2 Speeding Speeding Background National Highway Traffic Safety Association (NHTSA) Defined as exceeding the posted speed limit Driving too fast for conditions Speeding is a contributing factor in one-third of all fatal traffic crashes in the United States and costs society an estimated $40 billion annually. In % of the speed-related traffic fatalities occurred on roads posted at 50 MPH or less; 25% occurred on roads posted at 35 MPH or less. In a survey conducted by NHTSA, 80% of drivers reported they often exceed the posted speed limit on all roads. 33% reported that they often drive at least 10 mph faster than the posted speed limit. 66% felt that other speeding drivers pose a major threat to their personal safety.

7 SPEED STUDY AT EXISTING CAMERA LOCATIONS MARCH 2008 A speed study was conducted at each of the 10 existing red light camera locations in February consecutive hours of driving behavior related to speed was diagnosed. The speed threshold was set to detect speeds 10 MPH over the posted speed limit. There were 4690 total detections for speed = 2 excessive speed detections per hour per camera. West Third and Edwin C. Moses and US 35 and Abbey accounted for over 50% of the speed detections. 66% (3,095) were between 11 and 14 MPH over the posted limit 28% (1,313) were between 15 and 20 MPH over the posted limit 5% (282) were 20 MPH over the posted limit

8 ORC Proposed Ordinance Changes Ordinance language has been changed to reflect the inclusion of photographic speed enforcement in addition to red light enforcement. To encompass a broader monitoring area to include speed enforcement, the term intersections has been changed to locations. The current red light camera locations can also monitor for speed. A notice of liability shall be mailed no later than 20 calendar days after the alleged violation rather than 10 calendar days. A $25.00 late fee will be added to the $85.00 fine if the fine is not paid within 30 days of issuance of the citation.

12 VIOLATOR S CITATION: How Camera Enforcement Works Three (3) images are taken of the rear of the vehicle in violation. Scene A Shows the beginning of the violation where the vehicle is at or behind the stop/violation line. Scene B Shows the completion of the violation where the vehicle has entered into the intersecting lanes of traffic and through the intersection. Plate Image Shows the license plate of the vehicle in violation. The violation is also captured by a video recording.

13 CITATION RESOLUTION No points are imposed against the violators driving record under the Photo Enforcement Program. There are three options in which to resolve the citation. Pay the fine within 15 days. Check, money order, VISA or Master Card accepted. or Within 15 days, provide the information of the person who was actually driving the vehicle if not the registered owner, then mail the notarized citation to the processing center. or Within 15 days, return the hearing request to have the dispute heard before a Hearing Officer. An $85 bond must be received along with the hearing request prior to the due date of the citation before a hearing is granted.

14 CITATION RESOLUTION Failure to act on the above options will result in default and a $25.00 late fee will be added to the fine amount. The responsible party will receive a Default Notice. If the responsible party does not respond to the Default Notice, the citation will be sent to collections. Administrative Appeal Process: If the responsible party chooses to have a hearing and has paid the $85.00 bond prior to the notice due date, the following will occur: A hearing is held before a Hearing Officer. If the Hearing Officer finds in favor of the city that a violation did occur, the $85.00 bond will be retained to satisfy the fine amount. If the Hearing Officer finds in favor of the responsible party, the $85.00 bond will be refunded. If the responsible party fails to show for the hearing, the $85.00 bond will be retained to satisfy the fine amount.
