1 MEMORANDUM OF COOPERATION BETWEEN THE MINISTRY OF COMMUNICATION AND INFORMATION TECHNOLOGY OF THE REPUBLIC OF INDONESIA AND THE MINISTRY OF INTERNAL AFFAIRS AND COMMUNICATIONS OF JAPAN CONCERNING COOPERATION IN THE FIELD OF INFORMATION AND COMMUNICATION The Ministry of Communication and Information Technology of the Republic of Indonesia and the Ministry of Internal Affairs and Communications of Japan (hereinafter referred to collectively as "both sides";) DESIRING to furth 1 er strengthen existing relations between the two countries in the field of infom1ation and communication; AIMING to develop cooperation in the field of information and communication; CONVINCED that cooperation and exchanges in this field will foster mutual cooperation, friendship and knowledge between their peoples; CONTRIBUTING to further strengthen the Strategic Partnership underpinned by sea and democracy for peace, stability and prosperity regionally and globally, by using information and communication technologies. REITERATING common aspiration to further promote bilateral ties and mutual cooperation through mass media on bilateral cooperation in arts, culture and education; RECALLING TO the Agreement between the Government of the Republic of Indonesia and the Government of Japan on Scientific and Technological Cooperation signed in Jakarta on ]2 January 1981 ; TAKING INTO ACCOUNT the need to renew the Letter of Intent between the Ministry of Communication and Information Technology of the Republic of Indonesia and the Ministry of Internal Affairs and Communications of Japan concernin~ cooperation in the field of information and communication, signed in Okinawa on 30 1 October 2010, and PURSUANT to the prevailing laws and regulations of their respective countries; HA VE reached the following recognitions:
2 Paragraph 1 Objective and Basic Principle The objective of the cooperation under this MEMORANDUM OF COOPERATION (hereinafter referred to as the "MOC") is to promote cooperation and conduct exchanges in the field of information and communication, based on the principles of equality, reciprocity, mutual respect and benefit between both sides. Paragraph 2 Scope of Cooperation The scope of cooperation of this MOC will cover information and communication, including Information and Communication Technology (hereinafter referred to as "ICT"), telecommunications, broadcasting, postal services, human resource development, exchange of visits, education and training, and other areas mutually decided upon by both sides. Paragraph 3 Information and Communication Technology 1 Exchange of information on each country's ICT legal, technical and industrial regime, including information concerning: i. the ICT industries and their market characteristics; and ii. the implementation of information technology of small and medium enterprises; 2. Exchange of the results of research and the experience gained from the use of advanced technology in the field of information and communication and its influences; 3. Cooperation in the aspects of e-government, e-comrnerce, e-business, 50, IoT and the development of ICT infrastructure; 4. Cooperation in the field of Information Security; 5. Cooperation between ICT institutions from either public or private sectors in the field of network promotion and content exchanges of the two cow1tties; and 6. Exchange of ICT best practices and experiences between their respective agencies Paragraph 4 Telecommunications 1. Exchange of information on policy and regulatory m the field of telecommunication; 2. Cooperation to improve communication networks, including!bridging the digital divide; 3. Cooperation in the field of radio spectrum management; 4. Cooperation in the field of network security; 5. Cooperation in tbe field of capacity building; 6. Cooperation in rbe field of Disaster Management System ~
3 7. Facilitating the implementation of the cooperation in the field of telecommunication by private sectors; 8. Sharing knowledge and provide technical assistance m the field of telecommunication; 9. Cooperation between universities/research institutions from either public or private sectors in the field of telecommunication; 10. Technical assistance to bridge standardization and conformity assessment gap; 11. Capacity building to bridge standardization and conformity assessment skill gap; and 12. Any other areas which may be decided upon in writing by both sides relating to the cooperation in the field of telecommunication. Paragraph 5 Broadcastings Both sides wiji encourage and support cooperation on the following: 1. Cooperation in the field of broadcasting, including the exchange of information on public broadcasting policy and next generation broadcasting; 2. Facilitating collaboration such as the co-production, exchange and trade of media content between broadcasters, subject to commercial considerations and domestic regulations in both countries; 3. Developing innovation talent and capacity building in the field of broadcasting Paragraph 6 Postal Services 1. Consideration of the possibility of cooperation in the field of postal services; and 2. Exchange of information on policy and regulations in the field of postal services. Paragraph 7 Human Resource Development 1. Facilitating program of exchanging human resource with ICT standard competency; 2. Cooperation in the field of training ICT human resources; 3. Cooperation in the field ofict research; and 4. Collaboration in education. training, research programmes and policy and technical exchanges in the field of ICT between the relevant agencies, broadcasters, postal corporations and companies of the two countries, subject to commercial considerations.
4 Paragraph 8 Implementing Institution 1. For the implementation of this MOC, both sides will designate contact points for coordinating and facilitating cooperative activities under this MOC. 2. Pursuant to subparagraph 1 of this paragraph, the implementing institution will be: a. in Indonesia the Ministry of Communication and Information Technology; and b. in Japan, the Ministry of Internal Affairs and Communications. 3. Subject to the terms of this MOC. both sides may designate any appropriate and specific entity or entities within their countries to facilitate and participate in any activities and programmes as mutually decided upon between both sides in writing. Paragraph 9 Exchange of Visits 1. Both sides will encourage the exchange of v1s1ts between senior govemmentofficials, experts, specialists. researchers and other persons involved in the field of ICT, including broadcasting and postal services. 2. Details, duration, dates and financial arrangement of the visits will be decided upon by both sides prior to the visits. Paragraph 10 Expenses Expenses in the implementation of this MOC will be borne by each side based on the availability of funds and resources. Paragraph 11 Intellectual Property Rights Any intellectual property rights arising out of matters covered by this MOC. will be protected by the sides in line with their respective laws and obligations Paragraph 12 Confidentiality Both Sides will observe the c nfidentiality of all data and information supplied and received by each other for the i plementation of this MOC. Paragraph 13 Modification This MOC can be reviewed or modified at any time by mutual consent by both sides.
5 Paragraph 14 Settlement of Problems Any problems between both sides concerning implementation of cooperation under this MOC will be settled amicably through consultation between both sidles. Paragraph 15 Commencement, Duration, and Termination 1. The cooperation under this MOC will commence on the date of ii.ts signature; 2. The cooperation under this MOC will continue for a period of five (5) years and may be renewed for another period of five (5) years by mutual written consent of both sides. unless one side communicates its intention to terminate it by giving written notification to the other side at least six (6) months in advance; 3. The termination of the cooperation under this MOC will not affect the duration of any on-going programmes or activities under this MOC. This MOC is not legal binding docwnent and does not create any rights and obligations between both sides. Signed in duplicate in Tokyo on 17th September 2015 in the English language.
