6 124 THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 19 January 2016 South Australia Administrative Arrangements (Constitution of Ministers as Bodies Corporate) Proclamation 2016 under section 7 of the Administrative Arrangements Act Short title This proclamation may be cited as the Administrative Arrangements (Constitution of Ministers as Bodies Corporate) Proclamation Commencement This proclamation comes into operation on the day on which it is made. 3 Dissolution of certain bodies corporate The bodies corporate referred to in Schedule 1 are dissolved. 4 Constitution of certain Ministers as bodies corporate The Ministers referred to in Schedule 2 are constituted as bodies corporate. 5 Vesting of certain assets, rights and liabilities (1) The assets, rights and liabilities of the former body corporate known as the Minister Assisting the Minister for Housing and Urban Development are vested in and attached to the Minister for Housing and Urban Development. (2) The assets, rights and liabilities of the former body corporate known as the Minister Assisting the Minister for Planning are vested in and attached to the Minister for Planning. (3) The assets, rights and liabilities of the former body corporate known as the Minister for Employment, Higher Education and Skills are vested in and attached to the Minister for Employment and the Minister for Higher Education and Skills according to the distribution of Ministerial responsibilities and functions between the relevant Ministers so that assets, rights and liabilities appropriate to particular responsibilities or functions vest in, or attach to, the appropriate body corporate. 6 Alteration of title of body corporate The title of the body corporate constituted under section 7(1) of the Administrative Arrangements Act 1994 as the Minister for Business Services and Consumers is altered to the Minister for Consumer and Business Services. 9 19 January 2016 THE SOUTH AUSTRALIAN GOVERNMENT GAZETTE 127 South Australia Administrative Arrangements (References to Ministers) Proclamation 2016 under section 8 of the Administrative Arrangements Act Short title This proclamation may be cited as the Administrative Arrangements (References to Ministers) Proclamation Commencement This proclamation comes into operation on the day on which it is made. 3 Interpretative provision (1) A reference to the Minister Assisting the Minister for Housing and Urban Development in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Housing and Urban Development. (2) A reference to the Minister Assisting the Minister for Planning in an Act, a statutory instrument under an Act or any other kind of instrument, or a contract, agreement or other document will have effect as if it were a reference to the Minister for Planning. (3) A reference to the Minister for Employment, Higher Education and Skills in an Act or a statutory instrument under an Act will, if the Act was, on the day immediately before the effective date, committed to the administration of that Minister, have effect as if it were a reference to the Minister to whom the administration of the Act is for the time being committed. (4) A reference to the Minister for Employment, Higher Education and Skills in a statutory instrument or any other kind of instrument, or a contract, agreement or other document, made or entered into before the effective date (other than a reference to which subclause (3) is applicable) will have effect as if it were a reference to the Minister for Employment or the Minister for Higher Education and Skills according to the distribution of Ministerial responsibilities and functions between the relevant Ministers so that the reference will have effect as if it were a reference to the Minister to whom the relevant responsibilities or functions are currently assigned.
