1 Rider 101 Scope of Work CLEANING AND TREATMENT OF STORED #2 DIESEL FUEL RFP #DieselClean/ek 1.0 GENERAL SCOPE 1.1 Current Operations: The University of Texas M. D. Anderson Cancer Center ( M. D. Anderson ) Utility Resource Management Department has responsibility for sixteen (16) fuel oil storage tanks throughout the M. D. Anderson Campus located in, and in close proximity to, the Texas Medical Center, Houston, Texas. These fuel oil storage tanks are both above and below ground and vary in capacity. 1.2 The successful bidder (hereinafter called Contractor ) will provide diesel fuel cleaning and treatment of the #2 fuel oil stored in on-site fuel oil storage tanks and/or diesel emergency generators upon request by the M. D. Anderson Project Manager. Cleaning will involve the centrifugation and polish filtering down to five (5) microns or less of the stored #2 fuel oil and, when necessary, the addition of a biocide specifically formulated to inhibit the development of biological growth in the storage tanks. Contractor may periodically be required to provide certified laboratory testing of fuel samples for, but not limited to, particulate contamination, water and sediment, micro-organisms, cultures, and bacterial count/ml. 1.3 In FY2008, M. D. Anderson cleaned 254,000 gallons of diesel. However, this solicitation makes no guarantee of future annual volumes to be cleaned. 1.4 Contractor shall be solely and completely responsible for initiating, maintaining and supervising all safety precautions and programs in connection with the work herein. Contractor shall take all necessary precautions for the safety of, and shall provide necessary protection to prevent injury to all employees on the work site and other persons including, but not limited to, the general public who may be affected thereby. 1.5 Contractor shall recognize and perform in accordance with all stated intents, specifications and stipulations contained and referenced herein. 1.6 Term of any Agreement resulting from this solicitation is expected to be two (2) year initial term with the potential for two (2) addition two (2) year renewals. Pricing will be held firm for term of contract. 2.0 CONTRACTOR QUALIFICATIONS 2.1 Contractor shall have prior experience in diesel fuel cleaning and the use of biocides as described within this Scope of Work in Section 4.0 below. 2.2 Contractor must provide a list of four (4) references to include complete contact information and any prior work performed for M. D. Anderson with contact information. 2.3 Contractor shall provide adequate evidence in the form of a resume or work experience summary to substantiate that Contractor personnel are qualified to perform the tasks that are covered by the scope of work. 2.4 Contractor must follow bidding and invoicing procedures as described in Sections 7.0 and 9.0 below. 2 3.0 TANK LOCATIONS 3.1 See APPENDIX A for current tank type, capacity and location 3.2 Additional tanks may be installed during the life of the Agreement at additional locations 4.0 GENERAL WORK PERFORMANCE REQUIREMENTS 4.1 Gallon capacities referenced in Appendix A represent tank capacity and should not be considered to be representative of actual gallons of fuel contained therein or to be cleaned. At any one time, M.D. Anderson estimates the storage fuel to be approximated at 283,500 gallons. Contractor shall be responsible for determining exact number of gallons of fuel oil stored in each tank during the cleaning process and billing accordingly. 4.2 Upon request of the M. D. Anderson Project Manager, Contractor will provide diesel fuel cleaning of the #2 fuel oil stored in one or all of the sixteen (16) fuel oil storage tanks at any one time. Diesel fuel cleaning will involve the centrifugation and polish filtering down to five (5) microns or less of the stored #2 fuel oil and the addition of a biocide specifically formulated to inhibit the development of biological growth in the storage tanks. M. D. Anderson s Project Manager will identify the tanks to be cleaned when making a service request. 4.3 Contractor s personnel shall be experienced, knowledgeable and qualified to perform all aspects of the fuel oil purification and chemical treating work. 4.4 Contractor personnel and equipment will report for work at M.D. Anderson fit for duty. Fit for duty is defined as personnel are well rested and not under the influence of drugs or alcohol. Additionally, Contractor personnel must not be in possession of any weapons or unlawful substances. All Contractor vehicles entering into the Protected Area are subject to search by M.D. Anderson personnel and shall be free of all weapons, explosives, alcohol or other contraband. 4.5 Contractor shall perform the work in accordance with all applicable Local, State and Federal regulations. The Contractor shall provide M. D. Anderson with a copy of all applicable licenses and/or permits required by the State of Texas for the performance of such work. 4.6 Contractor shall maintain positive control of all tools, material and equipment during the execution of the work. 4.7 Contractor shall maintain positive control of, and responsibility for, disposal of all expendable materials intended to be used at M.D. Anderson. 4.8 Contractor must schedule all work through the Project Manager or his Designee. 4.9 M D Anderson personnel must be present during the polishing of the diesel fuel to verify and switch fuel tanks as needed. 5.0 PERSONNEL DOCUMENTATION AND TRAINING REQUIREMENTS Page 2 of 6
3 5.1 Contractor personnel performing work under this agreement must possess the knowledge, skills and experience to perform all aspects of the work in a safe and workmanlike manner. 5.2 M.D. Anderson retains the sole authority to determine the acceptability of any Contractor personnel to perform any tasks that are required by the terms of the contract and to deny access to the site for just cause. 6.0 CONTRACTOR RESPONSIBILITIES 6.1 Contractor must complete M. D. Anderson check list for off loading fuel (Appendix B). 6.2 Contractor shall provide all equipment, including power, centrifuge, filters, etc. required to perform the scope of work outlined in this agreement. 6.3 Contractor shall provide upon request any documentation on personnel and vehicles located on M. D. Anderson premises. 6.4 Contractor shall produce copies of regulatory licenses and permits required by the State of Texas to perform said work including TNRCC Registration and TCEQ Registration. 6.5 Contractor shall provide adequate retention devices such as bergs or other barriers to ensure any leakage/spillage is captured and not allowed to seep into the ground or run off into the storm drain system. This includes a sludge bowl capacity of at least 2.0 gallons. 6.6 Contractor shall provide all hoses, connectors and adapters required to interconnect the M.D. Anderson fuel storage tanks to the Contractor s equipment. 6.7 Contractor shall provide Personal Safety Equipment for the Contractor s employees. (i.e. hardhats, safety glasses, hearing protection, gloves, etc.) 6.8 Contractor shall retain ownership and provide proper disposal of all used filtration media or cartridges resulting from this scope of work. 6.9 Contractor is beginning any work with first obtaining an M. D. Anderson Cancer Purchase Order from the M. D. Anderson Project Manager identified in Section 8.0 below Contractor shall agree to, and comply with, all terms of Rider 106 Premises Rules. 7.0 BID PRICING 7.1 Contractor shall submit bid pricing based on performing all work after 4:30 pm until 7:00 am, Monday thru Friday and, if needed, all day Saturday or Sunday. 7.2 For this bid response, Contractor shall provide pricing as requested in Rider 102 Pricing Schedule. Successful bidder will invoice for the actual gallons of fuel cleaned and treated based on this quoted per gallon pricing. Pricing will remain firm for the life of the contract. 8.0 PROJECT MANAGER DESIGNEE: Page 3 of 6

D. Anderson is exempt from all state of Texas sales and use taxes. 8.2 Contractor shall submit all invoices to M. D. Anderson s Accounts Payable Department as described below and per Rider 116 Invoice Payment Requirements: All invoices must clearly reference the assigned Purchase Order as provided by the Project Coordinator or designee All invoices must clearly reference property worksite or a reasonably acceptable worksite abbreviation for the work completed All invoices must clearly indicate charges for each property site as indicated in Section 3.0 above. Charges will be reviewed by Project Coordinator and approved prior to payment by M. D. Anderson BID SELECTION CRITERIA 10.1 M. D. Anderson shall use the following selection criteria in evaluating all properly submitted bids. The importance given to each of the two categories is represented by a percentage number representing its relative importance or weight within the whole (100%) Pricing [49%] Experience [51%] Bidder s capability to comply with the Contractor Qualifications described in Section 2.0 above. 6 Appendix B Diesel Fuel Off Load Check List Task Description 1 Inspect area that fuel is being off loaded or cleaned for open drains or manholes 2 Cover all open drains and manholes with a mat prior to starting any cleaning or off loading fuel 3 Verify location of spill material prior to starting any cleaning or off loading fuel 4 Start off loading or cleaning of fuel 5 Inspect connections and hoses to verify no leaks 6 During the off loading or cleaning, one person must remain at the truck to immediately shut off the system in case an equipment malfunction occurs 7 When completed, drain all hoses prior to breaking any hose connection 8 Remove all mats from drains and manholes prior to starting any cleaning or off loading of fuel Completed Yes No Page 6 of 6
