1 Regulation on Diving with Equipment as a Sport in Turkish Territorial Waters CHAPTER ONE General provisions Aim Article l The aim of this regulation is to define the principles of diving with equipment as a sport in Turkish territorial waters. Scope Article 2 This regulation covers the conditions of diving with equipment as a sport off regions where Cultural and Natural Property Underwater to be Protected and military zones determined and proclaimed by the decision of the Council of Ministers according to Article 35 of the Law on Cultural and Natural Property to Be Protected numbered Legal Ground Article 3 This regulation has been prepared based on Article 45 of the Regulation on the Development of Yacht Tourism put into effect following the decision of the Council of Ministers dated 08/06/1983 and numbered 83/6708 issued in relation to the Law on Tourism Incentives numbered Definitions Article 4 In this regulation the following shall mean: a) Diving without equipment: diving without benefitting from any source of air, diving underwater, swimming and staying there as long as possible by abiding by technical rules within the framework of world sports education standards (ABC diving, Skin diving) b) Diving with equipment: Diving without any support of air from above ground (such as water pipe) but only with air filled tubes and two stage/phased regulators until a depth limit of 30 m (during training maximum 42 m) without any decompression whatsoever within the framework of sports education standards. Restricted Zones Article 5 All kind of diving in military restricted zones and in regions where Cultural and Natural Property to be Protected Underwater is located according to the decision of the Council of Ministers published in the Official Gazette dated 19/08/1989 numbered in line with Article 35 of the Law on the Conservation of Cultural and Natural Property numbered 2863 shall be forbidden with the exception of scientific research. CHAPTER TWO

2 General Conditions for Diving Legislation Article 6 For diving with equipment in regions other than those specified in article 5 the following shall be abided by: the Law on the Conservation of Cultural and Natural Property numbered 2863 and its regulations, The Law on the General Directorate for Youth and Sports numbered 3289 and its relevant regulation, The Law on Aquaculture numbered 1380, its regulation, circular, and the general rules stated below Permit Article 7 Diving with equipment as a sport in other than restricted zones shall be subject to permission. For underwater diving in groups organised by clubs, organisations and associations in areas other than restricted zones, information shall be provided in advance to provincial tourism directorates or a body designated by this directorate for permission to dive in the area. This information shall be forwarded by the relevant organisation to the Regional Coast Guard Command (or its authorized local unit) Divers of foreign nationality shall be subject to permit for all kinds of sports related to diving with equipment. This permit shall be issued by the provincial tourism directorates or a body authorized by it. One copy of the permit forms to be issued shall be submitted by the authorizing body to the Harbour Master, another to the Regional Coast Guard Command (or its authorized local unit). During checks, the permit document a copy of which shall also be given to the organisation requesting permit must be shown to the competent authority. Information about and application for a permit relating to diving for training and two person team diving systems shall not be compulsory (except for restricted zones). Document Article 8 Persons to dive with equipment as a sport shall hold a certificate of qualification (diving card or license) issued by the Federation of Underwater Sports, Life Guards and Water Ski. However, certifications obtained by organisations providing training at international standards shall be valid, as well. These documents can be converted into the qualification certificate (diving card or license) of the Federation upon application.

3 Sports diving, diving disciplines, powers, technical prerequisites and certificates of authorization relating to Turkish citizens shall be regulated in line with the principles identified and adopted by the General Directorate for the Youth and Sports Federation of Underwater Sports, Life Guards and Water Ski. For foreign nationals to be able to dive as a sport, they need to be members of the International Underwater Sports Federation or hold a certificate issued by national organisations or the competent institutions and organisations of their respective countries. Responsibility Article 9 Both security of life and during diving of the divers shall be under the responsibility of the diver and, for diving course participants such responsibility shall be born by diving instructors during the training. Turkish citizens shall have the option to dive accompanied by a diving guide. Sports divers who are foreign nationals shall be obliged to dive with a diving guide. Diving guides shall be responsible and liable for the conservation of cultural and natural property and the safety of property and life of divers during diving. However, the diving guide shall not be responsible and liable for any kind of problem to arise due to a mistake made by the diver who violated rules prior to diving and during diving. Diving limit Article 10 The depth limit for sports diving with equipment shall be 30 m. However, for training purposes this limit shall be 42 m. For diving below 30 m the necessary health staff and medical equipment shall be available. Authorization and limits specified in the certificate of qualification cannot be exceeded during diving. Equipment Article 11 There shall be no limitations for equipment in diving as a sport. In diving with equipment as a sport, the use of a balance vest (life vest, B.C.), tube pressure indicator, depth indicator and timer shall be obligatory. However, the use of buoyancy balloons or equivalent material shall be forbidden. Diving with decompression shall be absolutely prohibited. High-pressure compressors for tube filling shall be free available on land or on boats holding permit from the competent relevant authority during diving. First aid kits shall be made available by the agency, club, organisation, hotel, holiday village, school etc. that organises diving and on boats. Underwater taking of photos and video recording shall be free during diving.

4 All kind of devices required for photographing or recording can be used. Maintenance of equipment Article 12 Travel agencies, yacht enterprises, institutions and organisations and underwater clubs organising sports diving activities shall be obliged to periodically test and maintain the diving equipment (tube, regulator, balance vest etc.) used by their diving guides. These tests can be done by the organisations specified in the Regulation on Civil Diving Guides, by the authorized company representatives of the manufacturers or vendors of such equipment or by bodies notified by the Ministry of Industry and Trade. Boats to be Used during Diving Article 13 Turkish boats shall be used during underwater diving. However, foreign nationals arriving on their own boats and foreign groups that would like to dive off their own boats can do so after having obtained the necessary permit. Diving Safety Article 14 Two person team diving shall be compulsory for diving. The couple of divers shall be obliged to use a flagged buoy for safety. Night diving Article 15 Training for night diving as a sport can be done under supervision of instructors and by obtaining prior permission. Night diving other than this shall be forbidden. THIRD CHAPTER Prohibition Article 16 Commercial hunting of water products during diving as a sport shall be forbidden. Hunting as a sport shall be done according to the hunting principles of the Law on Aquaculture dated 22/03/1971 and numbered Article 17 Tampering with, damaging, shifting the place of archaeological and cultural property and taking out of the water cultural and natural property that is at the sea base even with the aim of showing it to museum officials shall be forbidden. Should such assets be found, they shall be reported to the relevant and competent authority. Acts distorting the underwater ecological balance during diving shall not be allowed.

5 CHAPTER FOUR Miscellaneous provisions Article 18 Foreign nationals that dive individually can dive on the condition that they abide by all required rules (including obtaining permit and requesting a guide). Article 19 Travel agencies, yacht enterprises, underwater sports clubs and organisations organising diving activities (diving tours as a sport, competition, training) shall assume all responsibility relating to diving. Article 20 For opening training centres and diving courses at hotels and holiday villages with a tourism license or by independent diving clubs and associations, an application shall be submitted to the General Directorate for Sports and Youth through the Governorship to get the required permit. Article 21 Services aimed at training staff with qualification as diving guides shall be rendered by the General Directorate for Youth and Sports Federation of Underwater Sports, Life Guards and Water Ski. Repealed Legislation Article 22 Principles on Underwater Diving by Foreign National Tourists as a Sport and Recreation published on 30/04/1984 and the annexed principles published on 06/03/1985 have been repealed. Enforcement Article 23 This regulation shall be enforced as of its date of publication. Execution Article 24 The provisions of this Regulation shall be executed by the Minister of Tourism.
