3 Occupational Health & Safety 8 Precaution Rules Who is responsible for Health & Safety in the Workplace? Occupational Health & Safety is regulated by mainly two sets of Legislation: The Occupational Health & Safety Act (85 0f 1993) and its Regulations The Mine Health & Safety Act (29 of 1996) and its Regulations 1. Identify Potential Hazrds For a safe workplace everyone must be PRO-ACTIVE by identifying dangers. These Acts place the responsibility for creating a healthy and safe workplace squarely on the shoulders of the Employer whilst making Employees responsible for cooperating with the Employer in his/her efforts to keep the workplace safe & healthy. The Employer must: identify the hazards in the workplace and remove or mitigate them and inform the Employees of any hazards still present train and instruct Employees on how to work under hazardous conditions issue them with Personal Protective Equipment to protect them against the hazards supervise Employees to ensure that they work in accordance with their training and instruction and use the PPE issued to them and, if Employees do not adhere to the above, discipline them. Employees must: act in such a way that they do not endanger themselves or any other person cooperate with the Employer in any health & safety measures that the latter may introduce obey OH&S rules and instruction report any unsafe acts or conditions report any work related injuries or illness suffered. The following hierarchy of responsibility for OH&S is suggested: The Employer to create & maintain a healthy & safe workplace The Chief Executive Officer to ensure that the Employer complies with OH&S legal requirements The Line Management to accept it s responsibility for protecting workers against work related injury & illness The OH&S Manager to advise and guide management in OH&S matters The OH&S Representatives to contribute to the maintenance of the healthy & safe workplace The Employees to cooperate with the Employer in OH&S matters 1. Identify Potential Hazrds which may be present while work is being done or something is being produced, processed, used, stored or transported. 3. Provide the Necessary Information or instructions, training and supervision while keeping the extent of worker 5. Take Steps to Ensure that every person under one s control complies with the requirements of the Act. 7. Use Trained Workers or supervision of workers who understand the hazards associated with the work. 2. Establish the Precautionary Measures that are necessary to protect workers against the identified hazards and provide the means to implement them. 4. Do Not Continue Unless the necessary precautionary measures have been taken. 6. Enforce Necessary Control Measures in the interest of health and safet y. The uvex Safety Academy is able to provide assistance in training OH&S role players in the selection of the correct and most effective Personal Protective & other OH&S equipment 8. Precautionary Measures must be implemented and maintained. 4 5
