No. :P6-W Page: 3 of 1 6 Code Of Practice For Jssing Dispensation I'MO Introduction Ports and Maritime organization (P.M.O) of the Islamic republic of Iran m performing its duty and in exercising its prerogative resulting from article 192 of the Islamic republic of Iran maritime code,1964 and paragraph 10 of article 3 ofp.m.o manifest, 1970 enabling it to issue any document, certificate or license for ships, masters, officers and other ship personnel and also in accordance with the provisions of the international convention on standards of training, certification and watch keeping for seafarers (STCW), 1978, as amended adopted by the Islamic consultative assembly in 1996 and taking into account Article VIII of the mentioned convention develops this "code of practice for Issuing Dispensation" which is applicable after endorsement by the board of executives of Ports & Maritime Organization. NOTE: The title of Ports and Shipping Organization changed to Ports and Maritime Organization dated through parliamentary act and approved by Islamic council assembly.

No. :P6-W Page: 4 of 1 6 Code Of Practice For lssing Dispensation P~IO 1- Objective: The objective of this code of practice is to set conditions and procedure for issuance dispensation for the posts of masters and officers of ships engaged on unlimited voyage taking into account safety, security, environment and fatigue. 2- Application: This code of practice applies to all shipping company requesting dispensation for posts of masters and officers of ships engaged on unlimited voyage. 3- Definition: For the purpose of this code of practice, unless expressly provided otherwise, 3.1 Certificate of Competency (COC) Means a certificate issued and endorsed for masters, officers and GMDSS radio operators in accordance with the provisions of chapters II, III, IV or VII of the STCW Convention and entitling the lawful holder thereof to serve in the capacity and perform the functions involved at the level of responsibility specified therein. 3.2 Circumstances of Force Majeure Means a specific circumstance in which general directorate decides to issue /not issue dispensation to the request of shipping company. 3.3 Code of Practice Means all national rules, regulations and requirements specified in this document which have been drafted by the PMO's General Directorate of Maritime affairs and endorsed by the PMO's board of executive 3.4Company Means the owner of the ship or any other organization or person such as the manager, or the bareboat charterer, who has assumed the responsibility for operation of the ship from the ship owner and who, on assuming such responsibility, has agreed to take over all the duties and responsibilities imposed on the company by these Codes of practices. ~ 0.. ;} ~,..,..i 3.5 Chemical Tanker Means a ship constructed or adapted and used for the carriage in bulk of any liquid product l" sted in chapter 17 of the International Bulk Chemical Code.

No. :P6-W Page: 5 of 1 6 Code Of Practice For Issing Dispensation I'MO P> 0 f\... }... <1>1':1' 3.6 Chief Mate Means the officer next in rank to the master and upon whom the command of the ship will fall in the event of the incapacity of the master Chief Engineer Officer Means the senior engineer officer responsible for the mechanical propulsion and the operation and maintenance of the mechanical and electrical installations of the ship. 3.8 Deck Officer Means an officer qualified in accordance with the provisions of chapter II of the STCW Convention. 3.9 Directorate Means Seafarer's standard directorate Dispensation Means a document issued as per provisions of the code of practice for issuance of dispensation entitling the lawful holder of a certificate of competency to perform in a higher capacity than stated in his CoC, for specified period and on a certain ship. 3.11Engineer officer Means an officer qualified in accordance with the provisions of regulation III/I, III/2 or III/3 of the Convention 3.12 General Directorate Means seafarers' standards directorate of Ports & Maritime Organization Master Means the person having command of a ship 3.14 Officer Means a member of the crew, other than the master, designated as such by national law or regulations or, in the absence of such designation, by collective agreement or custom Passenger Ship Means a ship as defined in the International Convention for the Safety of Life at Sea, 1974, as amended.

PMO Means Ports & Maritime Organization (PMO) ofthe Islamic Republic oflran 3.17 PMO's Board of Executive Means board of executive of Ports & Maritime Organization 3.18 Second Engineer Officer Means the engineer officer next in rank to the chief engineer officer and upon whom the responsibility for the mechanical propulsion and the operation and maintenance of the mechanical and electrical installations of the ship will fall in the event of the incapacity of the chief engineer officer STCW Convention Means international convention on standards of training, certification and watch keeping for Seafarers, 1978, as amended STCW Code Means the seafarers' training, certification and watchkeeping (STCW ) code as adopted by the 1995 conference resolution 2,as it may be amended by the international maritime organization Unlimited Voyages Means voyages not limited to the near coastal voyages. 4- Responsibilities: 4.1 Seafarer's Standard Directorate is responsible for revising this code of practice. 4.2 General Director of Seafarers' Affairs is responsible for approving amendments to this code of practice. 4.3 Deputy of Maritime Affairs is responsible to endorse amendments to this code of practice on behalf ofpmo's board of executive. 4.4 Seafarer's Standard Directorate is responsible for supervising the implementation of this code of practice. 5- Procedures 5.1 Conditions for Issning Dipensation I conditions for Issuing Dispensation

No. :P6-W Code Of Practice For Issing Dispensation Page: 7 of 1 6 P~ Dispensation shall be issued for a capacity of deck/engineer officers and for service on a specified ship Dispensation shall be issued only in circumstances of exceptional necessity and upon the request of a shipping company It shall be ensured that issue of dispensation does not cause danger to person, property or the environment or a compromise security and does not conflict with the radio regulation Dispensation may be granted for master or chief engineer officer posts on any type of ship and for officer's capacities on board of the following ships, only in circumstances of force majeure: Ro-Ro Passenger ship Passenger ship Chemical I Liquefied gas tankers The dispensation for a post shall be granted only to a person who is properly certificated to fill the post immediately bellow and is adequately qualified to fill the vacant post in a safe manner Shipping company must have taken steps to fill the vacant post by a seafarer holding appropriate certificate or recognition endorsement as soon as possible. Note 1: the validity of dispensation shall not be more than 3 months. Note 2: the dispensation shall not be issued for the post of master where minimum safe manning certificate of the vessel includes only one deck officer Procedure for requesting dispensation Shipping company requesting dispensation shall fill the application form attached to annex I of this code of practice and, along with the following documents of the person whom dispensation is applied for, send to Seafarer's Standard Directorate: A copy of the certificate of competency; and A copy of the medical fitness certificate Procedure for issuance dispensation The Seafarer's Standard Directorate, upon receipt of the request, shall control completeness of the information and documents specified in subparagraph A.S of application form to evaluate: The circumstances of exceptional necessity or force majeure, as applicable, prevail;, 0. l

No. :P6-W Page: 8 of 16 Code Of Practice For Issing Dispensation The introduced officer is qualified to receive dispensation as per conditions set out in above paragraph 5.1; The completeness of related documents & records based on the annex 1 of this code of practice; Records of casualties and different/similar incident for the same ship, if any; Reasons for and the number of previous request by the shipping company for issuance of dispensations; The shipping company's policy for recruitment, training and retention of seafarers serving on board; Shipping company has tried its best for recruiting and dispatching the required competent seafarer to the concern ship as soon as possible; and Records of previous dispensations issued for the concern seafarer, if any. Note: If the evaluations of the above mention steps are satisfactorily and upon agreement of the General Director for Seafarers' Affairs, dispensation will be issued and a copy is maintained Maintainance of the records For more efficient and effective monitoring of dispensations granted, the following records in respect of all dispensations issued shall be maintained: Name of the company Name of the ship IMO number of the ship Type of vessel Gross tonnage and propulsion power The capacity concerned Seafarer's name Seafarer's nationality Seafarer's date of birth The number of the seafarer's certificate of competency The number of the recognition endorsement, if applicable The country issuing the certificate of competency The number and validity period of the dispensation.

No. :P6-W Page: 9 of 1 6 Code Of Practice For /ssing Dispensation PMfl Note 1: The related information regarding total nnmber of dispensations issued for each year in respect of each capacity and the gross tonnage of the ship and propulshion power (GT2:500, GT2:3000, KW:::750, KW:::3000) shall be reported to the Secretary General of the IMO before I January of each year( attached form to this code of practice). Note 2: The code of practice for issuing dispensation as well as dispensations application form specified in annex I shall be sent to shipping companies for their use. Note 3: The dispensations shall be issued and granted using format set out in annex 2 to this code of practice. 6.
