3 CETS 215 Mnipultion of Sports Competition, 18.IX.2014 Hve greed s follows: Chpter I Purpose, guiding priniples, definitions Artile 1 Purpose nd min ojetives 1 The purpose of this Convention is to omt the mnipultion of sports ompetitions in order to protet the integrity of sport nd sports ethis in ordne with the priniple of the utonomy of sport. 2 For this purpose, the min ojetives of this Convention re: to prevent, detet nd sntion ntionl or trnsntionl mnipultion of ntionl nd interntionl sports ompetitions; to promote ntionl nd interntionl o-opertion ginst mnipultion of sports ompetitions etween the puli uthorities onerned, s well s with orgnistions involved in sports nd in sports etting. Artile 2 Guiding priniples 1 The fight ginst the mnipultion of sports ompetitions shll ensure respet, inter li, for the following priniples: d humn rights; leglity; proportionlity; protetion of privte life nd personl dt. Artile 3 Definitions For the purposes of this Convention: 1 Sports ompetition mens ny sport event orgnised in ordne with the rules set y sports orgnistion listed y the Convention Follow-up Committee in ordne with Artile 31.2, nd reognised y n interntionl sports orgnistion, or, where pproprite, nother ompetent sports orgnistion. 2 Sports orgnistion mens ny orgnistion whih governs sport or one prtiulr sport, nd whih ppers on the list dopted y the Convention Follow-up Committee in ordne with Artile 31.2, s well s its ontinentl nd ntionl ffilited orgnistions, if neessry. 3 Competitions orgniser mens ny sports orgnistion or ny other person, irrespetive of their legl form, whih orgnises sports ompetitions. 4 Mnipultion of sports ompetitions mens n intentionl rrngement, t or omission imed t n improper ltertion of the result or the ourse of sports ompetition in order to remove ll or prt of the unpreditle nture of the forementioned sports ompetition with view to otining n undue dvntge for oneself or for others. 5 Sports etting mens ny wgering of stke of monetry vlue in the expettion of prize of monetry vlue, sujet to future nd unertin ourrene relted to sports ompetition. 4 CETS 215 Mnipultion of Sports Competition, 18.IX.2014 illegl sports etting mens ny sports etting tivity whose type or opertor is not llowed under the pplile lw of the jurisdition where the onsumer is loted; irregulr sports etting shll men ny sports etting tivity inonsistent with usul or ntiipted ptterns of the mrket in question or relted to etting on sports ompetition whose ourse hs unusul hrteristis; suspiious sports etting shll men ny sports etting tivity whih, ording to relile nd onsistent evidene, ppers to e linked to mnipultion of the sports ompetition on whih it is offered. 6 Competition stkeholder mens ny nturl or legl person elonging to one of the following tegories: thlete mens ny person or group of persons, prtiipting in sports ompetitions; thlete support personnel mens ny oh, triner, mnger, gent, tem stff, tem offiil, medil or prmedil personnel working with or treting thletes prtiipting in or prepring for sports ompetitions, nd ll other persons working with the thletes; offiil mens ny person who is the owner of, shreholder in, n exeutive or stff memer of the entities whih orgnise nd promote sports ompetitions, s well s referees, jury memers nd ny other redited persons. The term lso overs the exeutives nd stff of the interntionl sports orgnistion, or where pproprite, other ompetent sports orgnistion whih reognises the ompetition. 7 Inside informtion mens informtion relting to ny ompetition tht person possesses y virtue of his or her position in reltion to sport or ompetition, exluding ny informtion lredy pulished or ommon knowledge, esily essile to interested memers of the puli or dislosed in ordne with the rules nd regultions governing the relevnt ompetition. Chpter II Prevention, o-opertion nd other mesures Artile 4 Domesti o-ordintion 1 Eh Prty shll o-ordinte the poliies nd tion of ll the puli uthorities onerned with the fight ginst the mnipultion of sports ompetitions. 2 Eh Prty, within its jurisdition, shll enourge sports orgnistions, ompetition orgnisers nd sports etting opertors to o-operte in the fight ginst the mnipultion of sports ompetitions nd, where pproprite, entrust them to implement the relevnt provisions of this Convention. Artile 5 Risk ssessment nd mngement 1 Eh Prty shll where pproprite in o-opertion with sports orgnistions, sports etting opertors, ompetition orgnisers nd other relevnt orgnistions identify, nlyse nd evlute the risks ssoited with the mnipultion of sports ompetitions. 2 Eh Prty shll enourge sports orgnistions, sports etting opertors, ompetition orgnisers nd ny other relevnt orgnistion to estlish proedures nd rules in order to omt mnipultion of sports ompetitions nd shll dopt, where pproprite, legisltive or other mesures neessry for this purpose. 4

Artile 7 Sports orgnistions nd ompetition orgnisers 1 Eh Prty shll enourge sports orgnistions nd ompetition orgnisers to dopt nd implement rules to omt the mnipultion of sports ompetitions s well s priniples of good governne, relted, inter li to: prevention of onflits of interest, inluding: prohiiting ompetition stkeholders from etting on sports ompetitions in whih they re involved; prohiiting the misuse or dissemintion of inside informtion; ompline y sports orgnistions nd their ffilited memers with ll their ontrtul or other oligtions; the requirement for ompetition stkeholders to report immeditely ny suspiious tivity, inident, inentive or pproh whih ould e onsidered n infringement of the rules ginst the mnipultion of sports ompetitions. 2 Eh Prty shll enourge sports orgnistions to dopt nd implement the pproprite mesures in order to ensure: d e enhned nd effetive monitoring of the ourse of sports ompetitions exposed to the risks of mnipultion; rrngements to report without dely instnes of suspiious tivity linked to the mnipultion of sports ompetitions to the relevnt puli uthorities or ntionl pltform; effetive mehnisms to filitte the dislosure of ny informtion onerning potentil or tul ses of mnipultion of sports ompetitions, inluding dequte protetion for whistle lowers; wreness mong ompetition stkeholders inluding young thletes of the risk of mnipultion of sports ompetitions nd the efforts to omt it, through edution, trining nd the dissemintion of informtion; the ppointment of relevnt offiils for sports ompetition, in prtiulr judges nd referees, t the ltest possile stge. 3 Eh Prty shll enourge its sports orgnistions, nd through them the interntionl sports orgnistions to pply speifi, effetive, proportionte nd dissusive disiplinry sntions nd mesures to infringements of their internl rules ginst the mnipultion of sports ompetitions, in prtiulr those referred to in prgrph 1 of this rtile, s well s to ensure mutul reognition nd enforement of sntions imposed y other sports orgnistions, notly in other ountries. 4 Disiplinry liility estlished y sports orgnistions shll not exlude ny riminl, ivil or dministrtive liility. 5

6 CETS 215 Mnipultion of Sports Competition, 18.IX.2014 Artile 8 Mesures regrding the finning of sports orgnistions 1 Eh Prty shll dopt suh legisltive or other mesures s my e neessry to ensure pproprite trnspreny regrding the funding of sports orgnistions tht re finnilly supported y the Prty. 2 Eh Prty shll onsider the possiility of helping sports orgnistions to omt the mnipultion of sports ompetitions, inluding y funding pproprite mehnisms. 3 Eh Prty shll where neessry onsider withholding finnil support or inviting sports orgnistions to withhold finnil support from ompetition stkeholders sntioned for mnipulting sports ompetitions, for the durtion of the sntion. 4 Where pproprite, eh Prty shll tke steps to withhold some or ll finnil or other sportrelted support from ny sports orgnistions tht do not effetively pply regultions for omting mnipultion of sports ompetitions. Artile 9 Mesures regrding the etting regultory uthority or other responsile uthority or uthorities 1 Eh Prty shll identify one or more responsile uthorities, whih in the Prty s legl order re entrusted with the implementtion of sports etting regultion nd with the pplition of relevnt mesures to omt the mnipultion of sports ompetitions in reltion to sports etting, inluding, where pproprite: the exhnge of informtion, in timely mnner, with other relevnt uthorities or ntionl pltform for illegl, irregulr or suspiious sports etting s well s infringements of the regultions referred to or estlished in ordne with this Convention; the limittion of the supply of sports etting, following onsulttion with the ntionl sports orgnistions nd sports etting opertors, prtiulrly exluding sports ompetitions: whih re designed for those under the ge of 18; or where the orgnistionl onditions nd/or stkes in sporting terms re indequte; d e f the dvne provision of informtion out the types nd the ojets of sports etting produts to ompetition orgnisers in support to their efforts to identify nd mnge risks of sports mnipultion within their ompetition; the systemti use in sports etting of mens of pyment llowing finnil flows ove ertin threshold, defined y eh Prty, to e tred, prtiulrly the senders, the reipients nd the mounts; mehnisms, in o-opertion with nd etween sports orgnistions nd, where pproprite, sports etting opertors, to prevent ompetition stkeholders from etting on sports ompetitions tht re in reh of relevnt sports rules or pplile lw; the suspension of etting, ording to domesti lw, on ompetitions for whih n pproprite lert hs een issued. 2 Eh Prty shll ommunite to the Seretry Generl of the Counil of Europe the nme nd ddresses of the uthority or uthorities identified in pursune of prgrph 1 of this rtile. 6

7 CETS 215 Mnipultion of Sports Competition, 18.IX.2014 Artile 10 Sports etting opertors 1 Eh Prty shll dopt suh legisltive or other mesures s my e neessry to prevent onflits of interest nd misuse of inside informtion y nturl or legl persons involved in providing sports etting produts, in prtiulr through restritions on: d nturl or legl persons involved in providing sports etting produts etting on their own produts; the use of position s sponsor or prt-owner of sports orgnistion to filitte the mnipultion of sports ompetition or to misuse inside informtion; ompetition stkeholders eing involved in ompiling etting odds for the ompetition in whih they re involved; ny sports etting opertor who ontrols ompetition orgniser or stkeholder, s well s ny sports etting opertor who is ontrolled y suh ompetition orgniser or stkeholder, offering ets on the ompetition in whih this ompetition orgniser or stkeholder is involved. 2 Eh Prty shll enourge its sports etting opertors, nd through them, the interntionl orgnistions of sports etting opertors, to rise wreness mong their owners nd employees of the onsequenes of nd the fight ginst mnipultion of sports ompetitions, through edution, trining nd the dissemintion of informtion. 3 Eh Prty shll dopt suh legisltive or other mesures s my e neessry to olige sports etting opertors to report irregulr or suspiious etting without dely to the etting regultory uthority, the other responsile uthority or uthorities, or the ntionl pltform. Artile 11 The fight ginst illegl sports etting 1 With view to omting the mnipultion of sports ompetitions, eh Prty shll explore the most pproprite mens to fight opertors of illegl sports etting nd shll onsider dopting mesures, in ordne with the pplile lw of the relevnt jurisdition, suh s: d losure or diret nd indiret restrition of ess to illegl remote sports etting opertors, nd losure of illegl lnd-sed sports etting opertors in the Prty s jurisdition; loking of finnil flows etween illegl sports etting opertors nd onsumers; prohiition of dvertising for illegl sports etting opertors; rising of onsumers wreness of the risks ssoited with illegl sports etting. Chpter III Exhnge of informtion Artile 12 Exhnge of informtion etween ompetent puli uthorities, sports orgnistions nd sports etting opertors 1 Without prejudie to Artile 14, eh Prty shll filitte, t ntionl nd interntionl levels nd in ordne with its domesti lw, exhnges of informtion etween the relevnt puli uthorities, sports orgnistions, ompetition orgnisers, sports etting opertors nd ntionl pltforms. In prtiulr, eh Prty shll undertke to set up mehnisms for shring relevnt informtion when suh informtion might ssist in the rrying out of the risk ssessment referred to in Artile 5 nd nmely the dvned provision of informtion out 7

8 CETS 215 Mnipultion of Sports Competition, 18.IX.2014 the types nd ojet of the etting produts to the ompetition orgnisers, nd in inititing or rrying out investigtions or proeedings onerning the mnipultion of sports ompetitions. 2 Upon request, the reipient of suh informtion shll, in ordne with domesti lw nd without dely, inform the orgnistion or the uthority shring the informtion of the follow-up given to this ommunition. 3 Eh Prty shll explore possile wys of developing or enhning o-opertion nd exhnge of informtion in the ontext of the fight ginst illegl sports etting s set out in Artile 11 of this Convention. Artile 13 Ntionl pltform 1 Eh Prty shll identify ntionl pltform ddressing mnipultion of sports ompetitions. The ntionl pltform shll, in ordne with domesti lw, inter li: d e serve s n informtion hu, olleting nd disseminting informtion tht is relevnt to the fight ginst mnipultion of sports ompetitions to the relevnt orgnistions nd uthorities; o-ordinte the fight ginst the mnipultion of sports ompetitions; reeive, entrlise nd nlyse informtion on irregulr nd suspiious ets pled on sports ompetitions tking ple on the territory of the Prty nd, where pproprite, issue lerts; trnsmit informtion on possile infringements of lws or sports regultions referred to in this Convention to puli uthorities or to sports orgnistions nd/or sports etting opertors; o-operte with ll orgnistions nd relevnt uthorities t ntionl nd interntionl levels, inluding ntionl pltforms of other Sttes. 2 Eh Prty shll ommunite to the Seretry Generl of the Counil of Europe the nme nd ddresses of the ntionl pltform. Artile 14 Personl dt protetion 1 Eh Prty shll dopt suh legisltive nd other mesures s my e neessry to ensure tht ll tions ginst the mnipultion of sports ompetitions omply with relevnt ntionl nd interntionl personl dt protetion lws nd stndrds, prtiulrly in the exhnge of informtion overed y this Convention. 2 Eh Prty shll dopt suh legisltive or other mesures s neessry to gurntee tht the puli uthorities nd orgnistions overed y this Convention tke the requisite mesures in order to ensure tht, when personl dt re olleted, proessed nd exhnged, irrespetive of the nture of those exhnges, due regrd is given to the priniples of lwfulness, dequy, relevne nd ury, nd lso to dt seurity nd the rights of dt sujets. 3 Eh Prty shll provide in its lws tht the puli uthorities nd orgnistions overed y this Convention re to ensure tht the exhnge of dt for the purpose of this Convention does not go eyond the neessry minimum for the pursuit of the stted purposes of the exhnge. 8

Chpter IV Sustntive riminl lw nd o-opertion with regrd to enforement Artile 15 Criminl offenes relting to the mnipultion of sports ompetitions 1 Eh Prty shll ensure tht its domesti lws enle to riminlly sntion mnipultion of sports ompetitions when it involves either oerive, orrupt or frudulent prties, s defined y its domesti lw. Artile 16 Lundering of the proeeds of riminl offenes relting to the mnipultion of sports ompetitions 1 Eh Prty shll dopt suh legisltive or other mesures s my e neessry to estlish s riminl offenes under its domesti lw the ondut s referred to in Artile 9, prgrphs 1 nd 2, of the Counil of Europe Convention on Lundering, Serh, Seizure nd Confistion of the Proeeds from Crime nd on the Finning of Terrorism (2005, CETS No. 198), in Artile 6, prgrph 1 of the United Ntions Convention ginst Trnsntionl Orgnized Crime (2000) or in Artile 23, prgrph 1 of the United Ntions Convention ginst Corruption (2003), under the onditions referred to therein, when the predite offene giving rise to profit is one of those referred to in Artiles 15 nd 17 of this Convention nd in ny event, in the se of extortion, orruption nd frud. 2 When deiding on the rnge of offenes to e overed s predite offenes mentioned in prgrph 1, eh Prty my deide, in ordne with its domesti lw, how it will define those offenes nd the nture of ny prtiulr elements tht mke them serious. 3 Eh Prty shll onsider inluding the mnipultion of sports ompetitions in its money lundering prevention frmework y requiring sports etting opertors to pply ustomer due diligene, reord keeping nd reporting requirements. Artile 17 Aiding nd etting 1 Eh Prty shll dopt suh legisltive nd other mesures s my e neessry to estlish s riminl offenes under its domesti lw, when ommitted intentionlly, the iding nd etting of the ommission of ny of the riminl offenes referred to in Artile 15 of this Convention. Artile 18 Corporte liility 1 Eh Prty shll dopt suh legisltive or other mesures s my e neessry to ensure tht legl persons n e held lile for offenes referred to in Artiles 15 to 17 of this Convention, ommitted for their enefit y ny nturl person, ting either individully or s memer of n orgn of the legl person, who hs leding position within the legl person, sed on: power of representtion of the legl person; the uthority to tke deisions on ehlf of the legl person; the uthority to exerise ontrol within the legl person. 2 Sujet to the legl priniples of the Prty, the liility of legl person my e riminl, ivil or dministrtive. 9

Chpter V Jurisdition, riminl proedure nd enforement mesures Artile 19 Jurisdition 1 Eh Prty shll dopt suh legisltive or other mesures s my e neessry to estlish jurisdition over the offenes referred to in Artiles 15 to 17 of this Convention where tht offene is ommitted: d in its territory; or on ord ship flying its flg; or on ord n irrft registered under its lw; or y one of its ntionls or y person hitully residing in its territory. 2 Eh Stte or the Europen Union my, t the time of signture or when depositing its instrument of rtifition, eptne or pprovl, y delrtion ddressed to the Seretry Generl of the Counil of Europe, delre tht it reserves the right not to pply, or to pply only in speifi ses or onditions, the rules on jurisdition lid down in prgrph 1, suprgrph d of this rtile. 3 Eh Prty shll tke the neessry legisltive or other mesures to estlish jurisdition over offenes referred to in Artiles 15 to 17 of this Convention in ses in whih n lleged offender is present on its territory nd nnot e extrdited to nother Prty on the sis of his or her ntionlity. 4 When more thn one Prty lims jurisdition over n lleged offene referred to in Artiles 15 to 17 of this Convention, the Prties involved shll, where pproprite, onsult eh other with view to determining the most pproprite jurisdition for the purposes of proseution. 5 Without prejudie to the generl rules of interntionl lw, this Convention does not exlude ny riminl, ivil nd dministrtive jurisdition exerised y Prty in ordne with its domesti lw. Artile 27 Other interntionl o-opertion mesures in respet of prevention 1 Eh Prty shll endevour to integrte, where pproprite, the prevention of nd the fight ginst the mnipultion of sports ompetitions into ssistne progrmmes for the enefit of third Sttes. Artile 28 Interntionl o-opertion with interntionl sports orgnistions 1 Eh Prty, in ordne with its domesti lw, shll o-operte with interntionl sports orgnistions in the fight ginst the mnipultion of sports ompetitions. Chpter VIII Follow up Artile 29 Provision of informtion 1 Eh Prty shll forwrd to the Seretry Generl of the Counil of Europe, in one of the offiil lnguges of the Counil of Europe, ll relevnt informtion onerning legisltive nd other mesures tken y it for the purpose of omplying with the terms of this Convention. Artile 30 Convention Follow-up Committee 1 For the purposes of this Convention, the Convention Follow-up Committee is herey set up. 2 Eh Prty my e represented on the Convention Follow-up Committee y one or more delegtes, inluding representtives of puli uthorities responsile for sport, lwenforement or etting regultion. The Convention Follow-up Committee my, if neessry, invite, y unnimous deision, ny Stte whih is not Prty to the Convention, ny interntionl orgnistion or ody, to e represented y n oserver t its meetings. Representtives ppointed under this prgrph shll prtiipte in meetings of the Convention Follow-up Committee without the right to vote. 4 Meetings of the Convention Follow-up Committee shll e onvened y the Seretry Generl of the Counil of Europe. Its first meeting shll e held s soon s resonly prtile, nd in ny se within one yer fter the dte of entry into fore of the Convention. It shll susequently meet whenever meeting is requested y t lest one third of the Prties or y the Seretry Generl. 5 Sujet to the provisions of this Convention, the Convention Follow-up Committee shll drw up nd dopt y onsensus its own rules of proedure. 6 The Convention Follow-up Committee shll e ssisted y the Seretrit of the Counil of Europe in rrying out its funtions. Artile 31 Funtions of the Convention Follow-up Committee 1 The Convention Follow-up Committee is responsile for the follow-up to the implementtion of this Convention. 2 The Convention Follow-up Committee shll dopt nd modify the list of sports orgnistions referred to in Artile 3.2, while ensuring tht it is pulished in n pproprite mnner. 3 The Convention Follow-up Committee my, in prtiulr: mke reommendtions to the Prties onerning mesures to e tken for the purposes of this Convention, in prtiulr with respet to interntionl o-opertion; where pproprite, mke reommendtions to the Prties, following the pulition of explntory doumenttion nd, fter prior onsulttions with representtives of sports orgnistions nd sports etting opertors, in prtiulr on: the riteri to e met y sports orgnistions nd sports etting opertors in order to enefit from the exhnge of informtion referred to in Artile 12.1 of this Convention; other wys imed t enhning the opertionl o-opertion etween the relevnt puli uthorities, sports orgnistions nd etting opertors, s mentioned in this Convention; d keep relevnt interntionl orgnistions nd the puli informed out the tivities undertken within the frmework of this Convention; prepre n opinion to the Committee of Ministers on the request of ny non-memer Stte of the Counil of Europe to e invited y the Committee of Ministers to sign the Convention in pursune of Artile In order to dishrge its funtions, the Convention Follow-up Committee my, on its own inititive, rrnge meetings of experts. 5 The Convention Follow-up Committee, with the prior greement of the Prties onerned, shll rrnge visits to the Prties. 13

The deision to invite nonmemer Stte to sign the Convention shll e tken y the mjority provided for in Artile 20.d of the Sttute of the Counil of Europe, nd y unnimous vote of the representtives of the Contrting Sttes entitled to sit on the Committee of Ministers, fter onsulting the Convention Follow-up Committee, one estlished. 3 This Convention is sujet to rtifition, eptne or pprovl. Instruments of rtifition, eptne or pprovl shll e deposited with the Seretry Generl of the Counil of Europe. 4 This Convention shll enter into fore on the first dy of the month following the expirtion of period of three months fter the dte on whih five signtories, inluding t lest three memer Sttes of the Counil of Europe, hve expressed their onsent to e ound y the Convention in ordne with the provisions of prgrphs 1, 2 nd 3. 5 In respet of ny signtory Stte or the Europen Union whih susequently expresses its onsent to e ound y it, the Convention shll enter into fore on the first dy of the month following the expirtion of period of three months fter the dte of the expression of its onsent to e ound y the Convention in ordne with the provisions of prgrphs 1, 2 nd 3. 6 A Contrting Prty whih is not memer of the Counil of Europe shll ontriute to the finning of the Convention Follow-up Committee in mnner to e deided y the Committee of Ministers fter onsulttion with tht Prty. Artile 33 Effets of the Convention nd reltionship with other interntionl instruments 1 This Convention does not ffet the rights nd oligtions of Prties under interntionl multilterl onventions onerning speifi sujets. In prtiulr, this Convention does not lter their rights nd oligtions rising from other greements previously onluded in respet of the fight ginst doping nd onsistent with the sujet nd purpose of this Convention. 2 This Convention supplements in prtiulr, where pproprite, pplile multilterl or ilterl treties etween the Prties, inluding the provisions of: the Europen Convention on Extrdition (1957, ETS No. 24); the Europen Convention on Mutul Assistne in Criminl Mtters (1959, ETS No. 30); d the Convention on Lundering, Serh, Seizure nd Confistion of the Proeeds from Crime (1990, ETS No. 141); The Counil of Europe Convention on Lundering, Serh, Seizure nd Confistion of the Proeeds from Crime nd on the Finning of Terrorism (2005, CETS No. 198). 14

However, when Prties estlish reltions in respet of the mtters delt with in this Convention other thn s provided for therein, they shll do so in mnner tht is not inonsistent with the Convention s ojetives nd priniples. 5 Nothing in this Convention shll ffet other rights, restritions, oligtions nd responsiilities of Prties. Artile 34 Conditions nd sfegurds 1 Eh Prty shll ensure tht the estlishment, implementtion nd pplition of the powers nd proedures provided for in Chpters II to VII re sujet to onditions nd sfegurds provided for under its domesti lw, whih shll provide for the dequte protetion of humn rights nd lierties, inluding rights rising pursunt to oligtions it hs undertken under the Convention for the Protetion of Humn Rights nd Fundmentl Freedoms, the 1966 United Ntions Interntionl Covennt on Civil nd Politil Rights, nd other pplile interntionl humn rights instruments, nd whih shll inorporte the priniple of proportionlity into its domesti lw. 2 Suh onditions nd sfegurds shll, s pproprite in view of the nture of the proedure or power onerned, inter li inlude judiil or other independent supervision, grounds justifying the pplition, s well s the limittion of the sope nd the durtion of suh power or proedure. 3 To the extent tht it is onsistent with the puli interest, in prtiulr the sound dministrtion of justie, eh Prty shll onsider the impt of the powers nd proedures in these hpters upon the rights, responsiilities nd legitimte interests of third prties. Artile 35 Territoril pplition 1 Any Stte or the Europen Union my, t the time of signture or when depositing its instrument of rtifition, eptne or pprovl, speify the territory or territories to whih this Convention shll pply. 2 Eh Prty my, t ny lter dte, y delrtion ddressed to the Seretry Generl of the Counil of Europe, extend the pplition of this Convention to ny other territory speified in the delrtion nd for whose interntionl reltions it is responsile or on whose ehlf it is uthorised to give undertkings. In respet of suh territory the Convention shll enter into fore on the first dy of the month following the expirtion of period of three months fter the dte of reeipt of the delrtion y the Seretry Generl. 3 Any delrtion mde under the two preeding prgrphs my, in respet of ny territory speified in suh delrtion, e withdrwn y notifition ddressed to the Seretry Generl of the Counil of Europe. Overll, it shll provide for rod nd effetive enforement pility with respet to those mesures. 3 With regrd to the provisions of this Convention, the pplition of whih omes under the jurisdition of eh onstituent Sttes or other similr territoril entities tht re not oliged y the onstitutionl system of the federtion to tke legisltive mesures, the federl government shll inform the ompetent uthorities of suh Sttes of the sid provisions with its fvourle opinion, enourging them to tke pproprite tion to give them effet. Artile 37 Reservtions 1 By written notifition ddressed to the Seretry Generl of the Counil of Europe, ny Stte or the Europen Union my, t the time of signture or when depositing its instrument of rtifition, eptne or pprovl, delre tht it vils itself of the reservtions provided for in Artile 19, prgrph 2 nd in Artile 36, prgrph 1. Artile 38 Amendments 1 Amendments to rtiles of this Convention my e proposed y ny Prty, the Convention Follow-up Committee or the Committee of Ministers of the Counil of Europe. 2 Any proposl for n mendment shll e ommunited to the Seretry Generl of the Counil of Europe nd forwrded y him or her to the Prties, the memer Sttes of the Counil of Europe, non-memer Sttes hving prtiipted in the elortion of this Convention or enjoying oserver sttus with the Counil of Europe, the Europen Union, ny Stte hving een invited to sign this Convention nd the Convention Follow-up Committee t lest two months efore the meeting t whih it is to e onsidered. The Convention Followup Committee shll sumit to the Committee of Ministers its opinion on the proposed mendment. 3 The Committee of Ministers shll onsider the proposed mendment nd ny opinion sumitted y the Convention Follow-up Committee nd my dopt the mendment y the mjority provided for in Artile 20.d of the Sttute of the Counil of Europe. 16
