports Safety and Security Database for the purpose of ticket sales and admission to sports events. Pursuant to the provisions of the Sports Act, a spectator can be admitted to the venue of a sports event if he agrees to identify himself when asked to do so by a security staff member. At the time of admission the security staff can check the match ticket or season ticket holder s identity, and can compare shall compare when ordered to do so by the police with the data shown on the match ticket or season ticket. If an access system is used, and if the use of club cards has been made mandatory by the organiser, the organiser can check the identity of the match ticket or season ticket holder by comparing the personal data shown in his official identity document shall compare when ordered to do so by the police with the data subject to legal data management and shown on the club card presented by the match ticket or season ticket holder. Pursuant to Section 72/B (5) of the Sports Act, within 3 working days from the expiry of the match ticket, season ticket or club card the affected spectator s name, place and date of birth, mother s name and residential address can be transferred to the investigation agency, the prosecutor s office or the court upon request for the purpose of evidence collection in a criminal or minor offence proceedings. The security staff shall transfer to the organiser the personal data recorded for the purpose of exclusion. The organiser shall transfer to the Sports Safety and Security Database the name as well as the place and date of birth of the subject of the banning order, the length of the ban, the name of the sports facilities and the group of sports events affected by the ban, within 3 days. Pursuant to Section 72/A (7) of the Sports Act the organiser or the person selling tickets on behalf of the organiser has the right to check the identity of the spectator on the basis of official identity documents and the data shown on the club card when selling match tickets or season tickets. Based on a written contract, the security organisation acting on behalf of the Data Manager on a case by case basis can have access to the personal data shown in the personal identification document, on the match ticket, season ticket or club card presented at entry for identification purposes. Notes about such personal data can only be taken if the security staff must determine the identity of the spectator to be removed from the sports facility, and if such information is needed for the exclusion procedure. The contents of the notes shall not go beyond the set of personal data that can be managed pursuant to the law. Information collected in this manner can be used by the security staff only for transfer to the organiser of the sports event or to the authorities arriving at the scene.

7 7 8) Parties to have access to the data - the ticker purchase process If a party purchases a ticket for an event of a club other than the club issuing their club card, by using the club card, the party consents to the transfer of their personal data by the Data Manager to the organiser and data processor of the match through the central ticketing system and the central club card system. Based on the authorisation granted pursuant to Section 72/A (7) of the Sports Act, and assuming that the party intends to purchase a ticket, in the ticket purchase process the following parties may have access to the data in order to be able to sell the ticket: I. Purchase by using a club card in general a) in the ticket office of a Hungarian stadium: Only the club organising the match and its data processor (e.g., the cashier, who is the employee or subcontractor of the club) can see the data. b) at the ticket office of the visiting team: If the admission tickets for an away match are sold to the visiting supporters by the visiting club, they do so on the order of the organising club (Data Manager), i.e., they proceed as the data processor of the Data Manager. In such cases the visiting club (or cashier) registers and uploads the personal data to the organiser of the match. The cashier of the visiting team sees the data and, apart from the cashier, the organiser of the match (home club) may have access to the data. c) at a reseller: The personal data of supporters purchasing tickets in the national network of Ticket Expressz (TEX) are seen by TEX, acting as the data processor of the clubs (and HFF) and they can be accessed by the organiser of the match. d) ticket purchased online: When tickets are purchased on meccsjegy.mlsz.hu website, the customer enters their own card number and PIN code into the system, which then collects the personal data from the data managing club through the club card register. The personal data are saved only if the customer purchases the ticket. When purchasing a ticket, the supporter sends their personal data to the organiser of the match themselves. The club card issuing club (or in the case of Football Cards, HFF) receives only statistical data indicating that the supporter purchased one ticket for an away match but even that can happen only if the supporter consented to the management of their data for marketing purposes. Only the organiser of the match and its data processors can have access to the personal data. Only Jegymester Kft., i.e., the subcontractor of Nádor Rendszerház Kft. operating the website can have access to the personal data provided on meccsjegy.mlsz.hu website, in order to be able to use the webshop and for contacting purposes. The personal data managed in that manner will not be transferred to any third party. II. Matches organised by FTC and DVSC Tickets for the matches of the two clubs can be purchased in the clubs own ticket sales systems, the central ticketing system is used only by the visiting supporters. The data are accessible only by the organiser of the match (FTC, DVSC) and by the data processors. Only the organiser of the match and its data processors (e.g., cashier, TEX) can have access to the personal data. In the course of ticket purchase, the data are managed in the same way as described in Section I. d). Further information about data management by FTC and DVSC can be requested from them as Data Managers. III. Ticket purchase without a club card

8 8 The cashier registers the data in the ticket system and only the organiser and the organiser s data processors can have access to them. 9) Data protection measures The IT system developed with the involvement of HFF guarantees that: - only authorised persons can have access to the managed personal data, using their specific user names and passwords; - the roles created in the system ensure that each person can access data only to the extent required for performing his job; - personal data related operations specified in Section 3 (10) of the Privacy Act are stored in the system. Such operations can only be performed by authorised persons with specific usernames and passwords; - During queries from the Sports Safety and Security Database, as well as during electronic data transfer of any kind personal data are transferred between the IT systems in encrypted format. The organiser of the sports event transfers the data of the individual purchasing the ticket by coding them with the hash algorithm (depersonalisation of data). The police use the same hash algorithm to code the data kept in its records and then, by comparing the received and recorded data, it may conclude whether the individual is subject to ban or exclusion and the system sends a response to the organiser. The police do not have access to the personal data of individuals not subject to ban or exclusion. The Data Manager and the data processors hereby state that they have developed adequate security measures for the protection of personal data from unauthorised access, modification, transfer, disclosure, deletion or destruction, as well as from accidental damage or destruction. The Data Manager and the data processor have made sure to inform employees with access to the data about the data protection requirements. The Data Manager and the data processor shall not forward any of the accessed personal data to third parties not authorised to access such data by law. Nor shall they forward such information to any person not mentioned in this Policy, and/or without the consent given by the affected data subject. The Data Manager shall maintain a data transmission log in accordance with Section 15 (2) and an incident log in accordance with Section 15 (1a) of the Privacy Act. While purchasing tickets online, personal data are accessible only by using the combination of the right card number and the correct PIN code. Club cards may also be used without a PIN code in ticket offices if the cards are also physically present. The club as Data Manager and its data processors have access to personal data but each club can only see their own data. The HFF can see only data of football card holders and individuals purchasing tickets to its events. The systems communicate with each other through an encrypted VPN (virtual private network) network with certified authentication (OpenVPN SSL). Users can access the pages of the webshop, the central ticketing system and the central club card system through a secure, encrypted link (SSL), therefore user data enjoy maximum protection. 9 9 NoJvNQ&lang=EN 9) The rights of the data subject Within the period of data management the data subject is entitled to - receive information, - have his data rectified, - have his data blocked, - object to data processing, - the deletion of data managed on the basis of the data subject s consent. The spectator who holds a valid match ticket but does not wish to attend the sports event, and therefore returns his ticket to the ticketing system, or the spectator who initiates the cancellation of his club card, has the right to have his data deleted from the club card and the ticketing system. The person concerned can ask the Data Manager for information about the management of his personal data. The Data Manager shall inform the person concerned in writing and in an understandable manner as soon as possible, but not later than 25 days from the submission of the request. Information shall be given about the managed data, the purpose, legal basis and period of data management and in case the data have been transferred to a third entity details of the entities that receive or have received the data, and about the purpose of such a data transfer. After data management is completed, personal data are deleted from the systems and the databases. After that the data subject can request information about the use of his data only by giving his club card number (or the string of numbers forming part of the bar code in the case of match tickets or season tickets). The Data Manager can deny the provision of information only in cases specified in the Privacy Act and within no more than 25 days. If information supply is denied, the Data Manager shall inform the data subject about the fact that he can seek legal remedy in court, or before the Hungarian National Authority for Data Protection and Freedom of Information (hereinafter: the Authority). Within the period of data management the data subject can request the Data Manager to rectify his personal data. The data subject can ask the Data Manager to block personal data other than those stored for mandatory data management, if the permanent deletion of such data would harm the lawful interests of the data subject. Blocked personal data can be managed as long as the data management objective that excluded the deletion of the personal data persists. Pursuant to Section 21 (1) of the Privacy Act, the data subject shall have the right to object to the processing of his personal data: - if processing or disclosure is carried out solely for the purpose of discharging the Data Manager s legal obligation or for enforcing the rights and legitimate interests of the Data Manager, the recipient or a third party, unless data management is mandatory; - if personal data is used or disclosed for the purposes of direct marketing, public opinion polling or scientific research; and; - in all other cases prescribed by law. The data subject can revoke his consent to the management of his personal data within the framework of consent based data management at any time, without justification and free of charge by instructing the card issuer to do so. The addresses indicated above inform the system operator on the revocation immediately in order to make it effective.

10 1 The data subject may request modification in their personal data managed based on their consent or may revoke the consent free of charge in an message sent to or, if they hold a club card, then they can do the same themselves online by using the website. If the data subject receives a newsletter or direct marketing or any other message relating to the validity of the club card from HFF, they can revoke their consent by clicking on the link included in the letter. The Data Manager or his authorised representative will regard the request sent by the applicant to the futballkartya@tex.hu address from the address given by the applicant/purchasing customer as his expressed will if the request is confirmed via by the Data Manager or his data processor when asked to provide such conformation. Data will be deleted after the confirmation is received. The data subject can submit his request for the modification or deletion of his personal data managed on the basis of legal authorisation in person to the Data Manager, at the place where he picked up his club card, or by post by submitting a certified copy of the original document verifying the change of data (e.g. marriage certificate, doctorate certificate, etc.), or a private document providing full evidence of his personal data. 11) Available legal remedies If a person believes that the law has been violated in connection with the management of personal data, or a direct risk thereof is imminent, he can initiate a procedure at the Authority for the elimination of the assumed unlawful data management practice (mailing address: 1530 Budapest, Pf.: 5., ugyfelszolgalat@naih.hu). The data subject can seek remedy in court if his right of informational self-determination is breached. If a request for information supply, data correction, deletion or blocking is denied, the Data Manager shall inform the data subject about his right to seek legal remedy in court or to turn to the Authority. If the data subject believes that the Data Manager, or the person or company conducting direct marketing activities on its behalf has violated the provisions of the Act on Commercial Advertising Activities, it has the right to launch a supervisory procedure at the National Media and Infocommunications Authority of Hungary due to unsolicited electronic advertising. 12) Data protection ID numbers of the data management systems: NAIH-79027/2014 Data management related to contact details for the preparation and issuance of Football Cards. NAIH-78898/2014 Data management related to details required for the delivery of newsletters and individual offers to Football Card holders. NAIH-70172/2013 Data management related to the operation of the webshop, and to the sale of named match tickets and season tickets. Effective date: 11 March 2016.
