3 1. TITLE Driveway Crossover Policy 2. POLICY STATEMENT Council s Policy for clarifying the responsibilities of developers and owners of property for the construction and maintenance of driveway crossovers for development, subdivisions and owner occupied dwellings. 3. PURPOSE The purpose is to; Assist the community in understanding their responsibilities regarding driveway crossovers. To provide direction for Council Officers for the management of driveway crossover construction and maintenance within Alpine Shire. To provide consistency in streetscapes for towns, villages and rural roads within Alpine Shire. 4. SCOPE This policy applies to the construction, alteration and maintenance of all driveway crossovers in the Alpine Shire including subdivisions, development and owner occupied dwellings. 5. POLICY DETAILS 5.1 Construction of Crossovers The powers of Council in relation to Vehicle Crossings are granted in Section 206, of the Local Government Act 1989 and detailed under Schedule 10, point 12 of that Act. As such Council requires all property owners to meet the full cost of providing any vehicular assess from the road carriageway to the property boundary. In the event of New Subdivisions, the land developer responsible for the subdivision will also be responsible for providing the driveway crossover from kerb or road carriageway to the property boundary to the satisfaction of the responsible authority. This assists the developer to satisfy the objectives of the Alpine Shire Planning Scheme for Built Environment, Clause and Lot Access, Clause
4 The owner/occupier of a property must apply to Council for permission prior to constructing a new driveway crossing. Permission is granted in the form of a Works within Road Reserve Permit. The crossover shall be constructed to a minimum standard to Alpine Shire Council Standard Drawings for Residential, Rural and Commercial crossovers. 5.2 Reinforced Concrete Driveway Crossover A property or subdivision lot requiring a new or upgraded crossover that as its legal access has frontage onto kerb and channel shall have as a minimum standard, a reinforced concrete driveway crossover constructed to Alpine Shire Council specification from and including the Kerb inlet to the property boundary. The surface finish is to be plain smooth un-coloured concrete from the road to the property boundary to ensure consistent streetscape is maintained. In the case of a new subdivision or development, the developer shall be required to construct a reinforced concrete driveway crossover to Alpine Shire Council specification from and including the Kerb inlet to the property boundary for each lot. 5.3 Bitumen Seal Driveway Crossover A property or subdivision lot requiring a new or upgraded crossover, that as its legal access, has frontage on a bitumen sealed road with no kerb and channel shall have as a minimum standard a bitumen driveway crossover constructed to Alpine Shire Council specification from the edge of the road carriageway seal to the property boundary. In the case of a new subdivision or development, the developer shall be required to construct a bitumen sealed crossover to Alpine Shire Council specification from the edge of the road carriageway seal to the property boundary. 5.4 Crushed Rock Gravel Driveway Crossover A property or subdivision lot requiring a new or upgraded crossover, that as its legal access has frontage on an unsealed road with no kerb and channel shall have as a minimum standard a crushed rock gravel driveway crossover constructed to Alpine Shire Council specification from the edge of the road carriageway to the property boundary. In the case of a new subdivision or development, the developer shall be required to construct a crushed rock crossover to Alpine Shire Council specification from the edge of the road carriageway seal to the property boundary. 5.5 Existing Crossovers 4
5 Where a subdivision or development includes an existing driveway crossing, the existing crossover shall be required to be upgraded to the required current standard as specified above. For example, for a two lot subdivision with an existing dwelling on one lot, the crossover to this lot will be required to be upgraded to the current standard. 5.6 Maintenance, Modifications and Repair of Crossovers Council requires all owners of property to maintain their driveway crossovers to an acceptable standard. Where an existing driveway is in a dilapidated condition, the property owner will be given notice to rectify and if necessary repairs be undertaken at the property owners cost in accordance with Section 206, of the Local Government Act Any modification to the shape or alignment of an existing driveway crossover, including kerb inverts, is the responsibility of the property owner. The owner/occupier of a property must apply to Council for permission prior to works of this type. Permission is granted in the form of a Works within Road Reserve Permit. 5.7 Redundant crossover Redundant crossovers must be removed at the same time as the construction of any new crossing, prior to the completion of development works, and where access to a property has been altered or prohibited by changes to the property. The cost of removal of the existing crossover and the reinstatement of street assets (i.e. footpath, naturestrip, kerb and channel and road pavement) is borne by the applicant, and must be in accordance with the relevant Council standards. A Council Works Within Road Reserve Permit is required for this work. 5.8 Second crossover Each lot is allowed a single crossover for the purpose of access. On request in writing from the property owner to Council a second crossover may be considered on a case by case basis. For the request to be considered minimum criteria is required to be met as listed below; a minimum property width of 22 metres is required for the installation of a second vehicle crossing. A minimum distance of 12 metres is required between crossings servicing one property, to accommodate two (2) on street parking spaces in front of that property. To preserve the garden character off a neighbourhood, the crossings should not dominate a development or street frontage. It is considered that the visual intrusion of two crossings of 6 metres in total width of property frontage of less than 22 metres would dominate the 5
6 street frontage and would lead to a detrimental effect on the streetscape. The minimum width of any crossover is to be 3.0 metres. 6. ROLES AND RESPONSIBILITIES The Manager of Engineering and Assets Services is responsible for the administration of the Driveway Crossover Policy. 7. SUPPORTING GUIDELINES This policy is supported by the: Road Management Act 2004 Local Government Act 1989 Alpine Shire Planning Scheme 8. HUMAN RIGHTS CHARTER This policy does not contravene the Victorian Government s Human Rights Charter. 9. MONITORING AND REVIEW The Development Engineer shall monitor the driveway crossover construction and maintenance activities to ensure the Policy is adhered to. 10.
