1 IKEA Compra Online Terms and conditions Terms and conditions of online sale through the IKEA website IKEA ITALIA RETAIL S.r.l., a sole-partner company having its registered and administrative office at Strada Provinciale 208 no. 3, Carugate, Milan, Italy, II), fully paid up capital Euro 7,800,000, Milan Register of Companies registration number and Taxpayer ID number , VAT number (hereinafter "IKEA"), offers all users the possibility of purchasing IKEA products online (hereinafter the Products ) through its website (hereinafter the "Website"), of which IKEA is the sole and exclusive owner. 1) General notes These Sales Terms and Conditions (the "Terms and Conditions") are regulated by the Consumer Code (Legislative Decree no. 206/2005), Section II, Remote Agreements (articles 50 67) and by electronic commerce regulations (Legislative Decree no. 70/2003), and apply exclusively to online sales of Products as identified and listed in the Our Online Products Website section ( The Customer (hereinafter Customer ) is encouraged to print these Terms and Conditions or store them with his/her preferred procedure. In case of changes to these Terms and Conditions, the Terms and Conditions posted on the Website at the time of order submission by the Customer shall apply to the purchase order. 2) Retail offering The Products and their respective Prices listed in the Website constitute a retail offer in accordance with the criteria specified in these Terms and Conditions and in the Website. The Terms of this offer apply exclusively to purchases made to the Website. Purchase agreements (hereinafter the Agreements ) made through the Website are entered into with IKEA. 3) Prices All prices are inclusive of VAT. Shipping costs (hereinafter Shipping Costs ) are at the Customer s expense, and are appropriately indicated in the Purchase Order (hereinafter the Purchase Order ). The Price indicated in the Website at the time of Order submission shall apply to the Products, regardless of any prior offers or Price changes occurred at a later time 4) Purchase Order Purchase Orders are submitted online through the ordering procedure (hereinafter the Ordering Procedure ) available on the "Online Purchasing" section ( of the Website. To complete the Purchase Order, the Customer may use either of the following alternative procedures: a) A Customer who is already registered in the Website through the Wish list section (hereinafter the Website User ), or holds an IKEA FAMILY Card (hereinafter IKEA FAMILY Member ), will simply need to enter his/her Username and Password and log into the Registered Users area. b) Customers who are not Website Users or IKEA FAMILY Members should enter the data required to complete the purchase in the appropriate form, and access the Purchase as a Pagina 1

2 Guest area. Please note that, before proceeding with the Purchase, the Customer may become a Website User and/or an IKEA FAMILY Member by registering online through the following link: 4&URL=/webapp/wcs/stores/servlet/InterestItemDisplay The Order Procedure is completed correctly if no error message appears. The Purchase Agreement is deemed to be completed when the Order is received by IKEA. IKEA shall then acknowledge receipt of the Order by an order confirmation (hereinafter the Order Confirmation ) to the address indicated by the Customer. The Confirmation shall contain a summary of the selected Products, their respective Prices (including shipping costs), shipping address, order number (hereinafter the Order Number ) and the applicable general and special Terms and Conditions. The Customer hereby agrees to verify the correctness of the data contained in the Order Confirmation and to communicate any corrections to IKEA within 24 (twenty-four) hours after receiving the Confirmation. Any additional costs caused by data errors not communicated in time shall be at the Customer s expense. The Customer shall refer to the system-generated order number notified by IKEA in all communications with IKEA. The offered Products may occasionally be unavailable; if all or part of the Products selected by the Customer are unavailable, IKEA shall promptly notify the Customer accordingly. 5) Payment terms Payment can be made online by Credit Card, following the procedure specified in the Website. IKEA Gift Cards and Coupons may not be used for payment. For transaction security reasons, IKEA reserves the right to request credit card holders to forward a copy of their identity document. At the same time that the Order Confirmation is notified, the amount corresponding to the purchased Products shall be debited to the Customer. IKEA shall issue an invoice of the purchased Products and send it via to the buyer in whose name the Order is made within 24 (twenty-four) hours after Order Confirmation. The information in the invoice shall be those provided by the Customer. This information may not be changed after the invoice has been issued. 6) Shipping and delivery terms IKEA shall ship the Products (hereinafter Shipping Service ) through specialized carriers (hereinafter the Carriers ), only to the areas specified in the Website. The Customer may look up the geographic availability of the Shipping Service at any time by entering the postal code of the area where they want the purchased Products in the appropriate field in the page accessed through the link below: gid=- 4&catalogId=11001&orderId=.&newLinks=true At the time of delivery, the Customer or a trusted person should be present to make sure that the packages are intact and clean and that the Products received correspond to those listed in the Order. In case of visible defects, such as incorrect amount and/or incorrect Product, or if the packaging is not intact, the Customer or the trusted person shall report the incident in the delivery note and contact IKEA at the following link: "Contact Us" ( no later than 7 (seven) days after delivery. IKEA delivers the purchased Products to the address indicated by the Customer, as follows: a) Orders weighing 30 (thirty) kg or less - (lightweight shipments): The estimated date of delivery shall be indicated at the time of Order submission. This date is merely indicative, and no responsibility can be attributed to IKEA in case of failure to deliver on said date. Pagina 2

3 Products are delivered at street level without prior appointment. The courier (GLS or Bartolini) shall deliver the Products Monday to Friday between 8:00 a.m. and 7:00 p.m. The Carrier shall make 2 (two) attempts to deliver the Products to the address provided by the Customer. In case of absence during the first delivery attempt, the Carrier shall leave a notice indicating the telephone number to be contacted in order to arrange the time of a second delivery; otherwise, the Carrier shall come back on the weekday following the first attempt. After the second failed attempt, the Products shall be held on free storage by the Carrier for 10 (ten) calendar days, during which period the Customer may contact the Carrier to arrange the delivery. After 10 (ten) calendar days of storage, the Order shall be automatically cancelled, and IKEA shall refund the order amount to the Customer after deducting shipping costs, which shall remain at the Customer s expense. These Delivery Terms shall not apply to delivery of items of the UPPLEVA Series, which are always delivered through the Delivery by Appointment Service, as described in paragraph b) of this Section 6, even if they weigh 30 kg or less. b) Orders weighing more than 30 (thirty) kg - (Delivery by Appointment): The estimated date of delivery shall be indicated at the time of Order submission. This date is merely indicative, and no responsibility can be attributed to IKEA in case of failure to deliver on said date. Subsequently, the Customer shall be contacted directly by the Carrier to arrange the Delivery date and time range. If the Customer needs to change the Delivery date arranged with the Carrier, he/she may do so free of charge up to 24 (twenty-four) hours before the agreed time range. To arrange a new Delivery, the Customer can contact the Carrier Monday to Friday from 9:00 a.m. to 6:00 p.m. or contact us through the "Contact US" link: ( In case of absence on the date and time range agreed with the Carrier, IKEA shall charge the cost of the new Delivery to the Customer. If: - the Products are to be delivered in areas where traffic is restricted or prohibited, e.g. restricted traffic zones (zone a traffico limitato, ZTL), restricted vehicle access zones, pedestrian zones etc.; - the distance between the unloading point and the building where the purchased Products are to be delivered exceeds 100 (one hundred) m; - the building where the purchased Products are to be delivered has no lift or freight elevator, or otherwise a staircase and/or doors whose size or weight capacity are suitable for the passage and lifting of the Products; the Customer shall inform IKEA through the contact channels listed in the Website s Contact Us section. Failing this, IKEA hereby reserves the right to charge to the Customer all costs of additional haulage services and/or rental of external platforms, cranes etc. Payment of such costs shall be made by credit card. The purchased Products may be kept on free storage by the Carrier for up to 15 (fifteen) calendar days as of the date the Customer was contacted by the Carrier. After fifteen days free storage, a total cost of (ten), including VAT, shall apply for the first 3 (three) days, and thereafter a maximum cost of 5.00 (five) per day, including VAT, shall be apply. These costs shall be charged to the Customer and shall be paid by credit card. Storage shall have a maximum duration of 30 (thirty) calendar days. If the Customer fails to collect the Products within said time limit, the Order shall be automatically cancelled and IKEA shall refund the Order amount to the Customer after deducting delivery and storage costs, which shall remain at the Customer s expense. 7) Shipping Costs Shipping costs (hereinafter Shipping Costs ) are at the Customer s expense, and are appropriately indicated in the Purchase Order. a) The cost of the Shipping Service for Orders weighing 30 (thirty) kg or less, as set out in Section 6 above, is (fifteen euro and fifty cents) for all the areas covered by the Pagina 3

4 Service. b) The cost of the Shipping Service for Orders weighing more than 30 (thirty) kg, as set out in paragraph b) of Section 6 above, is calculated according to the criteria specified in the Website s shipping page ( 8) Support Services For information about post-sale support services, please access the "Customer Service section: or contact IKEA through any of the channels listed in the "Contact Us" section. 9) Right of Withdrawal If the Customer is a Consumer, as defined in Article 3 of the Consumer Code, he/she is entitled to the rights set out in Article 64 of the Consumer Code to the extent provided under said law, and therefore has the right to withdraw from the Purchase Agreement (hereinafter the Right of Withdrawal ) for whatever reason, without providing the reason and without penalties, following the procedure described below. Customers may withdraw from the purchase of all (Total Withdrawal) or part (Partial Withdrawal) of the purchased IKEA Products. The Right of Withdrawal shall be exercised by sending a notice by registered mail with return receipt requested, within 10 (ten) business days after the date of receipt of the Products, to: IKEA ITALIA RETAIL S.r.l Ufficio Ikea Compra on line Strada Provinciale 208 n Carugate (MI). The notice may be sent in advance within the same time limit via (csc.compraonline.it@ikea.com) but must be confirmed by registered mail with return receipt requested, within the next 48 (forty-eight) hours. In the Withdrawal notice the Customer shall state his/her intention to withdraw from the Purchase and the Product(s) for which he/she intends to exercise the Right of Withdrawal, and shall enclose copies of the purchase invoice and delivery note. In the notice, the Customer shall also confirm that the Product(s) is/are intact and stored in perfect condition in the original package, complete in all its parts. A pre-completed form to be used for Withdrawal notices is available on our Website for downloading. Following the Customer s correct exercise of the Right of Withdrawal, IKEA shall send an with a Return Process number. The Customer shall refer to this number when returning the Product(s) (hereinafter Product Return ). Products must be returned, within 30 (thirty) calendar days after receipt thereof, to the Customer Service department of any IKEA store in Italy (hereinafter IKEA Stores ). To facilitate Product Return, IKEA provides a shipping service to Customers who request it. For information on shipping costs and procedures, please contact us through any of the channels listed in the Website "Contact Us" section ( In any event, the Right of Withdrawal is subject to the following conditions: the right applies to each individual Product purchased as a whole; the purchased Product(s) must be undamaged and must be returned in its original package, complete in all its parts (including outer packaging and accessory documentation); return shipping costs are at the Customer s expense; all responsibility for Product Return rests with the Customer. If the Right of Withdrawal has been exercised correctly, IKEA shall refund to the Customer the full amount paid, including Shipping Costs, within 30 (thirty) calendar days after receiving the Withdrawal notice. Product Return costs shall be deducted from the refund amount and shall Pagina 4

5 remain at the Customer s expense. 10) Warranties a) Legal warranty - Consumers Consumers, as defined in Article 3 of the Consumer Code (hereinafter the Consumer Code, Legislative Decree no. 206 of 6 September 2005), have the right to obtain the legal warranty provided under Articles 128 to 132 of the Consumer Code. Among other things, this Warranty requires the Consumer to notify IKEA, under penalty of forfeiture, of any conformity defects found in the Product, within 2 (two) months after discovery (Article 132, Consumer Code). Following this notice, the Consumer shall have the right to request that the Product be repaired or replaced, without prejudice to any other remedies provided by law. The aforesaid legal Warranty shall be effective for a maximum period of 2 (two) years after Product delivery. After this period, IKEA shall not be liable for any conformity defects identified by the Consumer. In case of Product replacement or repair, the warranty expiry date applicable to the replaced or repaired Product is the same as for the original product. This means that the two-year legal warranty period shall start from the date the original product was delivered. In order to obtain warranty coverage, please be sure to show your proof of purchase. For legal warranty provisions, please refer to Consumer Code Articles 128 et seq. b) Legal warranty Non-consumer Customers Non-consumer Customers, as defined in Article 2 of the Consumer Code, has the right to obtain the legal warranty provided by the Italian Civil Code. Among other things, this Warranty requires the Non-consumer Customer to notify IKEA, under penalty of forfeiture, of any conformity defects found in the Product, within 8 (eight) days after discovery. The aforesaid legal Warranty shall be effective for a maximum period of 12 (twelve) months after Product delivery. After this period, IKEA shall not be liable for any conformity defects identified by the Non-consumer Customer. In order to obtain warranty coverage, please be sure to show your proof of purchase. c) IKEA Warranty In addition to the 2 (two) year legal Warranty provided under the Consumer Code, IKEA offers additional warranties on certain types of products (hereinafter IKEA Warranty ), as indicated in connection with the individual products, to give you maximum peace of mind with your purchases. Additional information on our warranty terms and conditions (hereinafter IKEA Warranty Terms ) is available in the "IKEA Warranties" section of the Website ( The Warranty is effective as of the date of purchase of the Product at the IKEA store. In order to obtain warranty coverage, please be sure to show your proof of purchase. 11) Additional IKEA benefits IKEA offers all its Customers the possibility of changing their mind (hereinafter Change of Mind ) about purchases, including online purchases. After a purchase, each Customer will have 90 (ninety) days to go to any IKEA Store with proof of purchase, the undamaged Product in perfect condition in its original package, complete in all its parts, and original outer packaging, and to request replacement with a different item or refund in the form of a coupon to be used in any IKEA Store in Italy. Coupons cannot be used for online purchases. For promotions consisting of multiple items, the Customer must bring back all the items included in the promotion. The Change of Mind option applies to all IKEA Products except custom made items. Please note that IKEA FAMILY or IKEA BUSINESS card holders have 6 (six) months instead of 90 days to change their mind. Pagina 5

6 For any further details, please refer to the Website at: 12) WEEE Customers who buy an electric or electronic Product for household use may dispose of a similar old product using the Municipal disposal facility or trading it in at any IKEA Store in Italy and showing the proof of purchase of a new product within 90 days. The product must be undamaged and in conditions that will not create safety risks for personnel in charge of handling it, must not contain added extraneous elements or materials, and must be similar in size to the newly purchased product. Any products not meeting these requirements shall not be accepted. IKEA offers a free service for the collection of used products (hereinafter the Collection Service ). The request must be sent via to csc.compraonline.it@ikea.com within 12 (twelve) hours after receiving the Order Confirmation, and must indicate the Order number and the product to be collected. Delivery of the new appliance and collection of the old one shall not occur on the same day. The item will be collected within 30 days after the request, Monday to Friday between 9:00 a.m. and 6:00 p.m.; the service is free of charge. The Customer will be contacted to arrange an appointment. The product must be disconnected from the water and power lines, in conditions that will not create hazards during collection. The Service will only be provided if all these conditions are met. If the Customer is absent during the agreed time range, no other attempts will be made to collect the item. However, the Customer may bring the appliance subject to the WEEE regulations to any IKEA Store in Italy.
