1 Backgrund Checks Plicy f the Dicese f Trentn Regarding Criminal Histry Backgrund Checks Fr Emplyees and Vlunteers wh have Cntact with Children, Yung Peple & Vulnerable Adults At its June 2002 General meeting, the full bdy f the United States Cathlic Bishps apprved the Charter fr the Prtectin f Children and Yung Peple. The Charter was finalized at the Bishps Nvember 2002 General Meeting. Article 13 f the Charter instructs each Dicese t evaluate the backgrund f all dicesan and parish persnnel wh have regular cntact with minrs. As part f its cmmitment t implement the Charter and in furtherance f its cmmitment t prtect ur children and yuth, the Dicese f Trentn adpts this Plicy f Criminal Histry Backgrund Checks. The Plicy mandates criminal histry backgrund checks fr all priests, deacns, and seminarians even if during the curse f their ministry they have n cntact with minrs. It mandates criminal histry backgrund checks fr all religius, emplyees, vlunteers and third-party vendrs wh during the curse f their wrk r vlunteer activity at any Dicesan entity, have direct cntact with minrs r vulnerable adults. This applies even t thse wh have ne islated cntact with minrs if that cntact invlves an vernight activity. Backgrund checks will be btained thrugh fingerprint analysis cnducted by the New Jersey State Plice and the Federal Bureau f Investigatin. Fingerprints will be taken by IndentG. The prgram will be administered by the Dicesan Office f Administrative Services and crdinated n the lcal level by designated dicesan, parish, and schl representatives. The plicy prvides that persns wh were cnvicted f, r plead guilty t, crimes and ffenses invlving sexual miscnduct r physical vilence will nt be permitted t wrk with, r vlunteer in the presence f minrs. Persns wh were cnvicted f, r plead guilty t, lesser crimes and ffenses cannt wrk with, r vlunteer in the presence f, minrs unless express written permissin is given by the Dicese after an investigatin int the facts surrunding the cnvictin r plea. The same hlds true fr persns wh are charged with cmmitting a crime, but were nt cnvicted r did nt plead guilty. All investigatin will be implemented by the Executive Directr f the Office f Child & Yuth Prtectin and the Chancellr/CAO f the Dicese f Trentn.
2 The Plicy is effective thrughut the Dicese f Trentn as f January 1, 2004 Wh must be checked? Dicese f Trentn - Backgrund Checks Plicy Outline All Priests, seminarians and deacns regardless f their ministry All candidates fr the ILEM and the Diacnate All religius and all Dicesan emplyees and vlunteers wh during the curse f their emplyment r vlunteer activity have nging, unsupervised, cnsistent cntact with a minr r vulnerable adult n an nging basis r will have cntact with a minr r vulnerable adult n ne ccasin invlving an vernight activity. These includes but are nt limited t the fllwing: Parish catechetical leaders and staff Religius Educatin teachers, aides & supprt staff Directrs and staff f Yuth Ministry Prgrams Athletic Caches Directrs f children s and yuth chirs Adult scut leaders Summer camp persnnel Maintenance Staff including cntracted staff Altar Server crdinatrs St. Vincent DePaul Ministers (Required by their Natinal Charter) Fr questins please cntact Je Williams jtwsvdp@msn.cm Visiting clergy All priests r deacns, wh wish t minister within the Dicese f Trentn, must submit a letter f suitability frm their Dicesan Bishp t the Bishp f the Dicese f Trentn. Criminal Histry Backgrund Check Updates In Octber f each year, parishes, schls, and each department f the Dicese f Trentn and every ther entity affiliated with the Dicese that deals with minrs must review its list f vlunteers and emplyees wh are required t have criminal histry backgrund checks. Anyne wh cmpleted a criminal histry backgrund check, thrugh the Dicesan Prcess mre than fur years prir must have an updated check thrugh the IndentG prcess. Fr example, in Sept. 2013, updated criminal histry backgrund checks must be perfrmed n anyne wh has a cmpleted criminal histry backgrund check, anyne wh has an incmplete criminal histry backgrund check r anyne wh was passed n an appeal, during the years f 2009 and earlier.
3 All criminal histry backgrund checks and updates must be perfrmed thrugh the new IndentG prcess n a yearly basis. Please make sure that all vlunteers/emplyees use the new 4.0 versin f the Universal Applicant Frm with crrect cding in bx 7 fr yur parish. All criminal histry backgrund updates must be cmpleted n later than December 31 st f each cnsecutive calendar year. Identificatin Cards All emplyees and vlunteers (including unpaid caches) wh have cmpleted a Dicese f Trentn Criminal histry backgrund check, will be issued a Dicesan Identificatin Card, which must be wrn at all times during the perfrmance f their respective jbs r vlunteer duties fr the Dicese. This includes, but is nt limited t, Scut meetings, sprting events, and Religius Educatin classes. Failure t wear and display the ID card culd result in the temprary remval f the individual(s) frm an event, activity, r schl. Dicesan ID Cards will nt be issued fr anyne wh has undergne the NJDOE criminal histry backgrund check prcess and clearance, all ID s will be issued by their respective schl. Schl emplyees, staff and vlunteers must wear any schl issued ID during the curse f their emplyment r vlunteerism. Failure t wear and display the ID card culd result in the temprary remval f the individual(s) frm an event, activity, r schl Temprary ID Cards will be issued fr new parish vlunteer and emplyee fr a 30 day perid nly. All criminal histry backgrund checks must be cmpleted within thirty days f nset f vlunteerism r emplyment. Failure t adhere t this time line culd result in the temprary remval f the individual(s) frm an event, activity, r schl. Wh will administer the Prcess? The prgram will be administered by the Dicesan Office f Child & Yuth Prtectin. The Dicese and the New Jersey Department f Educatin will use the New Jersey State Plice State Bureau f Investigatin and the Federal Bureau f Investigatin t cnduct a cmprehensive evaluatin f the individual s criminal histry. Csts fr the prgram are the respnsibility f the parish r the dicesan department where the subject wrks r vlunteers.
4 Backgrund checks include: fingerprint identificatin; state and federal crime recrds. Hw will the Dicesan Prcess wrk? Cnsent frms and IndentG applicatin frms will be handled at the lcal Parish level. All schl staff and vlunteers must utilize the NJDOE criminal histry backgrund check prcess and frms. NO EXCEPTIONS. A cpy f the cmpleted IndentG frm, fr each vlunteer r emplyee must be retained at parish level and must be submitted t the Office f Child and Yuth Prtectin t the attentin f Margaret Dziminski, upn request. Results f the backgrund checks are returned t the Office f Child and Yuth Prtectin, wh will then frward them t the apprpriate parish crdinatr. Ntificatin regarding disqualified applicatins is handled in a cnfidential manner and will be sent directly t pastr, president/principal and/r Superintendent f Cathlic Schls. Disqualified candidates may request an appeal meeting with the Executive Directr f Child & Yuth Prtectin and Child Prtectin Crdinatr. Disqualified grandfathered educatin persnnel may als request an appeal meeting. The Executive Directr f Child & Yuth Prtectin will ntify the apprpriate pastr, president/principal and dicesan administratr, in writing, when a disqualified candidate can be reinstated as a result f the appeal prcess. What is the cst f the Dicesan Criminal Histry Backgrund Check Prcess? IndentG Emplyees - $56.20 Vlunteers - $25.70 Csts will be paid by the vlunteer/emplyee. The parish will reimburse the vlunteer/emplyee n the return f the cmpleted applicatin frm. Vlunteers and emplyees will be reimbursed regardless f the results f the criminal histry backgrund check.
5 Nte: All fees are subject t change withut ntice Schl Staff & Vlunteers Revised 5/3/2013 Criminal Histry Backgrund Checks will be cnducted n emplyees, supprt staff and unpaid schl vlunteers f all Dicese f Trentn Schls accrding t the backgrund check prgram presently administered by and under the guidelines issued by, the New Jersey State Department f Educatin within 30 days f hire r nset f vlunteerism. New hires and current emplyees (printed after 2/2003) that have already cmpleted a criminal histry backgrund check must present a cpy f their clearance letter. If the schl they are presently emplyed by is nt listed n their criminal histry clearance letter and they were printed after Feb. 2003, they must submit t the archival prcess, s that their current schl is listed n their criminal histry clearance letter. This prcess is als administered thrugh the NJDOE. All schl emplyees and staff hired between Jan and Dec must submit t a new criminal histry clearance nly if their current schl is nt listed n their criminal histry clearance letter. Prints taken during this time frame were nt archived s they are unavailable fr the archival prcess. All disqualificatins as a result f the NJDOE prcess will be sent directly t the president/principal and applicant frm the NJDOE with subsequent recmmendatins. Grandfathered Persnnel Thse schl staff members that were hired prir t 1991 are legally grandfathered thrugh the Department f Educatin and are required t have their criminal histry backgrund check dne thrugh the dicesan prcess. These persns are required t have a fur (4) year update f their criminal histry backgrund check. Disqualificatins that result frm the dicesan prcess will be sent directly t the pastr, president/principal and Child Prtectin Crdinatr. Disqualified grandfathered educatin persnnel may als request an appeal meeting. All fees are the respnsibility f the staff member r vlunteer are nt subject t reimbursement frm the parish r schl unless therwise stated by said parish/schl.
