4 How can legal services help Provide holistic service health care? Access to correct information in regards to changes in labor and/or immigration laws in your state and nationally. Knowledge of current migrant farmworker laws. Knowing the law helps you recognize violations!!! The legal services provider in your area may be willing to host workshops on migrant farmworker law. Help to ensure that correct legal information is disseminated to the farmworker community.

5 How can health care help legal services? Extra eyes and ears at the camps. Distribute legal services information to workers. Assist legal services with organizing information workshops for workers through the growers. (Pesticide, Field Sanitation & Safety) Educate the community about the plight of the migrant farmworker community. Provide information on pressing health issues that affect the migrant farmworker community.

6 Common Objectives Provide migrant farmworkers with access to information. Educate the community at large about the working and living conditions that migrant farmworkers face. Create awareness. Provide quality services to migrant farmworkers and their families. Improve the quality of life for migrant farmworkers. How is it that health and law have the same objectives?

7 Seasonal vs. Migrant Over 3 million migrant and seasonal farmworkers in the United States. Seasonal an individual whose principal employment is in agriculture on a seasonal basis who has been so employed within the last 24 months. Migrant establishes for the purposes of such employment, a temporary abode.

8 National Farmworker Facts Migrant Farm Labor supports the 28 billion dollar fruit and vegetable industry in the US; 85% of which are hand harvested and/or cultivated. One-Half of all individual farmworkers earn less than $7500 per year. One-Half of farmworker families earn less than $11,000 per year. These yearly earnings are far below the 2002 U.S poverty level of $18,100 for a family of four. 81% of all farmworkers are foreign-born.

9 National Farmworker Facts (cont d.) 77% of all farmworkers were born in Mexico. The average farmworker is 31 years old. 80% of farmworkers are men. 5 out of 6 farmworkers are native Spanish speakers. 12% earn less than minimum wage. Much of farm work is seasonal and workers cannot earn money in bad weather, while waiting for crops to ripen, when they are sick, or when traveling to their next job.

10 National Farmworker Facts (cont d.) There is only a 50.7% high school graduation rate among migrant teenagers. Frequent moves and the need to have them contribute to family income makes school attendance difficult. At least one-third of migrant children work on farms to help their families. Some children may not be hired directly but are in the fields helping their parents.

12 Let s Talk About THE LAW! H2A Visa Program Migrant Seasonal and Seasonal Agricultural Worker Protection Act Field Sanitation under the Occupational Safety and Health Act Housing Requirements

13 The H2A Visa Program Under the Immigration and Nationality Act, an alien may be admitted temporarily to the United States to perform agricultural labor if unemployed U.S. workers cannot be found to perform on the job. 8 U.S.C That U.S workers rather than aliens be employed wherever possible. H-2A workers may only be admitted to perform tasks in agriculture. There are insufficient U.S. workers able, willing, qualified, and available at the time and place needed. That the employment of guestworkers do not adversely affect the wages and working conditions of U.S. workers.

14 Protections under H2A Program Protection of U.S. workers from discrimination Employer may not offer better wages and working conditions to alien workers than it offers to U.S. workers. Employer may not impose any job restrictions or obligations on U.S. workers than it does not also impose on H-2A workers. Transportation Employer shall provide transportation or reimburse costs of inbound transportation and subsistence en route for any worker who completes 50% of the contract period. To the extent that these expenses reduce the worker s 1 st week earnings below the FLSA minimum wage, the employer is obligated to reimburse during the 1 st work week the portion of these expenses needed to raise the worker s earnings to minimum wage. Employer shall also provide or pay for transportation and subsistence costs from which the worker came. Free Housing

15 Migrant & Seasonal Agricultural Worker Protection Act (MSPA or AWPA) Protects non-h2a migrant and seasonal farmworkers. Provides employment-related protections to migrant and seasonal agricultural workers and is administered and enforced by the Wage and Hour Division of the U.S. Department of Labor. Responsibility for compliance is placed directly on agricultural employers, agricultural associations, and farm labor contractors. Definitions and in depth explanations can be found at 29 U.S.C et seq.

16 Protections under MSPA/AWPA Disclose the terms and conditions of employment to each migrant worker in writing at the time of recruitment and to each seasonal worker when employment is offered, in writing if requested. Post information about worker protections at the worksite. Pay each worker the wages owed when due and provide each with an itemized statement of earnings and deductions. Make and keep payroll records for each employee for three years.

17 Protections under MSPA/AWPA (cont d.) Ensure that housing, if provided, complies with substantive federal and state safety and health standards. Ensure that each vehicle, if transportation is provided, meets applicable federal and state safety standards and insurance requirements and that each driver be properly licensed. Comply with the terms of any working arrangement made with the workers. Agricultural workers can have more than one employer at the same time.

19 Field Sanitation under the Occupational Safety and Health Act (OSHA) OSHA was enacted in 1970 to assure safe and healthful working conditions for working men and women. OSHA field sanitation standards require covered employers to provide: toilets, portable drinking water, and hand-washing facilities to hand-laborers in the field; to provide each employee reasonable use of the above; and to inform each employee of the importance of good hygiene practice. Employers who fail to comply may be subjected to fines and criminal or legal action.

20 Field Sanitation under the Occupational Safety and Health Act (OSHA) (Cont d.) Drinking Water employer must provide portable drinking water, suitably cool and in sufficient amounts, dispensed in single use cups or by fountains, located so as to be readily accessible to all employees. Toilets and Hand-washing Facilities employers must provide one toilet and hand-washing facility for every 20 employees, located within a quarter mile point. Employers must maintain such facilities in accordance with public health sanitation practices.

26 Housing Standards Well drained and free from depressions in which water may stagnate. Not subject to, or in proximity to conditions that create or are likely to create offensive odors, flies, noise, traffic, or any similar hazards. Single beds not less than 50 square feet of floor per occupant. Bunk Beds not less than 40 square feet of floor per occupant. Separate accommodations for each sex or family.

27 Housing Standards All outside openings shall be protected with screening. Toilets for each sex shall be in the ratio of not less than one such unit for each 15 occupants. Except in individual family units, separate toilet accommodations for men and women shall me provided. Toilets shall be distinctly marked. Common use toilets shall be well lighted and ventilated and shall be sanitary and clean. Bathing and hand-washing facilities, supplied with hot and cold water for all occupants.

28 Housing Standards A minimum of 1 showerhead per 15 persons. Stove with a minimum of 2 burners. 1 stove to 10 persons or 1 stove to 2 families. Housing and facilities shall be free of insects, rodents, and other vermin. Fire extinguishing equipment shall be provided in a readily accessible location not more than 100 feet from each housing unit. Agricultural pesticides and toxic chemicals shall not be stored in the housing area.

29 Non-adversarial Approach File housing complaints with the Department of Labor for housing and field sanitation violations. Farmworkers can file the complaints. Health and Legal service providers can file complaints with DOL on behalf of farmworkers. DOL has the capacity to investigate housing complaints and look into other possible violations such as, wage and travel reimbursement.
