Mrs Moore knows this is a mistake and asks for the name of the credit bureau that gave the report. She discovers that the correction had never been done and her record shows a default payment. She explains this to the credit bureau, contacts the bank and asks that the matter be corrected. After a month the credit bureau has not updated her record. She lodges a complaint and 20 days later nothing has changed. Mrs Moore approaches the credit ombudsman who settles the matter and asks the credit bureau to update her information. Then she decides to upgrade her policy through her broker. The broker applies for a cancellation of her old policy as well as an upgrade to the new one. The new application is turned down but the cancellation of her original policy goes through. Ms Steyn discovers she has no cover. The insurer refuses to recognise this as a mistake. Ms Steyn goes to the long-term insurance ombudsman who finds that the error occurred between the broker and the insurer and that Ms Steyn should be fully covered as per her original policy. Case study: Mrs Coetzee signs unlimited surety for her son s bank loan. Her son pays the loan off and the bank releases the fixed deposit, which had been held as surety. Years later the son applies for another loan but cannot pay it back. The bank claims surety for this loan from Mrs Coetzee, stating that the original surety applied for the second loan as well. The Case study: Mr Naidoo decides to change his medical aid scheme to a scheme that offers a similar package but with lower premiums. He signs up and pays his first premium, but the company does not send his full policy documents immediately. After several requests he receives his policy documents via . He discovers his policy will not cover his existing asthmatic condition, even though his previous medical aid had been paying for his medication. Mr Naidoo would like to cancel the policy and be refunded for his first premium. But the scheme tells him he has to give two months calendar notice and that he will have to pay his premiums until the cancellation date. Mr Naidoo brings his complaint to the Council for Medical Schemes. Because Mr Naidoo was not made aware of all the rules before signing up, the Council agrees that the scheme should refund his premiums and cancel the policy immediately. The right to food is enshrined in the South African Constitution, making us one of the most progressive countries in the world in terms of economic and social rights on paper that is. Despite the implicit obligation to implement the right to food at a policy level, an estimated 50% of South Africans are living below the poverty line. While debate rages over policy requirements for poverty relief, in particular land reform, food prices are rapidly rising. Urban consumers are feeling the pinch, but rural communities are trapped in a vice grip, and experts are warning that if this continues South Africa could be spiralling towards a serious national food crisis. According to the latest report by the National Agricultural Marketing Council, an average monthly food basket consisting of white bread, chicken, potatoes, milk, oranges and eggs cost R415 in October 2011, and cost R455 in October With inflation and general costs rising at the same time, one might assume that such a price increase is inevitable. But considering that this basket price equalled 30% of the income of South Africa s poorest households in 2011, and 40.2% in 2012, and that food inflation remains higher than the overall inflation rate, it is clear that the situation is fast becoming untenable. By having to spend nearly half their income on food, poor communities have little left over to spend on other essentials. They are also severely limited in terms of access to education and other opportunities that may allow them to improve their plight. This economic downward spiral has pushed many South African communities into a volatile corner, with violent wage disputes and strikes expressing the extent of the economic pressures people are facing. According to the New England Complex System Institute (NECSI), cases of social unrest around the world, such as the Arab Spring uprisings in the Middle East and recent mine- and farm-worker strikes in South Africa have a direct correlation to spikes in food prices. WORKERS CAUGHT IN THE MIDDLE Worker demands for dramatic pay increases reflect that their wages have not kept up with drastic increases in the prices of necessities, especially food. Without attention to the global food price situation, more incidents of foodbased social instability are likely to rise, explains Yaneer Bar-Yam, president of NECSI. Article 27 of the Bill of Rights includes access to water and health care and social security along with the right to food. But of all these items, food is the only one that still comes with a hefty price tag, and frequently no access to more affordable alternatives. Olivier De Schutter, UN Special Rapporteur, has pointed out that South Africa may have developed a uniquely progressive jurisprudence in the area of economic, social and cultural rights but has yet to create food systems that work for the poor and not only sell to the poor. The controversy around farm workers wage increases illustrates the problem. Although the 52% increase will bring short-term relief to workers, the added cost for farmers will cause a knock-on effect that will have detrimental consequences to the food economy. Johannes Möller, president of AgriSA, said that the decision has not duly taken into account the implications for agriculture and employment, which will have drastic implications for this sector and related industries. This is especially true for labour-intensive sub-sectors where individual farmers will now have to make tough decisions on adjustments to ensure their sustainability. Such adjustments are inevitable, taking into account recent hikes in fuel prices and water tariffs and a likely sharp escalation in electricity tariff. According to AgriSA the wage increases could lead to farmers having to reduce the workforce and possibly turn to mechanisation in order to cut costs, which will have devastating consequences for communities who are already struggling. The rise of electricity and fuel costs along the supply chain is compounding the food price increase at an alarming rate. Add to this the pressure on farmers who are now forced to scale back on output in order to remain in business and we have a dire situation, with the possibility of future food shortages. There is an essential contradiction in the food economy. In order to survive and keep producing food, farmers need to pay labourers a wage that is too small for them to afford the food they have helped to produce. The industrial food industry is an illogical system that ends up starving its own workforce and consumer base. According to Dr Tracy van Heijden, research fellow at the Public Affairs Research Institute, we have a food economy that keeps farm incomes under pressure while pricing food out of reach of most South Africans.

3 19 There is a large, deeply entrenched profit-making industry built around the simple movement of food from farm to consumer. Costs are being added to farm produce all the way up the production and distribution chain. The difference between farm and retail prices is staggering. A litre of milk costs on average R3 at the farm gate, while retailers sell it for up to R12. Gareth Ackerman, chairman of Pick n Pay, points out that retailers in South Africa have the lowest profit margins in the world and are finding it difficult to keep prices down with so many costs to cover. This is particularly apparent when comparing prices for key food items such as maize between urban and rural areas. In July 2012, a packet of special maize cost on average R34.23 in rural areas and R25.93 in urban areas. Costs add up, and by the time food products have travelled from farm to city and back out to rural retail outlets they have gained a variety of stakeholders all demanding their share of the final sale. Considering that rural areas tend to have the poorest consumers, this situation is unfair and arguably unconstitutional. It cannot be denied that food is big business, and retail food prices are geared to gain the most leverage for their particular customer. Demand continues to play a role in determining retail prices, as can be seen when the same product has a different cost between retailers in the same area who may have a different customer base. What makes matters worse is that, while overpriced food items stand on shelves in shopping malls waiting for customers who can afford them, many tons of food that might alleviate hunger and ease financial burdens are being wasted every day. According to Food Bank SA hunger is not a matter of supply. Rather the problem is one of access and logistics. Currently South Africa produces more than enough food to feed all its citizens adequately. There are 600g of starchy foods, 300g of fruit and vegetables and Bill of Rights Section 27 Health care, food, water and social security 1. Everyone has the right to have access to health care services, including reproductive health care; sufficient food and water; and social security, including, if they are unable to support themselves and their dependants, appropriate social assistance. The state must take reasonable legislative and other measures, within its available resources, to achieve the progressive realisation of each of these rights. But through poor resource management and a lack of overall facilitation at government level, this food is not reaching the people it is intended to feed, and millions of rands are being wasted. Although the problem of food security is systemic and complex, there is plenty that can be done to change the course of the downward spiral through policy change and state intervention. While our situation is not unique, it appears that South African consumers are less inclined to protest than their international counterparts. Van Heijden points out that, all around the world, consumers, agrarian activists, farmers and governments are fighting back. But in South Africa, where the results of the dominant food economy widespread food insecurity and deepening rural poverty are truly shocking, there is little public outrage and apparent policy apathy, despite the fact that the right to food is enshrined in section 27 of the Constitution. The trend in building progressive and sustainable food economies is to shorten the distance between farmer and market by cutting out the middleman and facilitating access. This allows the farmer and the consumer to meet each other halfway, with farmers getting a higher price for their produce and the consumer paying far less than they would at ordinary retailers. For example in the city of Belo Horizonte in Brazil, the right to food has been incorporated into government policy the city s view is that to search for solutions to hunger means to act within the principle that the status of a citizen surpasses that of a mere consumer. Liberal economics have taken a back seat in a carefully monitored context in order to alleviate hunger and help local farms and businesses. The city facilitated the creation of special markets and restaurants with set food prices where farmers and food producers could sell produce directly to consumers. While normal food distribution channels continue to operate in the rest of the country, this intervention has paved the way for small-scale farmers to become fully sustainable, and has given poor consumers access to healthy, fresh and affordable food. The question is, what do consumers need to do in order to change the food economy? Supporting farmers markets and buying only locally produced food creates a market for emerging and small-scale farmers and will slowly affect the system from the bottom up. But a top-down approach, which directly addresses policy concerns, is also necessary. If the Constitution supports this cause then the public has a legal channel through which to contest current policies. The challenge is that this channel has not yet been tested on a large scale. Van Heijden explains: The Constitution guarantees the right to food, but the million-dollar argument is how is the state s responsibility in that respect understood? However if, as Van Heijden says, current economic and agricultural policies are undermining the right to food, and also undermining land reform, then it is up to the public to apply pressure and use whatever means are available to assert and protect our basic human right to food. 4 20 edition Low-cost housing and your monthly electricity bills We all want to keep warm this winter but with the rising cost of electricity it can be expensive to heat your home. If you live in a low-cost or subsidy house you may find that your electricity bill increases a lot in winter. Fortunately there are some simple ways to avoid this and even to shrink your bills! This means you can spend your money on other, more important things like your family. So, when looking at your monthly electricity costs, it s important to know how your home is built, and how you use the electrical appliances in your home. Both have a strong effect on how much you pay for each month s electricity. If you are soon going to be a homeowner, building your own home or already have a home, small changes can make a big difference in the long-run. First let s take a look at the way in which your home is built. The building materials of your home, and whether there are gaps in the floor, walls or roof, directly affect the comfort inside your home. If your house is built well with good insulation, it will not get too hot or too cold, and you will not need to heat or cool your home much either. Insulation is a layer of special material that is placed against or inside walls and in the roof. It traps the air and slows down changes in temperature in your home. For winter, first make sure that there are no air gaps between the walls of your home and the roof, that could allow wind in and the heat to escape. This way you can make sure that any heat you generate inside, perhaps from a heater or just from your own body heat, will not escape. Then see if you can add some insulation along the walls. For summer, a small roof overhang around the edges of your roof can prevent the sun from shining straight into your home during the hottest part of the day. This will keep it little cooler. Having insulation in your roof will help keep the warmth inside in winter, and keep the heat outside in summer. Have a look at the list of simple things below that you can do to lower your improve the insulation and comfort of your home. Simple steps to improving the comfort of your home: 1. Check for wind gaps between the top of your walls and the roof, as this is where most of the warm air from inside your home will escape. 2. Buy a special geyser blanket to make sure your geyser can keep water warm without needing as much electricity. 3. Buy some insulation from a hardware store, or even make some using newspaper or foam, and place it inside your ceiling to keep your house warm in winter. 4. Extend your roof over the edges of the exterior walls, making a small shaded area around the house, to prevent your house getting too hot in the summer. Now let s take a look at how you use electrical appliances, including hot water, in your home. Appliances use a lot of energy so you need to use it for short periods and as efficiently as possible. How long you use an appliance, and how efficiently you use it, directly affects your electricity usage. The main appliances that use energy in your home are the hot water geyser, any electric heaters you may have, the kettle and the stove. While all appliances use energy, these generally use the most. By being aware of how much time these appliances are switched on or plugged in, you can reduce your monthly electricity costs. Have a look at the following list of simple things you can do to lower your electricity cost and have a more energy-efficient home. Simple steps to improving the way your home uses electricity: 1. Turn the temperature of your geyser down to 60 degrees, this will still be warm enough for you to enjoy hot water, Buy some insulation from a hardware store, or even make some using newspaper or foam, and place it inside your ceiling to keep your house warm in winter. but it will not waste energy. 2. Only turn on the hot water tap when you need to, and don t leave it running unnecessarily. Every time you turn on the hot water tap, cold water enters your geyser and it must heat up again. 3. Make sure your hot water tap does not leak. 4. When you boil water in the kettle, only use as much as you need. Boiling additional water consumes electricity that will be wasted. 5. If you are using an electrical heater to warm your home, make sure the windows and doors are closed, and see if you can turn off the heater once it has warmed up the room you are in. If you are not using an electrical heater (e.g. using fire, gas or paraffin) please make sure at least one window is open so that you have clean air to breathe. 6. Do not unnecessarily leave your fridge door open. It uses more electricity. 7. Some appliances in your home, such a TV s, sound systems, DVD and video players consume energy just by being plugged into the wall socket, even when you are not using them! Make sure you unplug these when you switch them off. ishack With the current housing backlog many South Africans have had to build their own shack homes. If you live in a shack you too can make improvements to safe money and electricity. The Sustainability Institute in Stellenbosch and developed a home design called the ishack uses mall solar power panels to meet basic electricity needs directly from the sun. It is based on ecological design principles to improve the comfort within the home by making the best and most cost-effective use of shack materials, overall shack design, orientation relative to the sun and insulation. The ishack is useful for those people who do not yet have access to a low-cost or subsidy house, and the design methods can also be applied to existing shacks. 6 22 edition The law is on your side Unfair dismissals Getting dismissed from a job is not a simple matter of telling an employee You re fired. Labour law requires an employer to follow a fair procedure as well as to provide reasons for the dismissal. Failing this, the employer is open to a claim of unfair dismissal. The employee must use all available avenues within the work environment to present his/her grievances and attempt to have the matter resolved. A record of these attempts must be kept. If these avenues fail to produce results, the employee can take the dispute to a Bargaining Council for his/ her particular sector or the Commission for Conciliation, Mediation and Arbitration (CCMA). This must be done within 30 days of the dismissal. The employee will need to fill out forms at the CCMA, which will also be served on the employer along with a notice and date for a conciliation meeting. At the conciliation meeting is an informal process in which a commissioner attempts to find a resolution to the dispute. According to labour law, neither party may make use of legal representation during this initial informal procedure but the employee may be represented by a colleague or trade union representative. If no resolution is found the matter is moved for arbitration. During arbitration both parties may make use of an attorney to present evidence to the commissioner for him/her to make ruling. If during the conciliation process a dispute emerges as to a matter of alleged unfair retrenchment, freedom of association, or automatically unfair dismissal; the matter must progress to the Labour Court, rather than for arbitration. If the commissioner acknowledges evidence of unfair dismissal and finds in favour of the employee, labour law states that the employer must be ordered to reinstate the employee or pay compensation of up to a maximum of twelve months salary. Eviction Eviction laws in South Africa ensure that no one is removed from their homes without following fair legal procedure. A lease agreement is the created specifically to protect the rights of both the tenant and the landlord and establish the ground-rules before eviction becomes necessary. A tenant and a landlord should always agree on the terms of occupation through a binding contract called a lease agreement. By signing this, the landlord agrees to allow the tenant to rent and have the undisturbed use and enjoyment of the premises for a specified period of time and for a specified rent. The tenant agrees to timeously pay the rent. Further conditions are outlined and clearly stated in the lease agreement. Should either party break any of the terms or conditions of the contract they can be held accountable by law. The content of the lease is further prescribed by the Rental Housing Act, as amended. Failure to pay the rent, damaging the property, or using the premises for purposes other than that stated in the lease agreement could all be grounds for the landlord to cancel the lease. The tenant has to be given fair warning if the landlord intends to cancel the lease due to non-payment of rent. The tenant must be allowed an opportunity to find the money and make the payment before the lease is to be cancelled. Once the lease has been cancelled the tenant is legally obligated to leave the premises. However, if the tenant refuses to leave, the eviction cannot be enforced by landlord without an order of court. If the landlord attempts to evict the tenant without an order of court, he will make him-/herself guilty of an offense in terms of the Rental Housing Act. The court will only issue an eviction order when all circumstances in terms of the Constitution, the Prevention of Illegal; Eviction Act and the Rental Housing Act as well as Judicial Precedent has been considered. It is advisable to employ an attorney to obtain an eviction order. Once the order has been issued, the Sheriff will conduct the eviction on behalf of the landlord.
