1 INTELLECTUAL PROPERTY, TELECOMMUNICATIONS, AND TECHNOLOGY REGULATION AREA OF CONCENTRATION (REVISED 5/27/14) California Western School of Law proposes to offer an Area of Concentration in Intellectual Property, Telecommunications, and Technology Regulation (AOC). This AOC will enable students to obtain a solid foundation in the core areas of Intellectual Property, Regulation, Legal Skills Training, and some technology or specialty area such as Telecommunications, Copyright and Trademark, Intellectual Property, Patent Law, Biotech and Entertainment Law. Students will also get practical experience through internships, pro bono work, clinics and practicum courses. Finally, this AOC will focus on lawyering skills critical to effective practice in these areas, such as negotiation, applied reasoning and creative problem solving. There are 28 CWSL courses and 29 courses taught at CILE schools ( William Mitchell College of Law (WMCL), South Texas College of Law (STCL) and New England School of Law (NESL) in this AOC, taught by full-time and adjunct faculty. Courses may be taken at CILE schools as a visitor or via distance learning with permission from the professor and approval from the Vice Dean. You will need to complete a Visitor s form available from the Vice Dean. To access the form, go to To access the form to take a class online via distance learning, go to Students will have the opportunity to work in student organizations such as the Center for Telecommunications and Intellectual Property; and the Entertainment and Sports Law Society. They may also participate in internships and pro bono opportunities. This AOC is designed to provide students with a thorough and rigorous overview of intellectual property and technology regulation issues. This AOC is available to JD, MCL and LLM students. J.D. students should declare their intention of pursuing this AOC prior to the commencement of their fifth trimester; and LLM and MCL students should declare their intent during their first trimester. However, the application will not be submitted until you have completed the requirements and are about to graduate. All students must fulfill the four principal requirements listed below in order to complete this AOC. Students will not receive area of concentration credit for any course where they receive a grade lower than a 79 or B-. Students with a GPA in this AOC of 85, B+ or better are eligible for honors designation. For LLM and MCL students, who generally receive numerical grades which are converted to Honors Pass (85. B+ or better) Pass, and Fail; the Registrar shall use
2 students numerical grades to determine minimum GPA requirements and eligibility for honors designation. Students must select a member of the Core Advisor Group as their area of concentration advisor. Students must meet with their advisor at least once a trimester to discuss their curriculum and to ensure they are making satisfactory progress in their area of concentration. Any variations, substitutions and modifications must be approved in advance by their advisor. Professor Andrea Johnson will act as the Core Advisor and chair of this AOC. Professor Johnson will handle administrative and curriculum issues, as well as advise students. Professor Campbell will review any new proposed course offerings in Intellectual Property and make recommendations to the Curriculum Committee. Any full-time faculty who teach in this subject area can also act as a student advisor. Adjunct faculty, visiting professors, and visiting scholars constitute an essential component of this concentration. However, adjunct faculty may not be faculty advisors. Substantive Requirements: I. Course Requirements 1 : Students are required to take four core courses, and two or more electives. In addition, J.D. students are required to do an internship in some area within the AOC. LLM and MCL students are required to take a practicum course in lieu of an internship and pro bono work. To the extent there is a choice among core courses, students are free to take alternative core courses as electives. Students may also take courses at the CILE schools to satisfy a core or elective course requirement. A. Core courses: Students must take one course in each set of four areas: Administrative Process and Procedures, Intellectual Property, Skills Training and a Specialty Area. All core courses are currently offered at least once a year. You may also elect to take courses at one of the CILE schools to satisfy the requirements. CILE courses are listed separately below. 1. 6 South Texas College of Law: Intellectual Property Litigation Intellectual Property Survey Internet Law Patent Licensing & Technology Transfer Patent Office Procedure Trademarks & Unfair Competition Advanced Patent Law Students may take any other relevant course if approved by one of the co-chairs of the Core Advisor Group. II. Writing Requirement Students must write two scholarly papers. The first scholarly writing paper shall be associated with a core or elective course. Students taking a two credit course will be required to write a minimum 20-page paper (including footnotes and bibliography). Students taking a three credit course shall write a minimum 30 page paper (including footnotes and a bibliography). The second scholarly writing paper shall be a minimum of 20 pages (including footnotes and a bibliography) and may be written as part of a core or elective course, or independent study. One of the scholarly writing requirements may also satisfy the scholarly writing requirement for graduation. III. Practicum Requirement There is a practicum requirement for this AOC. Juris Doctor students must participate in both pro bono work and an internship as follows: Pro bono work with a minimum commitment of 50 hours, which may be completed in the second and third year; and Internship with a minimum commitment of 280 hours. LLM and MCL students in this AOC may elect to take at least one additional practicum course in lieu of both the pro bono or internship requirements. This means that these students would take the minimum two elective courses, plus a third course that is a practicum. IV. Student/Professional Organization Requirement All students in this AOC must participate in a student or professional organization in a specialty area for a least one trimester. Participation in one of the following student/professional organizations that are currently offered after the completion of their second trimester will satisfy this requirement:
7 Center for Intellectual Property, Technology & Telecommunications CWSL Law Review/Journal Federal Communications Bar Association Federal Communications Law Journal Entertainment and Sports Law Society San Diego Intellectual Property Law Association American Intellectual Property Law Association ABA IP Section San Diego Country Bar Association IP Section Student Intellectual Property Law Association Participation in any other student/professional organization should be approved by the Core Advisor. Completion of Area of Concentration: Student who satisfactorily complete the requirements of this AOC will receive a Certificate of Completion of Area of Concentration in Intellectual Property, Telecommunications and Technology Regulation. Students who maintain a cumulative grade point average of 85, B+ or higher in area of concentration courses will receive an Honors designation. No student will get course credit toward completing this AOC course if they receive a grade of less than 79 or B-. This means that while they may get credit for taking the course toward graduation, it will not count toward satisfying the AOC requirements. MCL and LLM students who satisfactorily complete the requirements of this AOC shall receive a Certificate of Completion of Area of Concentration in Intellectual Property, Telecommunications and Technology Regulation. LLM and MCL students who maintain a cumulative grade point average of 85, B+ or higher in area of concentration courses will receive an Honors designation. The Registrar shall use the student s numerical grades to determine minimum GPA requirements and eligibility for honors designation. Pro Bono and Internship Opportunities in Telecommunications and Intellectual Property Law The following organizations are current pro bono and internship placements in telecommunications and intellectual property law that are offered to students. Students can select from a variety of internships in and outside of San Diego in the areas of telecommunications and intellectual property. Of course, students may seek other pro bono or internship opportunities that provide a telecommunications or intellectual property focus.
