1 FABULEUX CIRQUE JEAN COUTU CONTEST Contest Rules 1. TVA Group Inc. and Jean Coutu Group (hereinafter collectively called the Contest Organizers ) are holding the FABULEUX CIRQUE JEAN COUTU Contest, which will run from May 30, 2016 at 6:00 A.M. (ET) to September 11, 2016 at 11:59 P.M. (ET) (hereinafter, the Contest Period ). ELIGIBILITY This Contest is open to all residents of Quebec, Ontario and New Brunswick that have reached the age of majority in their province of residence as of May 30, The following people may not enter and are therefore excluded from participation: employees, agents and representatives of Quebecor Media Inc., TVA Group Inc., Jean Coutu Group, its affiliates, related companies, divisions and subsidiaries, their advertising and promotional agencies, partners, participating merchants, involved partners, suppliers of prizes, materials and services related to this Contest or any other party directly linked to the running of this Contest, brothers, sisters, children, mother, father of their legal or de facto spouse and all persons with whom these employees, agents and representatives are domiciled. HOW TO ENTER 2. No purchase necessary. Persons wishing to enter this Contest must register through the Contest section of TVA s website (http://tva.canoe.ca/concours), click the Contest icon and complete the online registration form available starting May 30, 2016, at 6:00 A.M. (ET). i) When the electronic registration form appears, complete the entry form. Provide your name, phone number, address and correctly answer the mathematical skill-testing question. It is each entrant s responsibility to provide a valid phone number where he or she can be reached weekdays between 9:00 A.M. and 5:00 P.M. ii) iii) Upload a photo of your child performing circus artist tricks, with the understanding that you must hold all intellectual property rights regarding the photo you upload and possess all the permissions required from the holders of the child s parental authority, this being an essential condition to enter the Contest. BY ENTERING THE CONTEST, YOU ACCEPT, WITHOUT ANY CONDITION OR PAYMENT OF ANY COMPENSATION WHATSOEVER, THAT THE SUBMITTED PHOTO BE REPRODUCED FOR THE PURPOSES REFERRED TO IN SECTION 18 ( AUTHORIZATION ) HEREOF. Then, click on the Send icon no later than September 11, 2016, at 11:59 P.M. (ET), and you will automatically be entered in the Contest upon
2 receiving a registration confirmation message. You must enable cookies in your browser to enter the Contest. The Contest Organizers reserve the right, in their sole discretion, to refuse photos that are not related to the theme of the Contest that is, that are not circus related or that are deemed offensive or shocking or that represent unsafe practices. Entrants must honour the following restrictions; otherwise, the Contest Organizers reserve the right to cancel one or more of their entries: There is a limit of one entry per person, per day for the duration of the Contest. A person who participates cannot register more than one address, even if that person has several different addresses. A person who participates more than once a day or uses multiple addresses will automatically be removed from the list of entrants. PRIZE 3. In total, four (4) prizes are offered, each consisting of (see Conditions below for more details): Conditions: A family circus weekend for two (2) adults and two (2) children in Montreal, for a total of two (2) days and two (2) nights, from October 7 to 9, Approximate value of $3,750 CAD 1. The prize is non-exchangeable and non-transferable, and 2. The prize must be accepted as awarded, and 3. If a portion of the prize is not used, no compensation will be awarded, and 4. The winner must be available on the days selected by the Contest Organizers, that is, from October 7 to 9, The prize includes: a program of circus activities for four (4) people (2 adults and 2 children), 6. Monitoring and supervision by professional circus trainers 7. Accommodation in quadruple occupancy (2 adults and 2 children) for two (2) nights at a hotel chosen at the discretion of the Contest Organizers, according to availability, 8. Saturday dinner for four (4) people (2 adults and 2 children) in a place chosen at the discretion of the Contest Organizers, according to availability, 9. A group dinner for four (4) people (2 adults and 2 children), in a place chosen at the discretion of the Contest Organizers, according to availability, 10. The services of a guide during the trip, and 11. $200CAD per diem spending money for the winner. 12. Dates may be changed at the discretion of the Contest Organizers. TOTAL CONTEST VALUE: $3,750 CAD x 4 = $15,000
3 DRAW 4. The draw to determine the winners will be held September 13, 2016, at 3:00 P.M., in Montreal at the TVA Group Inc. offices located at 1600 de Maisonneuve Boulevard East, where a random draw will be held among all eligible entries to award the prize, in accordance with paragraphs 1, 2 and The Contest Organizers will contact the person selected as a winner using the telephone number listed on his or her entry form. It is the responsibility of each person to provide a phone number where he or she can be reached weekdays between 9:00 A.M. to 5:00 P.M. The odds of an entry being selected at random depend on the number of eligible entries received in accordance with paragraphs 1, 2 and 3 above. PRIZE CLAIM 6. To be declared a winner, the selected entrant must: a) Correctly answer the mathematical skill-testing question on the registration form, and b) Be reached by phone (in person) by the Contest Organizers within three (3) days of the selection of the winner at random, and c) Fill the Declaration and liability release form (hereinafter the Declaration Form ) sent to him or her, and return it to the Contest Organizers at the latest three (3) days after it is sent, and d) Declare to have read, understood and respected the Contest Rules. After the Declaration and liability release form has been properly completed and signed, the Contest Organizers will contact the winner to determine how the award will be presented, the manner of which being at the discretion of the Contest Organizers, according to the instructions of the prize provider, Jean Coutu Group. The Contest Organizers are not responsible for prizes that are lost, damaged, stolen or delivered late, including during transport and delivery. 7. Failure to comply with any of the conditions mentioned in the paragraphs above or any other condition in these Contest Rules will result in the cancellation of the entry of the person selected, without any liability on the part of the Contest Organizers, and a new draw for the prize will be held pursuant to these Rules until an entrant is selected and declared a winner. TERMS AND CONDITIONS 8. Verification. Entries are subject to verification by the Contest Organizers, with whom entrants agree to cooperate fully. Any entry that is, as the case may be, incomplete, fraudulent or delivered late, or that does not contain a correct answer to the mathematical skill-testing question, will automatically be rejected and will not be eligible for a prize. The Contest Organizers will not be liable for any
4 communication error, loss or poor transmission of entries as well as printing and distribution of the prize. 9. Non-compliant entry. The Contest Organizers reserve the right to disqualify any person or cancel one or more entries of any person entering this Contest or trying to enter by means contrary to these Rules or that are unfair to other entrants (e.g., entries exceeding the permitted limit, computer hacking, etc.). This person may be referred to the competent judicial authorities. 10. Acceptance of the prize. Prizes must be accepted as described herein and may not be transferred to another person, substituted for another prize or exchanged in whole or in part against money, subject to the provisions described in the paragraph below. The prize must be accepted as is without any warranty whatsoever, other than that which is legally binding. 11. Substitution of the prize. In the event that, for reasons unrelated to the winners, the Contest Organizers cannot award a prize (or a portion thereof) as described in these Rules, they agree to award a prize (or a portion thereof) of the same nature and equivalent value or, at their sole discretion, the value of the prize (or portion thereof) indicated herein in cash. 12. Refusal to accept a prize. The refusal of a person selected at random to accept a prize according to the terms herein releases the Contest Organizers from any obligation related to the prize with regard to that person. 13. Limitation of liability use of the prize. Any person selected for a prize acknowledges that, as soon as his or her prize winner status is confirmed, the execution of services related to the prize are the sole responsibility of the prize supplier. A statement to this effect may be included in the Declaration form and liability release form. Anyone who enters the Contest releases the TVA Group Inc. and Jean Coutu Group, its affiliates, related companies, divisions and subsidiaries, advertising and promotional agencies and their employees, agents and representatives from any liability for any damages that may occur due to the acceptance or use of the prize. To be declared a winner, and prior to obtaining the prize, the selected entrant agrees to sign, if required, a Declaration Form to this effect. 14. Limitation of liability operation of the Contest. TVA Group Inc. and Jean Coutu Group, their affiliates, related companies, divisions and subsidiaries, advertising and promotion agencies, their employees, agents and representatives disclaim all liability for the malfunction of any computer component, any software or any communication or telephone line that causes any faulty, incomplete or incomprehensible transmission, or that is erased by any computer or network, and which may limit or prevent any person from entering the Contest. 15. Modification. The Contest Organizers reserve the right, in their sole discretion, to cancel, terminate, modify or suspend this contest, in whole or in part, should an
5 event, an error or any human intervention occur that corrupts or affects the administration, security, impartiality or running of the Contest, as provided in these Rules, subject to the approval of Quebec s Régie des alcools, des courses et des jeux, if required. In all cases, the Contest Organizers, their affiliates, related companies, divisions and subsidiaries, advertising and promotion agencies, suppliers of products or services related to this Contest and their employees, agents and representatives, will not be held to award more prizes than indicated in these Rules or to award prizes other than in accordance with these Rules. 16. Inability to act including labour dispute. TVA Group Inc. and Jean Coutu Group, and their employees, affiliates, related companies, divisions and subsidiaries, advertising and promotional agencies, their employees, agents and representatives, assume no responsibility of any nature whatsoever in all cases where their inability to act results from an event or situation beyond their control or a strike, lockout or any other labour dispute at their location or the locations of the organizations or businesses whose services are used for this Contest. 17. Limitation of liability entry. By entering or attempting to enter this Contest, entrants release and hold harmless the Contest Organizers, their affiliates, related companies, divisions and subsidiaries, their advertising and promotional agencies, their employees, agents and representatives for any damage they may incur due to their entry or attempted entry in the Contest. 18. Authorization. By entering this Contest, entrants authorize the Contest Organizers, their partners and their representatives to use, if required, their name, photograph, image, statement regarding the prize, place of residence and/or voice, without any compensation, at their discretion and without restriction as to period of use, in any media worldwide, for advertising purposes or any other purpose deemed relevant. MORE SPECIFICALLY, BY ENTERING THIS CONTEST, YOU AGREE THAT THE PICTURE YOU SUBMIT OF YOUR CHILD PERFORMING CIRCUS ARTIST TRICKS BE USED IN THE JOURNAL DE MONTRÉAL, JOURNAL DE QUÉBEC (PRINT VERSION AND DIGITAL VERSIONS) AND JEAN COUTU WEBSITE, AS WELL AS THEIR SOCIAL MEDIA AND PUBLISHING PLATFORMS, WITHOUT ADDITIONAL APPROVAL OR PAYMENT OF ANY FORM OF COMPENSATION, WITHOUT RESTRICTION AS TO TIME AND TERRITORY, FOR PROMOTIONAL AND ADVERTISING PURPOSES. 19. Communication with entrants. No communication (other than during registration) or correspondence will be exchanged with Contest entrants except with those selected for a prize. 20. Decisions of the Contest Organizers. All decisions of the Contest Organizers or their representatives regarding this Contest are final and without appeal, subject to any decision of Quebec s Régie des alcools, des courses et des jeux in connection with any matter within its jurisdiction.
