2 Introduction Page 2 Why this Report This new report, created by Marcellus Drilling News (marcellusdrilling.com), shows the number of Marcellus Shale horizontal well drilling permits applied for or issued from January 1, 2010 through February 16, The report covers the states of New York, Ohio, Pennsylvania and West Virginia, detailing the number of well permits by geography and by drilling company. Leases are being signed in many locations landmen are on the move. Although signing bonuses can yield a respectable source of income for landowners, the real money occurs when energy companies drill on or near a landowner s property. Energy companies need a permit in order to drill, so permits are a good barometer of the intentions of drilling companies. Some would argue that a report showing where tracts of land have been leased would be useful and it would! But such data is not readily available, and for the data that is available, it would be a difficult (and massive) job to assemble. Drilling permits are an even better barometer than leases for signaling where there will be drilling activity because you need a permit to drill. Anyone can tie up land in a lease for years at a time but energy companies that are actually drilling are the ones landowners will want to do business with. Permits point the way to those drillers who are serious. Who Should Use This Report If you re a landowner who has not yet signed a lease, use this special report to see who is serious about drilling near you in your county and even in your municipality. If you ve already signed a lease, use the report to see if drilling may begin in your area in the near future. Business owners, from restaurants and hotels to convenience stores and other retailers, will find this report useful for predicting a likely uptick in sales and for planning possible expansion of operations. Government officials can use it to predict where there is likely to be increases in traffic and for anticipating other industrialization concerns like noise and wastewater disposal. Non-landowners and environmentalists can use it to keep a sharp eye on drilling activity in their areas. And energy companies can keep track of their competitors. Methodology and Accuracy MDN compiled this report from publicly available databases published by each state. While every effort was made to ensure the accuracy of the data, there are no assurances that it s 100 percent accurate. The purpose of the report is to use it as a guide in predicting where new drilling activity will begin and in the case of landowners, for deciding who you might want to sign a lease with. The data on the numbers of horizontal well permits is for drilling in the Marcellus Shale layer only. There are other shale layers in the Appalachian region of the United States. The Marcellus Shale, however, has the highest average total organic content (TOC) of any of the shales, making it among the most desirable plays for energy companies. Horizontal drilling combined with hydraulic fracturing frees up the largest amount of gas from the shale. Therefore, the permits tallied for this report apply only to horizontally drilled, hydraulically fractured Marcellus Shale gas wells. Limitations of the Data Pennsylvania has the best publicly available data on drilling. Perhaps that s not a surprise as they are the most active Marcellus Shale drilling state thus far. The data for Pennsylvania is for permits issued, renewed or drilling deeper, meaning not only did the energy company apply for a permit, but the permit was ultimately

3 Introduction Page 3 issued. Although a permit was issued, it does not mean drilling has necessarily begun but it is a good indicator that if drilling has not begun, it soon will. West Virginia s data did not include municipality names, so although you will see West Virginia numbers in Section 1 which is data by county and drillers within the county you will not see West Virginia in Section 2, which breaks the data down further by municipality. Also, the way the West Virginia database is constructed, we elected to include various types of permit activity in addition to permits issued. In some cases the data means a permit was applied for, in some cases it was issued, and in some cases it may mean a permit was renewed or there was some other activity at the well requiring a change in the permit. Bottom line, if there was activity or intended activity at a horizontal Marcellus Shale well in West Virginia, that well was counted in the numbers for West Virginia. New York has not seen any horizontally drilled Marcellus Shale wells yet. There is a moratorium on Marcellus drilling in New York until June 2011, so it doesn t make a great deal of sense for energy companies to file expensive permit applications unless there s an expectation that drilling will be allowed. Most of the companies that filed permits for Marcellus Shale drilling did so in 2008 and 2009, prior to the official moratorium. This report may not be as useful for New Yorkers as it is for residents in other Marcellus Shale states at this time, but future editions will be, once New York begins to issue permits. And in the meantime, New York landowners living in border counties like Broome, Tioga, Chemung and Steuben may want to see which drilling companies are most active across the Pennsylvania border in Susquehanna, Bradford and Tioga counties. It stands to reason those companies drilling nearby will be interested in New York when drilling finally begins. The permits counted in New York are for applications and not permits that have actually been issued. Ohio is just starting to see activity in the Marcellus. There were nine permits issued over the past year, and according to Ohio officials, two Marcellus Shale wells have actually been drilled. Look for more permits in the future from Ohio. No publicly available data could be found for Virginia, the western edge of which lies in the Marcellus Shale zone. And only two permits have been applied for but not issued in Maryland. That state, like New York, is currently considering whether or not to allow drilling in the Marcellus and if so, how it should be done. We will include data on Maryland in future editions of this report, should they begin to issue permits.
